those two people are now in the hospital recovering from their injuries. during the investigation, officers did discover the gun was a fake. >> the gun that was produced by the suspect as it turns out is a very real-looking replica semiautomatic firearm, but it does not appear at this point in time that it's a real firearm. it does appear to be a replica firearm. >> the two officers who fired the shots were not hurt. >> a story we brought you as breaking news. cal train crews working all night to clear a mess left on the tracks left behind after a train started gushing fuel. our crew arrived at the south san francisco caltrans station and we'll bring you a live look as soon as we can. it would appear the track is cleaned up and clear. as many as 400 gallons of fuel may have leaked on to the tracks last night prompting the all-night overnight cleanup. the train may have hit metal

along the tracks and something tough enough to rupture some of the tanks. hazmat crews were called to the station at 7:30 last night. >> caltrans has 100, 150 people that were taken off the train and taken by bus to where they needed to go. >> service between san bruno and south san francisco was suspended while hazmat crews cleaned up the spill. >> a north bay man now under arrest after leading police on a pursuit with an infant child and girlfriend in tow. eric diaz paneda led police on a chase, leaving his girlfriend and child behind. officers caught up with him overnight and officers surrounded the home and brought in a k-9 unit before he surrendered and he is charged with recklessly evading police and child endangerment and he's booked for three outstanding warrants for his arrest. >> no arrests and no motive as

san jose police investigate the 11th killing of the year. a man was found shot to death on a parking lot on center road a couple of blocks away from kelley park. the man'sed abouty was found near a parking lot near the scene of a large party or rave. at this point the police are not saying whether the death was linked to the party. >> when we arrived there were approximately 40 people outside who were detained and interviewed to determine their involvement. we located 40 people inside the nightclub who had barricaded themselves inside and we extricated those people and interviewed them. >> so far police have not released the name of the shooting victim. >> in oakland, police are investigating the shooting that left the newspaper photographer dead. >> 54-year-old lionel ray fluker was driving by when a stray bullet hit him. he was a freelance photographer

for "the oakland tribune." the person who was targeted was also hit and in critical condition at the hospital. police are offering up a $15,000 reward for information leading to an arrest. san francisco police are still looking for a pair of robbers that stabbed two tourists outside their hotel in the south of market area friday night. witnesses say one of the tourists was arguing with the men when he was stabbed. another tourist who came to his aid was also stabbed. police say their attackers then got in the car and sped off. the victims, fortunately, are expected to recover. this weekend members of the korean community are marking the first anniversary of the tragedy at the oiks university. ♪ ♪ the korean mafrter choral, and proceeds from ticket sales and from an art auction will go to

the victims' families. >> there is nothing better than an event like this to really move on, but also remember those people that are, you know, unfortunately not with us anymore. >> monday marked the first anniversary of the shooting rampage that took the lives of seven people. the former student accused of the mass murder is now in a psychiatric hospital found incoverage tent to stand trial. >> in south san francisco hundreds of first responders are training to respond to a major earthquake this weekend. it's the first time since 2009 that california task force three and four from the peninsula and east bay have joined forces in a multi-agency exercise. the training is being held in an abandoned warehouse. dru crews are honing skills in everything from extricating victims to dealing with toxic, biological agents and it was made possible by $150,000 in state and federal funding. it's a big day on the cal

welcome back to the broadcast. beginning with a live picture from the south san francisco cal train station. we're starting here because last night there was an accident involving one of the trains, ran over something that punctured one of the diesel fuel tanks and as much as 400 gallons of of diesel fuel spilled on to the tracks at that station last night. crews were at it all night clearing up and it looks like

they may have finished their job this morning. we have yet to see any trains come through, but we'll let you know if it looks like the trains are running on schedule this morning as well. new video this morning along the border of north and south korea. it remains calm this morning. north korea has been raising nuclear threats for a week. the military is authorized to use small nuclear weapons. at least one missile with considerable range has been moved to north korea's east coast. south korea's top military officer has put off a visit to washington to remain at home just in case, and the u.s. defense department is conducting an intercontinental missile test if it could be misinterpreted and make the situation worse. john kerry is in istanbul for talks with turkish leaders. he's expected to discuss the conflict in syria and he's expected to touch on restarting stalled israeli-palestinian peace talks by encouraging

turkish leaders to improving its ties to israel. the secretary of state heads to israel later today. during his trip kerry is speaking out about an attack in afghanistan that left six americans dead. u.s. diplomat 25-year-old ann schmetinghoff died trying to make a difference. she was on a mission to donate books to students in the south of the country when killed. she was described as, quote, vivacious, smart and capable. this is the first diplomat to be killed since the american consulate in benghazi, libya. new details in a massive fire at a fabric shop that killed a firefighter in philadelphia. the owner of the shop says it's possible the flames may have been is that corrected by an electrical problem. the fire burned the fabric shop, upstairs apartments and neighboring boutique causing a partial roof collapse that killed 53-year-old captain

the time is 7:14. what a pretty shot. the sun's about to come up over the city of san jose. thanks for joining us this morning. this summer san francisco's museum of modern art will close for a big renovation. work is expected to take at least a couple of years, but as nbc bay area's joe ro, r osato, jr., tells us, it may come to you. >> anyone who lives in one place, knows you accumulate plenty of stuff. when the museum of modern art, that stuff is countless pieces of modern art. >> we have a collection of 30,000 objects and located in different locations both in the building and outside. >> with moma closing its doors in june for a two-year renovation the art is getting packed up. every day a moving van is hauling off priceless load and cranes will be taking sculptures

from the rooftop garden. >> the summer mo will keck off the expansion which will more than double in space and in an arrangement that could be described as a work of art, the museum agreed to build the city a new fire station in exchange for expanding into the old one next door. in the annals of american museums i cannot think where it has built a new firehouse in order to continue to expand. >> reporter: it will display the collection and museums across the bay area and beyond. >> we will also be presenting a host of off-site projects in non-traditional spaces for contemporary arts such as christy field or the town of los altos. >> moma will stage eight sculptures by artist mark disuvero this may. >> for us, it's a chance to

experiment with the idea that art might help people see our park resources in new and interesting ways. momma is throwing a celebration including three days leading up to the next stay in 2nd. instead of going to momma to see modern art may be coming to you. joe rosato, jr., nbc, bay area news. plenty of pound the pavement in san francisco for the rock 'n' roll marathon. they will get the chance to run across the golden gate bridge any minute now. the 13.1-mile race started at the muni pier at 7:00 this morning. the race will end at the aquatic park promenade later today. the rolling stones will be rolling through oakland and san jose. ♪ ♪

♪ tickets to see the rolling stones in san jose and oakland go on sale tomorrow morning. they will play the oracle arena may th. expect the classics with a few other gems mixed in. speaking of a gem, we have one of our own. meteorologist rob mayeda is here to take a look at your sunday forecast. >> you must be referring to tuesday or wednesday. today it's an interesting mix that we'll see beth during the morning and by the time we get toward the evening, changing weather conditions. some mist with some of the low clouds and our temperatures, thanks to the low cloud cover not too chilly this morning and we're at 55 degrees in san francisco and 58 in oakland and in san jose you're at 51 degrees and winds still coming in off the ocean and as they turn offshore in the middle part of the week that will allow the temperatures to climb on up.

the story today mist with the low clouds between now and lunchtime. as we head through the afternoon probably sunny breaks and the next system that drops in will have more clouds our way, as the storm pattern is still fairly active and the bay area is getting a glancing blow from the jet stream in northern california and it will be after sundown tonight and it will have extra moisture to work with and extra lift that should give us more rain here and a bigger impact over the sierra overnight and once the system clears by, high pressure behind it. crank up the winds for monday and as high pressure builds over northern california those temperatures will climb on up tuesday and wednesday. you have light, maybe moderate rain very briefly shutting down before the monday morning commute as skies start to clear, winds will be kicking up for monday and hilltop locations gusts could get from 30 to 40 miles an hour. from tonight into early monday

morning and if you'll head to the high country, sierra travel, windy. you see the snow stacking up there and you could see some change control sunday night until early monday morning and arne the buy area today you should see highs in the mid to upper 60s from sun valley south and become over to low 60s. the coolest part of the week happening right now, windy and clearing as we go into monday and watch those numbers as we get into wednesday, 70s, near the coast and 70s and 80s inland. we'll see cooling as we head toward thursday and friday and once the system goes through tonight and into monday becomes a big time snowstorm for the rockies and once that clears we'll be staying dry. it looks all of the way into the start of next weekend. u.s. ski team racers are warming up on the colorado slopes and not normally we'll be doing in april, bethea wanted to

a body believed to be chief executive chief executive's chief insurance examiner has been found in a river days after he was reported missing. he was found dead and wrapped in

a blanket. he is 62-year-old william mckuhn who had been reported missing since thursday. four suspects are now under arrest. the four range in age from 20 to 23 years old. investigators aren't sure what their relationship to mckuhn might be and a motive has not yet been released. but investigators believe mckuhn's death, concerned, quote, personal matters and was not work-related. this morning popular evangelical pastor is asking for prayers after the death of his 27-year-old son. saddleback community church says he took his life. the coroner's office has not released how exactly he died. another pastor will preach in rick warren's place today. a funeral will be held tomorrow for pulitzer prize-winning film critic roger

ebert. the service will be held at the holy name cathedral in chicago. a separate memorial service is set to take place april 11th and the details have not been finalized for that. the ebert film festival will go on as planned april 17th through the 21st in champagne illinois. ebert died at the age of 70 thursday after battling cancer. fruitvale is set to hit the big screen on july 26th. that's three months earlier than originally planned. the movie focuses on the 24 hours leading up to grant's death on a platform in oakland. he was shot and killed by a bart police officer in 2009. "fru "fru "fru "frui "fruitvale." it's the first film by 26-year-old ryan koogler.

a family is demanding a noor weej an museum return a painting. the blue dress in the yellow armchair. the family of paul rosenberg has documents showing that the painting was taken from the art dealer's vault. the museum says it bought the painting in good faith more than 60 years ago and did not know the painting had been stolen by the nazis. the museum says it is continuing to negotiate with the heiress. much more on "today in the bay." we'll tell you how airborne officers tracked down four missing teens. plus a fake gun leads to real gun fire in san francisco. new details and the confrontation that prompted police to start shooting next. >> and put a ring on it. how the world champion giants are being honored ahead of today's game at at&t park and the freebie for the first 40,000 fans through the gates. this morning we're waking up

the man who was holding what looked like a real gun. the officers started shooting hitting the man holding the gun as well as another person. those two people are now recovering from the injury. that is when the officers discovered the gun was fake. >> any firearm in the person who pulls it. two officers who fired the shots were not hurt. >> a follow up to a story as breaking news, cal trans cruise working all night to clear up a mess from the tank. we hava i look at the south san francisco cal train station. we've not seen any trains pass through the section just yet. 400 gallons of fuel may have prompted the all-out overnight cleanup. the train may have had the metals and called to tank,

being rescued. they spotted the -- a chp helicopter hoisted all to the top of the mountain. the entire rescue, though, took less than ten minutes. all four are tired, but not hurt. they were taken to their parents by santa clara county's cher ofo offive's deputies. perks given by the district attorney are under investigation. jeff rosen gave managers vacation benefits that could convert to cash. the move is apparently an attempt to get around a pay cut in the latest union contract. rosen says he had the right to offer the hand-picked managers the perks. they're currently investigating the deal. oak lann could decide to cut ties with goldman sachs. activists are urging the city council to stop doing business with the wall street investment bank after it refused to cancel

an investment that would cost taxpayers $20 million before it expires in 2021, but the oakland city administrator is hiring a firm into cutting ties with goldman sachs. goldman sachs will reportedly get a chance to respond to the issue during the finance committee hearing on tuesday. an e connick oak tree at the state historical park will be cut down this fall. this is a picture of jack london and his wife in front of the tree in the early 1900s. california state park officials say the tree is ready to fall because of a wood-eating fungus and the tree killer known as sudden oak death. it is where landon wrote dozens of books and short stories. >> they will have the world series wins. before the first pitch they will hold a ceremony to honor the 2012 team. this is the team's second world series ring ceremony in three years.

welcome back to the broadcast. 7:43 is the time. you're looking at the skies over fremont this morning as the sun comes up this sunday morning. now think it's easy being governor of california? not if you're jerry brown this past week, anyway. for more we turn to nbc political analyst larry gueerst. i thought things were great for him. the budget was trending in the right way. he got the super majority. it's golden. the democratic governor and california. >> what's the problem? >> it was broad sided. brown was broad sided this week when 22 legislators, 22 democratic legislators wrote to him opposing what's been called now the peripheral tunnel project. now these complaints that happened before garvin, but never in such large numbers. a little background. a little background here. the peripheral tunnel project and two 30-mile long tunnels and

that's the peripheral canal which was 35, 36 years ago. how did that work out for you? >> not so well. it's still on the books and both of these, the ideas for both of these to move water from north to south provide additional supplies to farmers in southern california users and that's the hope, anyway. >> now, i'm going to guess. so like you said, he's got the democratic legislature. he's the democratic governor and there are ties that bind the political party and when you start talking in california there are other ties and other conflicts, right? >> the environmentalists are sitting right out there and they say it's harmful to the delta's ecosystem. they toss out one study after another. they also complain about the cost and we're not talking about a small amount here, and somewhere between 24 billion and 50 billion.

brown has a size abable chunk saying the environmentalists. we're not willing to play ball. so does this, with that lack of support does this make this a nonstarter or does jerry brown -- is this one of the ones he's willing to go to the mat for? >> you have to take a step back and look at policy making here. agricultural democrats are not the same way as environmental democrats and it gsz the same way as republicans and policy making takes place in all kinds of crosscurrents, if you will. so yeah, the easiest way to distinguish people who govern is to look at their party and the elephant or the donkey and how however you want to see it. the agricultural democrats and saying, you know, we can't go with this and that's what's divided everything up. so the coastal democrats are going one way and the democrats are the other way. brown is having a conniption fit

here because he can't get anywhere with it. before we look at the two-thirds majority thing, we need to realize that inside of that it's not so easy. you said jerry brown was on friday, he's not a rookie and this is not his first rodeo. how does he -- with an issue he's so familiar with, how is he surprised by this? he's always known there are some democrats opposed and we've seen 14 in the past and 22 is a much larger number and the majority is so fragile. they bearly had that. we should remind people that two-thirds majority is important because that's what you need to get important legislation passed especially when it comes to raising money. so he knows the right way, you might say. i think this is the kind of thing that happens to people even the people as successful as

brown. >> okay. so what happens now? back to square one. there's some man you havering here, some people are saying go with one tunnel instead of two. move less water instead of all of the water you want to move and brown may have to make that compromise. he's been around. this isn't his first rodeo. he knows how to make those compromises and that's one of the things that's rather refreshing about the second generation of jerry brown. >> he's tackling this and high-speed rail and two projects and that's a lot of water to carry. >> so to speak. let's talk to something that some people would think it is not as important, but still stole headlines this week. the president and kabul -- >> it just gets the whole thing of sensitivity what's sensitive to one person is not sensitive to another. oh, my gosh. look at her as attorney general. i think it speaks to the women's movement and it speaks to the

high level of concern that people have about obama, whether he's reaching out to minorities or not including women. one thing for sure, some people got their feathers ruffled. >> one of the arguments i'd heard were in gavin newsom were in that room, he's the best-looking lieutenant governor in the country, people would have laughed and it would have gone without a ripple. i guess it's one of these things where we run into how far we've come. >> the argument is you can say that about men who have made it, but when you still look at the fact that women are making three-quarters of what men make. there are now 20 in the senate out of a hundred and you say maybe you can't have that same kind of talk to a woman who is still trying to gain parody. >> you see how far you've come and then maybe we haven't come that far. always a pleasure. thank you very much.

clouds and we're getting more of that around the peninsula and winds offshore by tuesday and wednesday and it will bring our testimony temperatures up and temperatures tend to soar and we'll see that coming up in the seven-day forecast. in the meantime, areas of mist near some of the coastal hilltops and also toward the hills east of san jose and that's the low clouds being forced to rise up and over the hilltops and the weak frontal system going by. more clouds coming later on this evening and you can see why we have the jet stream still moving in just to the north of the bay area and the biggest impact of the last few systems have been around oregon and washington and the last one coming in after sundown tonight will drop further south. so by the time we get to 7:00 and 8:00, you'll see mostly cloudy skies and some rain possible, briefly, as we head into about midnight and by tomorrow night the story transitions from being the chance of wet weather to outright windy conditions especially on the coast. you'll get winds 20 to 30 miles per hour and a little gusty in

the hilltops and this is for monday and tuesday and wednesday as this high builds over the bay area, the jet stream moves way off to the north and you'll see temperatures climb up into the 70s and 80s. later on today, partly cloudy to mostly cloudy skies in the evening. as we head into midnight and 1:00 in the morning you will see a brief chance of getting showers on through and by the time you head to the monday morning commute and it will help clear out skies by monday. gusty at times and not much warm or monday and you'll see the temperatures start to climb on up. i think a lot of this will fall before the time we go to bed and before we wake up tomorrow morning and mainly an overnight event into the bay area. heading to the high country and look out for a chance of seeing snow especially late tonight on into monday, and you could see brief chain controls. mid-50s in san jose and mid to upper 50s in tri-valley and back
