>> it is 6:00 on the nose. good morning, everybody. happy to have you along for the ride. >> i'm laura garcia-cannon. nbc news reporting an fbi agent shot and killed a man linked to one of the suspects in the boston marathon bombings. that man has just been identified as ib are a ham tudashiv. he was being interviewed about his connects to suspects in the bombings when he apparently attacked an agent. now they will confirm a shooting incident involving one of the agents. the story breaking in florida now. we'll bring you more details as we get them. >> rescue workers still very much working hard down there once again combing through the wreckage of an oklahoma city suburb flattened by the massive tornado. crews making sure they have not missed anything during their many searches throughout the

endless rubble. the fire chief down there in the city of moore says he is confident right now there are no more bodies or survivors still stuck under the big piles of debris e. survivors of the tornado are now mourning the deaths of 24 people and dealing with the destruction. the complete destruction of neighborhood and homes. "today in the bay's" jody hernandez has spoken to survivors and joins us now live in moore, oklahoma. i can't imagine what it looks like on the ground there. >> it is absolutely a sight to see. you really can't describe it. the video doesn't do it justice, i will tell you. there is a strong scent of determination out here in moore, oklahoma, that people are going to get through this. the stories of folks pulling together have been truly remarkable. truly heartwarming. despite the massive destruction you see behind me. as bad as it looks people are pulling together in unbelievable

ways. we had a chance to talk to a man who shared how he helped parents and children reunite at briarwood elementary school right after the tornado hit. we have some new video of what that scene looked like. he said when he got there it was pure chaos. he described it as a war zone. children and teachers, injured teachers running around in a panic. but the truly remarkable moment for him was when he spotted his 7-year-old neighbor. we've got an image of that reunion. he was a first grader at the school. he was able to hug the little boy and let e him know despite what happened, everything was going to be okay. >> he said, i'm so kblad glad t you, big dog. he kept saying, where am i going to learn now?

where's my mom? he had questions and was very upset. it was a big hug that we had. i needed that hug as much as he did, i think. >> we are back here live now. that sense of connection and community have really been what's shining through. as bad as it looks, folks here determined to clean it up together. people are coming out with buckets, shovels to do what they can. there are folks here who are passing out food. local churches. a real sense of togetherness. folks say they are resilient. they are determined again to get through this. they say that's the oklahoma spirit. that is the oklahoma way. reporting live in moore, oklahoma, i'm jody hernandez. we'll send it back to you in the bay area. >> it's been such a short time since the tornado hit. what are people doing now currently for electricity, water to survive in the area.

is it back on? >> you know, right here where we have been based there is no electricity. there are no homes and nobody is allowed to be here. it is complete devastation. we are talking dozens of homes levelled. nothing left here. folks are staying with relatives. you know, they are staying in nearby churches and in hotels. but here there is really nothing left. this is the neighborhood that was hardest hit. >> a few inspiring stories out there. the big dog, little dog story. what a guy there. continue to talk to the people for us, jody. we'll check in later on. thank you very much. >> some of the people with family in oklahoma were here in the bay area when the tornado struck. this morning they are headed home not knowing exactly what will be waiting for them. christie smith joins us live at

oakland international airport where a flight to oklahoma has taken off now. good morning. >> good morning. there are two flights out to oklahoma city this morning. one at 6:00. now the next at 8:00 this morning. travellers saying they had to reschedule their flights to get out today. i'm not sure what they will find. some going to check on loved ones. also checking on property they have down there just to see how it is. one couple telling us they have never seen anything like the deadly tornado or destruction it left behind in moore. one of the toughest parts watching from here in the bay area is they didn't receive a text from loved ones for hours to let them know they are okay. they have a father in oklahoma and a house there. they believe that the house is okay as well.xñ they are telling us they are going to get a firsthand look and offer help. they don't know exactly what that will be. >> a lot of devastation. >> are you just going to help family and friends? >> we're going to go out and

>> yes, indeed. just right today. good morning to you. 6:07. what a beautiful start to the day here. san francisco. you know what, typically, may gray is the story. we have had very little of that so far this month. now we are getting into the end of the month. starting out crystal clear. as a result, look at napa. 37 degrees this morning. 5 degrees away from freezing up in wine country. after we were in the 90s just a couple of days ago. today we have a completely clear start. it's crisp out there. grab your jacket. we are getting into the coldest part of the day now. 46 in livermore and a wind chill factor with winds coming in off the pacific. out of the north-northwest e, strong in oakland. hold onto the steering wheel. we'll check on the drive with mike in a moment. for today your hour by hour forecast works like this. 70 degrees inland bay side. 65 at the coast. breezy conditions. we have subtle changes to take you through as we get into

memorial day weekend. really, things are looking steady. do want to talk about some of the things happening across the bay area for memorial day. we'll take you through the forecast. the camera shaking a little bit. >> you talk about the wind coming off the water and off the coast. over here on the east side freeway as well. the camera is getting caught with gusts. that could be an issue on the bridges, specifically the high rises for the san mateo and dunbarton bridge. there is a smooth flow under university avenue. let me show you maps. no real slowing. speeds coming down into berkeley off golden great racetrack there and slowing at the toll plaza as the metering lights are on the backups there. an issue in oakland on the tracks. b.a.r.t. recovering now. ten minutes delay because of police all the the oakland station. there is police activity causing

slowing in both directions. east bay out of the west oakland station. that should be less than ten minutes. we'll track that. muni is fine on the peninsula. cal train moving smoothly. we had slow downs out of the pass westbound. a crash and a disabled big rig around grant line road had things lighter into livermore for a time. looks like things are building. we have reports of another crash. slowing west 580 through dublin. we'll watch for 680 through pleasanton over the next 20 minutes as well. we'll get a look outside and see how things are shaping up in the next report. meanwhile north 101 north of 680. with the rest of the freeway shaping up pretty good. 85 still at the limitment. >> thank you very much. new this morning, santa clara

sheriffs deputies patrolling is substation in san jose after a suspicious man is found wandering if area overnight. the substation is the same one vandalized last month. fiber optic cables were cut and somebody shot a transformer. power and phone service were disrupted. this morning, pg & e is reporting no problems so far. deputieses set up a perimeter in hopes of finding the man. >> it's 6:11. coming up, taxes higher in san jose. why some patients will have to pay more for treatment coming up in a live report. >> tesla will pay back its entire loan and an immigration bill passes out of committee. we'll look at both in business. >> scott will take a look live outside from the south bay over san jose. green trees and hills in the back. a nice day to get out and do something to enjoy the sunshine and cooler temperatures. we'll be right back in minutes on "today in the bay."

6:14. rescue workers searching through debris in oklahoma making sure they haven't missed victims of monday's deadly tornado. the fire chief saysis goal is to conduct three searches on each building. >> foster farms recalling grilled chicken breast strips after a labeling mix up. the product contains wheat and soy allergens not listed on the labels. the grilled chicken strips being recalled were produced on april 23. >> a man with ties to the boston bombing suspect has been shot and killed by an fbi agent. nbc news is reporting the man was being interviewed about connections to the tsarnaev brothers when he allegedly attacked an agent. the fbi confirms it is investigating a shooting involving an agent but is not providing other details. >> it's 6:14. a big day for tesla.

this morning elan musk making a phone call and authorizing his banker to send hundreds of millions back to the government. >> the electric car company is paying back its entire loan. taxpayers will make a profit. >> a small one. tesla will be the first company under the green loan system to pay the loan back. tesla got more than $400 million from the department of energy. the car company hasn't made t$40 million in cars. it offered stock and raised the money that way. it's moving the risk, the liability from the taxpayer to the common investor, a much more traditional model for business. as you mentioned the payment will be electronic. more visual if he were to write a check. the department of energy and the obama administration could really use a good visual like that, considering this is what most people think of when they think of d.o.e. loans.

president obama and the bankrupt solyndra. other news looking ahead. we have hewlett-packard announcing profits or losses this afternoon. sunny vail based net app did the same on wednesday announcing it will cut 900 jobs worldwide. filings indicate 200 jobs will be in the bay area. >> it passes. [ cheers and applause ] >> history made in the senate judiciary committee. the first immigration reform since president reagan. there are dozens of details including support for dream kids, a path to citizenship. new visa minimums. one idea did die in committee. that's gay couples cannot sponsor their spouses' applications for a green card the way heterosexual couples do. democratic senators say it is one of the most painful things they have had to drop. they realize if they tried to keep equality in it would have died on the senate floor and been hopeless in the house. >> the reality of negotiation.

scott, thank you very much. >> 6:16. paying a price for pot. san jose voting to raise a tax on medical marijuana clubs. while the subject of marijuana always seems to stir up heated debate last night's vote had no opposition whatsoever. bob riddell joins us in san jose with more on the story. good morning. >> good morning. it will affect almost a hundred pot clubs like this one. it was a unanimous decision by the san jose city council. with no one from the public stepping up during the meeting to show support or opposition to the rate hike. starting in july the almost 100 pot clubs in city limits will have to pay 10% in tax. that's a hike of 3% which the city estimates will bring in an extra $1.5 million a year. the marijuana shops have created controversy in san jose over the past couple of years as reported in the merck.

the city tried to limit numbers. but they repealed the rule after pot supporters protested and tried to put it up for a public vote. the clubs are technically illegal. as long as they pay their taxes and aren't close to schools which are going from 7% to 10% starting in july. reporting live in san jose, bob ridell, "today in the bay." >> thank you very much, bob. looking forward to a nice day ahead. >> good out there. >> we are experiencing cooler temperatures. >> it's nice out there, guys. i poked my head outside. it's so nice. temperatures are crisp. we haven't been this cool in weeks. temperatures have fallen into the 30s in the north bay. that's hard to believe when you start the day with no low clouds. typically it is a lack of sunshine getting into the bay area that keeps it so cool. today there is an area of low

pressure to the north driving in the cool ocean air. 42 for fairfield. a cold start to the day at 42. h 4 for campbell and 48 here in beautiful san jose. also we have a wind chill factor. winds will pick up throughout the day. they are coming out of the north, moving to the south. strong now in the vicinity of 5 to 15 miles per hour gusts clocking at 45 miles per hour. keep in mind a blustery day. temperatures will be downright perfect. winds will be at their strongest between 11:00 a.m. and 7:00 p.m. when we meet back for our 11:00 broadcast. we'll let you know which of the cities are already seeing the 50 miles per hour wind gusts. plus more of an idea who will be hit hardest at that point. the winds will be the strongest especially in sonoma and marin county. 70 degrees. very comfortable in livermore.

north past the colosseum. you see that it's actually light passing high street headed into downtown. the southbound side going to pick up volume, moving quickly. the camera trembles from time to time. could be gusts of wind. keep it in mind over the bridges like the san mateo bridge over to the high rise section on the maps. you will see the peninsula off 92. south 280 at bunker hill. reports of a disabled big rig in the right lane. possibly the trailer might be smoking. there may be more details. i haven't seen slowing over the last five minutes. south 280 around bunker hill watching for the activity. dunbarton bridge and the peninsula bridge moving slowly. slower for livermore. in towards dublin. 84 itself. typical slowing. slow coming out of the altimont pass. we had a disabled big rig.

here is a story that ended up being a hoax. a woman robbed and attacked by two men who tried to kid map her baby is behind bars accused of filing a false report. 23-year-old jennifer flores told police two men pushed her to the ground near santa rita road in pleasanton. she claimed the men took off with her purse and tried to take the stroller with her son inside but surveillance camera from a nearby domino's pizza showed she left her purse at the restaurant. she later admitted the story was a lie. >> a case involving a santa clara sheriff's deputy will cost taxpayers $5 million.

the deputy was involved in a crash that severely injured an elderly man in january of last year. according to police reports the deputy was eating a mcdonald's hamburger, fumbling with a stuck radio microphone and trying to turn off a light switch when the patrol car hit the man's car. the man was badly hurt. he can no longer drive. the county agreed to pay the man $5 million in a settlement. >> 6:26. a famed berkeley restaurant will open in a month. the first visitors will pay a pretty money. chef alice waters hosting a grand soiree, june 21st, the day it re-opens. there is just one seating upstairs and one down stairs. the meal upstairses will cost $1,000. down stairs will cost $2500. the money goes toward chef waters edible schoolyard proj t project. it's been closed since march

gay. you may recall the story as he's been at the forefront for the movement for change within the boy scouts of america. ryan has been in the boy scouts since he was 6. he's now 18 and still waiting to officially earn the eagles honor which is the highest rank. he and his family will be watching this two-day meeting that starts today in texas. the boy scouts of america is based there. here's what's happening. 1400 local leaders are getting together to vote on the resolution that would lift the ban on gay scouts. we spoke to ryan's father who said if the ban is lifted this is a step in the right direction. however, obstacles would remain as gay adults would be excluded from serving as scout masters. >> it's good news and bad news. the concern is that there are thousands of adult leaders. highly qualified. dedicated to scouting who are gay. this decision as potential

policy won't help them at all. they won't be allowed to be in scouts. >> as recently as friday the resolution drew protesters around the country. these scouts protesting in minnesota and iowa holding signs urging leaders to vote no. they say by lifting the ban the scouts traditions would be under mined by the presence of openly gay youth. final vote is expected tomorrow. lauren and john? >> interesting to see what happens. we'll continue to follow it. >> absolutely. 6:36 now. an update on breaking news. new details about why an fbi interview turned deadly overnight. why it was linked to the boston marathon bombing. >> the city by the bay. going to be a great day to be in san francisco. giants playing a day game today, too. >> got the nationals.

want to update you on breaking news from overnight. nbc news reporting an fbi agent shot and killed a man linked to a suspect in the boston marathon bombing. his name is ibrahim tadashev. he was being interviewed in florida about his connection to suspect tamerlan tsarnaev. he attacked an fbi agent. fbi says it would be releasinging details on the incident coming up this morning.

>> also new this morning. >> the men are under 24-hour surveillance. wanted for questioning in the september attacks on the u.s. consulate. that killed four americans including u.s. ambassador and bay area native chris stevens. officials say the white house already has enough proof to seize the five men aster error suspects. they are waiting for enough evidence to try them in a u.s. civilian courtroom. >> an over night disgraced congressman anthony weiners toing his hat in the ring to be the next mayer of new york city. weiner stepped down two years ago after admitting to texting and tweeting inappropriate photos to women while he was married. experts believe he'll have big advantages over other candidates including $5 million in campaign funds. >> coming up, mourning death and dealing with destruction.

"today in the bay's" jody hernandez is live talking to survivors and the long road to recovery that lies ahead. good morning. >> reporter: good morning. it will be a long road to recovery. it's about 8:45 in moore and the cleanup effort is under way. i don't know if you can see it. there are bulldozers here at the moore medical center trying to do what they can. as you can see the damage is so severe it's truly overwhelming. the entire neighborhood where we have been camped out has pretty much been levelled. homes are piles of wood, metal and debris.

cars ripped apart and strewn about. local stores and businesses are out of commission. the place pretty much looks like a bomb went off here. what's really remarkable is that despite this there is a real sense of determination from the residents to pull together and get through it.qva we'll pull through this together. we have been through the dust bowl, tornadoes. what we do is we cleanup, rebuild and move forward. it's the oklahoma spirit. the amazing spirit, we are here live where you can see the devastation here at the moore medical center. s this is what's left. you can see there are a number of cars strewn about.

the access is limited here. there are cleanup crews today. i took a brief look at the neighborhood. they are not letting residents back in yet today. they are trying to get through their belongings. we saw residents with fears of looting. police are being careful about who they let into the area. us reporting the moore, oklahoma, i'm jody hernandez, "today in the bay." >> i would imagine the makeshift shelters may have to operate for a while. >> it's going to be. you saw the images. the homes are gone, levelled.

it's going to take a long time just to clear the space out. then much longer to rebuild. it's that bad. the folks will be displaced for a long time. >> so sad. thank you very much, jody hernandez for the latest. this morning another heartbreaking story from the oklahoma county sheriff's office. this dog was found in the wreckage guarding the body of its owner. the dog is at a shelter now. there is good news. deputies plan to adopt the little tornado survivor. faithful animal. >> yes. endless sad stories there. in the bay area, hundreds of people from oklahoma are now headed home for the first time since monday's deadly storms. passengers with loved ones living near devastated areas. christie smith spoke with passengers as they checked in. she's live now at oakland international with the story. good morning. >> good morning to you.

we have been speaking with dozens of passengers asking them if they are going to oklahoma city. even those who aren't on the 8:00 a.m. flight tell us they are sending their prayers. those who were on the 6:00 flight have a very determined look. they say they want to see the damage first hand and they want to do what they can to help. one couple tells us they have a home near where the deadly tornado struck. they now live here in northern california. the father also lived there. both homes, the father's and theirs both okay, they think. they say they are going to help with whatever they can after they have watched the suffering in moore. homes and buildings gone. never seen anything like it. they are not certain what they will find or what they were going to do to pitch in. >> it's horrible devastation. we feel for the families, their loss. hope that they've got plenty of support and some place to go. >> what do you do when you go to

help? >> we tonight know. it's our first time through doing this. >> we'll see in a few hours. >> reporter: they say the first few hours after the tornado were the worst. they weren't getting texts from anyone to say they were okay. they finally got those. again, their people are okay. they are going to help and not sure exactly how long they might be there. reporting live at the oakland international airport, christie smith, "today in the bay." >> what a scary reality. thank you very much. well, as people in oklahoma deal with the fath of the deadly tornado the nation remembers the second anniversary of the joplin monster that hit two years ago.y tornado the nation remembers the second anniversary of the joplin monster that hit two years ago. an ef5 killed more than 350 people. it was six miles long, three quarters of a mile wide with winds of more than 200 miles per hour. tonight there will be a moment of silence.

the next couple of days fierce winds continue. an area of low pressure to the north driving winds. the buoys are clocking winds 45 miles per hour. the gusts from time to time with sustained wind speeds from 5 to 15 miles per hour this morning. it's a chilly start to the day. we have been falling into the 30s in napa with a wind chill factor as well. pull out the coat and keep it with you as temperatures will be ten degrees below average inland. this morning you will notice the difference. 8 to 15 degrees cooler than 24 hours ago. let's show you. area of low pressure to the north. we have a strong pressure gradient as the high pressure ridge sits over the four corners region. the area of low pressure isn't really going anywhere. throughout saturday, friday night into saturday, look what comes our way. another area of low pressure will push this one in. for us that will provide a reinforcing shot of cool air. that means we hit the stride of

we have a big slow down out of petaluma to lakeville. that will be a big slow down. things are going back to the normal morning commute. 37 coming toward navado. nothing unusual. the big storm coming out toward sonoma raceway. it is there this morning. pretty standard. on the east shore freeway, upper east shore through berkeley and emeriville. orange showing speeds around 35 or 40 at worst. no incidents cause ago problem. we have the backup at the toll plaza as the major obstacle there. we'll look at slowing south of here for 880 south through hayward to the san mateo bridge. we have slowing there and unusual slowing eastbound over the span from the peninsula. no incidents on the span itself. we'll track it for the san mateo bridge. a crash just off 238. tracking that as well. a live look through fremont shows traffic building into the south bay. close to the limit.

the south bay, we have northbound routes seeing slowing in the northbound directions for 101. 87-85 and 280. all dropping speeds into the 40s and 30s as the volume kicks in. back to you. >> thank you very much. 6:55. the richmond city council put a deadline on chevron to come up with a compensation deal for last year's refinery fire. they will enter talks for 30 days to work out a deal. if no deal is made the city plans to hire a law firm to take chevron to court. chevron b said it is aware of the city's plans and will respond appropriately. >> san jose voting to raise the tax on marijuana collectives starting july 1. pot clubs in san jose will have to pay a 10% tax. that's up from the 7% rate that's been in place since 2011.
