thousands if not millions of dollars it decided it didn't need rule making and stuck with its guns and said the people challenging the ruling, the plaintiffs, should not be forced to endure and permits the fda to further delay this. the judge is saying get on with it. >> where does the case go now? is this going to be further bogged down in courts? >> it could be. the way it if works in federal courts is the mere fact the judge signed the order doesn't mean it is effective immediately. there is normally a delay in which they can decide to appeal. if they do decide to appeal they can ask the judge to put a hold on the effect of its order which judges usually grant. it will take a couple of weeks to see fit takes effect right there or as it works the way to the court of appeals. >> pete williams in washington on this controversial ruling this morning. pete, thank you very much. now to the other breaking story.

the tragedy on the outskirts of mumbai, india. crews are searching for survivors after the collapse of a building being constructed illegally. we have the latest developments from duncan. what's the latest. >> reporter: rescuers say they are determined to keep searching through the rubble and twisted metal trying to find more survivors. two toddlers have been pulled out alive but they are also finding bodies. 41 people killed including many children. dozens more are injured. according to one eyewitness report, the building appeared to tilt before collapsing. a official said the construction did not have a proper permit an poor materials were being used. >> thank you. we have breaking news out of north korea, as well. reports that two missiles have been loaded on to mobile launchers and moved to the country's east coast. nbc's chief foreign correspondent richard engel is

live in seoul this morning. good morning to you. >> reporter: good morning, matt. those reports are from south korean military sources. they say the two missiles have been moved by rail to the coast and are now on those launchers. after weeks of escalations and threats north korea's missiles may be ready to fire. south korean military sources say the north has moved two of what it appeared to be musudan missile s on to mobile launchers on the eastern coast. the missiles are not believed capable of carrying nuclear warheads. in fact, it is unclear if they are armed at all. they are estimated to have a range of 2,000 miles, perhaps more and could reach japan, south korea or guam where the u.s. has military forces. the united states may try to shoot them down. the south korean sources said the missiles have been quote hidden, perhaps to shield them from satellite view and

suggested that a firing could come with little advance warning. speculation in south korea is that the north may launch the missiles in a test fire, a show of force on or around april 15th, the anniversary of the birth of north korea's founder kim ill sun. they tried to launch a satellite but crashed in to the sea after 90 seconds. the musudan missile if fired may do the same. countries in the flight path worry about the intent of any missile launch and what may happen if they go off course. >> richard, you know this is a couple of weeks where it seemed every morning we have some new controversial move by north korea. most of the experts say this is only bluster, and yet it continues. what's the end game here? >> reporter: i think for the end game it is about messaging. north korea wants the world to recognize it is a nuclear power,

that it has nuclear weapons. north korea will feel more secure, insulated from a foreign attack, particularly from the united states. he is also trying, we have been told, to bolster his credibility among his inner circle, proof to the general that he is strong. whether something will happen or not, north korea seems to be deliberately mysterious. on the one hand, we are not seeing massive troop build up that would indicate an invasion. but consider this, just today pyongyang informed foreign diplomates in north korea that after april 10th they should have an evacuation plan in place because it can't guarantee their safety. >> richard engel in south, south korea this morning. thank you very much. >> a busy morning here this morning. we have new jobs numbers this morning. indicating slow growth. >> that's right. just out the latest labor department survey shows the u.s. economy added just 88,000 jobs in march.

the fewest in nine months. for more check in with mary thompson at cnbc's world headquarters with the jobs numbers just out. >> reporter: wall street is reeling from the weak job numbers for the month of march. the dow is up 154 points them nasdaq down over 40. the labor department reporting the economy only added 88,000 jobs last month, less than half the number expected. the lowest number in nine months them unemployment dropped from 7.7% in february. that's because fewer people are looking for work, not because more jobs were added. work place is at a 34 year low. >> mary thompson at cnbc, thank you. pressure is increasing for rutgers university director to resign. the assistant basketball coach resigned just days after the head coach mike rice was fired because of a videotape that showed him shoving and verbally abusing players.

a group of faculty members was calling for his resignation. a deadly strain of the bird flu has u.s. health officials on alert. the virus killed five people in china and the cdc is starting to work on a vaccine, just in case it is needed. so far, the strain has not shown evidence it can be passed from person to person. and more violence against law enforcement officials this morning as a man shot a homicide detective dead inside of a police headquarters in jackson, mississippi. the gunman was a murder inspect the process of being arrested and he was also found dead at the scene. you don't need -- to save the day. see what happens when a female becomes unruly at an airport. as she struggles to stop the attacker from entering the check point an off-duty officer leaps over the barrier and tackles the woman. that is corporal rogers. and not even wearing shoes as

statements he had made. >> psychiatrists and psychologists working at universities almost never hear of that. they may hear suicidal thoughts but hardly ever homicidal thoughts. i think a lot of people in the public wish she had done more. his student i.d. was deactivated but no proof that he was contacted directly or city police. >> it makes no sense for this to be dropped at the door of campus police and go no further. doesn't make sense at all. >> reporter: court documents reveal holmes methodically cased the movie theater. weeks before the shooting, the affidavit says holmes took images of the interior and specifically the door jamb of the theater. >> somebody is shooting inside of theater number nine.

>> reporter: after the bloodshed, when police found holmes by his car wearing tactical gear, they asked if he had any accomplices. holmes said, quote, it is just me. >> the affidavit says police found anti-anxiety and depressant drugs in his apartment. if convicted he could face the death penalty. >> miguel, thank you so much. two teenagers in california are lucky to be alive this morning after stranded for days in a rugged canyon. dia . >> reporter: rescuers credit good weather and persistent for bringing home two teens missing home since easter sunday to elated families. >> glad she is found. thank god. >> reporter: but it came with a price. one of the deputies involved in the rescue fell 60 feet and is in serious condition after suffering a head injury. it all started when 18-year-old

kyndall jack and 19-year-old nicholas cendoya got lost in a hike in trubuca canyon. the teens called for help when they couldn't find their car. >> after the 911 conversation, their cell phone died. >> he tried to cover up with brush to keep his body warm. >> reporter: rescuers heard kyndall jack calling for help. >> she was clinging to a ledge going in and out of consciousness. >> reporter: air lifted to the hospital, jack is being treated for dehydration. both teens an the reserves sheriffs deputy who volunteered his time to save them remain hospitalized this morning. for "today," nbc news, los angeles. sad news on this friday morning. tributes are pouring in for legendary film critic roger ebert. >> the 70-year-old lost his battle with cancer on thursday. natalie is back with more on that.

>> for nearly 30 years roger ebert hosted movie review programs on television, most famously with gene siskel. and i was lucky enough to visit roger in his chicago home in 2011. a privilege i will long remember. for three decades, roger ebert and gene siskel gave their trademark thumbs up and thumbs down on movies. making them household names. >> thumbs up for me. >> for ebert, movies weren't just his career, they were his passion. a star on the hollywood walk of fame, the first film critic to win a pulitzer. in 2002, he was diagnosed with thyroid cancer which drastically changed his appearance and robbed him of his ability to talk. >> it's not courage -- >> reporter: when we visited with him in 2011, he spoke through alex, his computer-generated voice.

nbc's special correspondent ben fokel is at buckingham palace with the details. good morning. >> reporter: good morning, savannah from a very cold london. prince william and kate are in scotland on part of a two-day tour. kate confirmed she's expecting in mid-july and they have a long list of children's names for both boys and girls. on the second day of their visit to scotland, the duke and duchess of cambridge joined by prince william's father, prince charles, opening a new outdoor center. thursday, the duchess hid her bump in a coat, a stylish nod to the scottish people she's visiting. william and kate known there as the earl and countess of stratham met athletes and joined in shooting hoops. playing ping-pong. and a mascot who was thinking about the royal baby.

good morning, everyone. there's more fallout this morning in the wake of the rutgers university basketball scandal. ken pernetti is out as athletic director after a videotape emerged showing coach mike rice using slurs against players during practice, as well as shoving them. rice was fired earlier this week, and on thursday, the assistant basketball coach, jimmy markelli, has resigned. north korea has reportedly placed two missiles on launchers along its east coast. they say the missiles are in positioning where they could threaten japan or u.s. military bases in the pacific. on thursday, the u.s. state department urged north korea to pause and consider the future of its people, saying the situation does not need to get any hotter. in texas, a funeral today for a district attorney and his wife who were murdered last week. meantime, new video has surfaced showing what the d.a. was doing to protect his co-workers just before his death. nbc's gabe gutierrez is in kaufman, texas.

personality that i don't do addictive things. i don't eat sugar. i don't drink. i don't, i would never do drugs. i'm very careful about how i live my life but i think that's a piece of mental balance. brain chemistry is affected by our food, by our thinks, by whether we take silence, like you said whether we get nature. >> you have two daughters, i think they're in their 20s now. >> yes. >> was it at all possible as a mom watching them grow up to not hyperanalyze every mood they went through, knowing your family history? >> you're correct. i mean i did have moments where i was afraid, because i've been afraid my entire life, but what i realized is when you can break that curse or that chain of dna and genetics and stuff like that and i truly think that you can, once i did that, i feel that i released them from that, you know, they're going to have their own problems and nobody's going to say they're not going to have days where they're sad

good morning to you. it is 8:56. i'm laura garcia-cannon. that breaking news we're following this morning is in east san jose where police continue to investigate a drive-by shooting. our chopper was above the scene just moments after it happened around 7:30 this morning. it is near the intersection of south white road and mount vista drive. there you see officers at the scene. officers say a car actually came up next to a 34-year-old man firing several shots. he was said to be hit twice. that victim was able to walk to a nearby home and call police. he was taken to the hospital. it's unknown if those injuries are life threatening. right now police are searching for a gunman and motive. we have a crew at the scene. update at 11:00.
