sold at costco. what you should be knowing before making the breakfast smoothie. >> reporter: if you bought a bag of these frozen berries, costco is asking you to throw them away. we want to throw an image up on the screen so you can know what the product looks like. a blue bag labeled with townsend farms organic anti-oxidant blend, a frozen mix of cherries, blueberry, pomegranate and strawberries. the berries could be tainted with hepatitis a. this is after 30 people in five states have fallen ill. this includes a 62-year-old woman from east cocoa county. she has since recovered. between february and their voluntary recall, costco sold almost bags in cocoa county alone. >> don't eat this brand of

frozen berries. throw it away. if they have eaten it, in the past 14 days, contact their health care provider to protect themselves with a shot for hepatitis a. >> reporter: symptoms usually don't show up until two to six weeks after exposure. symptoms do include fevers, chills, jaundice, vomiting. if you have those berries at home, throw them away. that's what costco is asking you to do. bob redell, "today in the bay." new this morning, three children are safe at home after tidewaters stranded them in an estuary near the oakland airport. the oakland fire department posted this picture last night. it shows the kids being loaded into a rescue boat on a marshy island several yards from shore off of do little drive. the kids went out to the island when the water was low. when the tide came in, the water became too deep to get back to

shore. former golden state warrior facing charges after a deadly car crash. blalock was seriously injured and is still in the hospital. police hope to question him sometime today. the suv he was driving crossed into oncoming traffic. play lock is being charged with driving on a suspended license and failing to stay in his lane. two men accused of taking part in a brutal gang rape outside a richmond high school homecoming dance. this happened four years ago. we started hearing from the victim who will take the stand. to forget. a 16-year-old girl gang raped while other people watched.

this was outside of her high school dance as you said several years ago. two of the accused are going to court for a trial. they are facing a really rare trial. it is a dual jury trial. what it means is that when 22-year-old jose monta know and 22-year-old marcell less peter go on trial, two separate juries will hear different opening statements. one legal analyst says both juries will sit together and hear much of the same temperature. prosecutors say the 16-year-old girl who was drunk and going in and out of consciousness was beaten and raped by a group of men and teens while others watched in an outdoor courtyard after a dance in 2009. the victim is expected to testify. at certain times, evidence will only be admission i believe against one of the defendants. this is two of the reasons for

this dual jury trial. >> one witness says, defendant 2 and i did this together. that statement is admission i believe against the first defendant but not the second defendant. the second defendant has no opportunity to cross examine that statement. >>. >> reporter: he said this is real wi really a complex case, which is why it has taken so long to proceed through the criminal justice system. there are four others. two reach plea deals. two others are awaiting trial dates. both men on trial this week have maintained their innocence. reporting live, christie smith, "today in the bay." it is 5:05. five people accused in the murder of a south bay millionaire expected to enter their pleas in court this morning. three men and two women have been charged in a home invasion robbery and killing of robbery kumra at his mansion last november. one of the women, a suspected prostitute claims he gave her a sexually transmitted disease.

her brother is a suspect in the homicide along with a second suspected prostitute. mountainview police are looking for two robbers who seem to be luring their victims by arranging a blind date. two robberies occurred at the very same complex on corunna avenue last week. the men were told to bring $2,000 but when they showed up at the apartment complex, the two robbers came up from behind them, held them at gunpoint and knifepoint and demanded the cash. right now, we have some video to show you just into our newsroom. a massive tree down on lombard street in san francisco. take a look at this. it fell right on top of that car. public works crews are now heading to the scene near lombard and laguna street. at this hour, it is unclear what other damage was caused or exactly how long this mess will take to clean up. we will keep you posted. look at that tree just crunching

we want to talk to mike and see how we are doing on a monday. golden gate bridge, smooth drive getting into san francisco. the maps also. 101 across the bridge in san francisco. folks come off of the bridge, westbound, no problem. jon just showed you the dramatic video with the tree across the cars. that has blocked the westbound lanes from what i'm told. there is traffic control at laguna. westbound, major impact. eastbound, going to be a spectacle. we will watch for the impact. so far, the censors are showing us a smoother drive. we will try to show you the video if you didn't see it earlier. san mateo and dumbarton, a stall. palo alto, live shot. light volume of traffic. folks are able to get by. on the other side of the bay, we are looking at fremont. a smooth flow of traffic.

for three san francisco police horses. that's hammer, rebel and magnum. they are retiring from their duties as faithful four-legged police officers, i guess i could say. in recognition for their service, police chief greg sir will be on hand nailing the retirees horseshoes on the mantle at lefty o'doole. the chief will feed a breakfast bucket of carrots and apples to the retired horses as well as two new rookie horses at the horseshoe hanging ceremony. apple set to fight in court over the way it prices its electronic books. scott mcgrew, a case it could easily lose. >> they will go down swinging for sure. even the judge in the case says she is pretty certain apple is going to lose its okay. it was brought by the federal government which accuses the company of price-fixing. the case so strong, all of apple's co-defendants, the book publishers have settled.

the 49ers coaching staff happened to be there with their family for an event when the tree split in two. offensive coordinator, greg roman, was hit by a branch. he was scratched up. we are being told he was all right. crews finally cleared that tree yesterday. palo alto city leaders will meet to talk about shrinking the council. they are proposing cutting the city council from nine down to seven. they also want to extend the term limit from council members from two consecutive terms to three. the group says other bay area cities ruffle the same size at palo alto have smaller councils. ships sailing into california ports have some new traffic lanes to follow this week. federal marathon officials and the shipping industry designated the new lanes in an effort to steer clear of whales and their feeding grounds. migrating whales are prone to ship strikes because they are out there being lured to the california shorelines in years where there are a lot of krill

to feast on. thousands of residential care facilities across california are trusted with keeping our loved ones safe but our investigative unit has uncovered some of the most vulnerable residents, the elderly and disabled are not being as well protected as they could be in emergencies. we found over the last ten years, fires have claimed 11 lives at residential care facilities in this state. experts say a key mechanism may have saved lives. to prevent more tragedies from happening. we spoke with connie cruise. a fire swept through this care home in 2011. >> at least it would have helped. maybe some of them would have survived. i wonder what was going through her mind.

three people were shot near the intersection of 13th and webster just a few blocks from the 12th street b.a.r.t. station. we talked to police. they believe all the victims will survive. they have not made any aest are arrests. one person was killed and two others injured after a shooting near international and 90th avenue. san jose police are working overtime to stop a sudden increase in gang violence. police held an emergency meeting over the weekend. they boosted the timing and number of their patrols. police arrested four alleged gang members in a rival gang member's territory. last week, san jose saw five homicides in a span of just seven days. police say they will do everything they can to fight gang violence. >> now, to a health warning you

they will lose. they were so convinced this case was doomed in court, penguin settled for $75 million. apple is going into court this morning and it dates back to steve jobs and the introduction of the ipad. apple started offering electronic books to take on amazon and kindle. amazon had priced every book at $9.99. publishers had little choice. amazon had the only practical reader. it wanted electronic books to be cheap so it could sell for kindles. steve jobs proposed a different pricing scheme. throw in with apple and see if we can all make a go of this to create a real mainstream e books market at $12.99 and $14.99. apple's current ceo told the wall street journal he doesn't see what all the fuss is about,

all eyes on the u.s. supreme court. they begin issuing ruling on major issues. among the decisions expected, california's controversial ban on same-sex marriage and the federal defense of marriage act. tracie potts live on capitol hill this morning. tracy, announcements and rulings like this usually take a pretty long time. what kind of time frame are you sensing we could expect before hearing a decision on prop 8? >> it is possible it could come this week or even today but more likely, these more controversial decisions tend to come at the very end of the term. we might have to wait until the

last monday or the very end of the month until we hear more. what this court says typically it could have a big effect on what other states do now that there are other states that have started to legalize same-sex marriage as well. there was another case that was linked to this, the defensive marriage act. california looking at state laws. the defensive marriage act looking at the federal government, one man, one woman marriage act and how that affects federal benefits, the person suing got a huge bill from the irs after her partner died and their marriage in new york was not recognized. so we wait to see what the court is going to say on both of those. not to mention voting rights and affirmative action. lots of cases still out there. nbc news will have a reporter and camera inside the court when the ruling, whenever that is released.

we will break in with a special report when an announcement is finally made. you can always get the latest information on our website, nbc bay area.com. p haing now, crew rs battling that fatst-moving brus fire. it has destroyed six homes and damaged nine other structures. the so-called power-house fire is burning about 60 miles north of los angeles in the palmdale area. thousands of firefighters are working to gain the upper hand on those flames, including 20 firefighters from santa clara county. the l.a. county sheriff's department estimates 2800 people and 700 homes are under evacuation orders. they are expected to be out of their homes until late today or tomorrow. this morning, the fire is about 20% contained. the search is expected to continue this morning for a sacramento teen possibly swept over a waterfall in yosemite. witnesses say, 19-year-old ala callman was swimming when he suddenly disappeared over the

edge of nevada falls. the river's current was moving very quickly when he disappeared saturday. he was at the park with members of his church group. at this point, no word on exactly how long they think the search will continue 5:45. the central valley railway shut down after a targ go train jumped the tracks and crashed this weekend. the train was traveling through denere, a small town 15 miles south of modesto. 15 train cars derailed yesterday afternoon. one witness said the train appeared to be going unusually fast. sheriff's officials say the train was not carrying anything hazardous. the tracks will be shut down at least until tomorrow for this investigation. >> it is 5:45 right now. if you haven't had the chance to get outside the door, christina loren, i hear you saying that maybe you want to grab a jacket. a little crispy out. >> it is a little bit crispy out there this morning. nice. a good time to open up the windows. it is going to be warm later on.

francisco's glide foundation which helps the city's poor and homeless. not only is consumer confidence the highest it has been in five years, so too is consumer sentiment which leaves us to ask, what's the difference? >> there isn't any, actually. on tuesday, the conference board released their consumer confidence numbers. the university of michigan does a similar study. it is forced to use different words. u.n. calls it sentiment. it gave us those numbers on friday. you say tomato. i say tomato. you are looking at a five or six-year high. it comes down to willingness to shop. good news. the theory is that households, particularly upper class households are making big money in the big rally on the stock market. they take those profits and spend them. that consumer spending makes wall street feel good, which causes a rally in stock prices and makes consumers feel good.
