>> announcer: from nbc news, this is "today" with matt lauer and savannah guthrie. live from studio 1a in rockefeller plaza. good morning, everyone, welcome to "today" on a tuesday morning, i'm savannah guthrie. >> and i'm matt lauer along with al roker and natalie morales. a lot of fireworks expected on capitol hill today. not only over the military assault cases. but also, you've got the growing scandal in the irs. >> the leaders of the conservative groups who were targeted are going to testify in a separate hearing today. have a lot more on that in a moment from nbc's lisa myers, but we want to begin at the pentagon. mick, good morning to you. >> good morning, savannah. all the military's top brass are marching up to capitol hill this morning where they're sure to face a tough grilling on a rising number of sexual assaults in the military. this on top of the latest incident at the elite naval academy which allegedly involves a volatile combination of sex, alcohol and football.

>> officials confirm, three navy football players are under investigation for allegedly say salting an unconscious female mid shipman at a party last year. when her client reported the incident, she was disciplined for drinking. but the three football players went unpunished and permitted to finish the season. >> the message sent loud and clear is she was getting in trouble for coming forward and nothing was happening to the men involved in the wrong doing. >> the alleged incident occurred as sexual assaults in the military rose to record highs. the pentagon estimates that sexual assaults skyrocketed last year from 19,000 to 26,000. that includes two recent incidents involving military members entrusted with protecting victims against sexual abuse. one has been charged with sexual battery.

pressure's now growing in congress to change the military culture that often protects the accused by changing the way the military justice system pursues and prosecutes sexual assault cases. >> these have to be treated like the crimes they are. these are crimes of violence, crimes of aggression, crimes of dominance. >> at this year's naval academy commencement, president obama told these graduates sexual assault poses a serious threat to the entire military. >> that's why we have to be determined to stop these crimes. because they've got no place in the greatest military on earth. >> one senior was missi not allowed to graduate pending the investigation into the latest academy sex scandal. >> and what's going to happen on the hill today, there's one proposal to remove the authority from commander to determine whether these cases go to trial. how is the military brass likely to respond to that? >> well, for the first time, we're hearing from many lawmakers, most of them women as you can imagine who are more

encouraged than ever that there will be some change. they think it'll be incremental and they've got a long battle ahead of them. but all this public attention is already making a difference. this victim at the naval academy, this alleged victim apparently came forward. she was encouraged by all this attention to seek out a lawyer. in the private sector, though, not a military attorney. savannah? >> we will hear more about this today, jim, thank you very much. matt? all right. the scandal involving the irs is also front and center on capitol hill this morning while new details are emerging about the agency's excessive spending on lavish conferences. nbc's senior investigative correspondent lisa myers has the latest on this. good morning. >> matt, good morning. today conservative groups improperly targeted by the irs get their turn before congress. and the inspector general who called what happened unprecedented is expanding his investigation. and those conferences, well, wait until you see what some

speakers were paid with your money. ♪ >> reporter: we've all seen the dance video. but for irs employees whose moods weren't improved by that. >> hey, this isn't so bad. >> reporter: the agency paid more than $11,000 for a happiness expert. $27,500 for an innovation expert and $17,000 for an artist who painted abraham lincoln and michael jordan during a session on leadership through art. this lavish spending, $50 million for conferences came during the same period as the agency was coming down hard on tea party and other targeted groups. singled out through what's known as a be on the lookout or bolo. a list of criteria that triggers extra scrutiny. >> ordered recommendations -- >> reporter: now the inspector general is investigating other bolos used by the office in cincinnati. who initiated them?

and why? sources familiar with the process tell nbc news that some bolos underreview or dictated to the field office by washington. >> we don't know everything by far at this point. what we know is bad enough. >> in an interview with nbc, former irs commissioner mark everson called for bipartisan select committee of the house and senate to thoroughly investigate while defending the overall integrity of irs employees, everson appointed by president george w. bush criticized bungling at every level, especially by senior officials who told congress conservatives had not been targeted. >> it was just tragically wrong to say there was no targeting. and then not to correct the record when it was clear that wasn't the case was also sort of shocking. >> the new acting irs commissioner danny werfol vowed to restore public trust. >> this agency is founded on a

principle of operating impartially and we failed in that most basic core principle here. >> now he promised to cooperate with all investigations. but congressional sources on both sides of the aisle say the irs still has not turned over a large number of documents requested by the senate and due last week. matt? >> lisa myers in washington. thank you very much. another major story in the world of politics. the dilemma now facing new jersey's republican governor chris christie. who will he choose as a replacement for the late democratic senator frank lautenberg? it is a political hot potato. chuck todd is nbc's political director and chief white house correspondent. chuck, good morning to you. >> good morning, sir. >> i think the "new york times" summed it up pretty well. normally a governor would love to have this opportunity because it gives that person a chance to have an impact on national politics, but there's a lot of personal political risk for chris christie. take me through it. >> there is. and timing is everything. he's in a re-election year.

and any time you introduce a new factor into all of this is always unsettling. he's been in a glide path to re-election. he's got a democratic challenger, but she's far behind. chris christie is on the verge of getting a whole bunch of bipartisan support. you have president obama with him virtually campaigning with him, though, of course, not endorsing. this is now actually a lot trickier than it should be. >> let's talk about his options. frank lautenberg was a staunch liberal, democratic senator for years out of new jersey. christie could on an interim basis appoint a democrat. what's the fallout from that? >> if he has any interest in being president of the united states and the republican nominee some day in 2016, he cannot alienate republicans by somehow preventing them the opportunity from getting a u.s. senate seat. mark my words, he will not appoint a democrat. >> let's say he appoints a republican on an interim basis and sets up a special election. let's say it happens in

november, that might put a guy named cory booker on the ballot for that seat. what does it mean to chris christie? >> well, that could mean that the democratic candidate for governor gets a lot of help. cory booker's very popular, could end up getting more african-americans to come out to the polls, but there's another option here, matt, there is some sort of legal uncertainty here in the law in new jersey, there's conflicting law here about when a special election should be held. the strictest ruling of the law would indicate chris christie, the governor's going to do the most strict reading of the law. what put the special election, matt, in october of this year a few weeks before the general election. now that would cost extra money. >> right. >> there may be pressure for him to put it at the same time. but he could end up calling for the special election and having the election in october. that means probably an easy win for cory booker or my any democratic nominee and saves him from any possibility. but, you know, republicans here

in washington, matt, they want this election at the same time as christie because they think they think christie helped their potential candidate. >> chuck todd in washington, chuck, thank you very much. there are new developments this more on the fight on that massive wildfire in california. >> good morning, everyone. hundreds of people in homes are still staring down the threat of on wildfires north of los angeles this morning. nbc's ayman has the latest from lake hughes, california. >> what difference 24 hours makes. yesterday evacuation orders were in place for about 3,000 people. it is a sign that firefighters have momentum on their side. really, the weather speaks for itself. for the first time in several days, as you can see behind me there is a marine layer that has set in on lake hughes. right now, that 33,000 acre blaze has been contained, up to nearly 60%.

no jury, i don't see much risk of a taint here. >> the crime scene photos rather extraordinary evidence leaked to the press since we have seen and you've examined the photos, do you see anything forensically from your standpoint that helps the defense or hurts the defense' argument? >> both sides in this case concede that oscar pistorius is the one who shot and killed his girlfriend through the bathroom door. the question is why? was it a mistake and when you look closely at the photos the shots are through the bottom half of the door, consistent with his story he heard a sound, he got up, didn't have time to put his prosthetic legs on and instead went on the stumps of his legs and shot to the too from a low angle. >> we mentioned a couple seconds ago a judge will determine guilt or innocence in this case. normally a defendant wants a jury trial. you have a different take on this. you actually think it benefits potentially oscar pistorius that

sweeping turkey over the last few nights and the young protester who has now become known as the woman in red. take a look at this picture, there she is in her cotton summer dress, necklace and white bag and she's of course being sprayed with tear gas by the turkish authorities. reuters news agency says the picture has become somewhat emblematic of what's happening in turkey these last few days as citizens starting protesting the removal of a park, really exploded into protests around a couple of cities in turkey so this is one of those pictures coming to stand for what is happening in turkey right now. turkey, of course, a popular search term at the moment as well. that's an example where maybe a picture is worth a thousand words. this case maybe not so much. this photo stirring emotions for different reasons. is it real or is it a hoax? a picture of an apparent taco bell employee licking those shells. >> i got to tell you -- >> -- was posted to the fast food chain's facebook page

>> salute the flag right there. >> that was great. another topic that is still generating a lot of conversation online, the deaths of three storm chasers, they died while tracking friday's devastating tornadoes over in oklahoma. so will the tragedy be a game changer when it comes to extreme weather coverage? let's bring in the weather channel's jim cantore on this and, of course, al is with us as well, and jim, we need to separate groups here. there are people who do this for science, there are people who do it for research, then there are the people like you who cover it as a weather event. there are also some amateurs who go in there for danger's sake. will this change the game when it comes to a couple of those groups? >> you know that's a good question, matt. you know, certainly the media has to look at crews and how they position them in this because they're not experienced storm chasers like the spotters are and also the scientists. the thrill seekers are out there and i don't know how they can be monitored or certainly kept out of harm's way but there were certainly too many people on the road. we've known this for years and the numbers have only grown and
