berkeley police driving around here after a report of a young boy saying he was sexually assaulted in this park bathroom behind me. if you know the area it's near adventure playground on university avenue. this happened yesterday. a boy under 10 years old said a man touched him inappropriate when he went into the bathroom around 140 in the afternoon. he told his mom who called police and officers from the berkeley police department east bay regional parks and fish and game department sealed off the area along university avenue west of interstate 80. they set up a checkpoint looking into interiors of cars launched a helicopter too. checked wooded areas around the marinea who couldn't locate the guy. a black man with blond hair and green-dyed streaks, 40 to 50 with a green shirt, blue jeans and black shoes on. investigators not sure if that was a wig he had on or not. we have calls in to berkeley

police overnight. they are telling us they are following up on leads and have been. so far, nothing has panned out. they may have more information later this morning. live in berkeley christie smith, "today in the bay." >> a fremont kidnapping suspect making his first court appearance today after police say he snuck inside a teenage girl's car with the intent to sexually assault her. some of the ordeal was caught on surveillance camera. marla tellez live outside the fremont hall of justice where the suspect will answer to a long list of charges. >> reporter: when the guy shows up to court here in fremont he will face six felony charges including kidnapping with the intent to commit rape assault with a deadly weapon and also false imprisonment and robbery. we can show you what he looks, like, too. hard to forget the mugshot because he's smiling here. 23-year-old aaron roy of free plont. police say on monday morning, roy snuck into the 16-year-old

victim's car while she shopped inside a lucky's grocery store on fremont boulevard. police say as the girl drove off, that's when roy popped up in her backseat held a knife to her body and ordered her to drive to a remote location. before long police say roy demanded she take off her clothes but that's when the girl had the courage to jump out and run and thanks to a neighbor's surveillance camera, you can see her in the upper left hand corner of the screen running for help into the care of a woman who happened to witness some of the panic. >> and i saw this girl running in the middle of the street in her flip-flops and she was screaming for help. i said honey's what's wrong? she said he's chase moog heing me with a knife. i said come here. we ran up the stairs. >> reporter: that alert

homeowner, star santa cruz activated her home alarm system right away. police arrived on scene, they lifted fingerprints from the girl's car and able to track down roy hours later eight best buy in dublin where he works and where he was arrested. held without bail here in fremont. scheduled to be arraign at 2:00 this afternoon. for the 16-year-old victim in all of this surprisingly she was not hurt physically but as we can all imagine, certainly shaken up emotionally. live in fremont, marla tellez, "today in the bay." police chase ends up in a motorcycle crash in san francisco this morning. this happened on crespi drive and 19th avenue in san francisco state. motorcycle speeding when it skidded and crashed into a car. the chase started in pacifica. unclear why the police wanted to pull the motorcyclist over. the condition remains unknown at this hour. state law makes want to make

sure crews are rushing their work on the bay bridge to finish on time. "sacramento bee" reports several assembly and senate members filed a formal request to see officials overseeing the project have offered any incentives to contractors to meet the labor day deadline. law makers say they don't want the final stages of the project to appear rushed. it's not clear if crews will be able to meet the deadline due to a siris of problems with steel bolts on the new span. decision on the opening date expected next month. construction at levi's stadium in santa clara on hold until tomorrow after an elevator mechanic was killed on the site. bob redell has been following the story since it broke yesterday morning. he has the latest on the ongoing investigation. good morning. >> reporter: good morning, jon. the construction will not be starting up today, at least not within the next 24 hours. could be tomorrow. it's up to cal osha the safety

agency conducting the investigation. once that agency gives its approveal approval, workers will be allowed to return to the site of nut $1.3 billion stadium in santa clara for the 49ers. when they do, there will be grief counselors and briefing about safety on the job site. work on one of the largest construction projects in the bay area has come to a halt. site was shut down and workers sent home yesterday after an elevator worker was killed. donald white a 63-year-old faur of four long time employee of the schindler elevator corporation standing on a ladder inside one of the elevator shafts when the counterweight, which helps move a elevator up and down came done on him. >> from our standpoint it is a family here. the effort of getting to point of we're are now it's been just a great communal effort on all of the workers to get us this point. there's a lot of concern that we

situation. tri-valley easy drive into the dublin interchange. speeds coming down into upper 50s, into livermore and through livermore for westbound highway 4. typical pattern there. no problems for walnut creek interchange. here still west 80 moves smoothly past pinole valley road. on-ramp shut down because of an earlier crash. bay bridge as you cross the bay, smooth drive for both decks into and out of san francisco. north bay new york problem back to you. >> now a commute note to go with what mike told you about the roads. b.a.r.t. taking aim at train noise. the agency exploring new ways to reduce all of the screeching and shrieking riders hear every day. b.a.r.t. grinds rails to keep the noise below the state mandated 90 decibels however that wears ow the tracks. so they're look agent other ways to reduce vibration.

welcome back. el paso county, colorado the black forest fire has been go on out there. we don't see a lot of flames and smoke. a stag nan, quiet shot. this is somewhere much more safe than happening out there. flames, though have burned a total of 60 homes so far.

that's not a problem out of the maze either. update to the crash on the upper east shore freeway, we hope to have pinole valley road on-ramp open at 5:40. that's when we hear from chp. they had to close it while they clean up the crash. the person involved they were reportedly trapped in a pickup that person has been pulled from the truck. no major issue. minor injuries. they will have that opened up in 15 minutes. we'll look at the saavedra bridge with the sun coming up a nice silhouette of the bridge and smooth traffic on 92 and the dumbarton farther south. >> thank you. 5:26. dozens of people arrested but still a lot more on the run. new details we're learning after the biggest gang bust in santa clara history. a teenager caught on camera escaping from her alleged kidnapper in the parking lot.

"today in the bay" christie smith joins us with the latest for the search for the attacker. a unique description. >> reporter: good morning. we spoke with berkeley police overnight and they're telling us that they're still working on

leads but so far, nothing has panned out and no suspect sketch yet after a disturbing incident reported. a young boy said that a man touched him inappropriately in the park bathroom. this man's description is unusual. a black man with blond hair that had green dyed streaks. not sure if that might have been a wig. 40 to 50 years old, wearing a green shirt, blue jeans and black sneakers. the boy, under 10 told his mom about the assault and she called police about 1:40 yesterday afternoon. a popular area for parents and kids right near adventure playground on university avenue west of interstate 80 at berkeley marina. right away police sealed off the area and started searching. visually inspecting cars leaving the area. east bay park police and fish and game helped out with the search. they launched a helicopter, checked all of the wooded areas here but couldn't find him. the special victims unit worked with the boy, who is with

family. police hoping to van update this morning. and again, asking for anyone who might know anything about this to please give them a call. reporting live in berkeley christie smith, "today in the bay." >> a follow-up for you this morning. total of nine people still on the run after the biggest gang sting in the history of santa clara county. the district attorney's office says that it's arrested 39 members of the nuestra familia gang. but nine are still wanted. the d.a.'s office says the gang's been active over last three years, leading to a 77-count grand jury indictment. a follow-up to breaking news we brought you yesterday. the man police say flashed a student at san jose state still on the loose. about 9:50 monday the student was waiting for her ride outside dunken hall san salvador street when a man exposed himself and ran away. police sent out a text alert. a kidnapping suspect from fremont making his first appearance before a judge today. he stan as excused of smeekneaking

inside a teenage girl's car and attempting to sexually assault her. marla tellez outside the fremont hall of justice with details. >> reporter: the suspect is 23-year-old aaron roy of fremont facing a half dozen felony charges. but judging by his mugshot he doesn't look too upset about this. i say this because he is smiling in his mugshot that was taken after getting arrested monday night in dublin at a best buy where he works. hours earlier, 7:00 a.m. monday, roy surprised his 16 victim by popping up in her backseat as she drove off from a grocery store parking lot on fremont boulevard. investigator says he held a knife to her body ordered her to drive to a remote location and told her to undress. over a mile away from where the ordeal started the girl jumped out of the car, ran through a neighborhood screaming for help. a few seconds of this caught on

a neighbor's surveillance camera. you see her legs hauling through a drive way. she saw star santa cruz, a neighbor who took her into her home and alerted police. >> panic. so i could see her eyes were red and she was obviously crying and shaking. in that moment to be able to think that smart, to get out of the car and run, i think she's the hero. >> reporter: the 16-year-old girl, we are happy to report was not hurt. she is okay. roy held without bail in froe freeh month and scheduled to be arraigned here at the allah media county superior court. police were able to track him down from fingerprints he left behind inside the victim's car. fremont police have their guy but asking anyone who may know anything about this particular incident involving roy or any other incident involving aaron roy to please contact fremont police. marla tellez, "today in the bay." >> 5:34. investigators trying to figure out what spashed this brushfire

in antioch overnight. flames shot up into the air, tore through dry grass. the fire broke out before 11:00 last night near wilbur avenue and minaker drive. crews took an hour to knock down the flames. in all, 15 acres burned. >> we didn't have as much wind as we normally have. weather was cooler made for an easier firefight. it was in a dune area so we had terrain issues sandy soil and significant amount of vegetation. it did burn quite hot. >> no reports of injuries. and it appears no buildings were damaged. happened to be in the south bay you may notice smoke in the area near millpitas. all part of a firefighting exercise. crews including the santa clara county fire department taking part in a live fire exercise at ed levin county park. happening today and tomorrow. the exercise is a culmination of

a four-day event. crews will practice using fire as a defensive tool in fighting much larger more dangerous wildfires. >> last thing we need that is dry, dry brush. but we've been having mild temperatures lately. >> we have. we'll keep those going. thanks for waking up with us on a wednesday morning. kids may be out for school at this point or might be getting out as we head through the end of the week. today's a great day to get outdoors. even about 3:00 4:00 still saying comfortable. not too hot for outdoor activities. cool conditions. all the way inland this morning. we don't have a lot of low cloud cover. a strong westerly flow. futurecast tells that story. peak wind gusts. warmer colors hot pinks, reds oranges, expecting the strongest gusts to occur. 30 to 40 miles per hour. strongest near the coast. between 3:00 and 5:00 wind will be at its strongest.

report. in the slow rain as you're approaching the off-ramp heading off the same area off the dumbarton bridge. 92, san mateo bridge was moving smoothly. until a couple of minutes ago, there was a squad car on the right shoulder with flashing lights. desk is calling to make sure that is the case for the pan itself. look at fremont, south 880, smoothly picking up company into the south bay. >> we have a warning for you. be extra careful on roadways as you head to work because caltrans crews will be out in force picking up trash alongside the highways throughout the bay area. crews will be cleaning up, highway 101 from 286-80 interchange to highway 37 in san jose and further north in san rafael and san francisco. the work is said to start 9:00 this morning. caltrans points out last year alone, it spent more than $52 million on litter removal.
