a new crash could affect your drive. taking a live look outside from the south bay. welcome to monday morning. may 13th. this is "today in the bay." from nbc bay area, this is "today in the bay." it is 5:00 on the nose. good morning, everybody. thank you very much for joining us. i'm jon kelley. i'm laura garcia-cannon. a new potential construction problem. it is threatening to delay the opening. "today in the bay's" christie smith joins us live with a look at the details. >> reporter: good morning, laura. the questions keep mounting about the safety of the new eastern span of the bay bridge. in march, broken bolts were discovered. they broke when they were tightened. a new potential problem. this has to do with steel rods that are at the base of the tower.

experts say inspecting them won't be easy. the san francisco chronicle is reporting that 400 or so of the rods could be vulnerable to cracking if exposed hydrogen from rainwater. they call it hydrogen wi. they could also be vulnerable in a quake. caltrans is saying it will make sure the rods are safe. access is difficult. the tower was loaded down on to them. what about the planned opening of the $6.4 billion eastern span on labor day weekend. >> what is driving the date is the safety, getting, and making sure that we have the right fix. taking the time to get the right fix and to be able to implement it. now, the metropolitan transportation commission will hear from caltrans on may 29th on a proposed fix for this. tomorrow, state senator, mark will hold his own hearings on

the boeltlts. he thinks there needs to be a third-party review on all projects like this. christie smith, "today in the bay." we have new information on a deadly shooting in the berkeley hills just above the cal campus. the berkeley online news site has said the coroner has identified the victim as an adult male who is not affiliated with u.c. berkeley. just after 5:30 yesterday morning, u.c. police found a man shot multiple times outside a vehicle on grizzly peak boulevard. that man died at the scene. they have not given any information on the suspect. they don't believe the shooting was random and don't believe the public is now at risk. the roadway did not reopen until just this morning. 5:02. a human head found in a load of recycling at an oakland garbage facility is now being investigated as a homicide. investigators tell the san francisco conichronicle that th

person had been dead for months or years. they cannot determine if it came from a man or a woman. cadaver dogs searched the area and did not find any other human remains today, a northern california community will continue to search for answers after learning a 12-year-old boy has been arrested for stabbing his 8-year-old sister to death. it is the story we have been following since the gruesome crime happened last month. "today in the bay's" marla tallez in our newsroom now with where that investigation goes from here. good morning the surprising arrest that happened over the weekend has sent yet another shock wave through that small, tight knit community of valley springs. to that end, counselors will be on hand at leila fowler's elementary school where she should be finishing up third grade. she was laid to rest last tuesday. her brother's arrest comes after a 15-day investigation by the calaveras county sheriff's

department. they said they spend more than 2000 hours going over the evidence and witness statement including a statement from the 12-year-old brother who told officials he found his sister's body and encountered an intruder in the home. he gave a suspect description. he is now under arrest. investigators aren't saying why the 12-year-old is the suspected killer. many people in valley springs have shift there had support away from the grieving fouler family. >> there are people out here that have already convicted him, already lynched him and made their judgments a fund-raiser for the fowler family was supposed to take place. that has been canceled. the organizing group released a statement saying they decided to cancel because of the hurt and anger within the community. another thing to note here is just one day before the 12-year-old's arrest, leila fowler's biological mother told the sacramento tv station her

son could never hurt his sister. she talked about how protective he was of her. coming up, leila's stepmother sassy f facebook asking for pry sassy privacy for her family. 5:05. the san francisco pot club may be close to shutting its doors for good. it is part of a nationwide crackdown on marijuana dispensaries. the federal government is moving to seize several businesses in the bay area. one is on mission street between 20th and 21st streets in san francisco. the landlords tried and failed to evict the club last year. now, the u.s. attorney, melinda hag, is trying to force the landlords to forfeit then ti en building. it is 5:05. we have some spectacular weather over the weekend. great mothers day for you and all the mothers out there. christina loren says, more warmth coming our way before it cools off, right? >> it is going to cool off dramatically. good morning to you, john and

laura. temperatures are rather crisp. 54 in livermore. a little bit more low cloud cover this morning than yesterday morning. you don't even know what was out there, because you were sleeping. as we stop the clock on your futurecast at 9:00 a.m., you can see. all this is going to be left of that fog. kind of clinging to the peninsula coastline. not expecting a whole lot of activity. we will see a nice, warm, sunny finish with highs in the upper 80s. 86, concord. 71 degrees. today in san francisco. your seven-day forecast is going to reveal that significant cooldown. it is coming up in my next report. first, i want to check your drive on a monday with mike inouye. >> i have a couple of notes over here. the eastshore freeway. i swung the camera around looking eastbound with the tail lights away from us around university. coming up to the area, reports of a car that has spun out. it sounds like a flat blowout. the car is reportedly in the

center divide. i didn't see anything here. the map doesn't show any slowdown as you are getting away from the bridge. this is coming off of the berkeley curve and heading up towards highway 13. we will track that coming off of the maze. meanwhile, a live look outside and see how things shape up across the san mateo bridge. this is 92 with the head lights off of the high rise. a little wind advisory for the high-rise section. christina is not talking about really severe winds right now. we will track that from both of those sources. a smooth drive across the san mateo bridge and the dumbarton bridge as well. we are talking about some road work. we do have a slow drive southbound, 280 just past the scene of an earlier crash. a deer was hit and killed around 92 just north of there. there may be some activity there with the crews on the scene there. a smooth drive otherwise. we will send it back to you. san jose, getting ready to get rid of some big eyesores out

there. today, graffiti cleanup time on freeway overpasses that could mean traffic trouble for some drivers. "today in the bay's" bob redell live in san jose. the question is, what's being done to make sure the graffiti stays off this time? >> reporter: good morning to you, jon. we are near the 13th street rail bridge that crosses 110 here in downtown san jose. if you can look beyond this chain link at the fence in the background. over the past couple of weeks, caltrans has added another fence. you can see it on top have o of the wood fence. someone was kind enough to tag it. as you can see over here, if you walk down the fence line, even though they put that up over there, someone else figured out another way to get on to this track. you can see right there through there to the corner past the tree on the left. someone has peeled back the fence and tried to get entry on the track. you can see pretty much how hard it is to keep people from actually trespassing and doing

this. we want to take a look at some of this video. if you have been commuting in downtown san jose, you are probably very familiar with the graffiti that has become an eyesore on the 13th street rail bridge over 101. a couple of other bridges as well. there is so much graffiti that when they start to work, monday night, they are expecting to take until wednesday to complete. some lanes of 101 might have to be shut down overnight. the emphasis is that should be happening overnight, should not be affecting your commute. we have spoke to people that are skeptical this cleanup is worth the effort. considering the lengths taggers will go through to spray paint public property. they will just cut a hole in it and risk their lives to get out on to that bridge. >> there is a ledge but i think they would have to on the top step but the ledge, you can walk out on that ledge. you have to be crazy. you won't catch me out there, that's for sure. >> reporter: the city, union

the bay." 5:12. the rising cost of commencement ceremonies at many california public universities putting a damper on graduation celebrations. 15 of cal state's 23 campuses now charge a graduation fee. by law, colleges are not allowed to use tuition fees to cover graduation costs. so many schools pass the bill on to students. at cal state east bay, a $45 fee to graduate. at san francisco state, it's $100. up $60 in the past two years. at san jose state, some students have to pay $75 to walk the stage at graduation it is 5:13 right now. the head of virgin america says it is nearly ready for an ipo. scott mcgrew, that company says, first profits and then a stock operation. >> you don't have to be profitable to have an ipo. you just look at tesla. it is profitable now. it wasn't back then. in the case of virgin, the company did make a profit in one quarter. it was a rare exception. in an interview with the wall

street journal, ceo david cut, says his san francisco-based company just renegotiated some debt. lenders will get part of the company. that means virgin is paying far less in monthly loan payments and that's a step towards a first-time offering of shares. in virgin's most recent quarter, the company lost $45 million flying you from place to place. it has been a pretty good environment for ipos. let's check the markets. jackie deangeles is live at cnbc world headquarters. good morning, jackie. good morning, scott. futures pointing to another low on wall street. the markets, another positive week. the dow closed above 15,000 for the first time. a key psychological level. the s&p 500 reaching new record highs as well. the dow, nasdaq and s&p notching their third straight weekly gain. we are going to get data on retail sales and business

inventory. the dow closing up on friday, 35 points to be exact. 15,118. the nasdaq adding 27 to 3436. back over to you guys jon and laura, over the weekend, kind of a scandal broke out over the bloomberg terminals that people use on wall street. the powerful network of computers that traders and journalists use to get financial news and stock quote. it turns out reporters that work for the bloomberg news agency are able to access some of the data that people do with bloomberg terminals. if alleged, that gives bloomberg reporters an unfair advantage in the financial news. they are getting data that nobody else is seeing. bloomberg says the data was very, very limited and it has since ended the reporters access. >> interesting. >> when you start messing with that, that's always going to get some attention. scott, thank you very much. let's see if it is money this morning. >> i saved money around here all the time which is where we pay the big money just to live here.

5:15. good monday morning to you. the weather is on your side. temperatures are pretty crisp. we do have some fog, only up in santa rosa. the only place we are dropping off at the immediate surface. down to half a mile at this point. elsewhere, we are looking pretty good. we could see more on this fog, start to settle in as we head through the next couple of hours. we are not expecting a lot. it is going to be pretty warm as we head throughout this afternoon. we could see flight delays go up in san francisco. 53 degrees there. back to work, back to business monday. i do want to point out, new york city, a weather system impacting the east coast. you want to check in with your carrier. 54 degrees to start the day in livermore. 54, good morning, san jose. 55 degrees, hey, there, oakland. it is going to be a nice day where you live as temperatures climb to about 66 degrees at noon. we are going to round out the day with plenty of 70s and 80s. this is the warmest day of the next seven. if you are trying to get out

there and want to hit the beach, do it today. 77, fremont. 79, redwood city. 71 degrees is pretty comfortable in the city by the bay considering we are starting to get more may gray each and every morning. that's really going to be the story for this week. temperatures tumbling as we head throughout the midsection of the week. we will be down to 70 degrees inland on thursday and just about as cool around the bay. 60 degrees on the coast. returning to winterlike weather. make sure you are ready for that. not talking about anything hot. he is, though. hotspots are his things. >> the brake lights, looking okay for 280. 880/17 goes across the screen right here. that's where i am watching on the maps. the camera, taking a little break. southbound 880 coming up toward the same interchange has been registering a slow drive. no incidents here. overnight crews might still be around. it doesn't sound like a lot was going on sunday into monday night. we will track that specifically around stevens creek boulevard.

the rest of the south bay, your northbound commutes are moving nicely right now. starting a gentle build. building here, livermore and out of the altamont pass. 80, 84. it is here that is the big concern. west 580 at the dublin interchange, reports of a hit and run crash, one car pulled over to the shoulder and now a secondary crash in this backup. we see slow west 580 and also north 680 heading up in towards san ramon into dublin. all lanes were cleared. this may be a different case as the second crash happens. we are looking toward the bay bridge. a quick look and see how things are shaping up. a light volume of traffic here and no problems down the eastshore freeway. 18 minutes from the bridge. she was talking about maybe the far north area, petaluma and some areas. san rafael looks really nice as far as the flow. new this morning, we are getting our first look at amtrak's next generation electric train. the rail company building 70

electric trains to replace aging engines that have been in service for more than 20 years. this is video provided by amtrak showing the first prototypes unveiled at the rail plant in sacramento where it is being manufactured. the first electric train is expected to be in service this fall with the entire fleet in operation by 2016 the electric trains will be used in the northeastern corridor between washington, d.c. and boston and across pennsylvania. it's been called the island's dirty little secret. we are talking about the number of drownings that have happened in kawhi this year alone. three bay area residents have died there. we have traveled to hawaii to find out why so many tragedies are happening there. drownings are the leading cause of deaths for visitors to hawaii and long been a problem in the state. community leaders believe more are dying there because visitors are being guided to once unknown locations. 11 people have drowned on the

island since january. last year, there were four all year. the investigative unit also discovered in the last decade, 74% of those who drown there were visiting. bay area resident, joy choew, watched her boyfriend and his friend getting pulled in by a wave. she never realized how much danger they were in standing near ayla va pool if there is something that could prevent this from happening to more people, then i feel like the information needs to be meaningful. not just giving a nod to the danger. >> do you think these guide book authors are responsible for guiding people to their death? >> the way the books are written, yeah, because they are specific. they tell you to go to private property and how to get there, to jump over fences. >> local leaders are going to extreme measures to try and keep people away from some of the beautiful, yet deadly locations

starting in southern california and ending in the bay area. yesterday, cyclists road 102 miles in the escondido area and they will be here in the bay area by friday with time trials in san jose. they will also ride in livermore and san francisco before ending in santa rosa on sunday. we'll get more details today about the bayarea's bid to host super bowl 50 or maybe 51. san francisco mayor, ed lee, and the super bowl committee, will talk at noon about what the bidwibid will entail. if the bid is victorious, it will be held at the brand new santa clara stadium in 2016. we will be finding out next week who will be hosting for sure the big game. 5:24 san jose state team winning the first ever wack tournament championship. they will play arizona state in the ncaa tournament on friday in

details come in. there is at least one vehicle in your middle lane. that's what's causing all of this slowdown very quickly building past tuscahara in your complete. look at all these folks. this is the beginning of the build. it already has an early jam, west 580. if you can, cut through livermore, go ahead. highway 84 still okay. we are also following something in the roadways. a disabled vehicle north of here. mike, thank you very much. this was a unique story. a new study shows texting while driving may be an indicator of other risky behavior. in a new study, more than 4 in 10 teenagers admit to texting while driving. the study also finds those who do are also more likely to not wear seat belts and drive drunk. researchers also reporting teens who text while driving are more likely to bing drink. use tobacco or pot, visit indoor tanning salons and have unsafe sex. very unusual connections here.

"today in the bay's" marla tallez has been following the case since it first broke weeks ago and joins us live. it is going to be a tough day for all the students in valley springs as they go back to school for the first time since learning their classmate, the 12-year-old boy of leila fowler is his suspected sister. the mother said her son could never hurt the children. the boy was seen at this candlelight vigil huddled with his family crying over his sister's death. they were reportedly raised by their stepmother. she wrote the day after her stepson's arrest. i don't have much to say but thank you to those standing by us during this devastating time and thank you for respecting our privacy. we need a little space. happy mother's day to all. many members of the tight knit community of valley spring started their mother's day at church where they were asked to

pray for the fowler family. >> i think we need to see him as a young man that certainly made poor choices. and fell way outside of the mark of what people would even call human or humanity. but his possibility for redemption in jesus and our possibility for forgiveness is as great in the plus column as this crime is in the column of negativity. >> leila fowler was found stabbed to death on april 27th. her 12-year-old brother told investigators he found her body and saw a man with long, gray hair leaving their home. since then, people of valley springs have been on edge as investigators searched for the suspect. they first looked at sex offenders and criminals in the area with long rap sheets. why they have arrested leila's 12-year-old brother is still a question the sheriff has yet to

answer. in an official press release, he put out, he said, this is an ongoing investigation. it is 5:33. new this morning, a massive house fire has taken the lives of four children and two adults in the eastern pennsylvania overnight. the fire started around midnight at a home in potsville, 95 miles northwest of philadelphia. flames could be seen shooting out of the home as firefighters worked to get a handle on the fire. the cause of the fire is now under investigation. following last week's deadly crash, organizers of the america's cup continue to say anything at this point is possible, including a complete cancellation. a formal meeting will be held tomorrow in san francisco with all four teams in the competition that will review the evidence after thursday's deadly crash of an america's cup catamaran and recommend changes if needed. organizers say it is not likely. they haven't totally ruled out

canceling the race completely. this morning, the investigation increasingly focusing on possible structural problems with the yacht. crew members say it went airborne, broke into pieces and folded on to itself, quote, like a taco shell. a new problem is threatening the opening of the eastern span of the bay bridge. this time, inspectors have taken a closer look at the base of the tower. "today in the bay's" christie smith joins us live on treasure island where hundreds of rods could be in danger of cracking. good morning. >> reporter: good morning to you. more questions about the safety of the new eastern span. this time, essentially, what we are talking about is the logo of the bridge. this is a potential problem in the base of the signature tower of the span. experts warn that inspecting this potential problem won't be

easy. caltrans recently discovered that about 400 threaded rods could be vulnerable to cracking if they are exposed to hydrogen. engineering experts say getting to these rods cob a serious challenge because essentially, they are in the base and the structure was lowered down on to them in pieces. the chair of the metropolitan transportation commission says. the other two we are going to be tested right now. we can get to them. they are in leaves right now within the foundation. >> the other 200 she mentioned are similar to the ones in march when they were tightened near the span. the next question about the planned labor day opening of the $6.4 billion bridge built for safety in a quake. that opening is still up in the

reports of some sort of a traffic hazard. a stalled vehicle or debris. chp didn't give us much more detail. they are heading up there partially sticking out into the slow lane from what we understand. dumbarton bridge and san mateo bridge move smoothly. we have a note coming up. this is north 238 just off of 580. reports of some sort of roadway hazard. we will track that. we already have early slowing as we end on this map heading towards that dublin interchange, slow as we still have that vehicle involved in an earlier crash, west 580. that pushes more folks down through livermore on 84, back to you. >> 5:38. the warriors have to be feeling good, heading back to san antonio this morning, all tied up in the playoff series against the spurs. two wins a piece. phenomenal game yesterday. warriors rally to beat the spurs in overtime. 97-87. you will get a game six at oracle arena.

lawmakers have more questions about the deadly attack that killed four law make ter ers in benghazi. the original assessment of who was responsible, there has been a lot of change. tracie potts, live on capitol hill with more. good morning. >> laura, good morning. these were the talking points that susan rice used, the u.n. ambassador took the talking points and went on all the sunday shows and said this attack was the result of spontaneous protest over the anti-muslim video. it turned out not to be the case. now, a lot of scrutiny over who changed those original talking points. the cia started out saying they were protesters but also al qaeda affiliates and extremists involved. that got dropped during the process of about a dozen revisions involving the state department spokeswoman questioning whether they should mention prior attacks. would it make the agency look bad. the white house got involved tingering with the language. now, the question lawmakers want to ask, who is responsible? >> the cia was the agency that

rid of a big-time eyesore. today is graffiti cleanup time. crews ready to move in. "today in the bay's" bob redell live in san jose with more on this plan to keep graffiti from going right back up. >> good morning. >> good morning to you. maybe you have seen these overpasses. there are three of them. the 13th street rail bridge, the mckie avenue and bird avenue bridge. all of them covered with graffiti. the problem has gotten worse over the past few weeks. over the past couple of weeks, caltrans is trying to keep taggers from going on to these areas. right here where the 13th street rail bridge over 101. you can see in the background they have actually added another fence on top of the existing fence. this new fence has barbed wire on top. it seems to be doing the trick. on that side, people want to get in the tagging. if you look over here to your right. that fence does no good, because someone over here decided to peel back this section where you can easily gain access. so it's got to be very

frustrating to try to stop this graffiti problem. >> starting tonight, workers will be working and pantdiintin over the graffiti. there is so much it could take until wednesday to complete. keep in mind, some lanes of 101 might have to be shut down. good news is that will be taking place overnight. not during our commute hours. we have spoke at people that work at businesses near these bridges who are skeptical this cleanup will be worth the efforts. considering the lengths tagers will go to to spray paint. they will risk their lives to get on that bridge to do their artwork. >> we'll see how long it lasts. they will find a way to tag it again. >> within a couple of days is my guess. at least for a couple of days without a clean bridge again. >> someone who is stupid enough and perhaps creative enough to cut the wire to, get around the fence, to climb, to get through the barricades, will find a way to get up to the bridge again.

there. not a major concern. up the peninsula, a smooth flow for 101 and 280. the debris looks like it has cleared. dumbarton, road work on the toll plaza starting at 9:00. a live look at the san mateo bridge. we will end with that shot. we do see that. we are also dealing with a build in the commute heading across the bay. we will send it back to you. wild video from lake county north of the bay area. more than two dozen homes are at risk of being swallowed right up this morning. the homes are in the town of lakeport. that's about 100 miles north of san francisco. a total of eight homes in the lakeside heights housing development have already been abandoned because they started to crumble as the earth began sinking. residents in ten additional homes are being warned right now. they could have to be evacuated at any moment. things there are so bad. u.s. postal service will not deliver mail to the area. homeowners, they have asked governor jerry brown to help out and declare an emergency so they can get funding to determine the exact cause of this big-time ground collapse.

we have homeowners that had their house totally ruined. no homeowner's insurance. it is excluded from landslides. now, the county may be abating those homes and sending a bill to the homeowners officials seem to think the groundwater has bubbled up to the surface and that's why the earth is actually sinking. nobody knows exactly why the water suddenly appeared in an area that normally faces groundwater shortages coming up, a flash from the past. the old place some californians could soon be adding to their new cars. mark zuckerberg loses a few friends over his new political group. we'll take a look in business and tech news.

barbara walters, will announce her retirement today. she has spent 37 years at abc news joining the network in 1976. she is the first female co-anchor of an evening news program. before that, she spent 15 years at nbc news where she co-hosted the "today" show. until she retires, walters will appear on news specials and on the talk show "the view." a show she created in 1997 scandal at the irs. it was revealed tax collectors deliberately targeted conservative groups for extra scrutiny, tea party groups to organizations teaching the constitution. not only is it a scandal but it keeps growing. the irs had specifically been targeting some conservative groups. it will allegedly show the irs investigators also took a look at the tax-free status of groups that educated people on the constitution and those which advocated for a limited

government. nonprofit groups enjoy a tax-free status. from time to time, the irs will make sure they are not advocating for a particular candidate, because that would violate the rules. what seems to have happened, irs investigators picked on conservative groups almost entirely. in fact, they actually looked for the words tea party or patriot in the charity name and targeted those for further investigation. two powerful silicon valley leaders have quit. mark zuckerberg's brand new forward u.s., that new group, elon musk, david sax, left the group after it started funding political adds. forward u.s., originally conceived as as a proimmigration effort, to loosen the rules to bring in more skilled workers. days after it was founded, they started funding political ads for candidates sw. >> speaking of zuckerberg, it has been almost a year since this, the facebook ipo. the actual anniversary is saturday. looking ahead, cisco reports
