possible care, that he's conscious and his wife michelle is by his bedside. we're told this is a reoccurrence of a previous lung infection. the same infection that brought him into the hospital for one day earlier this month. the same infection that saw him spend several weeks in hospital at the end of last year, including christmas day. and we know that this has been a problem for nelson mandela in the past. he suffered during his close to 30 years in prison while he was on robin island. and naturally people will be incredibly worried about the health of nelson mandela, but he's incredibly frail, he's 94, nearly 95, and south africans are being asked to keep him in their prayers. >> all right. raheeth, thank you very much. and now to another big story that's breaking in south africa right now. lawyers for oscar pistorius in court fighting for more lenient bail restrictions in his murder case. michelle kosinski from london.

what's the latest? >> reporter: hi, savannah, we just had the ruling. and this is a small courtroom victory for oscar pistorius, he is accused of premeditated murder, but was asking for the court for more freedom while he's out on bail, including being able to travel. well, the judge just agreed with him, even criticizing all of the restrictions imposed upon him by the lower court. oscar pistorius' case is back in court, but he did not appear as he did in february. in fact, he has not been spotted once since then when a judge deemed him not a flight risk or dangerous and set him free. he's been staying at his uncle's gated mansion. >> we know he's not doing very well. i know from his defense team have insisted that he see a psychologist. apparently he wanders around the house and tells his family constantly pray for reeva. pray for reeva. >> now that the defense asked for many of the conditions be removed, calling them unwarranted and not

substantiated by the facts. they think he should be able to travel, even outside the country with permission to no longer be under close supervision of jail officials who expect him to report where he is during the day and to be home at night. they think it's unfair he must submit to drug and alcohol testing. and he wants to be able to speak to his neighbors again and return to his home. that's where oscar pistorius shot his girlfriend to death early valentine's day morning through a locked bathroom door. he says he thought she was an intruder. prosecutors call it premeditated murder. at the same time, pistorius' brother carl is on trial for for cup pabl homicide after a car accident four years ago. he denies he was driving recklessly. both brothers facing the court and the eyes of the world. so with this ruling, pistorius will be able to travel. he'll just have to give the court an itinerary a week beforehand the judge says, look, we deemed

him not a flight risk, saying and that he shouldn't be understand such restrictions, saying that some of the original restrictions didn't serve any purpose. matt? >> all right, michelle kosinski in london this morning. thanks very much. now that dangerous situation near seattle this morning where dozens of homes are in danger after a gigantic, gigantic landslide. nbc's miguel almaguer is on the scene in coopville, washington. miguel, good morning. >> reporter: good morning to you. today it's still unclear what triggered that huge slide. one man narrowly escaped his home before it tumbled down the hill. police here say that dozens of homes are on dangerous land. >> reporter: the massive landslide roughly 1/4 mile wide and 1/2 mile deep swallowed a single home. and this morning, threatens or has cut off access to 34 more. >> the bluff used to slope and now it goes straight down. >> reporter: one house teeters from the cliff's edge.

through the end of april. the man charged with killing 12 people at a colorado movie theater last summer is offering to plead guilty in a bid to avoid the death penalty. james holmes is willing to spend the rest of his life behind bars as prosecutors weigh whether or not to accept the accused gunman's offer. and police in colorado have arrested a 22-year-old woman they say illegally provided the gun used in the murder of the state's department corrections chief. she appeared in court today. police believe she transferred the legally purchased weapon to evan ebel, a felon who could not legally possess a firearm. ebel died following that shootout with police in texas last week. he's suspected in the shooting deaths of tom clements and a denver area pizza delivery man. president obama's optimistic about getting a sweeping immigration bill through congress by the end of summer. the commander in chief told spanish language tv network telemundo that the issue can be resolved. the president says he wants to strengthen border security while

this after two days of historic argument at the nation's highest court. nbc's justice correspondent pete williams has been following this story. pete, good morning again to you. >> reporter: savannah, good morning. based on what the justices said, a majority of them seem prepared to strike down the defense of marriage act passed by strong majorities in congress 17 years ago. it blocks the federal government from recognizing same-sex marriages in the states that allow them. >> reporter: supporters of same-sex marriage are optimistic this morning based on what the justices say about a lawsuit brought by 83-year-old edi windsor of new york. she challenged doma when the federal government refused to recognize her marriage to another woman and slapped her with a huge inheritance tax bill. >> thrilled and -- and exalted and humbled. very humbled. >> reporter: some of the court's conservatives question her lawyer's claim that the country has a different attitude now about same-sex marriage. >> why are you so confident in that judgment?

how many states permit gay couples to marry? >> today? nine, your honor. >> nine, and so there's been this sea change between now and 1996? >> but the court's liberals said doma hurts same-sex couples. justice ginsberg says it creates skim milk marriages. >> for the federal government to say no joint returns, no social security benefits, your spouse is very sick, but you can't get leave. one might well ask what kind of marriage is this? >> justice kennedy, the likely pivotal vote, said the states traditionally define what it means to be married. >> i think it is a doma problem. the question is whether or not the federal government under our federalism scheme has the authority to regulate marriage. >> if the court bases its ruling on who gets to define marriage, then it probably won't be a

oh, baby. >> oh, baby. even with that weight, he is the second largest baby born in great britain following just one ounce short of the record. he has a royal name to match. ♪ >> reporter: say hello to not so little baby george king born a majestic 15 pounds and seven ounces, outside of bristol in the u.k. at just a month and a half he is already too big for clothes for babies his age. >> he didn't fit into any of his newborn. he went straight into 6 to 12 month clothes. >> reporter: this big boy has already survived a lot. he had a rough delivery, stunning his parents and doctors who expected a smaller baby. >> when they realized he was so big and then his shoulders got stuck, and that's when sort of everything got kicked off really. there was about 20 odd doctors in the room, and that's when it got really scary. >> reporter: baby george went five minutes without oxygen and

i know some people feel that 30 pounds in six months is not that big of a deal, but our goal is that he carries it lifelong. he's learning to make good choices and his diet and nutrition and get up and move on a regular basis so that will stay off. >> tell us about getting up and moving. we saw you running in the commercial, but you don't love running, right? >> no. >> what's your favorite kind of exercise? >> my favorite kind of exercise, it may not be really considered exercise, but last 15 or 20 minutes of my workout session, me and my trainer play basketball. and since i love basketball so much, if i do a good workout, he gives me 20 or 30 minutes of basketball the last half. >> i think it counts as exercise. in fact, we're taking on these ladies outside, maybe we'll get you to play with us a little bit. so you lost your 30 pounds, what's your next goal? >> i'm going to try another 30, probably about the same time frame. try to get it done within six months maybe. >> good luck to you.

makers of this are making a 3d scanner out later this year you can scan anything and make a copy of it. >> we had a comb on a little while ago this printer made and my first thought is, okay, but you can go to a mass production facility and you can knock out a comb in five seconds. here it takes about 11 minutes. why would you choose to do it this way? >> well, if you're making hundreds of thousands of combs, you would go mass production, but for me, i could redesign it on a computer and print out exactly a specialized one for me. >> all right. so at the moment. these are fairly expensive right now. i think this printer cost about $1,000. >> this one is around $2,200, but there are much cheaper ones. you can get them now as cheap as $500. >> home applications here or simply something we're going to see in businesses around the country? >> well, the dream here is that these things do make it into your home and become as cheap as a desk top printer is now and you buy a file and download a file and print things yourself.

we're back now, 8:41 with the truth about germs. an article in the washington post this week explores the idea that our obsession with being clean may actually be making us sick. so is it possible to be too clean? dr. carrie peterson is an internist at "women's health." it seems we're saying it's good to be clean, good to use some of the products out there on the market, but it's possible to take it too far. >> it is possible to take it too far because you can create super bugs. these are bugs that develop the resistance to the active ingredient and they become not only resistant to that but antibiotics. >> when i hear about super bugs, i think it's because we take too many antibiotics. does this also apply talking about antibacterial hand sanitizers and things like this? >> yes, you are correct, that the overuse of antibiotics create super bugs but antibacterials do, as well.

and we have no way to treat them. >> so this is about moderation. and i think it's well known i'm someone -- i'm a little bit of a germaphobe, not as much as people say. i don't use purell or other products like it more than once a day. is that within the safe zone? >> of course proper hygiene is necessary to prevent the spread of germs, but washing your hands with soap and water is sufficient as long as you do it properly, 20 seconds with soap and water, which is the amount of time to sing happy birthday twice. using purell once a day is fine, but you don't have to do that if you have access to soap and water. >> but the people you see carrying it around in their pocket and they're putting it on their hands. those are the people that this isn't a new study, by the way, this information affects. >> that's correct. the hyper vigilance is where the problem is. not only are people using it on their hands all the time, but there are so many new products available on the market. there are slippers, socks, mattresses, even toys and chop sticks. we're getting a little carried

away. we're going too overboard and it's not necessary and it's costly. >> let's make that point again. more and more these days at the drop of a hat, people don't feel well. they go to their doctors. and unfortunately, a lot of doctors give them antibiotics. >> yes. >> how far over the line are we with the prescription of antibiotics. >> it's a big problem in my opinion. >> in my practice, i try to teach my patients the difference between a virus and bacteria. often times patients will resist that. they really want to walk out of your office with a prescription. so physicians really need to be armed with educating patients about this and patients need to be aware that it's not always necessary. >> the other thing that came to my mind, doctor, when i read this information last night is how many times are you on the street and you see a new mother with a young baby and they constantly have those wipes out, those antibacterial wipes and using them on the baby or the child's hands and everything around that child.

we've had a series of crashes over the course of the morning continuing to add slowdowns. there's the back-up at the toll plaza. the fasttrack lanes, a lot less traffic there. relief through fremont and southbound for 880 down into the south bay. a very late slowdown on north 87. very slow, capital up into downtown san jose. new dominants released this morning are shedding new light on the newtown school shooting tragedy. adam lanza killed 26 vicks and took his own life within five minutes of shooting his way into that school. search warrants say the 23-year-old was carrying three gun us and had another one in the car. more on this story coming up at 11:00.
