straight up 6:00. almost 6:01. good morning, thanks for joining us. i'm jon kelley. >> i'm laura garcia-cannon. developing story in berkeley where an all-night search continues this morning for a man who sexually assaulted a child in a playground bathroom. overnight, police in the adventure play ground on university avenue at the berkeley arena, christie smith joins us live. the child is home safe but the suspect is still on the run. >> reporter: good morning to you. we have seen berkeley police driving around very early and they have followed up on leads overnight. so far, no luck. after a very disturbing report, a boy says that a man up toed him inappropriately in the park bathroom here behind me. this man they're looking for would stand out. described as a black man with blond hair that had green dyed streaks in it. they're not sure if that was his real hair or wig.

wearing a green shirt, blue jeans and black sneakers. the boy went into the bathroom near adventure playground yesterday and this man touched him. he told his mom, who then called police. this is around 1:40 in the afternoon. that set off a huge manhunt as police got help from east bay park police and the department of fish and game who sealed off the area, visually inspect interiors of cars leaving the area and launched a helicopter and checked wooded areas where there are encampments here. the berkeley police special victims unit worked with the boy, described as being under 10. he is with his family. so far, no sketch but police hoping to update later this morning. live in berkeley, christie smith, "today in the bay." new video from overflight showing a crash that ends a police chase from pacifica -- up san francisco, a police motorcycle -- chasing a motorcyclist where it exited

interstate 280. a crash into a car on krespi drive near san francisco state. 19th avenue was closed for a while. it is back open. it's unclear why pacifica police wanted to pull the motorcyclist over. that rider's condition now still unknown. surveillance video shows a teenage girl running for her life away from a man who popped up out of the backseat of her car with a knife. this morning, that teenager is safe and suspected kidnapper is behind bars, and awaiting his first court appearance. "today in the bay" marla tellez where today's hearing will be held. an incredible survival story. >> reporter: absolutely. as you mentioned, this girl, a teenager, 16, tough and resilient. i'll get to her in a moment. suspect, when he comes to alameda county superior court today faces six felony charges, including kidnapping, with

intent to commit rape, assault with a deadly weapon and also false imprisonment and robbery. those are just a few of the charges. we can show him, he's smiling in his mugshot, 23-year-old aaron roy of fremont. monday morning he snuck into the 16-year-old victim's car while she shopped inside i lucky's grocery store on fremont boulevard. as the girl drove off, he popped up in the pack seat, held a knife to her body and orred her to drive to a reploet location. he demanded she take off her clothes. that's when she had the courage to jump out and run. thanks to a neighbor's surveillance camera, you can see her in the screen running for help, right in the care of a woman who happened to witness some of the panic. >> and i saw this girl running in the middle of the street in her flip-flops and screaming for help. i said what's wrong?

t she said, he's chasing me with a knife. we went upstairs. >> reporter: that homeowner alert neighbor, star santa cruz, she immediately activated her home alarm system. that got police to the scene. police lifted fingerprinted from the girl's car and were able to track down roy hours later at a best buy in dublin, where he works. he is currently being held without bail. he will be arraigned here in fremont at 2:00 this afternoon. for the 16-year-old girl, she is physically okay. but as you can certainly imagine, shaken up emotionally. live in fremont, marla tellez, "today in the bay." new this morning, 15 acres torched after an overnight brushfire near wilbur avenue and miniker drive in antioch. it took firefighters an hour to get flames under control. no reports of injuries. no buildings damaged.

so far the cause remains under investigation. happening now, up to 60 homes have burned in a wildfire northeast of colorado springs. people in some 2300 homes forced to evacuate. right now that while fire has grown to 12 square miles. now to put that into perspective, that's larger than the town of los gados. the fire's one of four major wildfires fueled by hot, gusty, dry weather in and around colorado's rocky mountains. >> 6:06. out here in california, we had our share of fires. christina loren says another nice day ahead. >> beautiful. denver almost hit triple digits yesterday. it's hot there for us. cooldown, oh, it's going to continue. a beautiful day shaping up. wanted to start with the live picture, beautiful start to the day over san francisco. no low clouds. you can see for five to eight miles from the city. that's a good, good sign. getting a pickup this morning. a nice day.

we'll start out cooler but it's going to end up warmer. this is from san jose out looking towards the campbell water tower. want to give a shoutout, my hometown. we are running anywhere from 9 to 11 degrees cooler in coastal city. with lack of low clouds to blanket us. we'll start out cool, end up just about as warm if no warmther in east bay cities. wins reported out of the west. beautiful day shaping up. winds will pick up. that's the biggest difference between yesterday and today especially between 2:00 and 4:00. you see where you're getting hot pings, that's where wind will be the strongest at the immediate coast as we head throughout the second half of the day. good news, that's when we get our highest temperatures. we'll have a nice gentle breeze, 81 degrees inland. bay side, breezy do windy. 72 for you 4:00 p.m. 62 with the strong breeze at coast later this evening. changes headed our way. i'll take you through those. seven day outlook.

if you're ready to go, might know a couple of things that could slow you down. >> south bay. first, the live look here, 101 northbound 680. this didn't look bad. the map for the south bay, looking relatively smooth right now. look at that. no big issues as far as slowing for 101 or 87. 285, close to the limit as well. north out of the south bay up toward the peninsula northbound 101 i trouble spot around shoreline and highway 85, a crash north of the shoreline boulevard off-ramp has got a smoking car now. reports of a fire crew on scene. the fire department arrived. at least one, maybe two lanes blocked now. injuries reported, at least that's the initial call. a lot of activity north of the shoreline. 85 interchange, be careful right there. you see you're okay there. north of mountain view toward the palo alto area, that's what you're going to find. also a smoother drive farther north.

the earlier crash southbound 101 is there at marsh 101. it's on the shoulder. reports of injuries to the driver of the pickup involved. some debris reported in the area as well. no slowing toward the dumbarton. around the bay bridge toll plaza, that's the backup you see. sun is in our eyes in the other way. lighting changed. metering lights and big backup now past the west grand avenue overcross. back to you. we're going to go to breaking news right now. attorneys for ariel castro pleading not guilty. castro himself did not say a word in court. video just into our newsroom. he held his head down as that plea was made this morning. he's facing over 300 counts including 2 counts of aggravated murder, kidnapping and rape. prosecutors say castro kidnapped michelle knight, amanda berry and gina dejesus, locked up inside his home for more than a decade. he fathered berry's 6-year-old daughter also.

daylight today. nonetheless, temperatures that are perfect. and then things change. seven day outlook coming up. a great look at 101 through palo alto. phobes away from us heading north but coming into palo alto out of mountain view, a new crash in lanes. fire crews of scene. this is messing up at least that portion of the south bay. the update coming up. here's a look at some of today's top stories. san francisco police investigating a motorcycle crash near san francisco state. motorcycle apparently speeding when it lost control, skidded into a car. we're told pacifica police were chasing the rider of the motorcycle but it's not clear why. berkeley police on the lookout for a man who sexually assaulted a child at the bathroom of a berkeley marina. the search started yesterday afternoon. the suspect, a black man, blond hair, green streaks. a free month man expected to be in court facing charges of

kidnapping. 23-year-old aaron roy climbed into the backseat of a teenage girl's car in a grocery store parking lot ordering her to drive to remote area. that girl was able to escape and run to a neighbor's house for help. this morning, work at 49ers' billion dollar new stadium on hole after the death of a construction worker. bob redell live in the stadium now. construction site in santa clara. he has the latest on the ongoing investigation. good morning. >> reporter: john, good morning. work on hold for another 24 hours. it wouldn't be until tomorrow at the earliesearliest. that work would resume on the $1.3 billion stadium project, new 49ers stadium in santa clara. it will be up to cal osha when to allow workers to return to the site. and when they do, greeted by grief counselors and a briefing to remind them about safety on the job site. the site was shut down, workers sent home yesterday morning after an elevator worker was

killed. donald white, 63-year-old father of four children. a longtime employee of the schindler elevator corporation. he was standing on a ladder inside one of the elevator shafts when the counterweight came done on him. >> it is a family here. you know the effort of getting to the point of where we are now, it's been just a great communal effort on all of the workers to get us this point. there's a lot of concern that we do what's right for don's family. >> reporter: the contractors overseeing the project tell us that prior to yesterday morning, work site had a good safety record. only significant injury among the thousand-plus workers, in over 13 months' time, just a broken foot. for schindler, the company installing the stadium's elevators, the u.s. department of labor fined that company $25,000 after a worker fell down a shaft at a construction site in palo alto. that was back in 2011. reporting live here in santa clara, bob redell, "today in the bay." 6:15.

another boeing 787 having trouble in japan. a dreamliner was supposed to take off this morning but the right side engine would not start. passengers had to take other flights. the problem is not related to the battery issue that grounded 787 planes for months. here in bay area, the airport ramping up its daily dreamliner service to tokyo this month. the airline operates the service five days a week. the flight times will remain the same leaving mineta at 1:05 in the afternoon and arriving at tokyo's airport at 4:10 in the after noon. some of silicon's valley's biggesty. companies asking permission to tell you more about what the government wants to tell about you. >> microsoft and facebook

writing letters to government asking permission to at least explain how many times they have to tell the nation's biggest spy agency what you're doing online. google in its letter says the company has worked hard over 15 years to gain user trust. now there's a business angle to this, too. google and microsoft have been pushing the cloud, the concept that you keep your business records and run your business programs remotely on a server instead of your own office. but if you kept your data in your own office you'd know if the nsa showed up with a fisa warrant. you don't foe if they show up at google. the cloud has become less secure and it's one of the reasons you're seeing corporations expressing more outrage than the average citizen. head of the nsa in the army uniform, briefed some members of congress tuesday. he'll talk before the senate appropriations committee today and then thentire senate thursd.

that man, head of the nsa, spent most of his time on the hill briefing congress and groups about chinese spying. reuters points out, two weeks ago in a speech about foreign spying on the u.s., keith alexander said, quote, the great irony here is we're the only ones not spying on the american people. in march, alexander's boss, director of national intel against, jay clapper, was asked by congress, does the nsa collect data on hundreds of millions of americas to which john clapper said, no. >> time 6:18. christina loren back to tell us about we're getting used to this, nice this week. >> and by june standard in the bay area, it would be so much hotter. we could be dealing with severe fire weather. but that's not the case today. onshore flow persists. what a difference a day makes.

here, yesterday we had two-hour flight delays out of sfo. this morning, beautiful clear start over the golden gate bridge. a bit of patchy fog at the immediate coast. not enough to force flight delays. that's a good seen. it's the first day so far this week without any delays in the city. i want to point out, quite a bit of weather throughout the country. everybody at this point is right on time. that's the good news. we're starting out so mile this morning. it's a beautiful start. 55 degrees. inland cities comfortable. it's cool at the coast. you might have had to throw on an extra blanket. temperatures in the 40s navato. 48 degrees there. 56 to start in concord. whatever fog did develop, it's all going to clear out of here between 8:00 and 10:00 and a lot of sunshine. rebound, area of low pressure that brought us thunderstorms heading out of town. high pressure takes control. this will bring temperatures up to comfortable levels. maybe a bit above comfort when we head through friday. temperatures climb into the upper 80s.

anti-government protesters from istanbul's central square and nearby park. riot police and demonstrators collaring for nearly two week now. protesters have thrown firebombs, bottles and rocks. police responded with tear gas, wat water cannons and rubber bullets. four men are alive but injured after a small plane crashes into a golf course in 'v louisville, kentucky overnight. all four of those men listed in their early 20s. they are all still hospitalized. but at this hour, not a lot of information on their condition. that is not known the cause of the crash also unknown but remains under investigation. families affected by the sandy hook elementary school massacre will get an update on efforts to expand background checks to gun. the families of seven victims will meet with senator joe manchin today. other members of the newtown

community will meet with house speaker john bayne somewhere majority leader eric cantor. walgreens set to pay a record breaking $80 million fine to settle up allegations. the company allowed millions of controlled substances including the addictive painkiller oxycodone to hit the black market. walgreens accused of record keeping and dispensing violation. settlement will be the largest civil penalty paid under the controlled substance act in the history of the drug enforcement administration. one religious group considering cutting ties with boy scouts of america, southern baptist officials are expected to vote on a resolution today at their annual meeting in houston. the resolution has not been made public but urges the church to cut ties with scouting. after the boy scouts decided to allow openly gay members. and the fashion police hard at work. a town on the jersey shore set to pass a law banning people on the boardwalk from walking

know. a hong kong paper is reporting that he apparently did try to contact human rights attorneys to get some sense of what he should do next. the nsa, national security agency, and the fbi, they're tracking him. they want to know, first of all, what more does he know? does he have other documents? is there more that could come to light? and was there anyone helping him or did he act alone? all of that part of the investigation. meantime, here on capitol hill, lawmakers getting secret briefings off and on throughout the week. a couple of things coming out after the briefings. some lawmakers say they had no idea how big some of the programs got. the other thing is, some lawmakers think the fisa court should release its opinion so americans can see what the thinking was about keeping them under wraps. >> the story far from over. thank you for the latest. this morn, bryan stow is out of a central valley rehab

facility but the move not by choice. in a recent blog post, stow's family says the injured giants fan living at his parents' home in santa cruz county. the insurance company has stopped paying for his rehab. if you recall, you remember stow was beaten in the parking lot of a dodger stadium ball game after opening day against the giants. that happened two years ago. stow suffered massive injuries including brain damage and a loss of part of his skull. 6:32. california and nevada civil rights groups sued a hospital accused of shipping patients out of state without making arrangements for the care. a third ended up in california. the psychiatric hospital in las vegas violated the constitutional rights of mentally ill people. scram bee reports 100 pashs could join the lawsuit. officials have not commented on the suit. 6:32.

update on nelson mandela's condition. responding to treatment and his family is optimistic about his progress. a government spokes person said hours ago mandela is still in stable but serious condition. 94-year-old is battling a recurring lung infection with this mashing his fourth time in the hospital since december. mandela will turn 95 next month. happening right now, opening statements under way in the trial of suspected mobster james whitey bulger. the lead of the violent winter hill gang and participated in 19 different killings in the got

boston area. the 83-year-old fled boston in 1994 and arrested in santa monica, california, two year ago. trial expected to last three to four months. 6:40. moments ago the man accused of holding three women captive for about a decade has pleaded not guilty to hundreds of charges. ariel castro charged with kidnapping and assaulting women and sometimes chaining them up inside of his home in cleveland. during today's hearing the judge continued castro's bond at $8 million. last week, castro taken off suicide watch in jail. the county jail logs show him spending most of his time sleeping, watching tv, and occasionally drawing inside his cell. he faces over 300 charges. >> yeah. that's going to be long, dran out, and ugly. quick thinking and very daring escape here. we show you how a teenage girl breaks free from a man chasing her with a knife.

motorcyclist over. new, 15 acres torched after an overnight brush fire sheer wilbur in antioch. this took firefighters an hour to get those flames around control. working hard out there. new reports -- no reports of injuries. appears no buildings damaged during the fire. so far, the cause of this one remains under investigation. happening now, up to 60 homes have burned in a wildfire northeast of colorado springs. people in 2300 homes have been forced to evacuate. right now that fire has grown to 12 square miles. now to put that into perspective, that's larger than the entire town of los gad go. the fire's one of four major wildfires fueled by hot, gusty weather in and around colorado's rocky mountains. almost reached triple digits in denver yesterday. >> big ridge of high pressure, the same one that brought our temperatures to 111 on saturday. yeah, that moved to the west.

have summertime shift kicking in. slowing 680 towards sunol. also through livermore itself. we have that 84 traffic that cuts through showing a slowdown. not bad livermore, dublin interchange. now as we move toward the castro valley y, it wasn't until a few minutes we saw slowing. coming down 20 at interchange but smoothing into 40s and 50s south 880 toward san mateo bridge. smooth drive across the san mateo and dumbarton bridges once you get through the toll plaza. same with bay bridge once you pet through the toll plaza. metering lights on, backup to the berkeley curve. slowing into the 50s through berkeley coming off of that richmond/san rafael bridge. across the span. southbound 101 shows more congestion. slowing out of navato around highway 37 and the merge and slowing through the curves here.

close to the limit for most of san rafael and toward the golden gate bridge. this morning, surveillance video shows a teenage girl running for her life away)/p fra man who popped up out of the backseat of her car with a knife. this morning that teen average is safe and the suspected kidnapper is behind bars. awaiting his first court appearance. today in the bay's marla tellez at the hall of justice. it's a horrifying ordeal that's an incredible survival story. >> reporter: absolutely is, laura. good morning. 16-year-old certainly a hero in my book showing so much strength and courage. investigators say the guy who kidnapped her and intended to rape her, that's one of the six felony charges that this guy faces, aaron roy is the suspect's name. he faces kidnapping with intent to commit rape. judging by the mugshot he doesn't look upset i say this because the 23-year-old is smiling in the shot taken soon after getting arrested monday night in dublin.

and the best buy where he works. hours earlier, 7:00 a.m. monday, police say roy surprised his 16-year-old victim by popping up in her backseat as she drove off from a grocery store packing lot on fremont boulevard. he held a knife to her body, ordered her to drive to a remote location and told her to undress. just over a mile away from where the whole ordeal started. the girl had the courage to jump out of her car, ran through a neighborhood screaming for help. a few seconds of this caught on neighbor's surveillance& camer. you can see her legs running through a driveway. that's where she found stan santa cruz, a neighbor who took her into her home and alerted police. >> it was panic. i could see her eyes were red and she was obviously crying and shaking. in that moment, to think that smart, get out and run, i think she's the hero. >> reporter: as i said i agree with her. the 16-year-old girl, believe it or not, not hurt. she's okay.

roy held without bail. scheduled be it arraign at 2:00. police have their guy they're asking anyone who may know anything about this particular incident involving aaron roy or any other criminal activity he may have been involved with. call fremont police. this morning, our very first look at a man arrested for groping a woman in palo alto. 31-year-old is now behind bars at santa clara county jail. a woman had been bent over to pick up keys on kipling street when he drove by and grabbed her inappropriately. the victim was able to give mrs. a license plate number which led them directly to him. work at 49ers' billion dollar new stadium is on hold after the death of a construction worker. today in the bay's bob redell joins us live in santa clara with the latest on the investigation. bob?
