good morning and thanks for joining us. i'm laura garcia-cannon. >> i'm jon kelly. good morning everybody. we could find out today if a suspect arrested after trying to kidnap a toddler in el dorado county is linked to the brutal stabbing of an 8-year-old valley spring girl. a 42-year-old man was taken into custody in plaser ville, about 45 miles from the small town of valley springs. "today in the bay's" marla tellez is in the newsroom with more. >> today we could get the results from the dna samples that investigators sent to the state's crime lab. these results could tell us if this guy, 42-year-old jason wayvernon is the man who stabbed 8-year-old leila fouler to death. justin fouler told investigators he saw a stranger leaving their home. he said it was a man with long

gray hair. so far that is the only description investigators in calaveras county have released. now they are looking at this man who broke into an apartment in plaser ville yesterday morning and tried kidnapping a 15-month-old girl, that little girl right there. that mother, that brave mother fought back, called police and he was booked on kidnapping and burglary charges. his arrest comes just hours before 3,000 or so people came together to remember little leila last night at a candlelight vigil at her elementary school including her brother who refused to say good-bye. >> i'm not saying good-bye to leila. i'm going to say i'll see you later. there's no good-byes. >> leila's mother right there also spoke through her tears thanking everyone for their support. people wore purple and pink in honor of leila's favorite colors. to be clear there is no direct link to waiver nan and the

fowler case just yet. this is a story we'll continue to follow today and keep our eye on. >> thank you very much. new this morning, street battles have erupted between police and protesters in turkey during a mayday march. clashes broke out when demonstrators trying to push past barricades set up around istanbul's central care. in years past, the square has been the gathering point for mayday marchers. it's closed this year because of construction. police used water cannons and teargas to try to push people back. protesters responded with rocks. back at home activists are using mayday to call for attention to workers rights and immigration reform. rallies across the bay area. san francisco's march starts at 24th and mission at 3:00 p.m. in san jose supporters will rally at our lady of gaud leap pay church. on the peninsula, 5:00 in rengs

door of park. a young martinez boy injured during the boston marathon bombings. aaron hearn waking up in his own bed for the first time in weeks, he's home in time to celebrate his 12th birthday. christie smith live with an update on aaron's remarkable journey. christie, good morning. >> good morning, john. there are so many people in martinez following aaron hearn's progress through this whole ordeal. good news to report. that is what you said and he's back home in martinez, arrived one day before his 12th birthday. there is a note on the family door this morning that basically says he's doing well, that the family is trying to find some peaceful family time and they plan to speak with the media tomorrow, on thursday. so we're respecting their privacy and staying back away from the home. there's also a welcome sign on the house this morning.

hearn was hit by a piece of shrapnel in the bombing and underwent two surgeries, even visited the site of the bombing before coming home. in the hospital he had a number of visits including visits from members of the oakland a's baseball team, even first lady michelle obama stopped by. we're told he still has almost 100 staples in his leg from that injury. classmates have actually come by to visit him already. a friend said he really wanted to be back home for his birthday in his bed, unclear though exactly when he might return to school. reporting live in martinez, christie smith, "today in the bay." >> we wish him well. 5:05. law enforcement agencies in san mateo county will come together to remember officers killed in the line of duty. the police and sheriff's association is holding the fallen police officers memorial ceremony in redwood city. they're invited to commemorate

and honor those protecting san mateo county. an east bay lawmaker hoping a new bill will protect people from harmful chemicals found in building insulation. officials say those chemicals have been linked to cancer and other illnesses. assembly woman nancy skinner meeting with firefighters, doctors, to demonstrate a non-toxic flame retardant. skinner introducing the bill earlier this year. it calls for updated building standards that regulate the foam plastic insulation widely used in buildings. 5:06 early on wednesday morning. not too early to check the forecast. >> it might be the right time to open up the windows in your home, as a matter of fact. let whatever cool air you can come in right now. close those shades before you leave the house and try to combat the heat. it is goings to be a really

toasty day, especially in the north bay. 68 degrees to start the day in livermore and 47 in gilroy. that's where you're getting a little bit of a refreshing start. down in the south bay gilroy looking good, still slated to hit the mid 90s later today. winds will play a factor not as strong as yesterday by any means. however, strong enough to keep the red flag warning going until 6:00 p.m. weak disturbance came through. high pressure still the dominant feature. this kixd up enough wind and instability to keep the breezy and windy conditions at the coast for the higher elevations. i think winds will start to drop off particularly after about 7:00 p.m. we'll see calm conditions when we meet back here tomorrow. we're not going to have much wind to cool us off for the warmest day of the year which is tomorrow. expecting the numbers to jump in the low to mid 90s to the triple digits. 93 in fairfield, 91 in livermore and 91 in gilroy.

fly this morning. virgin america is bringing the first flight to san jose connecting sjc to lax. bob is live with the red carpet being laid out for the new flight. >> reporter: good morning, lawyer rachlt it should not be a big surprise to know it's going to be called the nerd bird. we're talking about four daily round trip flights starting today between norm net that and lax. the first flight arriving at 9:10 this morning here at sjc. mayor chuck read and airline founder richard branson will be on the red carpet to greet trv lers on this first inaugural flight of service for virgin america, daily flights between here and lax. by our count, virgin america is the sixth airline to fly this route. they claim it's different because it's the only airline offering up first class service and amenities like wi-fi on this

. energy drink monster suing san francisco, a counter move after the city demanded the company change how its drinks are made and marketed. the company based out of carona says it's being unfairly singled out to reformulate its drinks and change its labeling. they stand by the safety of their drinks which the company says contains half the caffeine of a 16-ounce brewed cup of coffee. the fda investigates reports of deaths linked to the energy drinks. experts say sales for energy drinks rose by nearly 17% in 2011. 5:13. code da, the electric car build in benicia filed for bankruptcy. scott, you warned they pay behind on payments to suppliers. >> the dealer group which owned the franchise said it was moving the store from stevens creek to capital expressway.

it's about two months early for this summer time weather. want to make sure you're all ready for that. winds are pretty strong at this point. santa rosa is getting the strongest sustained speeds up to about 17 miles per hour from time to time. our waves are rather big as well. that's because of that wind out there. winds are going to relax as we head throughout the second half of the day. that means we will see that red flag warning expire as we head throughout the second half of the evening. by about 7:00 p.m., we'll see a lot of improvement. that's good news. look how mild it is. you're at 68 degrees to start the day in livermore, about five to eight degrees away from our seasonal averages as far as our daytime highs go. that's an indication of how much above average we will be today. we could be touching on records yet again. we broke records yesterday when it wasn't that bad. 55 in santa theresa, 55 in campbell, 66 degrees right now in san jose. it's a balmy start to the day. area of low pressure tried to come through. it did bring in a weak disturbance. winds will drop off. they've been really, really dry

wind as well as a brush fire and a tree down 128 at scott. that's just north of calistoga for the north bay. community groups in berkeley making it clear they want their city to stay drone-free. the berkeley peace and justice commission along with its police review commission want the city council to ban the use of drones around the city. they say drones create safety and privacy concerns for residents. tonight the commission holding a town hall to develop a proposed resolution which they plan to present to the city council. >> it's 5:20. education secretary arne duncan continues his bay area tower today, joining representative mike honda at an educational town hall meeting at fremont high school. he'll then at head to the san francisco airport marriott hotel. yesterday duncan visited a san francisco preschool to push president obama's proposal for universal access to preschool

halfway through the week. can you believe it? it's the first day of may. live look outside. shark tank, sharks will be lighting things up in vancouver tonight against the canucks, 7:30. stanford hospitals and clinics will break ground on the new 824,000 square foot hospital at the construction site next to the existing hospital at blake wilbur. the ceremony is the latest milestone in a $5 billion construction project. it includes expanding,

rebuilding and seismically improving stanford hospitals and lucille packard children's hospital renovating the hoover pavilion and renovating stanford school of medicine. construction is expected to be complete by 201. speaking of construction, this is something you dream about but rarely happens, a major construction project coming in under budget. yes, i said it. under budget. the "mercury news" says the 49ers and the city of santa clara are taking out a mortgage on the team's brand new stadium and they're expected to spend a lot less than previously expected. since work started, interest rates have actually dropped and officials need to borrow less money because fans quickly bought up all the seats and licenses. this means the 9ers and city officials can take on less debt and in the long run, it may end up saving up to $90 million. congratulations. that is monumental. >> that had to be a great day in that front office when they heard that news. >> that thing is flying up out

jail this morning could be linked to the stabbing death of an 8-year-old valley springs girl. the 42-year-old man was taken into custody in plaser ville about 45 miles from valley springs. today in the bay's marla tellez joins us with more on the potential break in the case. >> good morning. we have been covering this story since it first broke over the weekend. 8-year-old leila fowler stabbed to death inside her valley springs home on saturday. since then, this small community has been on edge without any movement in this case. that is until now. investigators saying they are looking at this man, 42-year-old jason wayrynen as a possible suspect. wayrynen was arrested yesterday morning in placerville which is just 15 miles north of valley springs after trying to kidnap this little girl right here. she's just over a year old, tried to kidnap her from her own home. this man is facing kidnapping and burglary charges. his arrest comes less than 12

hours before thousands of people gathered in calaveras county to pay respects to little leila, including her best friend who is devastated and her mother crystal who fought through tears to say thank you. >> -- all of our family and friends for the overwhelming amount of support you've given our family. it will never be forgotten. thank you. >> this is my daughter, this was her best friend, they sleft together, went everywhere together, i took them to get ice cream together. i mean, it's a loss for us. just another daughter. >> so hard to see. that candlelight vigil was held last night at leila's elementary school. wayrynen's dna resorts are being processed at the state's crime lab. we could get more answers today and in the end learn if wayrynen

is the man seen leaving leila fowler's home after she was brutally murdered. this is a story we will continue to watch throughout the day. >> that little photo with her arms in the air, just heartbreaking. it's been a remarkable journey for a young martinez boy injured during the boston marathon bombings. aaron hearn now back home finally just in time to celebrate his 12th birthday. christie smith is live now with an update on aaron's long road to recovery. >> reporter: good morning, jon. the community in martinez has really pulled together for aaron hearn, a number of restaurants held fund-raisers, his classmates tried to raise money, too, even recorded a video for him. as you said, he is back home in martinez just in time for his 12th birthday which is today. aaron hearn visited the site of the boston marathon bombings before returning home to martinez. he was part of a group that traveled there to watch his mom run the race when he was hit by

shrapnel when those bombs went off. he was hit in his leg. this morning there's a note up on the family's home in martinez on the front door. it basically says aaron is doing well. right now the family is trying to have some peaceful family time alone. so we're respecting that and staying back. there is also a note on the door, sort of a welcome home sign that looks like a number of his friends signed it. according to the "contra costa times," hearn has almost 100 staples in his leg from all the surgeries he had. we're told he had at least two. while in recovery he got quite a bit of support. members of the oakland a's baseball team visited him while they were in town. he also got a visit from first lady michelle obama who stopped by and left a number of stuffed animals for him and his sister. that sign on the door says that the family is expected to speak on thursday afternoon. reporting live in martinez, christie smith, "today in the bay." it is 5:33. facebook boss mark zuckerberg

could be greeted by unwanted visitors when he arrives in menlo park this morning. protesters plan to deliver a petition signed by nearly 19,000 people. they're upset about a tv ad funded by zuckerberg's new political group that supports the keystone xl pipeline criticized by environmentalists. the group 350.org wants the ads to stop. the group, fwd.us is billed as a buy part partisan organization committed to comprehensive reform. parts of the bay area under a red flag warnings. the fires are not threatening any homes at this point. high winds blowing smoke into other parts of the bay area including san francisco. meantime, from the south bay to the east bay hills to the diablo area, cal fire increasing its staffing and equipment levels with fire season already starting early, cal fire officials say they are bracing

for a long and a challenging summer. >> what we'll see is in late july, august, september, is a longer window where we'll have the opportunity to have large major damaging fires within california. >> firefighters right now are worried about the tall dry weeds out there because there's not been a major wildfire in that area since back in 2009. that leaves a lot of dry vegetation there exposed to burn. >> it happens so fast. turns from green, green hills to very dry. high wind advisory today as well. >> yes. got the red flag warnings, strong winds. you protect your home especially if you live in the higher elevations, clear the brush away. that's one way to protect yourself and your family. it's getting hot two months earlier than summertime arrived. first day of summer isn't until june 21st. first day of may, temps in the mid 90s. this is the reason why, we're starting out nice and mild. getting these warm down slooet

registries can cause lasting and unwanted harm. right now juveniles convicted of sexting nude photos or having consensual sex with someone their own age are treated the same way as rapists. the group wants the law to change so there's more discretion when it comes to juvenile offender cases. an off-season injury forcing stanford's quarterback to call it a career. josh nunes, the starting quarterback for the first part of last season ruptured a tendon in his chest after dropping a barbell on himself while bench pressing in february. yahoo! sports reporting he had surgery a few years later. normally an injury like this takes 12 months to heal, subsequent injuries can be catastrophic. nunes made the decision to retire. freshman kevin hogan who replaced nunes led the team to a rose bowl victory. >> the sharks are waking up in vancouver getting ready for
