from the rest of the train to replace it way new one before it could continue on. that train did arrive in vancouver a short time ago about four hours behind schedule. >> in the north bay, a crash so violent investigators don't yet know whether the person killed was a man or a woman. it veered across four lanes of 101 before crashing into a concrete bridge support column and that's when the car burst into flames. the driver was pronounced dead at the scene. the crash happened around 6:45 last night on the eastbound highway 37 connector ramp. witnesses say it appears the driver was speeding moments before the crash. >> in another crash, a ferrari caught fear after the driver lost control in highway 1 in sonoma county. according to the chp the driver somehow lost control and slammed into a tree. both the driver and the passenger were killed and the burning ferrari damaged the asphalt so crew his to close the road down for repairs and that

lasted about six hours yesterday. no word yet on the cause of the crash, but officials say they don't believe will alcohol was a factor. >> new video of a house that went up in flames in san jose. a fire started on this home on crater lane and ferrell court not far from the intersection of moral avenue and sierra avenue. the fire crews arrived on scene around 3:00 this morning and at that point the two-story home was fully engulfed in flames. so far there are no reports of any injuries and officials say no one was home at the time of the fire. the cause is still unknown, but witnesses told fire crews that the fire started near an electrical panel. >> sadness and shock continue to repel through the bay area over the suicide of a south bay teenager who police say was sexually assaulted. her name is audrie pott, although we do not identify the

victims of sexual assault, we do so with the permission of her family. kimberly tere. >> the santa clara sheriff said a piece is missing. critical electronec device may have pictures. >> if it's got power it can triangulate the phone based on the towers. whoever did powered it off or destroyed it. in which case, if it's gone it's gone. three 16-year-old boys are accused of sexually assaulting audrie pott on september 2nd while unconscious at an unsupervised party. they took photos of the attack and sent them out online. >> once it gets out on the social network it tends to spread and it's almost impossible to delete it because i might share it with you on facebook and you share it with somebody on twitter. somebody on twitter sends it to

someone on linkedin. you'd have to contact everybody that had it and asked them to delete it and the backups as well. >> as those photos circulated around school and online, audrie took her own life. her family set up a foundation to honor their daughter's memory. a message was posted on the foundation's facebook page. it read, quote, we suspect that the boys who we believe are responsible for audrie's death took deliberate steps to destroy evidence and interfere with the police investigation. >> the family of audrie pott is devastated by her loss and they're looking for answers. they'd like to know what it is that actually happened to their beautiful, young daughter, and we strongly, strongly encourage and hope that people will come forward and help them get answers to those questions. >> audrie's parents have not spoken publicly about the case yet, but have scheduled a press conference for monday. audrie's mother, father and

stepmother are all expected to be there. a candlelight vigil has also been planned for 8:00 p.m. friday to honor audrie. it will be held at saratoga high school where she and the suspects went to school. that was kimberly tere reporting. the three suspects are expected to have their detention hearings either tomorrow or tuesday. a woman is behind bars this morning in connection with the kidnapping of an 11 month old baby girl. you might remember it happened in san jose last month. 30-year-old karla hernandez is facing multiple charges including kidnapping and child endangerment. the baby's mother reported her daughter missing on the morning of march 25th. she said she was warming up her car with the little girl inside, strapped in the car seat and walked away to close the garage door and that's when hernandez got in the car and drove away. information from witnesses and the sketch that you see on the screen helped them to track hernandez down. nine months after a mother and father were shot and killed inside their san jose home

police say they arrested the man they think pulled the trigger. authorities arrested this man pedro medina this week in mexico. he's accused of killing marybel and pedro jimenez in their home. the couple's children, all of them under the age of 9 were home at the time. the shooting was a result of a love triangle. marybel had dated medina while separated from her husband and medina reportedly became obsessed with her. honoring a sacrifice nine years later and the building now bearing the name of a south bay soldier killed in iraq.

we're looking at downtown san jose on a beautiful day. hopefully you don't have to do your taxes which are due tomorrow. the lawmaker who admitted using $130,000 in public funds to pay for his gambling habit. newly released court documents show supervisor george share cowa was back gambling within three days of resigning and said he was getting help. the document shows he went to thunder valley casino and had a comped meal there. he pled guilty to 12 criminal charges, five of which are felonies and he did so in exchange for leniency.

in response, the district attorney's office said it would not seek the maximum penalty of eight years in prison, but instead would seek one year. an nbc bay area legal analyst say it could hurt his chances of getting less or getting house arrest. >> it's very similar to a defendant that's charged with a serious alcohol-related offense being caught in a bar. it's a significant problem when you are asking the court for leniency and the d.a. is saying that he's not genuine in his efforts for rehabilitation and this is a ploy to gain mercy from the court. >> it is likely share kaua's attorney will gain proof that the gambling addiction is a serious one for which relapse is a normal part of the recovery process. the judge is expected to set a date for sentencing on april 30th. still ahead on "today in the bay."

good morning to you. looking live over blue skies in fremont. if you have an umbrella out on your patio, you may want to take it down. we'll check in with rob mayeda in a bit. >> a post office now bears the name of the first south bay soldier killed in iraq. joining friends and family of the soldier, congresswoman deborah eshu helped to name the post office. it is now the lieutenant kenneth m. ballard post office. the army lieutenant was killed in iraq in 2004. ballard's mother says the dedication is not just for her only son, but for all military families. >> well, i just hope that they remember that there are people serving on behalf of the country. that they stand up while we stay home. when they go in i hope they'll say who is that lieutenant ken ballard and that they maybe go look for him and find out a little bit about the kind of

people that serve in our military. >> ballard was a mountain view native who was awarded three bronze stars ands a purple heart during his nine years of service. dozens of families have new homes this morning thanks to habitat for humanity and a project unlike any other. the organization welcomed 36 bay area families into a new condo development in daly city this weekend. this development is the largest for the non-profit on the whole west coast and featureses a sustainable urban design. all of the families are low income and each had to spend at least 500 hours helping to build their own homes and others in the complex. 12,000 volunteers also pitched in and dedicated time to help build a new development on mission street. it took 160 years to do it, but this morning there's finally a monument dedicated to the dozens of people killed in a steam boat explosion in the waters in santa clara county. >> it marked the explosion of the steam boat jeshy lynn. it was 1853 when the steam boat headed out for san francisco, but a bowler pipe exploded killing many of the 100 people onboard. we spoke to one of the historians responsible about the significance of the day. >> overwhelmed. i am just so excited and a little tearful, too. it's been really exciting to see this actually come to pass after 160 years and it's finally taking its place in california history. it's a wonderful thing. >> britain hopes it sparks interest in the role. and california's rich history of steam boat commerce. at that point it was the easiest way to get to san francisco because the steam boat was too dusty. rob mayeda has a look at the forecast and aren't we lucky we

can now drive dust-free. >> dust kicking up later on. right now gorgeous start to the morning and mainly clear skies and that's the reason why we're wake up. pretty chilly temperatures, 30s and 40s, and 39 in napa, 48 in san jose and san francisco relatively cool and 47 degrees near the water and also 47 in oakland. the winds, fairly light right now. we do have a bit of a sea breeze. these winds will pick up in intensity this afternoon. northwest winds probably 15 to 35 miles per hour and locally higher gusts out of sfo airport toward this evening. some changes in the forecast and we'll see a dry finish at least during the daylight hours and tonight into monday, a chance of seeing showers and a stronger wind arriving monday into tuesday and the second half of the week start to climb up once again. hour by hour, mostly sunny skies and breezy at times. one thing you will notice, clouds on the increase and here you go, after midnight into early tomorrow morning, a chance

of seeing showers. this forecast looks just like this time last week where we talked about a system coming in sunday night into early monday morning and not a lot of rain expected and as the system quickly exits the bay area and the reason why it will leave quickly and gusty winds shoving it away later tomorrow. as the jet stream drops down we'll see this cold pocket of air that will not only bring us the gusty winds and it will drop our daytime highs and upper 50s and many spots for tomorrow. the coolest day of the week, monday, windiest days, monday into tuesday and after that the system starts to lift out and we'll see those temperatures climbing back up. i do want to point out for monday if we'll head to lake tahoe and look out for snow showers today will be fine and don't get caught off guard tomorrow as we see more snow showers picking up during the day tomorrow around high country. 50s in san jose, close to 70. in the warmest spots and mid to upper 60s around the trivalley

today, and low 60s into san francisco and still near 70 in santa rosa, and the coolest task of the seven-day forecast, clearly, monday into tuesday with the chance of showers for tonight and gusty winds at times probably for at least a couple of days and as the wind backs off and a nice forecast, wednesday into thursday you'll see the temperatures climbing on up and between monday and friday, look at the highs going from the 50s into the 80s and that is a springtime seven-day forecast for the spring back and forth versus the cool and pre-summer like conditions and the winds are getting gusty this afternoon. >> i was thinking of layering as a winter strategy, but clearly -- >> we will need it for the first three days of this week. >> thank you very much, rob. it is april 14th which means if you haven't filed your taxes yet you have until tomorrow night to get it done. for more on that and what else is happening in the world of business here's cnbc's tyler matheson. wall street starts off with tax

child care is often a juggling act for parents. when normal arrangements fall through, then what? if you're lucky your employer may provide emergency back-up child care, how trust worth set back-up nanny and who is accountable if something goes wrong? investigative reporter vicky wynn takes a look at the multibillion industry including one of the biggest companies providing child care. >> yes. yes. >> 19-month-old dylan and chloe. a happy handful for their parents, mom and dad are physicians who say they called bright horizons for back-up care in january. it has the largest national network of in-home care providers. we befkly invited this person into our home that we were told was perfectly trustworthy and

cared for the girls. >> the internet history had been deleted. >> exactly. out of pay pal they got $2500. >> they went to facebook a few times. >> in all about $5,000 had been withdrawn from the couple's account. >> you can see every five minutes or ten minutes they were trying to do some sort of search. >> do you know what was happening to your girls during this time. >> we try not to think about that part because we don't know what they did. >> her husband came to the home to drop off lunch. the investigation of the computer showed a motel room was booked in his name and his facebook page was open, but without cam flas their home the lewises have no way of knowing if the nanny was alone that day or how their girls were cared for. >> honestly, i don't know how they reacted and the best we can hope for is that they were left in their crib, to scream it out for serve hours. >> they filed a police report, but even with evidence from the forensic search sfpd says it

doesn't have enough resources to investigator. what surprised the lewis' was the response from bright horizons. >> we were told it's unfortunate what happened to you, but there's not much we can do about it. >> bright horizons declined to speak on camera. we regret that the family has had to go through this. we have clear processes to ensure that all caregivers in the network meet the highest standards and that includes a thorough background check and that our providers have insurance coverage. it has never had a case like this by 20 years had they not been reimbursed by their banks and paypal. >> that's ridiculous. >> when they asked for compensation for the time and cost spent recovering their identities they were referred to this company. med staffing based in fremont. it's one of 1200 companies that subcontract with bright horizons to provide back-up care. >> our contract through our employer was with bright

horizons. med staffing declined to speak on camera, but said in a statement said we have provided back-up care to bright horizons families for almost five years. they referenced prior to making an assignment. the nanny is no longer in their network. ? so we reached out to the nanny. she hung up when we asked her about the allegations. >> are all background checks created equal? >> no, they're not. the child care resource and referral network. she said parents should always ask for the nanny's name or driver's license so they can check it through the state's database. it's the only authorized screening of in-home care givers in california with access to fingerprint records at the state department of justice and the fbi. >> it also looks to see if the person has had a family child care license revoke order teaching credential revoked. >> she had access to all of the new accounts. >> while situations like the

my ponytail holder ready. >> and any hats you might have on your head and they'll blow off to a different zip code later this afternoon. it is nice out there. clear skies and the sun is out, but it's chilly. we have 30s and 40s to start the morning off. what you will see is winds out of the west-northwest from 15 to 30 miles per hour and by sunset tonight i think you will notice some clouds on the increase. our temperatures by 1:00 looks like mostly 60s. exception to the rule, san francisco, firly cool afternoon and i do want to show you hour by hour in terms of the clouds. more clouds approaching by sunset tonight and here is the change in the forecast. 8:00, 9:00, showers in the north bay and after midnight, into tomorrow morning even showers through san jose. we did have sunday night into monday morning showers clearing quickly because of gusty winds picking up and the exact same forecast. we'll talk about these windy changes and a warm-up for the second half of the seven-day

forecast and we'll have that coming up in just a few minutes. >> to the tensions on the korean peninsula and john kerry who got china onboard in dealing with the north and he's now headed to japan this morning hoping for the same. kerry traveled to tokyo from beijing where he met the president of china yesterday. in response to ongoing threats from north korea japan has deployed advanced missile interceptors in and around tokyo. during his visit to beijing, kerry affirmed that the u.s. and china would work together to rid north korea of nuclear weapons. analysts think north korea will test launch a missile possibly tomorrow to mark the anniversary of the birth of its founder. in venezuela voters are headed to the polls this morning to elect a successor to the late president hugo chavez. voters will choose between president hugo chavez. voters will choose between acting[p and capriles. >> recent polls show capriles has closed the gap. this morning crews in bali

are working to move the lion airplane which crashed into the water near ret sort island. investigators are now onscene and the wreckage will help to be moved to facilitate their investigation. aviation authorities removed the plane's so-called black box which records data. >> the 737 was new with a large crack behind the wings and then filled with water. all 108 people onboard survived, but 40 people survived with injuries. closer to home in the north bay a crash so violent investigators don't yet know if the driver was a man or a woman. the driver veered across four lanes on northbound 101 before crashing on to a concrete bridge support column. that's when the car burst into flames. the driver was pronounced dead at the scene. the driver was pronounced dead at 6:45. witnesses sea the driver was speeding moments before the crash.

from the rest of the plane. the train is expected to arrive in vancouver, canada, this morning and we reported it did arrive and it was four hours behind schedule. the fire started at this home on crater lane and farrell court. when fire crews arrived on the scene they say the house was fully engulfed and that was at 3:00 this morning. so far there are foe repono rep injuries and that's because it appears no one was home at the time. witnesses told fire crews that the fire looked like it started near an electrical panel. and a follow up. now we have new information about santa clara conte supervisor george shirakawa who resigned from his job after being accused of using $130,000 in public funds to feed his gambling habit.

new documents showed he was gambling again just three days later. when disgraced santa clara george shirakawa pled guilty, he did so in exchange for leniency. he had resigned from the county board and released this statement to his constituents which reads in part i have been in ongoing medical treatment for my addiction and depression. i realize i need to ak is not responsibility for all of my actions. the district attorney's office said it would not seek the maximum penalty of eight years in prison for committing perjury and misusing $130,000 in public funds. >> we were aware of his addiction. we were aware of some of his public service. we were aware of how the community was wronged. we knew he was going to step down right away and we wanted to end the nightmare. >> but the nightmare is not over for shirakawa. three days after resigning and apologizing, shirakawa was

gambling at thunder valley and was comped a meal at a restaurant. that could hurt shirakawa's hope for anything less than a year served other than a year in jail. >> it's very similar to a defendant charged with a serious alcohol-related offense being caught at a bar for sentencing and the d.a. is saying that he's not genuine in his efforts for rehabilitation and this is a ploy to gain mercy. in the same document the d.a. is pushing for a full year in the county jail. >> clark adds that it is likely that shirakawa's attorney will gain proof that the a connection is a serious one for which relast lapse is part of the recovery process. >> building bridges in order to fight crime.

bill. >> joining us now, nbc bay area larry gerston. we always talk about the fact that what's on the table in the beginning is what makes it out of the kitchen. >> and in no case does it exemplify that more when you talk about gun control in the wake of newtown and the spirit is that every parent and every grandparent has for their children or grandchildren? >> why aren't we doing more? you see this move in the setting to finally ask yourself several months and open up discussion which opens up along the way opportunities for possible legislation. >> here are the major areas, chris, that require discussion here. the idea of assault weapons bans and bans on pga mag cleps that --'s com prehundredsive national gun registry and mental health programs emphasizing

other components. those are the major elements. >> so we know that it's early, but what seems like it has a good chance of moving forward to the house? >> at the end of the day it's not going to be nearly as robust as people anticipate. mental health programs really seem to be -- have the best lickly hood of moving true and if you think about that, this legislation is fairly benign. nobody wants anyone who is deranged to have any weapons. this legislation allows all parties concerned today. we did something about newtown and all of the other recent tragedies that we seem to be reading about week after weak. >> what about the biggies that people were about, banning assault weapons and the national gun registry and what happens to all of that when there's such fervor in the beginning and then it doesn't appear. what happens? congress doesn't seem to have

the appetite to move ahead on assault weapons and if anything comes with it, registration is the idea. they feel there will be sufficient loopholes here to make the policy meaningless and just unenforceable. >> california has probably the best, strongest legislation when it comes to gun control, assault weapons, waiting periods and the whole thing. >> it could really be something for the other states to emulate. >> we hear from the folks on the side of gun right activists who say just enforce the rules that we have. if it's such a watered down version does it become a version of what we are doing? >> it may be. the question to me is why is it that we can't do more? there seem to be two answers. >> first, people are likely to name the bad guys. the rifle association and gun

owners. as the folks were holding it all up and it's true. why do you want to have thi thingness of officials to listen to them. public opinion plus, for universal background checks and the public doesn't look at the issue with the same intensity or concern such as other issues like jobs or taxes or the right to choose types of things or social programs. those are the things that really get people going one way or another. when the public is really angry, that's when congress act, but until then, congress will sit back and do what with members believe they have to do just to get along and that's going to be modest, minimal changes which will leave proponents like california senator dianne feinstein, long the leader in this area. >> right.

good sunday morning to you. here's another view from san bruno mountain, looking nice and steady for now. looking back at san francisco, we have high clouds passing by and a chilly start to the morning. we're seeing temperatures in the 40s and even some 30s to get things started in napa, and by the way, we'll see chilly temperatures as cooler air starts to sweep on in ushered in by gusty wins at times heading into the afternoon. right now the winds aren't too bad and they should stay that way through lunchtime and you will see the wind speeds start to pick up as we see rapid changes in the forecast today.

wrap things up and a chance of some showers and the winds will increase monday into tuesday. the temperatures climb off as we head toward wednesday, thursday and friday. we'll see the temperatures climbing into the 60s and low 70s in landz and many just cooler than yesterday and it will probably not feel warm outside if the cooler air is sweeping in from the west northwest heading through the afternoon. what we'll notice today around sunset tonight are increasing clouds and a chance of showers moving south past midnight and into tomorrow morning could still see lingering showers in and around the south bay and skies actually clearing rapidly and the reason why the skies will clear rapidly is we'll have gusty winds pushing the system out of here fairly quickly. rainfall totals much like we saw exact same time last week. sunday night into early monday, not expected to be much and what does fall will probably quickly
