good morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> i'm jon kelley. good morning, everyone. we have breaking news for you in albany where police have forced out a group of protesters trying to reoccupy a piece of land owned by uc berkeley. most of the occupiers did leave pie peacefully. at least one person has been detained. the occupiers moved in on friday. they say they were upset because of the plans to build a senior housing facility and grocery store on that land. protesters would like to turn the area into an urban farm. the university, it claims, it is a different part of the land that will be used for housing and commercial development. we will, of course, continue to monitor this all morning long as police have that raid going on. they bring you. we will bring you the latest information as we have it. >> there is a deep sense of loss in calaveras county after the stabbing death of an eight-year-old girl. that sense of loss coupled with shock and disbelief that the

child's brother cob the onem tt killed her. grief counselors will be on hand to help leila fowler's classmates cope with her death and the weekend arrest of her 12-year-old brother. marla tallez joins us live with new details. >> reporter: even for those of us that don't know the fowler family or live in calaveras county. what so many people want to know is why. at this point, the sheriff's department isn't saying what evidence they have that has led them to leila fowler's 12-year-old brother. his arrest comes after a 15-day investigation. he says his deputies spent more than 2000 hours going over all the evidence and witness statements, including a statement from leila's 12-year-old brother who told officials he found his sister's body on april 27th and even saw a man leave their home. he also gave a suspect description. the turn of events has left many friends confused and trying to make sense of the emotional roller coaster. one girl talks about being there

for both of leila's brothers on the day of their memorial. >> they were trying to comfort me from crying but i'm really in shock now. >> there are people out here that have already convicted him, already lynched him and already made their judgments. >> reporter: since the arrest, an upcoming fund-raiser for the fowler family has been canceled. they decided to cancel because of the hurt and anger within the community. as for the family, the biological mother spoke out saying her son could never hurt his sister. coming up in my next report, leila's stepmother, the woman who raised the two, has something to say and she says this on facebook. we will get into that, laura. we'll look forward to that report. thank you, marla. the case of a human head found in an oakland garbage facility is now being investigated as a homicide. investigators telling the san francisco chronicle the person had been dead for months or

maybe even years. they also say the mummified skull probably came from outside the city but have not yet determined whether it came from a man or a woman. cadaver dogs searched the area but did not find any other human remains. a san francisco pot club may be on the verge of shutting its doors for good. they have started to proceed to seize the building on mission street between 20th and 21st street. if is one of many locations where property owners were warned to evict marijuana clubs or face possible prosecution. the landlords say they tried and failed to evict the club last year. now, u.s. attorney, melinda hag, is trying to force the landlords to forfeit the entire building. the first such action taken against the san francisco landlord by the u.s. department of justice. a new week brings word of another potential problem for the new bay bridge. this time, the issue is at the base of the bridge but brittle steel, still, the heart of the problems.

"today in the bay's" christie smith joins us live on treasure island with the latest on the new cause for concern. good morning. good morning to you, jon. the questions keep mounting about the safety of the new eastern span of the bay bridge. in march, 32 bolts were tightened and they cracked under pressure. now, a new potential problem. at the signature of this whole thing with steel rods in the base of the tower of the span. experts say that inspecting them won't be easy. the san francisco chronicle is reporting that caltrans only recently discovered that 400 or so threaded rods could be vul fleshl to cracking if exposed to hydrogen from rainwater. they call this hydrogen embrittlement. they could also be vulnerable in an earthquake. they are saying they will make sure these rods are safe. access is difficult because the tower was actually lowered down on to them. what about the planned opening of the $6.4 billion eastern span labor day weekend?

bottom of the screen. folks are waiting at the university avenue on ramp. i will put it on the map. we have marked it on the map. the southbound side, reports of a couple of cars on the shoulder with busted windows. don't know the cause. chp is going to check it out. we will continue to track this. the northbound commute is just fine. we are looking across the bay. a crash around 880. it sounds like it is on the shoulder. a distraction and slowing and debris having just gotten cleared off of the 580 split. that's causing more slowing. that's a problem if you are coming out of the tri-valley area. that's a problem. it looks like things have eased upcoming to the dublin interchange for westbound 580. an early crash caused early slowdown and backed things up through livermore. a little heavier flow of traffic through livermore and into valicitos. a smooth flow for the south bay, northbound 101 shows a little bit of slowing. we'll show you the live picture.

the scene. caltrans says there are hundreds of threaded steel rods on the span of the bay bridge that could be vulnerable to cracking. the agency says it is planning to inspect 400 rods, a process that could delay the planned opening on labor day weekend. >> >> today is the deadline for the government to appeal a court decision to lift age restrictions on the morning after birth control pill. if the justice department does not appeal, the pill could be available to anyone at any age. the head of virgin america says it is nearly ready for an ipo. >> first, profits and then a stock offer. >> you don't have to be profitable to ipo. you just look at tesla. it is profitable now. it wasn't back then. in the case of virgin, they made a profit in one quarter. it was a rare exception. in an interview this morning with the wall street journal, ceo, david cuss, says his company just renegotiated some of its debt. under this new plan, lenders

will get part of the company. this means virgin is paying far less in monthly loan payments. this will be a step towards an offering of shares. in virgin's most recent quarter, the company lost $45 million flying you from place to place. it has really been a pretty good environment for ipos. the markets are up. s&p 500 set new records last week. dow closed above 15 k for the first time. though, not everybody has been a winner. thur, we saw t thursday, we saw the ipo of software. that landed with a thud for early investors. it has been exactly a week since this, the ipo of facebook. may 18th. the actual anniversary. the system report profits wednesd wednesday. cisco, very important. it makes such important devices, the boxes that make the internet go. it gives us an idea of the

overall economy. googleas ipo gets underway. the sixth time the google developers have gotten together. i'm sure they will be talking about google glass. you can't get a ticket even if you wanted to. they sold out in 45 minutes. even though they cost $900 a piece. a pretty penny to send are child to college. now, just to graduate, that is going up as well. rising costs of commencement ceremonies in many public california universities putting a damper on some graduation celebrations. across the state, 15 of cal state's 23 campuses now charge a graduation fee. by law, colleges are not allowed to use tuition fees to cover graduation costs. many schools pass that bill on to students. at cal state east bay, a $45 fee to graduate. at san francisco state, it is zc $100. up 60 in the past two years. san jose state, some students

have to pay $75 just to walk the graduation stage. >> so it could be the last day you will have to deal with this eyesore on your morning commute. cleanup crews already getting set to do some heavy cleaning right now to get rid of that graffiti on freeway overpasses in san jose. "today in the bay's" bob redell live on highway 101 in san jose where that cleanup could be causing headaches for drivers this morning. >> i wouldn't be shutting down any lanes but for the morning commute, it will be okay. anyone that commutes into downtown san jose, i'm sure is familiar with this eyesore. you are looking at this 13th street rail bridge that goes over 101. you can see many taggers have gone to town on that putting tons of spray painted messages there. starting tonight, the city along with caltrans, union pacific, are going to start to clean up the graffiti by spray painting

it o. they have become such an eyesore. there is so much graffiti on that bridge. it could take until wednesday to get it all covered up. as far as traffic is concerned, there may be some lane shutdowns on 101. as i mentioned before, that would only be happening overnight. it is not going to affect your morning commute. we have spoken to people who work at businesses near the bridge who are skeptical that this cleanup will be worth the effort. now, caltrans, union pacific, have extended fences near that bridge. they have put barbed wire on top. if you consider the lengths the tagers will go through to spray paint public property, they are not sure that is going to work. we have seen one section offense that was peeled back. if they can't climb the fence, they will just cut a hole in it and risk their lives to get down to that bridge. >> there is a ledge but i would think they have to on the top

stuff. you can walk out on that ledge. you have toe crazy. you won't catch me out there. that's for sure. >> reporter: but they are craze why you enough to do it. we have seen the amount of tagging on that bridge, the 13th avenue brinl. here we are, heading still southbound on 101. we are coming across another rail bridge that's been tagged. i'm not sure which one this is, if it is the mckie or not. they are going to be cleaning up some of the other bridges. the bird avenue bridge as you are heading into downtown san jose where it has rip tommy. that's become infamous. if you are caught tagging, dmv has a right to suspend your driver's license for up to two years. it is a crime that's very hard to crack down on. the tagging does take place

overnight. reporting live on southbound 101. let's check in with christina now. she has to look at our forecast for today. how are we starting our monday? >> in idaho, you see a whole other type of graffiti. it literally says, pink floyd, the wall. 6:19. taking you outside. look at that fog. this has not been the case. we haven't had the may gray for quite some time. 6:19. look at all the fog in san francisco. the good news about this live picture is, i told you, we could see flight delays out of sfo, back to business monday. not so much the case. we are expecting flight delays. they are thickening up as we speak. good morning, san francisco. if you are trying to catch a flight elsewhere, we did have delays earlier out of new york city. lots of improvement there as well. everything is on time. that bodes well for business travelers. as we head throughout the day, your temperature is going to climb from the 50s where we are

now into the 70s and 80s. another beautiful day before we start to drop like a rock. by the end of the woeek, low 70 inland. low pressure starts to slide to the south as we head throughout the day today. that will keep the onshore flow in place. with the jetstream sitting right over us, we will see the impulses that move through the bay area. tomorrow morning through friday. it is going to keep that onshore flow in place. temperatures are going to fall from the mid-80s into the low 70s. noticeably cooler between today and specially when you look at thursday. friday into saturday, we start to climb you right back up. it is good news. you want that warm weather on the weekend where you can get on out there and enjoy it. it looks like that will be the case as we head through saturday and sunday. 6:20. the drive is picking up. he has your hotspots. hi, mike it is really kicking in right now. we had early slowing in the east bay, the tri-valley west 580. early crash there. it cleared up as far as the slowing. it is back again.

now, speeds back down below 50 as you are heading over towards the 586/80 interchange. they planned their routes getting down through livermore. a little extra slowing. we changed from 40s in towards the 50s. maybe it is starting to sort itself out. we will track the tri-valley, because it is just going to build for the morning heading down towards sunol. west 580, really slamming in over the next 15 minutes. up towards the 580 split where there was some debris in the roadway. that moved. there is still a crash, still clearing. one of the vehicles might be a motorcycle. no major injuries reported. north 238, very slow causing a backup. that's what keeps 880 a little clearer toward hayward. san mateo bridge had overnight, a wind advisory by chp. not a major concern. the sign is still lit up. we will track that as well.

the backup will last for much of your morning commute. a traffic update coming up in a second. thank you very much, mike. at 6:2567, a disturbing discove. four children and two adults found dead after a house fire in eastern pennsylvania. it started about midnight at a home in potsville, 95 miles northwest of philadelphia. flames could be seen shooting out of the home if firefighters were to contain the blaze. they suffered minor injuries. the causes of the fire now under investigation in new jersey, three children now safe after police stormed a home and killed the man who had been holding them hostage for 37 hours. tragically, police also found the bodies of the children's mother and their 13-year-old brother. police say the suspect was the mother's boyfriend, 38-year-old gerald murphy, who was also a registered sex offender. the fbi says the mass shooting during a mother's day parade in new orleans is an act of street violence, not an act of terror. at least 19 people, including a few children, were injured.

police say at least three people fired into the crowd yesterday. so far, no arrests have been made. also, this morning, emergency shelters being set up in central mexico ahead of what could be a major eruption of a volcano near mexico city. a seven-square mile zone is shut down. soldiers and police keeping watch over this area. that volcano has been spewing steam and oozing lava since saturday. we will be right back after this.

half sunshine in san jose. just about full sunshine in the east bay to start the day. what i want you to notice about this deck of clouds, rather thin. you can start to see the sun starting to breakthrough. not a lot of low cloud cover to start the day. we are starting out nice and crisp if you want to get any sort of outdoor activity done. you are going to have really nice conditions, until 10:00, 11:00. temperatures will be on the warm side inland. the story of the week is we are going to drop you off temperaturewise each and every day starting tomorrow through the end of the week. you will notice these increments are pretty substantial by 5-8 degrees. bayside, 3-5 degrees of cooling as we head through tomorrow. that gradual cooling trend extends well into the week. this is going to be one of the coolest weeks we have had in quite some time, 85 inland are bayside, 75, 71 at the coast. we have a very slight chance for some showers as we get these cooler days stronger onshore flow. we are expecting dridsle as well. we have a lot to talk about when

i take you through your full forecast. if you are ready to go to work, mike is here to help you out. >> our chopper over the castro valley "y." that continues, the earlier crash we saw. they cleared the lanes for north 238. there is the slow drive. splitting off. just get together left side of your screen. the photographer showing us what we have got. you see the yellow where it says 238. still jammed up on the castro valley "y" and coming out of the castro valley itself. about seven miles before you start to see any relief. it is very slow. jamming up in towards castro valley things start to clear. you can use the bart system. there are no delays reported there. these are not the right maps. a smooth drive for the b.a.r.t.

system. traffic flows smoothly through the area. let me get you a look out through the cameras. the south bay, traffic flowing nicely northbound to 101. this is clear. we have some slowing approaching the area many could go over on capital expressway as well as north 87 coming into the downtown area. >> hitting the roads, that second leg of the tour. california set to start in five hours from now down in southern california. riders will start off in mar marietta. the tour is actually taking a reverse route starting down in southern california and ending right here in the bay area. yesterday, cyclists rode 102 miles in the escondido area. they will be here up in the bay area by friday with time trials in san jose and fans are being advised to expect stepped-up security in the wake of the boston marathon bombings. the riders will tour and also run through livermore and san francisco before ending in santa rosa sunday morning.

a cleveland house they are calling a house of horrors where three women were held captive for years. it is now boarded up and fenced in. for now, the house is considered a two-story crime scene. some neighbors simply want the house torn downment a local councilman says there have been threats to burn the house down. we have new video just out showing the dramatic police rescue of the four women held in that cleveland home. this video shows police pulling on the screen door of that house and prying their way inside. you don't see it on camera. police say gina dejesus and michelle knight both jumped into officer's arms shortly after this entered the home. amanda berry and her 6-year-old daughter were also out of that house. the suspect in the colorado movie theater shooting rampage wants to change his plea to not guilty by reason of insanity. james holmes will officially ask for the new plea during a hearing today. holmes is accused of killing 12 and injuring 70 others during a

midnight movie screening last summer in aurora, colorado. his motive is still a mystery. prosecutors are seeking the death penalty o.j. simpson back making headlines heading to court in las vegas. he is asking for a new trial on armed robbery charges. he was convicted in 2008 of leading the robbery of two sports memorabilia dealers in vegas. the fomer football star, he claims he thought the items were personal belongings stolen from him after his murder trial in the 1994 killing of his ex-wife. simpson, currently serving 9-33 years in prison. 6:41. coming up, turf war on the farms to oust protesters in the east bay an entire subdivision swallowed up. the investigation into what's leaving so many homes splintered and now sinking. >> is tesla the best-selling car if you do the math right or

on hand. they are on campus to help students cope with the news their 12-year-old classmate is now under arrest for allegedly stabbing his 8-year-old sister to death. "today in the bay's" marla tallez has been following this case since it first broke weeks ago. she now joins us with the updated details. >> reporter: it is certainly going to be a tough day for all the students in valley springs who have essentially lost two classmates in just two weeks. first, the loss of third grader, leila fowler, who was stabbed to death at her home on april 27th. now, the absence of her 12-year-old brother who is suspected of killing her. on friday, a day before his arrest, his biological mother told a san francisco tv station her son could never hurt his sister. he was seen at a candlelight vigil. they were reportedly raised by their stepmother coverwhose fac was covered with pictures of leila.

i don't have much to say but thank you to those standing by us in this devastating time for our family and thank you for respecting our privacy during this time. a brand new iv%reality for the fowler family. not everyone is standing by them. an upcoming fund-raiser for the family has already been canceled as community members struggle to make sense of this emotional roller coaster. >> they are all now afraid this money is going to go to the defense of the young man, the young boy. they don't think the community should be sporting that. >> i was trying to comfort them and they were trying to comfort me from crying. i am really in shock now. >> you may recall after leila's death, investigators first looked at sex offenders and criminals in the area with long rap sheets. now that leila's brother is under arrest, the sheriff is not saying why or what evidence they have. only that he was arrested on the charge of homicide and that the investigation is ongoing.

>> can't imagine what that family is going through. thank you very much. grizzly peak boulevard has finally reopened after an all day and all night investigation into a deadly shooting. so far, the name of the man found dead has not been released to the public. they say they do not believe the public is at risk. >> some pretty wild and amazing video to show you out of northern california where more than two-dozen homes are at the risk of being swallowed up this morning. they are in the lake county town of lakeport. 100 miles north of san francisco. homes have been abandoned. residents in ten other homes are being warned they could be forced to leave at any moment. the area is so unsustainable

that the u.s. postal service will no longer deliver mail to the county. they try to determine exactly why the ground is sinking. it is very odd here, because that area usually has groundwater shortages it is cleaning day for a much maligned san jose overpass. crews will start dealing with this eyesore. the plan is to wash away or paint over the graffiti that drivers have been complaining about and then try to keep it from coming back. that cleanup comes with a catch. it could have an impact on drivers. talking about, all the graffiti up there, all over the span. it has been there for quite some time. caltrans and union pacific and the city of san jose, they are going to get up there and clean it up, take it down, painting it over it, to get it back to its original state. you are talking about the traffic since it is happening overnight. there is a chance that some of the lanes of southbound 1 o 1 and northbound 1 o 1 cob shut down. it is overnight. this would not affect the morning commute. there is so much graffiti on that bridge, however. it could take until wednesday to complete this job. we have spoken to people that work at businesses near the bridge who are skeptical this clean wup will be worth the effort. here is why. they are thinking, once you paint this over, these taggers are going to come right back out and do it again. they have added extra layers offense along the 13th street bridge and put barbed wire on
