>> marla tallez in to laura garcia cannon. three people now in the hospital after a triple shooting in oakland. all three were shot just hours ago near the intersection of 13th and webster just a few blocks from city hall. police have wrapped up the investigation at the scene. they believe all victims will survive. the person who pulled the trigger is still on the loose. they will be holding a news conference to talk about violence plaguing the city. >> a trial about to get underway for two men accused in a brutal rape. wept on for hours according to prosecutors. as you said, for the first time, we're going to be hearing from the victim who was just 16 years old and a student at the time. two of the accused are facing a rather unusual trial. one 22-year-old jose montano and 20-year-old marcellle sechlt peter go on trial, two juries will hear different testimony. they say she was beaten and raped repeatedly while others stood by and watched. it happened nay courtyard at richmond high school after a the defendants are accused of basically the same crime. certain evidence will only be admissible against one at a time. the fact the victim is telling her own story, this all leads up to a dual jury trial.

>> she has to relive the events of that night. you don't want to make her do that twice. it is bad enough to have her do it once. >> reporter: he tells us this is a really complex case. this is why it has taken so long for the trial. there are four other defendants on this. two others reached long sentences in prison. two others are awaiting trial. this trial starts this afternoon and is expected to run about six weeks. reporting live in martinez, christie smith, "today in the bay." we want to give you a little heads up if you commute over the richmond, san rafael bridge. you should be bracing for possible delays. the lanes approaching the richmond toll plaza have been shifted to cre it aan "s" curve arou around the construction. the speed limit has been reduced to 45 miles an hour. replacing the bridge decks and expect the projects to be finished up in three months. >> 6:03. bay area health officials say a recent case of hepatitis a has

been linked to an outbreak of the disease and frozen berries. they think the berries became contaminated and what costco is doing about it. good morning. >> what they are doing is asking anyone who bought these bags of berries to just throw them away. this is what they look like. they are a blue bag of frozen berries, labeled with townsend farms organic, anti-oxidant blend. costco issued this warning last week, that the berries could be tanlt tan tainted with a strain of hep a. around 30 people in five states have already fallen ill, including a 62-year-old woman from eastern contra costa county. she was hospitalized after eating the berries she had bought from a costco in her area. she has since recovered. between february and this voluntary recall, costco sold

almost 900 bags of the berries in cocoa county alone. >> we are most concerned that people that have this brand of frozen berries in the freezer don't eat it and throw it away. if they have eating it, particularly in the past 14 days, we are asking people to contact their health provider and find out if they can get a shot to protect themselves from hepatitis a. >> how did this hep a strain end up in the bag of berries. it was most likely transmitted by an infected food handler. symptoms don't show up until 2-6 weeks after the exposure. these are some of the symptoms you can expect. if you have the berries, throw them away. reporting live, bob redell, "today in the bay." >> happening right now, at least 2800 people still out of their homes while a wild fire rips through the mountains, 60 miles northeast of los angeles. the so-called powerhouse fire

pretty certain apple is going to lose this. the federal government accuses apple of price fixing. the case is so strong all of apple's co-defendants, the book publishers, have settled with the feds. there are subtleties with this case. we are going to go over some of them. apple has reached deals with warner music, publisher of such band as the grateful dead. to create iradio. the service could be introduced as early as next week at the worldwide developer's conference in san francisco. if you are a music fan, this may be a whole lot of fog. a big deal for apple. they finally get into the music streaming business. other options, all free, have been around for years and run on your apple devices already. if anybody should take note of this, people who own shares of pandora. looks like we will see a minor move on the markets to the side.

back to back weekly losses. down. dow is at its five straight months of positive gain. the last time that happened was 95. on friday, we get that economic data of the jobs report, which is easily theiw' most important number we get as far as the economy. >> very good. thank you, scott. well, having a paid internship could pay off when it comes to finding a job. good news. a new survey showing 2013 college graduates had a much better chance of scoring a job if their internships were paid. according to this survey by the national association of colleges and employees, 63% of 2013 grads with paid internships received those job offers. 37% had unpaid internships and job offers. that's only slightly higher than the rates for grads with no internship, 35%. the survey also found grads with paid internships had much higher starting salaries than those

here is 101 coming up through the area. confirming what we saw on our censors. crews over here traditionally. 101 to 380. if you are 20 minlths utes to hn hour late for the morning commute, a burst of traffic comes through. that's what's causing this traffic backup. slow heading up into millbrae past sfo right here and over towards 380. 280 very clear. we will track it. i have heard nothing about any eto beyond 6:15. right now, 6:20, we'll see. farther south as you are heading north on the peninsula, things are moving smoothly through palo alto. 280, great drive on that side of the bay. in the south bay, slowing continues to build. north 01, second burst. this one hits and six from now. slow from 680 toward 880. 280 and 85, not a problem right now. the tri-valley moves smoothly,

protesters killed hundreds on june 4th, 1989. opening arguments are set today in the court-martial of a former marine accused of leaking classified documents to wikileaks. 25-year-old bradley manning said he wanted to show the public how america was really fighting the wars in iraq and afghanistan. he faces 21 counts of espionage. he could face life in prison if convicted. an alleged mob boss on the run for 16 years finally being brought to trial today, james whitey bu whitey bulger charged with playing a major role. bulger was captured two years ago at his home in santa monica. >> a tough week in capitol hill. hearings get underway. the acting irs commissioner.

deals? the e monday, june 3rd. this is "today in the bay." good morning. look who is back. it is 6:30. i'm marla tallez in for laura garcia cannon. >> i am glad to be back. >> thanks so much. i am jon kelley. good morning, everybody. apple heading to federal court to defend itself against charges of a conspiracy to raise the price against electronic books. scott, apple going to trial alone after five publishers cut a deal with the government. some people are asking, would it be smarter for apple to seek a settlement instead? >> the judge in the case is asking that. you know it is going to be a long day in court when the judge says she thinks she is going to lose. why is apple fighting?

because the pricing agreement it made with publishers is fundamental to apple's business model. they take a flat cult of everything they sell, books, apps, movies and music. i think apple's fear is if they settle out of court on the books issue, the conditions of that settlement with the department of justice would affect its other businesses. apple simply cannot afford for that to happen. the case dates back to steve jobs. in the introduction of the ipad. that's wheneá apple started offering electronic books via its ibooks store to take on amazon and its kindle. amazon has priced every book in the store at $9.99. steve jobs proposed a different pricing scheme in an e-mail to rupert murdoch, a publisher. he said, throw in with apple and see if we can all make a go of this to create a real mainstream

there. no chp, crashes or stalls for the area. look at the slowfm northbound. building out of burlingame up towardspc< sfo. it does look like the crews that i see on scene are moving. that might be better news. chp has no upd far as any activity. 280 meanwhile moves smoothly toward 380 where you can move over and take 101 into the city, if that's what you choose. the rest moves smoothly along the peninsula. highway 84 moves nicely over on the=%k peninsula side. southbound 880 through hayward, ahgt typical build there. here, very slow now for 680 southbound. lower as you are coming down through pleasanton. 84, tough livermore. over toward that dublin interchange, we move over toward the approach. the city moves nicely along the bay bridge.

the backup at the toll plaza, the slow drive across the bay bridge. lumbar street moves very slowly through city streets. eastbound, that's the red zone. westbound, we have slowing towards laguna. that is usually not there. jon, i am going to hand it off to you. i think you have a clue as to what might be going on.iññ this new video. a massive tree down on lombard street in san francisco fell on top of a car. police, they have actually shut down the westbound side of lombard. they are diverting traffic now at laguna street. so iwlfar, good news as far as injuries. no reports of any at this point. it is unclear how long it will take to clean up that big mess. we want to update you on the powerhouse fire burning in southern california. about 3,000 people from some 700 homes are under evacuation orders as this wild fire burns through dry brush north of los angeles in the angeles national forest. good news.

we have just learned the fire is now 40% contained. so crews are making some head way on this. it has destroyed about six homes and damaged about 15 other homes. 6:36. powerful storms could delay a cross country flight for the first air croft powered by solar energy. the powerful storms ripped through the midwest damaging the hangar where the solar plane is scheduled to land. solar impulse announcing it will use a revolutionary inflatable hangar to replace the one damaged at the st. louis airport. the solar-powered plane started its journey here in the bay area taking off in early may. a semi truck inside of a swirling tornado. look at this. incredible new video just into our newsroom. >> that's such terrifying, scary

several dozen people are being treated for injuries. the fire may have been sparked by three explosions in the farm's electrical system. nine students and a policeman dead after a suicide attack in eastern afghanistan. 15 other students being reported hurt. the local police chief says a local school had just let students out for lunch when a bomber on a motor bike set off explosives. the attacker may have been targeting a past military patrol passing by the area at the same time. >> intense new video to show you of a semi truck being flipped over by a tornado. it was shot by a storm chaser. back on friday on interstate 40 just outside of oklahoma city. the truck actually collided with the storm chaser before the big rig was flipped.

happening right now, a wild fire, that crazy one down there in southern california called the powerhouse fire forcing almost 300 people to evacuate from some 700 homes. the fire just continues growing in size this morning. it is now 46 square miles of dry bush north of los angeles in the angeles national forest. a little reference, that's almost the size of the entire of. we're being told at this point so far six homes destroyed, 15 others have been damaged. right now, this fire is at about 40% contained. new this morning, extra security patrols will be at pleasanton middle school this morning after someone left a threatening note on campus. the school said the threat was discovered written on a wall in the girl's bathroom.

robbed and beaten after a high school dance in richmond. is going t be sharing her story for the first time in a courtroom while two of the accused are facing a rather unusual trial with two juries. 22-year-old jose montano of richmond and 22-year-old marcellles peter said they are innocent. they will hear different opening statements. both juries will hear much of the same temperature and sit in the same courtroom. prosecutors say the girl was drunk and in nd aout of consciousness when she was raped by a group of men and teenagers after a school dance in richmond high school in a courtyard while 20 others watched. this was in 2009. the fact a victim will testify, another reason for having two juries. >> she literally has to relive the events of that night. you don't want to make her do that twice. it is bad enough to have her do it once. >> he says this is a really complex case, which is why it
