leader, kim jong-un has ordered the army to strike the u.s. and south korea in a case of reckless provocation. tensions have increased as the u.s. continues to run military drills with south korea. u.s. secretary of defense, chuck hagel, says the allegiance with south korea remains strong and they won't back down in the face of threats from the north neighbors in the south bay community want to handle their fast food fight by themselves today without city leaders. they are taking on a proposed mcdonald's. arturo santiago live in west san jose with why they want to take matters into their own hands. >> reporter: good morning. there are a number of kearns. their biggest complaint seems to be focused on a mcdonald's staple, the drive-through. nearly 800 neighbors signed the petition with the intention of keeping a mcdonald's restaurant from opening.

a lot of the residents believed that mcdonald's wa derail efforts to fight childhood obesity and others concerned kids would run across the street and it would take business from nearby restaurants. they can't stop the mcdonald's from being built but might be able to keep it from having a drive-through. they have denied a permit for the drive-through leaving the final decision to the city council. >> that's where the traffic problems comes up, the risk to kids comes up and where we lose our ped neighborhood and the ease of getting in and out of this parking lot which only has these two significant entrances. >> this site is zoned and permitted for restaurant use. if they choose to drop their drive-through plans and meet our design guidelines, they can build right now. >> supporters of the mcdonald's say the restaurant would bring in 57 new jobs and $62,000 a

year in payroll taxes alone. now, again, about 100 people gathered to meet with councilman, peter constan. the anti-mcdonald's neighbors will meet again today to talk about where they will go from here. 5:04 now. 6-year-old eduardo grihalva has been battling cancer half his life. his only hope is a bone marrow trance plat. his favorite s.w.a.t. team visited him in the hospital and tested for a bone marrow match. today, the search to find a donor ramps up. bob redell is live in river glen school in san jose where they are holding a drive to help find the match. a sad story as well. >> good morning. later today, his family and teacher will be holding this

registration drive. the 6-year-old boy desperately needs a bone marrow transplant to fight leukemia. here he is this past wednesday. san jose's s.w.a.t. team visiting him in the hospital in an attempt to lift his spirits. he has dreams of one day joining the elite squad. was given a s.w.a.t. pen and honorary team. he was diagnosed with a rare form of lymphoma in his head when he was three-years old. doctors determined this past january he was in remission. a month later, they diagnosed him with leukemia. the only thing that can save him is a bone marrow transplant according to his medical team. it doesn't take much to get on the bone marrow national registry, just a swab of the cheek. it is painless, doesn't take much time. in eduardo's case, a match would have to be with someone with the same ethnicity. which is in his case latino or hispanic. even if that's not you. it is important to consider signing up for the registry,

benefit from these changes. 5:13. a new record for the stock market this morning that scott mcgrew promises will go unchallenged today. >> the s&p hit an all-time closing high on thursday. there is no training today because of the good friday holiday. the s&p doesn't get as much attention as the dow but a better indication of what's going on because it tracks 500 stocks instead of the dow's 30. the latest highs are more related to the expectation the fed is going to continue its policy of easing than anything in the economy. low, almost nonexistent interest rates are driving people out of bonds and into equities. it is not impossible to think if the report is good, it could hurt the markets. people will worry that good news could slow the fed goodness. stock market and the economy are

gate and you can see not as much traffic but definitely visibility very low here across the north bay, in fact, some of our slowdowns beginning to pick up across some of the solano county. you will notice down south, further south, san mateo bridge, not seeing a whole lot of fog here. as you get across the water, expect to see some of that this is in vallejo. starting to see a slowdown on the northbound side of 29 an the southbound side. i would suspect this is fog related. we don't have any major accidents to report. that is always good news. more coming up in a little bit. in the meantime, back to you, marla and laura. 5:18 now. this next story is one of fame, murder and redemption. 40 years ago, rick stevens was on top of the world as the soul full lead singer of the bay area's own tower of power. his signature song, you're still a young man, launched him and the band into the spotlight,

until drugs got the best of him. stevens spent the last 36 years in prison for murders he admits to. now, he is a free man and he is making a comeback. i recently sat down with him. >> back once again. >> after being gone for almost four decades, singer, rick stevens, is back once again but not before living half his lifelocked up. >> changed me physically, changed me spiritually, changed me mentally and emotionally. i had to go to prison to grow up. >> let's go back in time. there we have ricky and the ravens. >> the baby face stevens dabbled in several groups before becoming the front man of tower power in 1969. it wasn't long after that the group from oakland caught the attention of the queen of soul. >> aretha saw us and told bill graham, honey, i got to have

19-year-old abraham hade faces 16 years to life in prison for second-degree murder. the jury determined that hade told lies from the witness stand blaming the death of someone on a 14-year-old friend. he was stabbed to death last april. the 14-year-old initially confessed to the murder to save hade from a longer prison term but later admitted hade was the killer a week and still no arrests for san jose's latest homicide. the victim's family says the system that should have protected her failed. she was stabbed to death last week allegedly by her ex-boyfriend. that's despite a restraining order against him. police say she dated the 25-year-old juan ramirez for only a few months before she broke it off. he then stalked her for the last two years. >> she feared for her life so much that she went into kick boxing. she was asking my brother and my sister-in-law to help her buy a

gun. they were just going to teach her gun safety. >> cruz had just returned from court last friday renewing her restraining order against him when she was attacked and killed. students in one bay area community will notice something different. drug sniffing dogs are back on the job. they are bringing in dogs to find illegal and prescription drugs as well as alcohol and weapons. previous drug-sniffing dogs focused only on illegal drugs and they were cut in 2007 because of budget cuts. officials voted to bring back the dogs to discourage students from bringing contraband to campus. they will visit various schools. neighbors in a south bay community want to handle this fast food fight by themselves without any city leaders. they are taking on a proposed mcdonald's. good morning. >> reporter: we are on the corner of miller and bollinger on the lot where this proposed mcdonald's is slated to be built. hundreds of neighbors do not want it here mainly because it is going to be coming with a drive-through. so far, the city seems to be siding with them on that account. the concerns are numerous. mcdonald's could undermine efforts, they say, to fight childhood obesity, safety issues with kids running across the street to get to the fast food and it might take away from nearby restaurants. the biggest beef, though, seems to be with the drive-through. 750 residents signed a petition voicing their opposition to the mcdonald's and its plans to install a drive-through. they have denied a permit for that drive-through. the developers are appealing that decision to the city council. >> we have a neighborhood here and it is really a pedestrian neighborhood more man anywhere along. the kids are walking back and

forth. a drive-through just isn't in the character for a pedestrian neighborhood. >> counselman, pete constant, says the site is properly zoned. if the developers were willing to do without the drive-through, he says, they could start building right now. supporters of the mcdonald's say the restaurant would bring in about 57 new jobs and that would include about $67,000 a year in payroll taxes. the anti-mcdonald's is neighbors are going to meet to see where they go from here. i'm artur roe santiago. a new war memorial will be unveiled in san jose. nbc bay area got a chance to see the memorial before the unveiling. there was a lot of care put into the planning of t both sides are bent inwards to simulate an embrace of the families who are there to grieve. the tops are pointed upward

checks, the assault weapons ban and limits to high capacity magazines. more than 100 events around the country calling on congress to vote on these measures. they coincided with new details released about the shooter, adam lanza. we are learning from search warrants that he fired 154 bullets. he had with him a bushmaster, semi-automatic rifle and ten 30-round magazines. we learned new details, books on autism. clippings from newspaper articles about other shootings and an arsenal about weapons. just after the newtown shooting, support had risen. it has dropped about ten points. here on capitol hill, republicans and democrats are resistant. at least six could vote against

any new gun laws. many cities throughout the country are buying back guns. a group in arizona is handing them out. the campaign to give free shotguns to single women and homeowners to protect themselves has people in tucson divided over the offer. the pro gun group called the armed citizen project announced it is spending $12,000 on guns for neighborhoods with high crime rates to make up for the underfunded police department. prosecutors in colorado have rejected a plea deal from the man accused of last year's movie theater mass kerr kir. james holmes offered to plead guilty in exchange for the death penalty. he is guilty of shooting 12 and wounding others. new information on a death threat on a state senator leland yee.

santa clara investigators say they found 26 guns, thousands of bullets and dozens of high capacity magazines. the 45-year-old was charged with possessing assault weapons, explosives and bomb-making materials as well as threatening ye. yesterday, the court unsealed the search warrants will revealed everything found in his santa clara home. he reportedly was angry at the state senator for proposed gun control laws in just a matter of hours, a judge could decide whether or not to allow a sexual abuse lawsuit against the moraga school district. cal swim coach is suing the district saying it failed to protect her from sexually abusive teachers when she was a student. kristy myt christie smith, live. >> reporter: carol buchanon said she tried to complain to school administrators but in her opinion, they were slow to

respond. now, she says, she feels guilty. in hindsight, if she knew then what she knows now, she would go directly to child protective services. now, she is retired from the moraga school district and may best be known as a whistle blower in a sexual abuse case involving cal swim coach, kristen konane. they told her that a popular science tepor, dan witers, was abusing them. last year, she said she felt vindicated when she came forward. >> my husband came running in when he heard me screaming out. i knew it, i knew it, i knew it. why didn't somebody do something? >> reporter: buchanon said up to 25 years, the district didn't fire her but suggested she take a leave. she released a statement saying in part, i can't believe how many people at the school knew about the sexual abuse and how many warnings the district ignored to find out that there was someone at the school who

welcome back. take a look at these live pictures from pittsburg, pennsylvania, where firefighters are really trying to attack this massive five-alarm fire happening at an apartment complex. look at how they are going after it from all angles there. we don't know how many if any people have been injured there. one we are keeping an eye on this morning out of pittsburg, pennsylvania. >> famed bay area restaurant, chez panisse, is facing another delay in reopening bumping the target date to june. the contractor in charge of rebuilding it says the fire damaged more than they expected. crews are working on a new steel frame to replace the damage wood frame structure. they have managed to salvage

the temperature climb. 79 degrees in the bowl of water that i'm cooking this morning but it will continue to climb and it will boil. it will cook. it will do whatnot. we have thought about scrambled eggs will be a good one. every good recipe that i cook at home involves garlic and onion, a little butter, garlic and onion in a pan. you could totally do that here. it has various stirring mechanisms. a little saute, et cetera. that's the cool part. the shocking part, if you will. the thing that got my attention is it's price. i would call it $2,000. they would say it is $1,995.95. >> for that, a margarita and

kelley. neighbors want to handle their fast food fight without city leaders. they are taking on a proposed mcdonald's. arturo santiago is live in west san jose with why they want to take matters into their hands. a petition is going around. right, arturo? >> reporter: that is right. hundreds of neighbors have sipsed this petition. the biggest complaint seems to be focused on the mcdonald's staple, the drive-through. nearly 800 neighbors signed this petition with the intention of keeping a fast food restaurant from opening near miller and bollinger. they believe a mcdonald's wa derail efforts to fight childhood obesity and others concerned that kids would run across the street to get to the fast food and worries the new mcdonald's would take business a from other nearby restaurants. they can't really stop the mcdonald's from being built on the corner
