charges might be filed. reporting live in berkeley, christie smith, "today in the bay." police at uc berkeley need your help. trying track down a man that attacked a person on campus. uc police releasing the sketch of that suspect. back on april 1st, he got into an argument at sproul plaza and punched him knocking him right to the ground. the suspect is believed to be a cal student. he stands about six feet tall, heavy build with black hair and brown eyes. he was last seen near the south side of hurst gym. also new, san jose police looking for the driver who hit an officer with his car outside of hp pavilion. that officer was just released from the hospital. the story involves an attempted burglary and a sold-out concert. "today in the bay's" marla tallez is live near the pavilion in downtown san jose with that story. good morning. >> reporter: good morning. we're at the intersection of delmas and san fernando. hp pavilion is just a few blocks

away. this is where this officer-involved hit and run happened and where the suspect was last seen right here at this intersection. this all started last night right after a sold-out concert, about 11:30 last night. one of the people leaving this concert walked up to his car in an overflow parking lot right where we are on delmas. that's where he found the suspect attempting to burglarize his car. the suspect actually returned the items he was trying to take. police say that's when the suspect jumped into his own car, drove off, going about 40 miles per hour down delmas street the wrong way and that's when he hit an officer who was just trying to conduct traffic. >> it is supposed to be family friendly at this event. you don't want anybody to get hit. if an officer gets hit and we have immediate access to radios, we can get more information out quickly. we had officer saturate the area. that's why we had such a good response. >> reporter: lieutenant mike sullivan tells us the officer has just been released from the

hospital. he will be okay. he has a broken leg and some other injuries. again, the officer has been released from the hospital. as for the suspect, he took off in a late model black tl acura integra. that is the vehicle officers are looking for this morning. he is described as a his responsibhispanic man with curly hair. since midnight, they have made more than half a dozen stop on similar-looking vehicles. they have not found him. lieutenant sullivan says they do have a partial license plate. he is confident sooner or later, the suspect will be taken into custody. live in san jose, marla tallez, "today in the bay." they are set to present findings for a fire in richmond. the u.s. chemical safety board releasing a detailed report into the cause of the august fire. the investigation includes corroded piping led to the leak

and the fire and blames the state's regulatory agency for not being proactive enough. they plan to discuss this at a news conference. a public meeting will be held friday in richmond. meteorologist, christina loren, she joins us now. >> how are we looking? we are looking great. want to make sure you are ready my friends to drive to work through showers. we have showers coming down from 101 north to san jose. take it easy out there. it has been the past three hours. i notice that trend. as i widen out, you can see the south bay dealing with that rainfall this morning. we want to thank you for waking up with us each and every morning. don't dilly-dally. you want to get out safely. these winds are going to pick up as we head throughout the day today. the jetstream is situated right on top of us. active weather and showers.

trenches below the road. traffic expected to be affected for the next nine months. the goal is to have the extension opened by 2017. after 25 years of waiting, relief inside for contra costa riders. they approved a plan to fix the congested interchange near martinez and concord, 680 and 4. they are set to authorize plans to add a third lane in each direction along three miles of highway 4. construction set to begin in 2015 with later phases including new connector ramps and a fly-over ramp. no delays expected on amtrak even though a train derailment tied things up over the weekend. north of fremont. crews spent yesterday fixing those tracks and gave the green lit light an all-clear.

good morning, everybody. welcome back. a live shot from san francisco's embarcadero. how about a nice krucruise ship there. maybe if you finished your taxes, a chance to jump on board and salil away. a total of 61 department chairs at the department of san francisco city department are keeping their jobs but will take large pay cuts. this will reduce the school's

cost by more than $1 million annually. the agreements, one of several ongoing negotiations between city college officials and labor groups. discussions are aimed at getting finances under control following last year's scathing review from the accreditation commission. the supreme court will try to decide whether it is per miss i believe to patent jeans or parts of jeans. scott mcgrew, an incredibly complex case in front of the justices. >> can someone patent genetic material? that's the big question. a company called myriad has connected genetic material that responds with yours. can this be patented, specially if it could help cure cancer. myriad said it spent millions of dollars finding the answer. if they tell everybody what the cancer gene called brca 1 and 2 look like, it will give away the secret of the test.

it wants to protect the genes under a patent the way that coca-cola protects its patent for soda. another winning week for the markets last week. we continue to hear from companies issuing financial reports this week. let's turn to brian shactman. he is live at cnbc's world headquarters. futures are lower. i want to point out two things. oil is down below $90 a barrel. gold is selling off to the tune of $90. the market still coming up. another positive week. the dow had its third best week of the year. in terms of today, china in focus. a report shows growth in the second largest economy. the flood of earnings continues this week with a third of the dow jones center report. the biggest name isn't a dow component. it isn't a big name at city. it just came out and had stronger than expected earnings.

starting the week off earningswise. the nasdaq losing 5 to 3294. >> thank you much. blackberry, the phone maker that sought research in motion. very angry at a stock analyst who said according to his research, people were returning the new blackberry z-10 to the store in tomorrows higher than expected. now, this new z-10 blackberry phone, the company more or less has bet the future on it. blackberry says it has looked at its own records and it can't find evidence of high rates of return. so the company wants the government investigation. now, laura, serious money at stake. blackberry's stock dropped about 8% on that analyst report. >> thank you very much, scott. >> it is 5:15. let's check back in with christina loren. we have seen rain overnight. looking forward. >> a little bit of winds of change to look forward to today. they are going to be blowing

we will check the forecast in a bit. >> 5:22. some popular rides at disneyland and california adventure will not be running, space mountain, the matter horn and soaring were all shut down after the state fined disney more than $200,000 for workers safety violations. these were related to an incident when a maintenance worker was seriously hurt on space mountain. the matt tern hoerhorn was reop yesterday. lebron james is doing a little moonlighting as a meteorologist in training with his miami heat going for the playoff. he was showing flooding in his neighborhood. following that post, the national weather service issued a flood warning alert saying, lebron james, number 6 of the miami heat, reported significant street flooding in the coral gables area.

40-50-mile-per-hour gusts. we'll let you know how long it will last. flags and cars being pushed around by that same wind. we will show you what's going on for 280 coming up. the latest moves and effort to connect the entire bay area with one public transit system. a live look outside. hp pavilion, downtown san jose this morning, monday, april 15th. this is "today in the bay." from nbc bay area, this is "today in the bay." >> thanks for joining us. i'm laura garcia cannon. we have breaking news out of berkeley. police right now trying to make sense of just a bizarre overnight shooting. officers arrested an elderly man accused of shooting a firefighter responding to a call. one of those officers was grazed by a bullet. "today in the bay's" christie smith is live in berkeley with an update on this ongoing situation. >> reporter: firefighters don't always know what they are

walking into. in this case, it was a home with an 88-year-old man inside who had a gun and berkeley police say that he opened fire and actually hit one of those firefighters who is recovering this morning. they don't know exactly what set this off but it started last night around 1:45 in the morning. five berkeley firefighters went to a medical call. about ten minutes later, they called berkeley police asking for help. while police were on the way, they actually got another call from firefighters saying that the situation had escalated. there were shots fired. all the firefighters made it out of the home by the time that police arrived and the man had barricaded himself inside. >> i can manimagine the situati was very scary for them. they were able to get out. he did surrender and there was no further incident after that. so that man surrendered shortly

after. police were here for quite a while gathering evidence from the home. there was even another person inside that made it out when all of this started. the elderly man was taken to a hospital for a mentally valuation. again, investigators still not sure why he did this but they say that once they gather more information from him, as well as the injured firefighter, they may know exactly what criminal charges might be filed here. reporting live in berkeley, christie smith, "today in the bay." san jose state students are on alert after an early morning robbery. students received an e-mail from the police saying a man used a pistol to rob a student outside the freshman dorm around 4:00 yesterday morning. the areas patrolled by police regularly. it is not usually deserted even in the early morning hours. police are warning students not to walk or bike alone after dark. >> in palo alto, police looking for the man who robbed a local credit union. police say the provident credit

union was robbed. this man handed the teller a note saying he had a gun but never showed the gun. witnesses say the man drove off in a silver or gray thunderbird. the very same credit union was robbed back in january. police did make an arrest in that case. new this morning, san jose police looking for the driver who hit an officer with his car outside hp pavilion. that officer was just released from the hospital. the story involved an attempted burglary and a sold-out concert. "today in the bay's" marla tallez joins us live in downtown san jose with the story. good morning. >> reporter: that officer was hit by the suspect at this intersection. if you no know this area, we ar just a few blocks from the hp pavilion. right after the suspect came flying out of the overflow parking lot, that's when this happened. it was about 11:30 last night

when the concert had just wrapped up at hp pavilion. as you mentioned, it was a sold-out concert. so we are talking 15 to 17,000 people were in this area. one of the concert-goers got to his car and found the suspect breaking into it. the suspect then jumped into his own car, a late model black four-door acura tl. police say he was going about 40 miles per hour down delmas the wrong way when he hit the officer, who was directing traffic. lieutenant, mike sullivan tells me, since then, they have made more than half a dozen stops on similar-looking vehicles but still have not found the guy. >> we think it is a partial plate. we will put it in the system to come up with something more substantial. we will continue to circulate. we believe he got out of the area completely or might have dumped the car nearby. we will check local streets. the suspect is only described as an his responsibpa

with curly hair driving a late model four-door ac kaur ra tl. lieutenant mike sullivan tells us the officer that was hit has been released from the hospital with a broken leg and other injuries but that officer will be okay. live in san jose, marla tallez, "today in the bay." it is the biggest public works project in silicon valley history and construction kicks off in just a few hours. 7:00 this morning, road work on the south bay's b.a.r.t. extension will start on hostetter avenue between lundy and flickering avenue. drivers will notice a temporary lane shift to the south and a reduction in traffic lanes from three down to two laps in both directions. this marks the first major road work in san jose. the road work is expected to tie up traffic for nine months. the new extension is scheduled to open up in 2017. >> maybe last time. >> it seems like it has taken a

while. let's get to the forecast with meteorologist, christina loren. what are we in store for for this monday? >> good morning to you. we have a whole new week, a whole new forecast. we have some showers this morning. want to make sure you are aware of these before you head out the front door from san jose down to gilroy along 101 slick conditions. i can show you right now, we have a little more on the way as i take you way up north toward eureka. temperatures are going to be nice and cool. you will need your jackets. look at your wind speeds. picking up. wind advisory don't go into place until 11:00 a.m. showers on for today. it is also going to create a really tight pressure gradient for us. we are talking about strong winds all day long. temperatures on the cool side. low 60s. upper 50s, towards the 90s by the end of the seven-day forecast. stick around. it is coming up in my next report. first, let's check your drive. back to work monday.

trafficwise, it is all right, good. traffic slowing nicely, 280 northbound. on 17/880. the head lights coming toward us. starting to build a bit. we do have reports of a hazard. we did have a little slowing north 280 coming out of downtown just for a short period of time. a wooden pallet at the off ramp marked on your ramp. it is open but they may have to do a little temporary stoppage as they move that pallet. be careful if you are heading over in the next 15 minutes into downtown 280. the power issue over there at alum rock only affecting two households. highland and marrow over in alum rock but not affecting alum itself. a nice easy drive, san mateo bridge. gusty conditions reported overnight on the san mateo and

do dumbarton bridges. winds will get more severe later on today. we will see how things are shaping up. it is 5:36. the parents of a high school sophomore who killed herself after an alleged sexual assault that involved cyber bullying will speak out this morning for the first time. they are filing a wrongful death suit against three teenage boys accused in the assault. bob redell joins us live in juvenile hall where the boys are awaiting a court appearance as well. good morning, bob. >> reporter: good morning to you, laura. those three 16-year-old boys locked up here at the juvenile detention center in san jose are supposed to make their first court appearance tomorrow. as for the parents of audrie pott, she is the 15-year-old girl they are accused of sexually assaulting, the parents will hold a news conference at 11:00 this morning to announce that "today," they are filing a wrongful death suit against the teens. this will also be the first time they will speak publicly about

what happened to their daughter. in september, their daughter, a saratoga high sophomore killed herself apparently out of humiliation. eight days earlier, the three boys who are friends allegedly sexually assaulted her. then, they texted an e-mail with photos of the attack to several classmates. on friday, the boys attorneys released this statement. that reads quote, much of what's been reported is inaccurate. most disturbing is the attempt to link audrie's sue sicide. >> the family, their emotions turned to anger when they read this. this tells us they are not accepting responsibility. this tells us they are still in denial. this tells us they are not remorseful at all. >> the parents plan to push for audrie's law, legislation that would increase penalties for cyberbullying and strengthen

sexual assault laws so teens can be tried as adults in cases like these. they have been in touch with state senator, jim bell and a congresswoman. 5:38 right now. a nevada mental hospital accused of shipping patients out of state on greyhound buses, including sending some of them right here to california. we'll let you know what they are saying in defense of the move. a big week in washington could have a huge impact here in the bay area. they are getting ready to take up the issue of immigration. a live report is ex in.

congress is trying to find compromise on gun measures and immigration. tracie potts has the details. >> let's talk immigration.

that's what florida senator marco rubio spent most of his weekend on talk shows. he is part of the gang of eight that plans to unveil their compromise, to provide for comprehensive immigration reform, keeping 11 million people now in this country illegally here. many of them working but beefing up the borders. that is still the concern of a lot of conservatives. still unclear whether or not this can pass the republican-controlled house but even the senate where it was crafted. on gun control, we could see action on that as soon as wednesday, possibly tomorrow but more likely we are hearing wednesday. this compromise that would expand background checks to gun shows and internet sales, even the sponsors say it is going to be really close. as of this morning's count, 53 are in favor to get it passed, they need 60. there are still nine, including democrats and republicans for whom we don't know how they are going to vote. the first republican to sign on

was named susan collins. even though the people back home may not like it in her conservative district, she thinks it is a reasonable approach. we will keep an eye on both of those, immigration and gun control this week. >> we will see how it shakes out. thank you very much. in the meantime, "today," t the nra will head to new york. people in new york who own assault weapons must register them. the deadline is by august 2014. there is a limit of seven rounds per magazine except at competitions or firing ranges. the new laws violate the constitutional rights of law-abiding gun owners. naval ships could be called on to track and possibly shoot down any rockets or missiles launched by north korea. in recent weeks, they have been

threatening south korea and the u.s. over joint military exercises. foreign analysts caution this may just be cyberrattling which the north has done in the past. the british military rehearsed a full ceremonial procession which will be held on wednesday. more than 800 troops are taking part in the drill, although officially not a state funeral, this will be britain's largest service since the death of queen elizabeth's mother in 2002. died last week after suffering a stroke. >> the deadly costa concordia cruise ship disaster in italy. the court weighing possible indictments against six crew members including the captain. the captain is accused of running the cruise ship aground off the coast of italy in january. a total of 32 people died in

that wreck and he is facing manslaughter charges. we want to check the forecast with christina loren. what are we up for? >> it is going to be windy, enough so to where we have a wind advisory prompted by the national weather service. we only see maybe a handful of those, up to 10 a year here in the bay area. that goes for the inland area. typically, pretty windy in the higher elevations and the coast. this morning and all day today, widespread, strong, gusty winds. make sure you are ready for that. we pulled out the barbecue because it was so nice. you want to make sure you put it back before you head off to work. those winds are starting to pick up between 11:00 and 9:00. that's when that wind advisory will be in effect. showers are starting to wind down right now. we are fair game for light showers. 10-15% in the forecast. winds are picking up. if you drive a high-profile vehicle, take it easy specially

bridge this time as the backup starts in these lanes. thank you very much. the trial for an accused serial killer in marin county is set to begin in less than two weeks. today, lawyers will make their final pre-trial motions in the case. joseph naso is set to go on trial april 24g9 for the murders of four women. he is acting as his own attorney. his trial has been through a series of delays. the alleged murders took place from the 1970s to the 1990s. more than a dozen people recovering after a tour bus crashes near yosemite. a lot are from right here in the bay area. the bus was traveling on highway 41 saturday night when that driver simply lost control and crashed the bus right into a tree outside the park. all 16 passengers were injured. the driver was not. his bus is owned by a tour company in burlingame that caters to chinese-americans. chp says the driver was likely

just spoke to police. >> reporter: what a night for berkeley firefighters. they came to this home because someone inside had called and they needed medical attention. shortly after they arrived, all five of the firefighters were running for cover, because an elderly man inside of the home had opened fire hitting one of those firefighters who was grazed. that according to berkeley police who say that this call is highly unusual. five firefighters were called to had this home for a medical call. they called berkeley police for help. then, they called back within ten minutes and said that the situation had escalated that this man was shooting. all of the firefighters made it out of the home and the man barricaded himself inside but eventually surrendered. >> there was only a minor injury to one firefighters. thankfully, there was no further injuries to police personnel or the gentleman or any of his family. >> now, berkeley police stayed at the home for
