today's mary ann favro live in the bay. >> reporter: i'm here at fire station 1. this plan calls for having firefighters only respond to fires, not medical emergencies but fire department personnel tell me that this is not sitting well with them, because they say it could put the public safety at risk. the san jose city councilman, pier luigi oliverio repitched the idea after a violent weekend. three people were murdered in a four tsh hour period sunday. two of the victims were teenage boys. the proposal from a 2011 grand jury report that recommended fire crews only respond to fire. this report found 70% of fire department calls are not fire related. >> it is really a matter of what residents want and we could raise taxes or simply reorganize the way we do certain things in the city and provide you 110

more police officers tomorrow. the weekend murderings now bring the city's homicide to 19. on pace to match last year's total of 46 which was the highest it has been in 20 years. in the city, there are 33 fire stations. in one given year, they respond to about 74,000 different calls. they don't just respond to fires. they also respond to emergency services. at the san jose minetta international airport, at seven different hospitals and san jose state university. that is one reason why the fire department says this is not a good idea. reporting live in san jose marianne favro for "today in the bay." 5:02. the numbers are in. it is a sizeable increase in drunk driving arrests on this memorial day weekend. from friday evening up until this morning, chp officers arrested more than 1100 people statewide for driving under the influence. this includes 61 arrests in santa clara county.

that's about twice as many arrests from last year. officers also responded to two alcohol-related deadly crashes in the bay area. los angeles police have arrested a 26-year-old man who they think is a person of interest in the stabbing death of an 11-year-old boy. police say the deadly attack happened yet morning at an apartment in west lake district. the boy died from his injuries. our l.a. station is reporting the man arrested for the crime is the boy's stepfather. he was taken to the hospital for treatment after suffering an injury to the shoulder. investigators are now looking into what led up to that attack. we are learning new details about a hit and run crash that killed three young people from daly city. m police say speed and alcohol may have played a role. the driver of a green mustang rear-ended a honda on hillside boulevard. the honda hit a retaining wall and the driver is expected to be okay. police think the mustang hit a

different retaining wall breaking the car into two. three passengers were thrown from the car and they all died at that scene. the victims were 22-year-old ruben vasquez. 23-year-old rosa thia and 21-year-old jonathan muten's friends gathered at the scene of remembering his dream of being a mechanic. >> he accomplished that. i went to school. he got all his credentials. he learned everything he needed to learn to become part of society in a good way. all he did was help people. he fixed everybody's car. the driver of the mustang, 26-year-old paul diaz, ran away from the scen from the scene. he went into his home before turning himself in. he was booked on felony hit and run and vehicular manslaughter charges. we are following breaking news we want to get to in san francisco. police are on the scene in the mission district where a triple shooting just took place right

next to the b.a.r.t. station. "today in the bay's" bob redell is live in san francisco with the breaking details on the shooting. bob, what can you tell us? >> good morning to you. this took place at 16 and mission at the mission street b.a.r.t. plaza near wells fargo. if you are not familiar with the area, that gives you a pretty good idea. it happened in the plaza around 3:50. a little bit over an hour ago. there were three people shot. sfpd telling us at least ten people were hit and shot. two of the people have nonlife threatening injuries. all three have been taking to the hospital police say there have been witnesses. so they are interviewing them right now. csi, the crime scene investigators have arrived on the scene to process the evidence. there are markers out there. i'm not clear if those are shell casings or other bits of evidence. there is a second scene in the bayview. that's where police were involved in a car crash, they believe, with a suspect vehicle. according to one report, they do have the occupants of that

vehicle detained. all sfpd will tell us that they believe it is related, not exactly 100% sure whether those are the suspects involved in this or if it is something else going on there. three people shot around 3:50 this morning. two of them nonlife threatening. the other condition unknown. two hit in the leg, one in the torso. there is another scene in the bayview district where police were involved with the suspect vehicle. they have the occupants of that vehicle detained. they expect this section of mission street will be shut down at least for another 30 minutes. reporting live, bob redell, "today in the bay." thank you, we'll keep checking back. 5:06. a san jose child psychologist accused of molesting his patients is expected to be back in court this morning. 56-year-old john visher is charged with 21 counts of child molestation and child pornography. he abused at least four kids as

early as 2001. advocacy groups believe there are more victims suffering in silence. his victims are urging others to come forward. if convicted, he faces life in prison. now, to a preview of an exclusive investigative unit reports. a group of san jose state seniors say they are outraged. their university failed to take action against a professor who admitted to crossing the line in his office with one of his students. they first exposed that university officials did not discipline jeffrey mathis for a sexual encounter with a student behind closed doors last august. he called it consensual. she said it was an assault. now, the students are calling on university administrators to fire him because they say his behavior violates faculty guidelines. if the university is not going to do anything, we are going to raise awareness and do something about this. >> you can hear for from the sjsu students and see their

petition, tonight at 11:00. a horse is recovering after being rescued from a well in san rafael. it took crews several hours to cre t free the horse from the well. the horse, named buddy, was not seriously hurt. he apparently fell in when the well's cover broke yesterday afternoon. not a small feat pulling out a horse like that. the good ews, they used a crane and a veterinarian came out to help pull him out. they added water to raise the level of the well which helped raise the horse to the top. >> good teamwork right there. meteorologist, christina loren, take a look at our forecast on this tuesday. a lot of people starting off their work week. >> starting off their work week. a lot of people trying to get home from the long holiday weekend. we don't have any flight delays but we do have thick, low clouds. that could become problematic as

somewhere around the high-rise blocking the slow lane. i have been watching all these lights. as far as i can see on the foster city side of the high-rise, traffic is moving in all lanes. we will watch that and check from the hayward side. from the toll plaza view, things look smooth. somewhere along the stretch between the flat section and the top of the high-rise, reports of the slow lane being blocked. the person who called it in. be careful. we will track that as a bridge crew heads out. no problems and no delays. castro valley "y," a smooth drive out of hayward around san leandro. we are following 880 southward. a little slowing here around the interchange. heading over toward the dumbarton bridge, debris reported there blocking a lane. sounds like a slowdown because possibly a traffic break. chp says they have just cleared the scene. that might be why we see a little slowing going on there as well. a live look outside. the live censors over to the east bay. tri-valley, smooth drive.

instead of plugging a recharger in, attendants would remove the battery, swap it out for a fresh one and off you went. one of the biggest problems electric cars have. they take a long time to recharge. there is talk that tesla is thinking of the same sort of model for its cars. it already has an extensive series of recharging stations but we have expected ceo, elon musk, to announce a battery s h battery-swapping program. wall street and bertha coombs are back after a three-day weekend. she joins us at cnbc headquarters. good morning. pretty soggy here. that made it all the better for all those people that gorged on arrested development on netflix. futures higher. markets snapped. a four-week winning streak last week after fed chairman, ben bernanke hinted that the

chairman may be looking at starting to pull back. today, we are going to get data on home prices and consumer confidence. we have gotten earnings from tiffany's well ahead of expectations. the dow edging up eight points on friday. we will start date at 15,303. the nasdaq slipping a fraction, starts today at 3459. back to you. bertha mentioned online video, yahoo! has been bidding for the online tv service, hulu. the website, all things digital, which covers yahoo! more than any other company says yahoo! is willing to pay $800 million. hulu, a joint project between several tv networks, runs hundreds of television shows. hulu makes money. that's one positive. another is it would give yahoo! another outlet for some of its programming. that's another positive. you get a lot of discovery on hulu. the daley show and modern

toward the city. you can see right now, we still have that cloud deck covering at 1500 feet. it is not at the surface. this morning, i think that's where it is going to kind of stay put. it is trapping in the warmth from yesterday. that's the good news. we are starting out near 60 degrees just about everywhere. the showers that came through, at this point, we stop your real time doppler radar and you can see mostly dry. however, over the past three to four hours, we had some showers roll through the south bay. watch out. that's where we are expecting slick conditions until about 8:00 this morning. 57, san francisco, 55, napa. high pressure builds in. it is going to take a couple of days to really start to warm us up. as it does so, we are talking about a return to the dry, down sloping winds by this weekend. that will translate into triple digit heat and elevated fire danger. keep in mind, a very hot weekend, specially inland. today, not too bad. 75 degrees on the way to livermore. 71, fremont and 71 degrees today

in san jose means you don't need the a.c. or the heater this morning with temps so mild toward the 60-degree mark. here it comes. 80 degrees by thursday, friday into saturday. the 90s return. the warmest cities across the bay. we are talking metropolitan inland cities hitting 97. the triple digits are on their way to fairfield. >> he is keeping you updated. he is back on the job. good morning. we are looking out here toward the south bay. we are talking about back on the job. this was a holiday monday. a lot of times that has the ripple effect. we saw lighter flow on friday. a little bit lighter traffic tuesday. we will track this. we will show you the south bay right now. no major drama. the major roadways, highways and freeways moving smoothly. the expressways showing a big drive. no big buildup just yet. capital expressway was showing up a bit coming off of 101. it has calmed down right here through this portion of san

jose. to the east bay where we have the slowing, westbound 580 coming out of the altamont pass. coming in over towards vasco road speeds. with the orange, 45 miles per hour, 55 and 60 as you are passing by vasco. the volume is starting to increase there as well as highway 4 as you might expect coming off the antioch bridge. on the bridge itself, we had an earlier stall. sounds like everything has cleared from your commute coming down in towards antioch. pittsburg, bay point, speeds coming down to 45 through the stretch. once you reach bay point and concord, you are just fine heading over towards the eastshore freeway. it moves nicely on this map. we don't see any problems for the maze. it shows you as we are looking up towards berkeley and richmond. no problems as far as visibility for our drive. just 18 minutes off theo3f cbr.

traffic flow just fine into the city. hundreds of passengers on board a cruise ship that caught fire, they are tlon way home. royal caribbean says the more than 2200 passengers aboard its grandeur of the seas cruise ship will have flights back to the u.s. arranged today. fire broke out yesterday morning on the third deck of the ship as it sailed off the coast of florida. the ship never lost power and made it to a nearby port in the bahamas. luckily, no one was hurt. the cause of the big fire, you see it there in the front, is still under investigation. it is 5:20. senator john mccain made a is your visit to syria meeting with rebel leaders. he sat down with members of the free syrian army who asked for weapons and air strikes against the government. mccain is a member of the senate foreign relations committee which voted to provide weapons to moderate rebel groups. the u.s. military is looking to what caused a u.s. fighter jet to crash off the coast of

okinawa yesterday. the f-15 jet developed a problem which caused the pilot to eject. according to the japanese coast guard, the pilot was rescued via helicopter. o okinawa's governor says this could be disastrous if it crashed into a densely-populated area. running a marathon is a big accomplishment. how about running ten of them back to back to back. a group of friends willing to do just that. how their feat is helping the victims of the boston marathon bombings.

5:23. an inspirational story. a group of ultramarathoners in washington, d.c. have a bold plan to help victims of the boston marathon bombings. the men ran double and triple marathons to raise money for the families of martin richard, the 8-year-old boy who died in the bombing, as well as another man who lost both his legs. now, the plan is to run the money to those families and that's a distance of 450 miles. 90% is mental. the other 10% is mental. so part of it is in your mind. the other 10% is, you have to be out of your mind. >> the men are doing this as a relay splitting the distance into 26-mile increments. by the time they reach boston, they will have each done between 10-12 marathons. they expect the entire journey to take them five days. >> and how many pairs of shoes? >> and how many massages there after? >> hopefully, they will fly home. they deserve it. we want to check the forecast

with meteorologist, christina loren. you said it was breezy. it is a tad breezy out there. good morning to you, laura and marla. good morning to you at home. taking a live look at what we are expecting. by 4:00 p.m., 75 degrees inland bayside. around 70 degrees at the coast. we'll start with our look at the san mateo bridge. look at how beautiful this is. a little while ago, things were a little bit cloudy. couldn't quite see the peninsula side. a clear view, a clear drive. we are still tracking reports of a truck pulling a boat on a trailer and stallout on the high-rise. i haven't seen any slowing over the last 20 minutes. we will track that again. no delays coming off of the hayward side through castro valley, the castro valley "y," an easy drive as well. approaching concord avenue, sounds like there is some sort of debris in the roadway, maybe some boxines there.

no problems coming off of highway 4. i just showed this to you a couple of minutes ago. speeds coming down into the 30s and 20s at time out of antioch. there is the bill for highway 4. we will watch it take effect over 580. we'll send it over to you. thank you very much. in china, a unique auto race is now underway. nearly 100 drivers taking part in the fifth annual classic car rally. pretty cool. it took off just a few hours ago near the great wall of china. the race course stretches 7600 miles from beijing to paris. it is expected to last more than 30 days. the winner will receive a magnum of champagne. 5:26. we continue to follow breaking news in san francisco. three people shot near the 16th and b.a.r.t. station. bob redell is at the scene and he will give you an update coming up. up in smoke, one bay area city's plan to put a stop to smoke shops. we take you live outside the golden gate bridge.

jose. good morning. i'm marla tallez in for jon kelley. i'm laura garcia-cannon. we have an update to breaking news in san francisco. police are looking for a gunman involved in a triple shooting at 16th and mission barth statio.a station. new breaking details on the shooting, bob. possible suspects detained. more on that in a moment. i'll tell you what happened here around 3:50 at 16th and mission at the b.a.r.t. plaza. there were ten shots fired, three people hit, one over there to your right. and two more over to your left. now, two of these people were hit in their legs and another in their torso.

sfpd telling us two people have nonlife threatening conditions. the condition of the third is unknown. all three are at the hospital. police tell us they have other witnesses. it is not clear how helpful they are. the person or persons with the gun did get away. it is possible that they were caught. this is video just into our newsroom from cameron and nickels in the bayview. collided intentionally with an early model mercedes. they were trying to keep it from going away. results were what they wanted. they were able to detain the people inside, more than one person inside the car. sfpd tells us this is related to the shooting here at 16th and mission. if you have business in the mission district, b.a.r.t. station not affected. this is in the plaza, not blocking off the escalators. mission street is back open.

fanning the flames. they only happen about 10% contained. the red cross has set up an evacuati evacuation center at santa barbara city college. no local crews are there to help fight the fire. >> a vallejo teen who disappeared has been found. they were searching for 17-year-old calvin knight when they discovered his body at sandy beach in rio vista. witnesses say knight and another boy were playing in the water when he suddenly went under water. he yelled for help but the other boy thought he was joke and told him to quit playing around. signs are posted at the beach warning people not to swim because of the sudden dropoff and strong currents in the water. investigators are looking for a teenage boy that burglarized an elementary school in fremont. it happened in the principal's offer on grimmer elementary.

the principal caught the teenage suspect burglarizing her office and ran off before getting into a getaway car. there could be new reforms at the santa clara county board of supervisors. today, they will discuss publishing their weekly appointment calendars for the public to review. it would help improve transparency and oversight of elected officials. full vote could come as early as next month. the move comes after former supervisor, george shirakawa junior resigned in march after revealing to the public he used public money to cover his gambling addiction. it is 5:35. a major decision from the supreme court on prop 8 could come any day now. the ruling on california's ban on same-sex marriage could come as early as today but it is more likely to be issued in late june. height court could strike down prop 8 all together, uphold it

or dismiss the case, meaning larger constitutional issues would not be settled. the justices are also expected to issue a ruling on the federal defensive marriage act. that case seeks to strike down a portion of the act which denies certain benefits to legally married same-sex couples 5:36. tobacco retailers who want to set up shop in one bay area may have to wait a bit. today, the antioch city council will consider a temporary ban on new smoke shops. they site several concerns about the 12 shops currently doing business in the city. seven are located within blocks of schools and studies show minors that try to buy tobacco prod dugs in contra costa county are successful many of times. they have received complaints about loitering and crime outside smoke shops. good morning. 5:36. welcome to tuesday. yesterday, we were in the 50s. meteorologist, christina loren, it is warmer today. the reason why, laura and

marla, the cloud cover overhead. you can see it looks like a blanket. that's how it serves, like a blanket over the bay area trapping in the warmth from yesterday. these are your mid-level clouds. look at this. we also have some low clouds showing up in san francisco this morning. let me show you how it looks now via the golden gate bridge as you drive over the watt iter th morning. this fog is so thick here. it is going to generate a pretty steady drizzle as we head throughout the day. we don't have any flight delays but with all the fog, i wouldn't be surprised to see some go up as we head through the next half hour. marla is right. look at these numbers. 60 in san jose, 60 sunnyvale, 56 to start in gilroy. the coldest cities across the bay area are starting out close to 60 degrees. that means we will easily touch on the mid to low 60s by noon today. it is going to take a little while for that cool air to mix up and the low pressure system that came through yesterday. look at these numbers to finish out the day at 4:00 p.m. 75, livermore, 78, close to 80

knew ones that have moved on to the boardwalk and families that have not been able to rebuild their homes and lives as this entire effort continues. politically, we will see him again with republican governor, chris christie. the last time they made quite a buzz, it was just before the election when christi praised the president. now, he is running into a strongly democratic state that the president carried. the focus will be not only the jersey shore but the white house says the president wants to use that as a bigger example of economic recovery and how to get the middle class back to work. in the meantime, the red cross is taking heat for unspent funds that were donated for super storm standy relief efforts. month are than a third of the $300 million donated to help storm victims is still sitting in the bank seven months after

the storm hit. the red cross says it is holding on to the money to help address needs that weren't immediately apparent after the storm. critics are calling on the red cross to give the remaining $110 million to local relief organizations. >> organizers of a benefit comedy show hoping to bring laughter back to newtown, connecticut. less than six months since a gunman killed 20 first-graders and 20 teachers at sandy hook elementary. stand up for new town. george zimmerman will be attending what may be his last pre-trial hearing. that's when judge, debra nelson, will decide if certain evidence will be admissible in his trial. he is charged with murder in the death of 17-year-old trayvon
