7:42 am
california governor jerry brown may soon be held in contempt by a federal district court judge. for more on this ugly predicament we turn to analyst larry gerston. thanks for joining us. we've been talking about prisonings for a while. >> the courts think otherwise and that leaves the governor in just a bit of hot water. as you said, for the past 17 years, that's a long time, the
7:43 am
federal courts have seized control of the state's prisons, why? three critical issues here, kris. capital punishment and the way we conducted that, medical treatment of the prisoners or the lack thereof and overcrowding. the judges have been satisfied for the first two areas. okay, fine, but overcrowding remains an issue. so much so that at least one judge may cite brown for contempt if he does not end overcrowding soon. to his credit, brown's already reduced the state prison population by 30,000 prisoners. mostly by moving them to the counties. we've talked about that before, but the state -- the supreme court, the u.s. court of appeals said that brown has not done enough to solve this problem. >> clearly, governor brown thinks he has done enough and that moving those prisoners to their, you know, local municipalities was a big part of that. what does he say now? >> he's got a problem now.
7:44 am
he's responding in two fronts. first, he's threatening to take the oversight issue to the u.s. supreme court where he would argue that california has a substantially complied with the court orders and that california should be left alone. in the meantime, the second front, brown proposes to ease prison county, more shifts through county jails and relocation to state fire camps and early releases of frail prisoners. this has caused a firestorm in the legislature, why? because so many counties are already reeling that their jails are overcrowded and under fund happened. a bad combination and all part of brown's realignment ban and the federal courts have said no, no, no. you haven't done enough even now. >> part of the reason why we have an overcrowding problem is because as californians we say we want stiff penalties and we want people to do time if they do the crime, right?
7:45 am
>> yeah. yeah. this is when we have to look into the mirror, chris. why? because the legislature and the voters during the 1990s passed a series of measures for several major crimes. which allowed judges convicted of penalties to 25 years to life if they were convicted a third time of almost anything. so that prison population swelled to 125 in 1994 to 170,000 in 2010. that's a big jump. those are the changes that led to overcrowding and that's the huge drain on the state budget. in fact, about 10% of the budget. so even though brown has done a lot more than his predecessors and gray davis and arnold schwarzenegger, he still hasn't reduced the population enough as far as judges are concerned. until he satisfies the federal courts and they have been watching him, until he satisfies
7:46 am
the courts, he's likely to be in judicial hot water and nobody wants to be there. >> what is the penalty? >> if you are a governor and held in contempt. you know what happens if you're not a governor, but -- >> are they going to put him behind bars along with the other guys? even more overcrowding now. i don't know, exactly. one would expect that he's not going to be incarcerated, but it certainly is an embarrassment and to be fair of the governor, it's hardly his doing and he inherited the mess and somehow he'll have to find a way to please the judges because if he doesn't it could get ugly. >> i will see you next week. >> wall street reaches an all-time high and the nation's jobless rate hits a record low. for more on that and what else is happening in the world of business, here's cnbc's tyler matheson. >> wall street kicks off a new week of trading after reaching all-time highs for the dow and s&p on friday following a sizeable pickup in hiring in april and some analysts expect those records may keep building
