new this morning, a warning for you. if you're planning to head to the livermore area, two lanes near airway boulevard shut down because of an overnight crash and a separate hit and run. the chp says the truck initially hit sand barrels on the highway just before 1:00 this morning knocking them over into the two left lanes. now, while crews were clearing that debris, another car slammed into a chp cruiser that was pulled over on the side of the road. the driver took off and is still on the loose this morning. the officer who was in that cruiser was taken to the hospital with minor injuries. the lanes are expected to be closed for an hour or so. no charges will be filed against the woman who was once accused of poisoning orange juice at a san jose starbuck, store. the last time we saw the woman she was getting out of jail and trying to avoid the media to get home. last month, police arrest the the 50-year-old chemist on

charges of attempted murder. police said she put a deadly dose of rubbing alcohol in those orange juice containers before then placing them back on the coachee shop shelves. but now the district attorney's office says it will not file any charges against the woman because test results showed the containers actually contained vinegar and orange juice and not rubbing alcohol. the d.a. says neither ingredient is considered harmful and it cannot prove that she tampered with the drinks. >> that kind of stinks. i mean, if she really didn't do anything, she's got this fallout that she's going to have to deal with. >> the woman's attorney says she is relieveled and hopes her life can now return to normal. a man is behind bars this morning. accused of killing another man with a machete. earlier this month. san jose police say 19-year-old transient christopher lima attacked 3-year-old demetrius porter last thursday outside a jack in the box in south san jose.

porter died at the scene. investigators say thep t two me did not know each other. police say drug, may have been the reason a local basketball player put a deadly hit on an emerging rap star. the man is now in jail for the murder of an up and coming rapper in georgia last june. authorities believe white and as many as four other people conspired to hire a hitman to kill the rapper. white played basketball for sara high school in san mateo and san francisco state university where he just finished his senior season. u.s. marshals arrested white. >> mr. white was arrested in our county and we filed the district attorney's office a felony fugitive proceeding against him in court. that's extradition proceedings. >> white will go back to georgia to face murder and assault

charges. former east bay high school football coach is in jail, arrested on suspicion of nearly 2 dozen counts of child sex abuse. 51-year-old baron edwards faces 21 counts of sodomy of a minor under the age of 10 and two counts of lewd acts with a minor under the age of 14. edwards coached the varsity football team at kennedy high school in richmond from 2004 to 2005. investigators are not saying when those alleged abuse attacks happens. edwards is being held on more than $21 million bail. the kindness of strangers may have saved the life of this campbell store clerk who was being robbed and stabbed. a husband and wife jumped into action to stop that brutal attack and it was all caught on surveillance video. police say while the actions were heroic, they also could have been deadly. "today in the bay" has the story.

>> we have a scuffle and he tried to stab me. >> reporter: he was not about to give up his hard-earned money without a fight. help was going to defend his property even though the mask the robber had a knife. his was slashed but he fought him off. >> i was freaked out because, you know, he almost ran over me. i thought, what is going on? >> reporter: they saw several people chase after the robber. francine and her husband knew what they had to do. going into a block formation. >> i quickly asked him, what are you doing, because all i could see is his eyes. and i could see confusion in his eyes. >> reporter: trying to figure, should i tackle the guy, should i sweep him. but i didn't and i just went for the backpack, grabbed the backpack and i pulled and pulled. he struggled a little bit. i got it free.

>> reporter: officers arrested the robber a short time later. believe their actions slowed the robber down and played a role in the crook's arrest. police say they understand the frustration with the rising number of burglaries in the area but they caution people not to try and capture a criminal. >> we really want to commend the citizens and witnesses who were able to give us information but once again we don't want people putting ourselves in a situation where they could get injured. >> they know they put themselves in potential harm but they say they would do it again. >> like a "spider-man" moment, where do you take the responsibility and do something for the actions or do you just let the guy go and don't do anything. >> and that was george kitoyomo reporting. police say they will push for the 17-year-old to be charged as an adult. a murder that rocked the

community to its core. jenny lin was killed in her home. her attacker has never been caught. every year her family holds a memorial to honor the young girl's life and to pray for a resolution. here's "today in the bay"'s cheryl hurd. >> reporter: jenny lin loved music, family and the color blue. all those things were used to remember her at her memorial service at the castro valley library friday night. >> we miss jenny a lot. even after 19 years. she lives in our heart every day. and we miss her. >> reporter: jenny's family and friends have shown that love every year for the past 19 years. on the anniversary her death, people gathered to remember her and to let people know there's still a $100,000 reward for information leading to her killer. >> a lot of it is still that sadness, you know, tears come very easily when i think about her and what happened. >> on may 27th, the 14-year-old was murdered in her home.

in 2006, alameda county police were looking at a possible suspect, alexander sebastian shaw, but no charges have been filed. >> we are still looking at him. he's been interviewed a few times. and we are hoping that some of the evidence that we have with the new technology, new dna technology, might help us to tie him or rule him out as ajenny's have closure. but until that day comes, they will keep working on ways to bring awareness to their daughter's unsolved murder. this year, they dead date ededi memorial to an art contest. even as the family works to improve the safety of other children, finding jenny's killer remained their biggest hope. >> after seeing the cases broken in other states like the ones in cincinnati or, you know, we, those are encouraging events,

more than 20,000 people will be on hand to celebrate the large et graduating class in the history of the university. more than 8,700 students are graduating at this year's 112th commencement ceremony. delivering the commencement speech is the ceo of the san francisco giants. this weekend celebrating the largest multicultural festival on the west coast. it's happening in the mission district. eight city blocks from harrison street from 16th to 24th street will be bursting with music, dance, arts and krachts and exotic foods from many of the countries that celebrate carnivale. and a parade tomorrow morning happens at 10:00. some people may be heading

to do a little camping, hit the lake. this morning, fight fighters are asking everyone to be aware of the increased fire danger and be extra careful outdoors. with one of the drier records, by late may, an average year, cal fire says it usually resp d responds to 850 wildfires. here's a few reminders to stay safe. make sure your camp fire is out before leaving the area. and when barbecuing, never leave the grill unattended. if you're planning to head in the water, always wear a life jacket, never leave children unsupervised and never swim alone. cal fire also says drinking and swimming is just as dangerous as drinking and driving. aaa estimates more than 4 million californians will travel

at least 50 miles from home this weekend. we are looking live. certainly looking a little busier. if you have it left and you are leaving, you can check out that around the bay area, the golden gate and san mateo bridge. the bad news though, the national average price for a gallon of gas is up 7 cents this past week and could increase even more this weekend. the average price of gas in san jose is $4.03 a gallon. 9 cents lower than in san francisco. a fallen of gas is about 20 cents higher this year than it was last year for memorial holiday. now, let's check in with rob miatte. gas prices may be going up but the temperatures are going down. >> especially by the time we get to monday. not only will the temperatures be going down but we may be seeing rain drops.

including restaurants. law is clear that only service animals are allowed in facilities that serve food. some people are faking disabilities just to give their pelts an all access pass. >> reporter: people love their dogs in the bay area. so much so, they go pretty much everywhere. but there are some places our pets just can't go. state law says only service animals are allowed in food facilities. that means anywhere food is sold or served. still, some people smuggle their pelts into pla pets into places shouldn't be. after all, ways the harm? alex writes a blog about life with a service dog. bright was trained by canine companions for independence to help alex get around, pick things up and live her life. bright is not trained to deal with people who pose their pelts

as service animals. >> our dogs are very submissive. if there's another dog set on being aggressive and confrontational, that puts my dog at risk. >> reporter: alex says she's seen owners outfit their drawings to pass them off as service animals. it's easy to do. plenty of websites sell official looking vests to anyone. >> you don't take advantage of the perks of someone else's disadvantage. >> i'd like to say she's a service dog. >> reporter: you said you'd like to say she's a service dog? >> we've actually done it before. >> reporter: we went undercover in san francisco and found people claim to be confused by the law. >> who really knows. i'm just kind of over it in general. >> reporter: while others explain how to get around it. >> if you say you have a service dog, they can't throw you out. >> reporter: business owners can only ask two questions when someone with an animal walks in.

is this a service animal and what is it trained to do. cheaters know there's no proof required. we observed multiple pet owners slipping past these signs. >> i thought only service dogs were allowed to be public access. >> i don't know really where the bounds are. >> yeah, i usually don't listen t to any kind of rules. >> reporter: it's that attitude that's frustrating to people with real service dogs. not to mention some pets might prefer to stay home. >> i think a lot of people have special relationships with their dogs. >> reporter: san francisco food safety director richard lee says allergies and the potential for disease are the reasons state law restrict s pets. san francisco had 61 complaints. santa clara, 37. inspectors gave these businesses

signs to post. >> the last year, we saw 17 complaints. >> reporter: unlike people who use disabled parking placards, people with service animals are not required to register anywhere. >> the americans with disabilities act is very liberal in this regard. >> reporter: this ceo says his group and others are now lobbying the department justice to crack down on service dog fraud. >> there needs to be some standard and somebody neutral who's knowledgeable about the situation, judges, whether that's a legitimate assistance dog. >> reporter: alex says she and bright already face enough discrimination without help from people who cheat the law. >> people think the only person that impacts is them and it's just an inconvenience to them they can't have their puppy everywhere with them but it goes much deeper than that. >> reports that pretending a pet is a service animal is

sab jose. this is in the almaden neighborhood of san jose. the fire started in the garage and spread to the second floor. it is now under control. officials say the family signed was awakened by the smoke alarm. we're told the home is actually up for sale and is listed at $1.4 million. there was an open house planned for today. the family says all of their belongings were packed inside that garage which went up in flames. the cause of the fire was under investigation. the latest on the devastation in oklahoma. president obama's expected to tour the destruction of the city of moore tomorrow. this morning, we're hearing chilling 911 calls for help moments after the tornado levelled the city. one of those calls comes from a man would was at a day care center when it was reduced to rubble. >> we have a day care full of babies. we need help bad.

>> okay -- >> we need help bad. we got a day care that just got cremated. >> funerals for the 24 people who lost their lives in monday's tornado will continue through the weekend. ten of the people who were killed were children. the youngest just four months old. new video this morning of the bridge collapse in washington. you can see the section of the bridge completely cave into the water. it appears to happen so quickly. investigators say a truck carrying an oversized load crashing into the side of the bridge likely caused that collapse. it ended up in the river. everyone survived but one woman remains in the hospital this morning. now, detour several miles out of the way. officials are trying to find a prefabricated section to replace

that portion of the bridge. no poison found. santa clara district attorney's office says it cannot prosecute the woman who was accused of putting poison inside containers in a starbucks in san jose. the story on what was really in that juice. >> reporter: last time we saw the woman, she was being released from jail and trying to avoid media to get home. accused of putting a deadly amount of rubbing alcohol in orange juice containers. kelly remembers it was quite a scare. >> some weirdo was putting stuff in the drinks and what's this world coming to and this is in our own backyard. it just seemed weird. >> reporter: by phone, the woman's attorney says the incident changed the 50-year-old's life. >> she'd been employed by

johnsons for ten years. immediately after this matter hit the press, she was suspended from her position. >> reporter: since the april starbucks scare, the district attorney's office has been reviewing the evidence and decided not to file felony or misdemeanor charges because test results show nothing harmful in the orange juice. >> the only contaminant in the orange juice was vinegar and we just concluded we cannot prove beyond a reasonable doubt. >> reporter: her attorney says she is relieved and hopes her life can return to normal. >> she didn't really do anything wrong but -- >> that kind of stinkings. i mean, if she really didn't do anything. she's got this fallout that she's going to have to deal with. >> reporter: we may never know what exactly happened inside this starbucks but the district attorney's office says it doesn't have a calls.

police are offering worlds of praise and a word of warning to a group of citizens that helped catch a masked arms robber who violently attacked a liquor store clerk. take a look at the video from the shop. you can see a macked r emasked behind the counter. a fight breaks out. the crook cut his neck and stomach before running out. several people started chasing the suspect through the parking lot. then across the street. scotty and his wife saw what was going on and joined the effort. >> should i tackle the guy, should i sweep him. but i went for the backpack, grabbed the backpack. he struggled a little bit. i got it free. >> really want to comment the citizens and the witnesses would were able to give us

"today in the bay's" kimberly terry explains. >> reporter: nine school districts are getting money from the state that some say is long overdue. >> this money is money state of california owes us for projects we've already completed.

at the time we build a number of our facilities, most of which predate my tenure in the district, we were not able to fully fund them. but needed them so we fronted general fund money. this is money that's been owed us for years. >> more than $57 million will be spread among school districts for construction projects that are already been completed in most cases. in castro valley, the money will go back into the general fund which is where the school district took the money years ago to pay foro je projects whi include the fine arts center. >> obviously, once we back fill the money that was front the in the past, we'll begin looking at what projects can we take on. >> reporter: like most school districts, it is looking at aging infrastructure and determining what projects need to be pryioritizprioritized. >> we are still one of the lowest funded states in the

special friends from pets in need are joining us this morning. we have lisa here with hugo who needs a new home. >> that's right. >> so cute. looks like a little poster dog. >> yes, he's a puppy. he's only right at about 4 months old. so he has a lot of growing left to do. he'll probably double in size. we thing he's pug, beagle, daschund mix. >> he's really cute. i don't think the tv does him justice. >> he is very shy right now but at the shelter we call him hugo-go-go. >> he's looking for an active family. >> the kids are out school, it's a wonderful time to bond with your furry family member.

>> thank you very much. if you want to know more about hugo or any of the other pets, go to the website, petsinneed.org. lisa, thanks for coming in today. we appreciate it, hugo. so cute. we want to update you on the story we first told you about earlier in the newscast. the crash on 580. two lanes still shut down because of the overnight crash and separate hit and run involving a chp cruiser. you can see on our real-time traffic camera that there is a backup. that's the part that's in red. chp says the truck initially hit sand barrels on the roadway, knocking them into the two left lanes. while the crews were clearing that debris, another car slam noodle a chp cruiser which was pulled over on the side of the road offering assistance there. the ch p officer did go to the hospital with injuries, but is
