good morning, everybody. it is 4:30 on the nose. happy to have you along. i'm jon kelley. good morning. i'm marla tallez in for laura garcia-cannon. let's take a look at the forecast with christina loren. temperatures this morning are pretty crisp to start. plenty of 50s out there. 54, livermore, 55, oakland, 60 degrees in sunnyvale. the big story is the warmup that starts today and kicks into high gear friday and saturday. i'll let you know how hot it is going to be in your city and how hot that heat is coming up. first, i want to check your drive. >> these folks, a little closer than us. they should be done with their workday pretty soon. we are looking at the northbound side of 880 where there is construction. we're following an earlier crash at high street. i've been watching the few cars that are getting off there. the construction crew still there. they will be there until just after 5:00 this morning. we are looking at a drive south

of there, for 880. no problems on the peninsula. we will track things farther south. >> this one has a lot of people's attention. your personal privacy violated. a brand new report appears to confirm the u.s. government is operating u.s. surveillance. verizon providing phone records for some businesses to the u.s. government. the report says a highly classified court order requires verizon to hand over information to the national security administration on a, quote, ongoing daily basis. all that data includes phone numbers and duration of calls. it does not contain contents of those calls. christie smith will be live at 5:00 with a more in-depth look and scott mcgrew will tell you what it means for you. in a little more than 12 hours from right now, president obama is going to be landing in the bay area.

we want to give you a live look at downtown san jose where the president is going to be staying tonight. tonight, some barricades up. parking signs are up to keep the roadways clear. barricades are in place. president obama will leave the white house about 9:00 this morning. he is going to stop in north carolina before arriving at moffett field about 6:00 tonight. >> we can also tell you mr. obama will first attend a reception in palo alto. then, he will head down to puer portolo valley and before he leaves on friday, he will dlib a statement on obama care. >> we are going to show you the home where mr. obama will attend the dinner. it is the home of the co-founder of sun micro systems. the menu of the fund-raiser will include a greek salad and chicken breast saltimbaka.

managing to pull a 61-year-old woman from all the rubble after a building collapses leaving six people dead. the woman reached out for them more than 12 hours after a vacant four-story building crashed down on to a thrift store yesterday morning. she was rushed to the hospital where she remains today in critical condition. that woman was the 14th survivor rescued from that wreckage. she was the very last person unaccounted for. now, as mentioned, a total of six people were killed during that collapse. the building was in the process of being demolished when a part of it gave way crashing on to the thrift store. people say that store inside there, they heard several noises that sounded like explosions and then the ceiling started to fall. most of the victims, they were inside that thrift store. the wife of an employee who was killed says she spoke to her husband on the phone just 15 minutes before the collapse.

>> my daughter called me and she said, mommy, put the tv on. i put the tv on. it was bad. 22nd and market. i call. i took out my phone right away and i call him. he didn't answer me. we had just put the phone down 15 minutes. so i call him again. he didn't. i've been calling him. he never answer. >> beyond heartbreaking there. the cause remains under investigation this morning. authorities say the building has no prior violations san jose police are investigating the city's 22nd homicide after a man was killed while trying to save a young man with disabilities from being beat up. the family of 58-year-old francisco lugo says he died tuesday morning after he was hit on the head on saturday. they say he came to the aid of a

young man being picked on by three other men on north 12th reet. that's when the men turned on lugo. after he was attacked, he was dragged to a nearby home and put on the coach without anyone calling 911. >> they are not sure how long my dad was in that house. we know when they got inside, my dad was sitting next to a woman, sitting there drinking water when my dad was dead. >> the family will hold a memorial car wash saturday in san jose to raise money for a funeral that will happen at white road and monta vista drive. today, san jose leaders will hold a prayer vigil to honor victims of recent violent crimes. six people have been killed in san jose since memorial day weekend. mayor chuck reed and san jose's fire chief and deputy district attorney will be the speakers. we have a follow-up for you this rng month. the san jose police department says criticism over its response

to reports of a prowler at a local elementary school is unfounded. administrators say police twice failed to respond to calls about the alleged prowler on campus earlier this week. police say they did respond after investigating higher priority calls. when the prowler returned the very next day, of tficers were scene within four minutes. the man was later arrested after a burglary call in the area. a brand new charge against george shiarrakawa jr. this time, felony discrimination. he mailed phoney fliers to discredit a candidate. they were meant to can loo like it was from her campaign but evidence on one of the mailers matches his dna a protest in san francisco

wednesday to close at 14960. the nasdaq losing 43 points closing at 3401. meanwhile, microsoft to end the fbi are working with authorities in 80 countries to launch an assault on one of the world's biggest cybercrime rates. the group is believed to have stolen more than half a million dollars from bank accounts over the past 18 months. the hackers used this to take over 5 million p.c.s around the world using them to steal from dozens of financial institutions, including american express, bank of america, city group and paypal. finally, craving a big mac and hash browns. the golden arches is here to please. mcdonald's plans to start serving a limited number of breakfast and dinner items between midnight and 4:00 a.m. at some of their restaurants. you can mix and match and order that egg mcmuffin and fries.

garment factory building in bangladesh is out of the hospital this morning. the 19-year-old seamstress briefly talked to reporters outside the hospital this morning. we do have video of that young woman on the day she was actually pulled out of the collapsed building. she says she will never, ever go back to factory work and she already has a brand new job. she will be work nth house keeping department at the westin hotel in bangladesh's capital. new details about the raid on a senator's office at the state capital. the "associated press" is reporting the fbi searched the office of senator ron calderon tuesday night as part of an investigation into legislation he introduced for a los angeles area water district. they were spotted leaving the office with boxes of files. the fbi has not disclosed the details of this investigation. they admit it reportedly gives a
