>> reporter: the jury also saw graphic photos of alexander. some so gruesome his sisters were reduced to tears. >> doesn't have any weapon whatsoever. not only does he not have that, he doesn't have any clothing on. and as he sits there, he doesn't have any dignity either. she's taken that from him. >> martinez reminded jurors of what alexander said days before his death. >> you, jodi arias, are the worst thing that ever happened to me. >> reporter: at times it seemed too much for arias. she sobbed and grabbed at her face but martinez said if the jury valued facts more than arias' lies they only had one choice. >> return a verdict of guilty for first-degree murder for no other reason that it is your duty and the facts and the law support it. >> reporter: now the jury can convict on lesser charge such as

the family of a martinez boy injured in the boston marathon bombings talking to the media again later on this morning. aaron hern was hit by shrapnel. after two surgeries, he was finally released from the hospital. he returned home to the bay area earlier this week just in time for his 12th birthday. he was at the warriors game last night and got the vip treatment. this morning, the firefighters at a san jose recycling plant checking for some hotspots after a major fire there. that happened yesterday. the plant processes paper. so a lot of fuel there to feed the flames. the plant is located on east alma and tenth street near the municipal baseball stadium. the cause of this fire right now still remains under

children and six educators nearly six months ago will be the focus of an emotional meeting tonight. stephanie gosk is in newtown, connecticut, with more on the story. good morning. >> reporter: good morning, tamron. with the tragedy on this scale there's little guidance from history on how best to recover. newtown is figuring it out as they go and the next big step is deciding what to do with the school. the road to sandy hook elementary school is closed, only a small memorial remains. the students are bussed to school in a neighboring town but that was always just a temporary solution. newtown needs an elementary school but should it be a new one? erica lafferty's mother was sandy hook elementary's principal. >> i would chain my body to it and protest if they try to reopen it. >> if that's the best site logically, economically for the other children, the ones that

relationship goes bad and someone decides to get revenge. >> my stomach dropped. i honestly could feel myself turning white. >> reporter: holly jacobs was 26 and a ph.d. candidate when her life suddenly turned upside down, naked pictures she had sent to her boyfriend years before showed up on the web. >> i just felt like my life is ruined. >> reporter: experts believe it happens more than you may imagine to both women and men. but unlike sexual assault in most of the country, so-called revern porn is not a crime. >> any time our society chooses not to blame that kind of malicious behavior and instead blame the actions of the victims you could be next. >> reporter: last month jacobs sued her ex-boyfriend ryan in civil court becoming it's believed the first person in florida to sue someone for allegedly distributing revenge pornography. seh is also facing related criminal charges including stalking and unlawful publication. his lawyer says seh never posted

any pictures of holly and claims someone hacked his computer, stole the pictures and then posted them. >> he adamantly disputes the charges, he's steadfast denies any involvement and his position is he's a victim as much as holly is. >> reporter: how best to avoid this problem, experts say don't take pictures and then share them. >> anybody who think this is isn't going to happen to them is resting on people are good people and they're not. >> reporter: for "today," kerry sanders, nbc news, miami. >> joining us exclusively is holly jacobs and her attorney, patrick magee. >> good morning. >> this wasn't just a facebook profile photo, you changed that back but you started to see other photos showing up in other places, right? >> um-hum, yes, they started popping up on sites every six months, and then all of a sudden i started dating somebody new in

november of 2011 and they went viral. >> at times the picture would come up and your name and contact information would accompany it, which becomes a dangerous situation. >> yes, absolutely, because you have people, i mean my, mail address was attached to these so i had harassing e-mails constantly coming in, my work location was posted up there so i was terrified. i was so afraid somebody would physically stalk me. >> reporter: i want to mention in your case it was mostly nude photographs, in other cases, i mean there are very sexually explicit videos that have been posted by an ex-boyfriend or an ex-girlfriend online, and yet it doesn't seem as we heard in kerry's piece that in enough states there's any way you can fight back against it. >> right, currently they have a law in new jersey right now that actually helps victims fight against revenge porn and that's the best law in the books so i would urge other states to take on this law, it's new jersey

2c14-9. >> there are people who are going to look at you and say you shouldn't have taken the photos in the first place. when you take photos you should always think they may eventually end up online. how do you respond to that idea? >> its sea absolutely a new version of victim blaming and what i would say to victims when they hear that is just hold onto that little voice inside of you that says this is not right. what's happening to me is not okay. and there need to be laws in place against this. >> patrick, what's the outcome you're looking for. i know there is legal action under way. what is the best case scenario? >> to get injunktive relief, get the pictures down and stop the propagation of the images. we filed for injunktive relief temporary and permanent. we have enough evidence, we think it's pretty good. >> four years holly since this began. what is the message you want to

send? >> stand up for what you feel is right. 'not okay that people are doing this and exploiting you just because you trusted somebody and because you shared intimate photographs in an intimate relationship. that's not the problem here. what's the problem is that somebody is using this against you and trying to drive you to suicide. you know, they're ruining your lives. that's not okay. >> holly jacobs, thank you. i think it's brave you're speaking out and patrick thank you as well. >> thank you. >> let's go to savannah. now to one of the most remote and pristine places on the planet and a battle brewing over oil, with the story here is nbc's ann curry. >> reporter: deep in ecuador's lush amazon rain forest the most biodiverse place on earth the rarely seen tribes are sharpening their spears and preparing their blow guns to fight ecuador's new plan to auction as much as 8 million acres of the rain forest for oil drilling.

a tribal leader sings "we are not going to lose our culture. we are going to protect our land." boston university biology professor kelly swing has come to know the riches of the rain forest after researching here for more than 20 years. >> there may be one-tenth of all the species on the planet that is the space the size of south carolina. >> reporter: he's come to know the tribesmen who he says will fight to the death to protect this land, and he says america, a top importer of oil from ecuador shares responsibility for this coming conflict. >> we're definitely guilty in this story. >> reporter: and the toxic legacy of past oil drilling in other parts of the rain forest. smells pretty bad. i understand that more oil has been spilled here than in the exxon "valdez" disaster in alaska. >> we're talking about hundreds

of small spills that add up to a huge amount. >> reporter: another tribe has been told to expect oil operations to begin at any time. angry women say they will fight with their men because they believe their purpose in life is to save the forest. a tribal leader and shaman heal per >> my grandfather protect this land and up to this, my father said me, you need to protect. if i am leaving, i am going to fight, my community. >> reporter: as long as you're alive you're going to fight for your community. >> yes. >> reporter: you feel so strongly. >> yes. i'm sorry. >> reporter: he see no, sir difference between the survival of the forest and the survival of his people. the drilling is being ordered by the government of ecuador, which depends on amazon oil for up to

50% of its revenues. ecuador's vice president. >> translator: if ecuador were in a position to provide for all of the needs of its people, we will be happy not to exploit. however, that is not the case. >> so if confronted with indigenous people with spears, would ecuador use force? >> translator: according to international law, if dialogue fails, there is a process of escalation of the use of force. >> reporter: in this battle of blow guns against bull dosers the kichwa and rowani are outmatched, professor kelly says this is about more than saving the rain forest. >> i see this as a human rights issue. i think it's very sad to say that most human rights issues don't really come to be recognized as human rights issues until people start to die. >> reporter: ann curry, nbc

>> good morning. >> deedee, the first thing that came to their mind how did deedee take this. you were married for about a dozen years as husband and wife. >> yes. >> tell me about the moment when jennifer came to you. >> well, there wasn't really one moment. it was sort of a series of moments and it's hard for me to go back and think exactly what was the minute that things changed. >> did you consider ever that maybe this was the end of your marriage? >> i wasn't sure i wanted to be married to a woman. i was scared about what it meant for my future and our future, but i'm not sure i ever came to that sort of very edge of the precipice saying i can't stand this. it was hard and scary and i didn't know what was going to happen but there was not a time when i said forget it, i can't do it.

>> jennifer you obviously agonized. in the end you made the decision that you had to do this for who you were even if it risked your family. >> you have to be true to yourself and i didn't want to be raising a family in which i was teaching my sons that it's okay to lie, and it's hard though. certainly one of the things as a father that i thought was my job was to protect my family, to stand in between them in trouble and suddenly i was the trouble so that wasn't, that wasn't much fun. >> were you prepared for the possibility you might lose everything, that you might lose your wife and your kids? >> i don't know what i was prepared for. i came out slowly. it wasn't like one day i waltzed in, in sequins and said now my name is tiffany chiffon. we worked it out slowly over a couple of years, many years actually and in some ways that transition is still going on. i mean, it's one of the things about being a family that you keep changing. we've been married for 25 years.

we are not the people we were when we got married in 1988 and he is not the same person he was when he was born thank goodness. he's less trouble now. >> zach, you're in college. >> i am. >> we've been chatting for a while, a great kid. this could not have been easy growing up. it's hard enough to be a kid growing up. other children can be mean. what was it like for you? >> you'd be surprised actually. i was never made fun of because of that. i've never had anyone say anything negative to me because of who my parents are. i've been really lucky, though. my parents are great and what more can i say? >> we should probably explain that name matty is the result of, the name that they invented for me which is one day we were sitting around the kitchen table and zach looked at me, he was

about 6 and he said we can't call you daddy if you're going to be a girl. i said what do you want to call me, how about matty, that's half mommy and half daddy and i know a girl named matty at school and she's cool. >> and his brother said damy. damy didn't stick but matty did. >> do you ever wish my gosh we could go back to the way we were 12 years ago? >> no, no, i don't. i mean i think the wonderful thing about our family is that we've been able to build a life that we're really happy with, that you know, i never felt trapped in this. i get to choose every day to stay married to the person that i fell in love with 25 years ago. >> what we know is that the gender of parents is a whole lot less important than the love in a family. >> fascinating story, jenny, deedee and zach thank you for sharing. the book is called "stuck in the

good friday morning to you. 9:26. i'm laura garcia-cannon. the woman accused of leaving poisoned orange juice at a starbucks in san jose is out of jail this morning. ramineh behbehahian was released yesterday because prosecutors have not yet filed charges. prosecutors say they will wait for official lab test to determine what was in the bottles to decide what charges to file. firefighters on the way to ventura county to help fight the springs fire. they left early this morning. the fires burned 10,000 acres forcing hundreds of people out of their homes. history in the making, taking off from the bay area. the solar impulse left moffett field in mountain view around 6:00 this morning on a cross-country flight.

it's trying to become the first plane to do so without a drop of fuel. plane runs purely on solar power. first stop phoenix, arizona, traveling 40 miles an hour the plane will make a few stops along the way before eventually arriving in virginia by mid july. we'll have a look at weather and traffic right after the break.

everybody can relate to this, everyone's in a relationship going through something and, like john you said it best when you said it's like inside trading. >> really? i didn't think of marriage that way but go on. >> it's what we show you everything, the everyday, the ugly, the lows, the highs. >> what you see is what you get so for us it was a wonderful experience and the fact that we have a bad memory that we can document everything for one year was fantastic. >> i'm curious why people do this when you know marriage is tough and now you're putting it out there for everyone to see. why did you do it? >> personally for me, well kim and i, we have say story to share. >> you dated five years before the proposal. >> did not live together. >> real old school but modern twist to it. but at the same time a lot of our friends we let them know we're not perfect, not this, don't idolize us but at the end

the family of a martinez boy injured in the boston bombings will talk to the media in a

matter of minutes. he was hit by shrapnel seriously injuring his legs. after two surgeries, he was released from the hospital and returned to the bay area this week. we'll have their reaction today at 11:00. this morning firefighters are at a san jose recycling plant checking for hot spots after a major fire there yesterday. the plant processes paper so there was plenty of fuel to feed the flames. the plant is located on east alma and tenth street near the municipal baseball stadium. the cause is still under investigation. another hot day for this friday. lets get a look at the forecast with meteorologist christina loren. hey, thanks, martinez. not quite as hot as yesterday but still kind of a scourger in places like livermore. 92 there, 91 concord. close to temperatures records again today. once that sun starts to drop off at 7:00 giants taking on dodgers tonight at at&t, 66 degrees. right here on nbc bay area. catch that game if you're headed out there, you won't need a jacket for tonight's game.

best fried mashed potatoes from your restaurant that were buttery and delicious and mouth-watering. >> i'll give you the recipe for that. >> wow. >> what are you whipping up today? >> this is a classic seafood stew from marseille in france. we're going to do a little low country rendering. we've got the broth down, sweat vegetables, onions, carrots, celery, fennel and saffron is very important. i'm going to add the local seafood. and clams and wreck fish from the charleston bump. it's about 150 miles off the coast here and it's a delicious fish. similar to grouper. and we're going do dump it all right in there. >> and the mussels. >> and vegetable, tomato, leeks. >> excuse me while i season it. >> hoda's cooking.
