"today in the bay" eastpoint joins us live from pleasanton. teachers took pictures of the little girl bound with duct tape. >> reporter: it is one of those stories. it certainly makes you shake your head. we are told that the pastor of the church is who ahorrified ans no child deserves to be treated this way. there is a meeting with parents

after this about these disturbing allegations. a little girl had her hands and feet taped up. that was her punishment for refusing to take a nap. the incident happened at centerpointe preschool where a 2-year-old wouldn't go to sleep. the teacher took out the masking tape and taped her up and took a picture. the teacher shared the story and photo with a former colleague at a luncheon. one of the people there included the girl's mom who is a teacher at centerpointe christian school. she went on to tell the police and the school. we immediately listened to her talk to the other teacher and notified licensing of the incident. >> the report from the state licensing department obtained by the pleasanton path states the

allegation is substantiated here. it says the school needs to notify parents and have a meeting to discuss discipline. apparently, we are hearing that letters have already gone home to families explaining what had gone on and we are also told that the school is going to be closed on a friday for retraining and then reopen next wednesday. we are also hearing that the pastor of the church is on his way down here to speak with the media. we are hoping to hear from him soon. as soon as we do, we will let you no he what he had to say. reporting live in pleasanton, christie smith, "today in the bay." free on all counts. this morning, an east bay man free after 14 years in prison for a crime he did not commit. today, the man is speaking out. nbc bay area will be the first local station to talk to johnny williams this morning, convicted of attempting to rape a 9-year-old girl back in 1998. just this month, a judge overturned his conviction, after dna testing spear headed by the

northern california innocence project proved he did not commit that crime. we will have that interview a little later on city council tackling a tough love approach to get scores of homeless people off the streets and into housing but it is going to take money, your money, lots of it. bob redell live at city hall. how would the city pay for the new proposal? >> reporter: that's a big question. the proposals they are putting out, which i will go over in a minute, they are very preliminary. one suggestion is to help pay for this, ask other counties to help t what is going to happen at city hall. they might every tuesday. they will consider ways to better combat homelessness here in the south bay. the most recent figures from 2011, means there are 7,000 people that have no home. some live in one of the 60 or so

encampments that have sprung up in the woods and along the waterways here in san jose. just this past friday, the city took down one of those large encampments. they evicted dozens of people. about 100 people had set up tents in the area. the problem is where do they go, most likely to other encampments. today, the city will discuss solutions put forward by councilmen, sam lacaro. ideas include building more affordable housing, cracking down on the encampments and steering faith-based groups to encourage to live indoors instead of enabling them to sleep outside on the street. the city council must grapple with a shrinking police force and a tighter budget. they have not put a dollar figure on this. we know how tight times have

been and how much a challenge it will be for the city council. reporting live here outside san jose city hall, bob redell. in redwood city, you can pay for takeout as in plastic. when you carry it out, you are going to have to start using paper. the city approving a plan to ban plastic bags. this goes in effect for six months. businesses will have enough time to use up all their plastic stock. palo alto considering expanding their existing ban on plastic bags and san carlos, requiring reusable bags throughout the city. >> i always forget them. leave them outside. you're going to want to go outside today. the weather is spectacular. >> beautiful.

"today in the bay." from nbc bay area, this is "today in the bay." it is 6:30 on the nose. good morning, everybody. i'm jon kelley. i'm laura garcia cannon. the catholic church on the cusp of a conclave o to elect a new pope. we have a live look at the vatican where one round of voting will be held today. all of the cardinals attended mass earlier to set the spiritual tone. a total of 115 cardinals will enter the conclave, all under the age of 80. upon entering, cardinals and staff take a vow of secrecy.

only one ballot is held today. after today, as many as four votes a day can be held. it takes two-thirds of the vote to be elected pope. >> after each vote, smoke will billow from the two stoves at the sistine chapel. one of the stoves was built in 1938, used to burn the paper ballots each time they vote pd the other was used to create the proper smoke. the wit for the new pope. black if not chosen. they use special cartridges for the smoke but what chemicals are used is a secret. the vatican will also ring the bells at st. peter's basilica church. the new pope, they set up a

>> reporter: it is hard to imagine the parking situation getting even tougher. we are standing in one of the five parking lots that they offer, winchester boulevard and olin drive. the movie theater is right behind us. this could completely be demolished and become an office building. they would add three new buildings, 700,000 square feet. the oakland tribune reports it would come date 25 hin to 3500 employees. as mentioned, one building would reportedly wipe out the parking lot along winchester and olsen. another building would go up on the south side of the theater. that space would require the developer to bulldoze an apartment class on dudley avenue. as it stands stan tan na row already has hundreds of shops

and restaurants. >> reporter: don't forget. people actually live here. the developer has a plan to build an underground parking garage. people would have the option to park below. this plan is not set in stone just yet, because the city of san jose has to improve it. we can tell you new law where san francisco dog walkers are taking effect sometime very soon. anybody walking more than four dogs all at once. walking more than eight at a single time. it requires each dog to have its own leash no longer than eight feet. the law amims to curb people walking too many dogs and not

welcome back. in the past 15 minutes, we have learned a criminal investigation has been launched against an east bay teacher accused of tying up a 2-year-old student because she would not take a nap. "today in the bay's" christie smith is live in pleasanton where she just spoke with school administrators. christie, what are they telling you? >> reporter: shocked and stunned are the words they used in describing their reaction to this incident after a former teacher is now being accused of taping up a young students hands and feet all because the little girl didn't want to take a nap.

this was at centerpointe christian preschool. this came to light march 4th. although they don't know when the incident occurred. the former teacher was at a luncheon with current teachers and showed a photo of the child actually bound. in the group at the luncheon, the girl's mom who is a teacher at the preschool. alarmed, she notified the school and pleasanton police. the pastor at the school's church just shared his reaction. >> this preschool is a part of our ministry to our church to love and care for people of all ages. it is absolutely deplorable to us that any person, including the children under our care would in any way do something so terrible as this incident. children are made in the image of god and deserve to be fully respected. this is a dehumanizing incident that we are greatly grieved

is a little bit later, about a half hour later than we typically see. if it is the same at their house as it is with mine, we feel timing things on the second day of work. we are looking towards northbound 101. starting to see the slowdown kick in. we are showing you the south bay in general. here is a slowing from 680 up. as you get up towards 880, checking the fog. 87 itself, not a big deal. we have the earlier crash, the motorcycle crash has cleared. no major injuries there. 85 finally starting to show the slowdown. it extends. it will calm down to about here over the next 40 minutes. we will look over here toward your roadways. south 680 out of pleasanton around the bend, a slower drive. recovering after two other crashes cleared the roadway. all activity is cleared but you still have the slowdown as the

traffic continues to feed in. pretty standard drive through livermore over towards dublin. south 680 shows volume down. westbound, in towards cass strol valley, a little heavier slowdown. everybody is meeting here at the castro valley wide. slow between the bridges. expect the northbound side to kick in over the next 20-30 minutes. heading over to the bay bridge, metering lights are on. no big deal. we have that build coming off of the east shore freeway. we have the volume of traffic and the glow. that extends up to the north bay, santa rosa. could cause an issue and maybe fog through there as well. 6:50 this morning. it is a new era for the catholic church. as we look live at the vatican where 115 cardinals will take

in reverse order of seniority into the sistine chapel. after the voting, we will either see white smoke indicating we have a pope as they say here in italy or black smoke meaning we will be right back here again looking for the same thing tomorrow. >> thank you very much. tracie potts, live from vatican city. we have a developing story to tell you about from afghanistan where five u.s. troops are dead after a nighttime helicopter crashed. that black hawk chopper going down outside kandahar city in central afghanistan. all five of the soldiers dead, all five americans. initial reports show no enemy activity in that area during this time. this crash brings the total number of u.s. troops killed monday to seven making it the deadliest day for u.s. forces so far this year. two u.s. special operation forces were shot and killed hours earlier yesterday in an insider attack by an afghan policeman in eastern afghanistan. north korea's leader, kim

jong-un, is telling his troops to be on maximum alert for a potential war. he reportedly said, quote, war can break out right now. state media reports kim is following through on threats to cancel the 1953 armistice that ended the korean war. south korea says there are no signs that north korea would attack or conduct more nuclear or missile tests any time soon today, we may hear the plea of the man accused of killing 12 people and injuring 70 others. many expect 25-year-old james holmes will enter a plea of not guilty. that could be the only way he could avoid life in prison or execution. prosecutors say he planned the mass shooting for months and built up an arsenal of weapons congresswoman jackie spear is calling for a federal investigation into the army's dropped rape charges against santa cruz cop killer, jeremy

cases starting in sonoma county, two men will be arraigned in connection with the killing of three men in a forestville cabin. they are being charged with murder, burglary and conspiracy. investigators say that three men were killed as a result of a marijuana deal. today, a judge could decide whether a san francisco couple will go to trial on charges of killing a man who was allegedly pimping out their teenage daughter. they are accused of plotting with two other people in the shooting of calvin sneed in san francisco's bayview district back in june of 2012. they believe that barry gillson is the one that pulled the trigger in redwood city, sentencing set for a man who killed his neighbor's poodle with a brick. he killed the dog a year ago because it wondered over on to his property too many times.

this is "today" with matt lauer and savannah gurthrie live from studio 1a in rockefeller plaza. and welcome to "today" on this tuesday morning, morning, everybody. i'm savannah gurthrie. >> and i'm matt lauer. we're following that breaking news out of afghanistan this morning. a black hawk helicopter went down near kandahar city. reports are everyone onboard were killed. >> the cause of the crash is under investigation. we want to get straight to mike taibbi in kabul this morning. what can you tell us? >> reporter: good morning, savannah. it's been raining on and off in kabul all day here. it's raining very heavily in kandahar province last night about 300 miles southwest of kabul when this black hack helicopter went down with five crew members aboard. all five crew members, american service members were killed. a coalition spokesman told us there was no hint of activity at the time of the incident. the taliban have not claimed credit for the deaths as has been the case very often in the past. now, add it to the two deaths of
