thanks for being with us. it is 4:30. i'm marla tallez in for jon kelley. i'm laura garcia-cannon. let's first check the forecast with meteorologist, christina loren. good morning to you, laura and marla. good morning to you at home. this might be kicking off an abbreviated workweek. as you are making your way out the front door, count on slick conditions. we had shower activity roll through over the past three to four hours. right now, it is all clearing out of here. a little bit of aftermath this morning. a little bit of slick conditions. we are going to check the roads with mike. he is back. what i can tell you now is that we are in the 60s, headed toward the mid-70s. coming up, the triple digits on the way. here is mike. >> good morning. we are looking over here. i want to show you what christina is talking about. there is moisture in the air. here, through the oakland area and getting into the city, the midst ought to be enough to keep the roadways wet. through fremont, slick on the

roads, san jose, things are okay. this is the glow past 880 and the coliseum. you see the glowing lights and the sheen off of the roadway. be careful. the on and off ramps will be slick. it may take a little sunshine. just not out yet. back to you. it is 4:32. happening now, a wild fire is forcing thousands of people from their homes and campgrounds. the fire has grown to more than 1200 acres threatening 50 homes. u.s. forest service, garage and two cars have burned. 20-mile-per-hour winds are fanning the flames. crews only have it 10% contained this morning. the red cross has set up an evacuation center at santa barbara city college. as of right now, no local crews from the bay area headed to help out in the fire fight. they are read did i just in case. 4:32. a vallejo teenager who

disappeared has been found. a dive team was searching for 17-year-old kevin knight when they discovered his body. knight and another boy were playing in the water yesterday morning when he suddenly went under water. he yelled for help. the other boy thought he was joking and told him to quit playing around. signs are posted at the beach warning people not to swim because of a sudden dropoff and strong currents in the water. we are also learning new details about a hit and run crash that killed three young people from daly city. speed and alcohol may have played a role. the driver of a green mustang rear-ended a honda on hillside boulevard around 7:30 yesterday morning. the honda hit a retaining wall. the driver is expected to be okay. police think the mustang hit a different retaining wall breaking that car into two. three passengers were thrown from the car.

they all died atd t the scene. the victims were 22-year-old ruben vasquez and 21-year-old john voil la. >> he went to school and got all the credentials to become part of society. all he did was help people. he fixed everybody's car. >> police say the driver of the mustang, 26-year-old paul diaz, ran away from his scene, went into house before turning himself in. rusafala's family lives there and she drove a green mustang. he was booked on vehicular manslaughter charges investigators are looking for a teenage boy that burglarized an elementary school in fremont. the burglary happened in the principle's office. the school's principle reported friday's incident after she caught the teenage suspect burglarizing her office.

she told police he ran off before getting into a getaway car, which may be a cold buick la sabre. it is 4:34. this morning, two separate shootings in san jose killing three. two of the victims were teenage boys. dozens of friends gathered at a tree on reinhardt drive in east san jose late last night close to the spot where the teenage boys were shot on sunday. both boys were students at independence high school. just hours later on sunday night, someone shot and killed a man in south san jose. chuck reed says the police department continues to work hard even though they are stretched thin. we have one of the smallest per capita of officers of any big city. they are putting in overtime and working hard to keep the community safe. sunday's shootings now make it 19 homicides this year so far in san jose. that's compared to 16 at this time last year. san jose firefighters are speaking out against a

controversial idea from a city councilman. he wants to hire more police officers by reorganizing the fire department. councilman pier luigi aloe var yo repitched the idea after the 20 homicides. it stems from a fire report recommended fire crews respond only to fires and not to medical emergencies. 70% of fire emergency calls are not fire related. >> it is a matter of what residents want. we could raise city or reorganize and provide 110 more police officers tomorrow. last night, a spokesperson for the fire department told us the agency disagrees with the councilman's idea and believes it would put public safety at risk there could soon be new reforms at santa clara county board of supervisors. today, they will discuss publishing the calendars for review.

it would improve transparency and oversight of elected officials. a full vote could come as early as next month. the move comes after former supervisor, george, shirakawa resigned after saying he used public money for his gambling decisions. he is expected to be sentenced next montd. a major decision on prop 8 could come as early as today. it is more likely to be issued in late june. the high court could strike down prop 8, uphold it or dismiss the case all together, meaning larger constitutional issues would not be settled. justices are also expected to issue a ruling on the federal defensive marriage act. that case seeks to strike down a portion of the act which denies certain benefits to legally married same-sex couples tobacco retailers who want to set up shop in one bay city

we had some showers roll through over the past 15, 20 minutes. your doppler radar already drying out. as we head throughout the next couple hours, temperatures are going to stay nice and comfortable. like i said before, we are starting out in the 60s in many of your cities. san jose, sunnyvale, close to 60. in oakland, san francisco, 57. 58 to start the day, to start the day in livermore. that means by about 1:00 p.m., we will see plenty of mid-60s. today, warmer by about 10 degrees on average. comfortable conditions. the showers created beautiful air quality. the pollen levels have dropped off as well. 75, livermore. 78, fairfield. 75 degrees today in concord. mike is back. good morning to you. >> i want to give you this beautiful look at the decline coming off of the high-rise at the san mateo bridge. you can see in the background those twinkling lights on the east bay. that's great.

we can see that clearly even thou there is moisture in the air. we don't have any delays i was driving through fremont, slick conditions. south of the area on 880 itself, fremont cleared up getting into milpitas and san jose. a smooth drive past tesla and the auto mall parkway and the truck scales. farther toward the bay bridge toll plaza, you notice there is a little sheen on the roadway, still slick in spots around there. no problems at the maze and as low clouds whoever around, visibility is okay so far. 4:40. still ahead, president obama heads back to the jurscy shore meeting with governor chris christie. why some are pointing to the political impact of this trip. another fee tacked on to your plane tickets. this one isn't coming from airlines. who is proposing that increase next. another big night for the bay area boy injured in the

promised $50 billion, most for housing and transportation, a lot to help small businesses. >> we are going to apply for the grants governor christie has helped secure. new jersey is promising a timely comeback. >> the government is here for moments like this when one person helping another isn't enough. the state is spending $25 million to push tourism just in time for summer. the white house says the president will use this as an example of putting middle class families back to work. >> tracie potts, nbc news, washington. the red cross is taking heat for unspent funds donated for superstorm sandy relief efforts. month are than one-third of the $300 million donated to help storm victims is sitting in the bank seven months after the storm hit. the red cross says it is holding on to the money to help address needs that weren't immediately apparent after the storm. critics are calling on the red cross to give the remaining $110 million to local relief

organizations. the florida man accused in the shooting death of trayvon is back in court today. george zimmerman is in what may be his pre-trial hearing. zimmerman is charged with second-degree murder in the death of the 17-year-old last year. he his trial is set for june 10th. crews remove cars and debris from a bridge collapse in washington state. huge crane sitting on a barge in the river removed an orange suv from the fallen 160-foot section of interstate 5 bridge. washington state department of transportation says the operation will be done carefully given the instability of that wreckage. a temporary bridge will be constructed and could be done as soon as the middle of next month. the cost of flying is going up. this time, it is not the airline's fault for that and the rest of your news before the bell. we turn things over to bertha

cooms. the airlines say, don't blame us. we are not behind us. we do have futures point willing higher after the markets snapped their winning streak. we expect to see a higher open. last week, folks got a little skiddish after ben bernanke said the fed might start pulling back on its economic stimulus program sooner rather than later. the airlines meantime say if flight prices go up this summer, blame it on the obama administration. the white house is proposing an increase on taxes on air travel by about $14 a flight. the government says higher taxes are needed to help cut the deficit paid for airport improvements and add thousands of customs and immigration officers to reduce weight times for foreign flights. the airlines opposed that price saying it is going to backfire and that it is actually going to

good morning to you. giving you a live look out at the south bay. hard to tell what that is just because it is so dark. it is so early. we are checking that forecast. christina says it feels a little tropical outside today on this tuesday. it is 4:54. two bay area students will soon hit the stage in this year's scripps national spelling bee. they will take part today. 13-year-old audrey bancok and 13-year-old niha copakala are competing against 13 other students. it includes vocabulary. students must not only spell the words correctly, they must know what they mean as well. this is the first time in the bee's 86-year history that now vocabulary will be part of the scoring. 4:54. the world's tallest peak is

getting ready to celebrate 60 years of climbers. they are putting on the final touches for mt. everest's big climb tomorrow. an estimated 4,000 people have made it to the top. just last week, an 80-year-old japanese climber became the oldest man to reach the summit. we brought that to you on our 11:00 a.m. show. >> we did in the morning too. just so inspirational. >> an 81-year-old is supposed to be doing it, showing him up. >> no excuses. >> i am not yet 82. so i will wait until then and then set the record. we will look over here. another noelt fte for the city. we learned that muni line 13 and 14 is rerouting between 16th and 17th. you will see the police activity. we are tracking that. we are looking over toward the traffic getting into the city. low clouds hovering at the deck
