good morning to you and thanks so much for joining us. i'm laura garcia-cannon. >> i'm jon kelley. good morning everybody. right to the breaking news out of san francisco. we have an update for you here. at least one firefighter has been injured in that house fire, this happening in the city's bayview district. "today in the bay's" christie smith has just arrived on scene. chris stirks what do you seend what can you tell snus. >> reporter: good morning, jon. that firefighter was hurt when stairs to a balcony collapsed here this morning. he was taken to a hospital and checked out. he hurt his knee but is expected to be okay. i want to step aside so you can see only of the damage here this morning. firefighters telling us this fire is suspicious because it spread so fast, but also because the home that burned was vacant, but it was also packed with items for some reason. it quickly jumped to two alarms overnight with flames spreading from a center lot to the vacant

lot and then across the lot to another home on the other side where a family was inside, including a woman in her 80s who was sleeping at the time this broke out. a neighbor banged on the door. she was able to get out okay. everyone else was, too. this is on hudson street south of third. firefighters say when they knocked down the flames, they focused back on that vacant home. >> this building here was actually vacant. there's a lot of stuff in there, kind of a hoarding situation. >> it was a hoarding situation? >> kind of a hoarding situation in there. a lot of stuff, a lot of material, a lot of material on fire. >> reporter: still a lot of questions this morning. they're trying to figure out why it was -- may have been a hoarding situation. two cars burned out here as well. you can see this one here, the small burgundy car and the suv suffered damage as well. at this point six people

displaced. the red cross is out here. that elderly woman who was displaced in all this, she is getting help, too, from the family and neighbors as well are helping her out, making sure she is warm. still, no word on a cause. live in san francisco, christie smith, "today in the bay." we'll keep checking with you. in a matter of hours, the santa clara d.a. will outline the largest gang bust in county history. it involves 48 alleged gang members and accuses them of a wide range of crimes from selling drugs to murder. "today in the bay's" bob redell joins us with what else the d.a. is expected to reveal this morning. >> reporter: good morning, laura. santa clara county district attorney jeff rosen is expected to hold a news conference at 10:30 this morning at his office in downtown san jose to outline the en indictment he has brought up against the gang known as

nostr familiar mill yeah. 39 men and nine women have been charged with 77 crimes that they allege took place between 2010 and may 30th of this year. the charges include murder, bank robbery. at one robbery at alliance credit union the en indictment charges that one of the defendants, a woman, allegedly robbed the bank by threatening to blow up employees with a bomb that turned out to be fake. another two weeks later another defendant robbed a bank of america branch also in that same location. an attorney for two of the defendants tells bay city news service she believes this gang bust, the largest ever in santa clara county history is politically charged. reporting live in san jose, bob redell, "today in the bay." the fight is not over between the town of los gatos

and gun retailer templar sports. templar sports claims the town's plan for a firearm ordnance would possibly prevent the shop from selling guns in the future. the ordinance was introduced on friday it would require them to file for a permit and require an annual meeting for permit renewal. templar sports say it is new ordinance would not grandfather the shop in despite already having submitted a gun permit to sell guns. all they want is a quality education for all and accountability. parents and educators will be meeting in front of toyon elementary school today addressing concerns over being labeled as an elementary school district with the lowest latino algebra proficiency rate. peninsula city tonight talking about how to make a busy street safer.

residents have positioned the city council to improve safety along with a stretch of ralston avenue between 1 o 01 and 280. it calls for speed limit changes, bike lanes and a crosswalk with blinking lights. a man started this petition after his friend and her daughter were hit by a car on that road back in february. the city council right now conducting a traffic study on that area and is set to discuss possible improvements at that meeting tonight. the alameda police department remembers two fallen officers today, unveiling a new memorial. sculptures of robert davey junior and deward gresham. gresham was killed in 1942 when another car hit his motorcycle. officer davey was killed during a drug raid in 1983. in a surprise move the obama administration says it is giving up its long battle against the morning after pill. this means girls of any age will

soon be able to buy the emergency contraception with a prescription. "today in the bay's" marla tellez is in our newsroom with how soon we could actually see this happen. good morning, marla. >> reporter: good morning. it's hard to say exactly when the first batch of plan b will be available on store shelves. two things here, number one, all the labels need to be revised to remove the fine print of age restrictions. and more importantly, number two, the manufacturer still needs to submit a formal application to the fda. the food and drug administration saying to comply with the justice department's order, the fda has asked the maker of plan b one-step to submit a supplemental application seeking approval of the one-pill product to be made available over the counter without any restrictions. the fda says once that happens, it plans to approve it right

away. to be expected, women's rights advocates are calling this move, quote, reproductive justice. however, the obama administration is facing a firestorm of criticism from opponents who say this decision diminishes parental rights, many saying the president is caving to political pressure because in the past, mr. obama making it very clear as the father of two daughters he supported the age limitations. now those are expected to be wiped out as the justice department says it will submit that plan to a federal judge in new york to comply with the order to allow girls of any age to buy it without prescription. that's expected to happen soon. 5:08 right now. we check back in with meesologist christina loren. one of the days to get out and enjoy. >> i'm so for that plan. good morning to you. 58 in oakland, 57 in concord. great day for any sort of activity across the bay area, even right by the beach today it's going to be pretty nice. have to wait until probably noon

lululemon ceo stepping down as the company tries to rebound from a recall of one of its popular styles of pants. christine daye will leave once a replacement has found. she recently came under fire when lululemon had to recall yoga pants because the fabric was too transparent. experts say the fallout from the recall is forcing that ceo out. shares in tesla meantime taking a dip as investors get charged up over batteries. scott mcgrew, you said all along tesla is a battery company first. >> tesla is all about batteries. you recall it was huge dues when

tesla announced leasing. that, too, was about batteries because it means you can give your tesla back to the dealership before the battery pack wears out. tesla even guarantees its battery. this is the primary reason you see so many teslas on the road. people aren't worried about the service life of the battery. well, over the weekend, baron's newspaper pointed out tesla is taking on a lot of financial responsibility. what happens, for instance, if tesla takes the cars back at the end of the lease. do they replace the battery in every used car and at what cost. imagine ford replacing the engines of every ford car after two years. let's get a check of the markets this morning. jackie deangelis is wooif at cnbc word red quarters. >> features lower after stocks failed to hold on to early gains that we saw yesterday. the markets got an initial pop after s&p upgraded its outlook on the u.s.'s credit rating

saying that it feels better about economic prospects. but that optimism was short-lived. it didn't last throughout the session. the dow ended up slipping nine points to 15,238, the nasdaq edging up four points to 3,473. on top today data on wholesale trades. watch for that, scott. >> jackie, thank you very much. on monday we told you about the big changes coming to your iphone even before apple did. after the big event, i think the biggest news is the so-called kill switch that will be introduced with ios 7. one of the most common crimes in big cities may be wiped out. watch this guy stealing an iphone from a 6-year-old boy sometime back. how mean. apple on monday said users would be able to totally shut off their cell phones if stolen. bricked, we call it because they become as useful as the brick. even if the thief takes the

cover at the immediate coast. we're expecting most of it to clear at least partially by 10:00 a.m. and complete clearing by about noon today. we'll see a lot more sunshine and a gorgeous, gorgeous day on tap. what i can tell you is, as that sunrise starts to make an appearance, we head through the next half hour, we'll see gorgeous live shots coming into the newsroom. we'll show you those throughout the morning. high pressure doing its job to keep us nice and mild, keep that air mass crisp. today we'll see a rush of the norm. that means low clouds to start the day, lots of sunshine later on and an onshore breeze that feels good at the heat of the day. we'll see 60s to 70s around the bay and plenty of 70s and 80s inland. 79 in concord and 62 in san francisco. you might need a coat there. you can ditch the coat in the city by the baby friday. cooling you off for father's day for the cool dads like mike inouye out there. over to you.

>> hey! southbound a little yellow here, only down to 60, 59. that's how sensitive our sensors are. we have debris that was reported 85 around santa theresa. another bit of -- sound like apart from a truck that someone said was in the lanes. whatever it was, it's clear from south 17 into highway 9. south bay looking good. we do see early slowing coming westbound 580. speeds down toward about 50 miles per hour. that's pretty slow for this time of morning. it's only 5:18. there it is approaching the dublin interchange. not a big deal for livermore and no incidents reported through the stretch. meanwhile, we'll look over towards the bay bridge toll plaza where traffic volumes are very light. no delays down the eastshore freeway. you can see the lights from the city with low clouds not as much as factor as they were yesterday. no backups, metering lights.

golden gate bridge, the same story. yesterday a lot of low clouds. today very clear view across the bay. yesterday morning, also a lot of slowing. highway 37 for southbound 101. we should have heavier volume than yesterday. yesterday had a bit of inclement weather. today not so much. back to you. >> thank you very much. we have a followup now. the 16-year-old boy accused of killing a south bay paramedic has pleaded not guilty. christian burton's father says his son was framed for the april 4th murder of quinn boyer. boyer was shot in the head in the oakland hills in what police say was an attempted carjacking. burton will be tried as an adult. the trial of the man accused of going on a shooting rampage at oakland's oikos university will be delayed until december. doctors say won goh is still not competent to stand trial. he'll return to court at the end of the year for another update on his mental competency. seven people were killed in the school shooting in april of last

year. a bay area lawmaker introducing new legislation. state senator ellen corbett introducing a bill yesterday requiring the passenger compartments in all limousines to have at least two exit doors and two windows that can be pushed out from the inside. this move coming just days after a group of elderly women safely escaped a limousine fire in walnut creek and just a month after five women sadly died in a limo fire on the san mateo bridge. this is video of that. corbett says the death of those women could have been prevented. an alarming new trend is popping up on muni buses. the agency is trying to figure out why riders are kicking open the rear doors and jumping out while the bus is still rolling. it's happened 15 times in the past week and a half. muni spokesperson paul rose says the actions are not smart and they can put other riders' lives in danger. one theory is riders mistakenly

get on the wrong bus and grow impatient. police plan to increase their presence on the bus lines using plainclothes officers. a group wants to make citizens safe from cyclists. a civil grand jury urging the city to set a zero bike fatality goal. a woman was seriously injured by a cyclist who was reportedly riding on a sidewalk downtown. riding on sidewalks, for the record, is illegal. meantime, the san francisco bicycle coalition says the city needs to dedicate bike lanes to prevent more accidents, big-time accidents from happening. 5:21 right now. a california theme park that's letting you cut in line for the right price. >> i like the idea. good morning! wow. want to start the day with something heart healthy and delicious? you're a talking bee... honey nut cheerios has whole grain oats that can help lower cholesterol.

"today in the bay's" christie smith is live on the scene with the latest information. good morning.

>> reporter: good morning to you. hours after this started firefighters are still spraying water on this. one firefighter saying in his opinion this could be suspicious. another says it is interesting. you have a vacant home full of items that caught fire. one firefighter said he thought it looked like possibly a hoarding situation. neighbors say they think it could have been squatters involved. firefighters saying they're just not sure about that. when they arrived overnight, the flames were already inside and outside the home and it had also burned a carport in a center lot, and it started to spread very quickly to another home nearby with six people inside including a woman in her 80s t. neighbor was able to bang on the door, get her out and everyone out. it quickly jumped two to alarms on hudson street in the bayview. in fighting this, a firefighter was hurt when stairs to a balcony collapsed. i'm told he's doing okay. here is what firefighters saw when they first arrived. >> when our crews arrived on

scene we basically encountered a wall of flame in what's now the vacant lot. there was so much flame that you couldn't actually tell what was on fire. we knew we had a house fire, the house on the left here. we knew we had a fire in the house on the right. what was in the middle we didn't actually know. >> reporter: in all six people were displaced. six people displaced. they are getting help from the red cross this morning. also neighbors out here helping. two cars burned in this fire. also a carport burned down, still trying to figure out the cause of this. again, why a vacant home would catch fire. again, still spraying quite a bit of water on this, making sure everything is out. that's the latest from here, reporting live in san francisco, christie smith, "today in the bay." >> thank you, christie, appreciate the update. we can tell you dozens of known gang members in santa clara county facing a long list of en indictments. this part of the largest gang bust in county history. later this morning. >> reporter: good morning, john. this news conference scheduled for 10:30 this morning, supposed to be a long one, about an hour long. and speaking will be santa clara county district attorney jeff rosen here at his office outlining this en indictment against nuestra familia. 48 alleged members, nine of whom are women and charging them with 77 crimes that they allege took place between 2010 and may 30th of this year. the charges include a murder, drug dealing, weapons and at least six bank robberies. show you video we shot this morning. the the alliance federal credit union used to be located here. the en indictment charges one of the defendants, a woman allegedly robbed the bank with threatening to blow up the

employees with a bomb, turned out to be fake. another woman robbed a bank of america branch also on snell. an attorney says she believes this gang bust, the largest ever in santa clara county history is politically charged. reporting live in san jose, bob redell, "today in the bay." now, this bust comes just as san jose police -- san jose is poised to approve a budget to put more officers on the streets. today the city council will vote on a budget that includes millions of extra dollars for police and firefighters. mayor chuck reed wants to spend the money to help recruit new police officers, higher community service officers and fund place over time and gang prevention. a spokesperson says the city needs to add police officers and improve pay because officers are leaving faster than they can be replaced. >> raley's says it's too early to say who hacked into its

system. they say it's not sure if it's an isolated incident or something linked to larger attack. over the past weekend several customers telling the sacramento bee there was suspicious activity in their accounts. raley's which also runs knob hill foods telling customers to keep an eye on their credit and debit accounts. east bay municipal utility district will vote on)uj raisin water rates by 19% over the next two years for ratepayers in contra costa and alameda counties. the utility says it needs the increase to pay for pipe and equipment maintenance. under the proposal rates would go up 9.74%, about $4.00 per month for the average customer. next year, another 9.5% increase would kick in, about $4.00 more. a public meeting will be held in oakland to discuss the increase. the meeting starts at 1:15. 5:35 right now. i've been paying attention to

christina loren all morning. equation, low clouds, low humidity equals spectacular. area. much better than yesterday. we've got a good looking day shaping up. part of the reason why is because the humid air mass is exiting the bay area as it starts to push into the cierra nevada we will see a breeze this morning. temperatures are running cooler. you can feel the difference out there. the air is not as heavy and the dew points have really dropped off. that's good news for the morning. it's crisp out there, 57 to start in livermore. 57 in oakland. today looks fabulous all the way until about noon, it's going to be down right perfect. inland temperatures reaching below 70s at that point. that means hiking, biking, having a barbecue will be great. 81 on the way to livermore. 62 in san francisco. you know living in the bay area, things won't stay steady for long. i will sort out the changes and let you know when we're going to

snowden. tracie potts joins us live from capitol hill say. >> reporter: the fbi is on the hunt for snowden this morning. first stop hong kong. he told "the guardian" newspaper that he's been hiding out in a hotel room since he made these revelations public about surveillance programs, phone programs, phone records being collected and e-mails being collected as well. however, now we're told overnight he left that hong kong hotel room, so the fbi has been checking around trying to figure out where he s. they've been to his moth ears house in maryland, his father's house in pennsylvania. we've seen them at both locations. here on capitol hill lawmakers get a briefing today, the house and senate following up on thursday, not only about the surveillance programs, but now about this worldwide manhunt and about the investigation. it turns out the phone records and the e-mails and the internet activity, that may not be the end of it.

this is 545, we expect to see no major slowing. traffic should show a little heavier traffic flow. we're not seeing that even through the construction zone south 880 where the crews looked like they cleared the area. this might be a lighter flow. talking about south bay going through graduations over the last week or so. that will be the case for the east bay schools over the next week. a lighter flow as well here. this is 580 which has storted things out through livermore. speeds steadily into the 40s. 35 for the most part as you're approaching basco road. the burst of traffic has smoothed itself out. also a little lighter than we typically see. now, as we head over toward the maze and the bay bridge, a smooth drive as well. the eastshore freeway not a problem. approaching 24 and 580, smooth drive as well.

a number of law enforcement representatives joining the president including the current consultant to the oakland police department and former los angeles and new york police chief william brat ten. these are marks coming as the senate is poised to hold a pair of procedural votes to determine if the debate on immigration overhaul will be allowed to move forward. if the immigration bill is passed, it would give 11 million undocumented immigrants the chance to become u.s. citizens. right now breaking news to tell you about from san jose state university, a warning from police after an indecent exposure right on campus. nbc bay area's marla tellez is live with who the officers are looking for. >> reporter: good morning. i just got off the phone with the public information officer for san jose state. right away she stressed two things. number one, she thinks this is an isolated incident. she doesn't seem to think this is a serial incident. she also wanted to point out that school is out of session,

so this may not have involved any students at all. when san jose state is in session, there are about 30,000 students, most of those, of course, enjoying the summer break. in the meantime i can tell you an indecent exposure incident was reported to campus police about 9:50 right in front of where we're stand ning this morning. this is duncan hall. police say a suspect exposed himself to a female and took off on foot. the suspect description is rather limited. still we want to point out what this description is. a hispanic man in his 20s wearing a white shirt and jeans and also wearing a teal hat. so this is who campus police are looking for, a suspect -- hispanic man in his 20s wearing a teal hat who may have indecently exposed himself to a female outside duncan hall in san jose state just before 10:00. pat harris with san jose state says officers are on high alert but again school is out of
