fast food restaurant at the shopping center. a san jose police officer that happened to be on a traffic stop a block away heard the crash and was the first responder out on the scene. the paramedics came out and declared the driver dead on the scene. police think they know who he is but are not releasing his name until they are able to notify the family. they think he is in his late 20s, early 30s. no obvious signs of drinking and driving but they won't be able to rule that out for sure until toxicology tests, not something the coroner would be performing. in the foregrounds, a white van pulling up. we believe that coroner is coming on the scene which means that maybe the scene will be cleared up sooner than initially thought. the eta was around 7:00. with the coroner coming on the skeep, it is quite possible it could be sooner. for more on your morning commute, i'm going to send it over to traffic anchor, mike inouye. mike? as you saw, bob talked about

the coroner potentially arriving on scene. that white van we just saw. that may be the issue. let's look at some maps and talk about the areas and get you located again. here is the south bay. you see 101 northbound with the orange have the that's the build for your morning commute. bob is talking about monterrey highway, a major roadway through san jose. southbound is closed. northbound, that is why you see the orange heading up towards interstate 280. the big issue is that it is approaching kurtner. kurtner and tully are open as you are heading toward highway 87. this is offering a distraction. this is open. around the scene from alma, you are going to have to go around the target shopping center to the north. you will be redirected by the local police as well. alma is open heading toward 87. we see slowing between the two. pretty typical stuff. another issue for the south bay. one we showed you a couple seconds ago. we are looking toward a power

outage caused by this. this power pole. the sweeper truck, the front windshield is bashed in. it sounds like the wheeler truck hit the pole and took out the pole. 578 customers reported. this is near the intersection of coleman and taylor. also, a major surface street complete. so far, we have seen traffic throw pretty light. this does look like it is off of the main commute route right there. we are now looking at the bay bridge. another main commute route and this back up here, in the cash lanes. the fast-track lanes are moving smoothly. we should see these metering lights turn on in the next five to ten minutes. heavier volume coming out of the maze. so far, a smooth drive over the bay bridge. back to you. we also have new video to show you of a fire overnight in alameda. you can see the flames coming through the roof of this building on park street near san jose avenue.

francisco city hall with a look at all the anticipation ahead of today's landmark hearing. good morning. >> reporter: good morning to you, marla. big day in store. today, cities like berkeley and oakland and san leandro will be raising the rainbow flag at their respective city halls, not so much to try and sway the court but to encourage people here in the bay area who support same-sex marriage and see this as really the start of a number of very historic rulings. hundreds of marriage equality support rs rallied at city hall in san francisco yesterday. they are urging the u.s. supreme court to rule in favor of marriage equality as it considers california's ban on proposition 8. couples shared stories about their roller coaster ride to marriage and hopes the justice will see they should get equal treatment. we got married in 2004 and were

lucky enough to get married again in 2008. opponents of same-sex marriage also plan to stand up and be heard along with couples who traveled from the bay area to washington, d.c. to be on the steps of the supreme court while their future is debated. also, on wednesday, the court will take up the federal defensive marriage act that defines marriage as between one man and one woman. same-sex marriage supporters also planning vigiles about this whole issue tonight, this evening at the state building here in san francisco from 4:00 to 8:00 and tomorrow night. reporting live in san francisco, christie smith, "today in the bay." right now, we are going to go to washington, d.c. where more than three dozen people are waiting in line outside the supreme court for tickets to watch the hearing as it unfolds. the tickets are specially in demand because the court does not allow tv broadcast of the arguments. taking a live look outside, the supreme court this morning, you can see the rambunctious crowd. many are going to great length

and great expense to secure their spots in line. we will have a live report on how far spectators are able to go. let's go to meteorologist, christina loren live right now. she is tracking a storm coming our way. >> a couple of storms. really hard to dictate where they are going to end up. both are not very developed at this point. both are really hard. they are not going to be attached to the jetstream. we will talk about that in a moment. 49, san jose, 47, gilroy. a jetstream is like a river of air that carries o our storm systems from west to east across the united states. we are going to see a couple of systems not on that transportation system. it is hard to tell where the showers are going to develop. thick fog in the north bay. if we see any activity, you have the best chance for that north of the bay bridge today. we are going to see a little bit of drizzle. the fog will be the thickest between now and 8:00 and between 8:00 and 11:00. we are going to start to clear

we have heard from amanda knox over the decision to overturn her 2011 decision about murder. what she has to say. even thou the court has ordered a new trial, italian law cannot force amanda knox to return to italy. according to her attorney, if she is convicted and the conviction is upheld by the highest court, they could try to

extradite her. it would be an issue for the united states. amanda knox and her then boyfriend were accused of killing meredith kercher, a british student, in italy. the two were found guilty and she was sentenced to 26 years in prison after serve willing four years. their convictions were overturned because of numerous errors made during the investigation. amanda knox and her then boyfriend, raffaele sollecito were released. last year, prosecutors filed a motion appealing the acquittals. they called the verdicts contradictory and illogical. the top court looked as if there were procedural irregularities in the trial that would give groupds for a new trial. the court did not examine the details of the case itself. >> this must be viewed in the context of the italian system. her appearance is not legally

"today in the bay's" tracie potts joins us live outside the supreme court building with a look at what's happening right now. good morning, everyone. they actually opened those doors much earlier than we thought. now, we see why. the sidewalk outside is absolutely the way it get those. there are hundreds of people out here it waing in line hoping if that happens.

this has brought a lot of people to the u.s. supreme court. first name, prop 8 is going to be looking at whether or not bans on same-sex marriage are unconstitutional. today, on the level of prop 8, on the federal level, with the defensive marriage act. what we typically think from public opinion even with all outside here today. one of those things very well may keep in mind the fact that public opinion should be so dramatically just in the last decade or two. 58% of americans according to the poll support same-sex marriage. that is reflective of what we've seen out here today. the court could make a very narrow decision that only applied to california. we could see a decision that applies to america or we could see something -- there are 38

it could be much worse as you know. we are known for our fog here in the bay area. the only place with less than .025 visibility. metropolitan cities are looking pretty good. santa rosa, half a mile visibility up there. we are down to a quarter mile. improving a little bit there. a couple of systems headed our way. the first arrives as we head through tonight. the subtropical air stays in place as your temperatures aren't going to drop off all that much. as we head through the next few days. a little bit of a warmup with two areas of low pressure. with these systems, you will find some air in the areas that do pick up the precipitation. where are we expecting the rain. mostly up in the north bay as per usual. it is hard to dictate when and how much we are going to get. we meet back here tomorrow morning. sonoma county. stop that clock again. take you into late wednesday and

nicely. low clouds kicking in. so far, an easy drive over to the peninsula and a nice, smooth drive. taking up the volume. palo alto into or out of san francisco, 101 or 280. one of the issues we are following is this. we have this power pole that is still down. a sweeper truck took out the power pole and almost 600 customers. we hear there are just 23 customers that remain without power. we have local traffic control for the businesses there. your business might be affected if you are traveling there. a head's up. they are quickly fixing that situation. we are following another situation, breaking news in san jose. a deadly crush shut down part of monterrey road. police have been on the scene at monterrey road near tully for more than four hours now.

bob redell joins us with the latest. bob? >> reporter: it could be pronlly another hour. they thought maybe they would have this reopened by now. it sounds like it is going to be a little bit longer. the coroner is out here. what they are trying to do is remove this car that was crashed in front of the el pollo loco. they have to remove the car and the man who unfortunately died in that car early this morning. monterrey highway southbound is shut down from stouffer to the entrance to the plant's shopping center which is just before the intersection with kurtner and tully. there is some slowing, because you have people trying to see what's happening and in the southbound direction, there are. this accident happened around 2:00 this morning. it was a solo accident. a man in a rad car, a ford focus. it is hard to tell. the car was so demolished.

misdemeanor charges after a fellow teacher caught her dosing toddlers with the sleeping aid sominex. she was arrested a few weeks ago but now free. she will be arraigned on charges in morgan hill. a follow-up to a story we first told you about last week. san francisco police say a missing service dog taking from his sleeping owner on a b.a.r.t. train is back home safe and south. archie was found yesterday five days after he went missing. police say an anonymous tip led them to a home in san francisco where they found that small pomeranian. this he checked his microchip and confirmed it was archie. police interviewed the people in the house and charges there are pending. an emotional mourning years in the making is california's fight over same-sex marriage winds its way from the ballot box to the highest court in the country. >> as california goes, so goes the rest of the nation. it is inevitable.
