good afternoon, thanks for joining us for a special 4:00 edition of nbc bay area news. >> we're on one hour early because of the stanley cup finals here on nbc bay area. we begin with new details in the fremont kidnapping. the suspect claims he simply got into the wrong car. that's the defense from the man accused of kid snapping and trying to sexually assault a girl. jodi? >> the 23-year-old didn't say anything in court today. he won't enter a plea until next month. but these charging documents say plenty. his attorney claims he's a good kid from a good family.

>> the incident that he is charged with is completely out of his character. he has no history of violence. he has no history of sexual assault. >> reporter: but 23-year-old aaron roy is accused of just that. he appeared in court where he was charged of kidnapping with the intent to commit rape. he hid in the back seat of a 16-year-old's car while she was in the grocery store and made her drive to a remote location by knife point then ordered her to take off her clothes. luckily she managed to escape and run for help. >> clearly the worst case scenario is that the suspect may have raped her. i think it was because of her actions and her keeping a cool head and knowing what to do, that she did not become a victim of rape. >> reporter: according to the charging documents, they found rape pornography videos on roy's phone and laptop found in his home was on with the search reading rape sleep porn.

court documents say roy claims he got in the car by accident and that he wanted the girl to let him out but she continued to drive. >> there are no allegations that he physically assaulted this young girl. there is no evidence that i have seen at this point that he punched her, hit her, pushed her or groped her in any way. >> reporter: of course, roy is accused of many other very serious crimes in addition to the kidnapping count, he's being charged with robbery and also being charged with the possession of cocaine, according to the charging documents. police found cocaine in his wallet. he'll be back in court on july 8th to enter a plea. reporting live in fremont, jody hernandez, nbc bay area news. a summer camp field trip ended early when seven girls went to the hospital. the crash happened just after 11:00 this morning on market street near sixth in san

francisco. witnesses say the bus appeared to be slowing down when it was rear-ended by the eastbound f line street car. the bus was carrying 30 children on a field trip from the bay view summer camp to the cable car museum. a total of 15 people had minor to moderate injuries. witnesses say the kids were shaken up. >> i saw a little girl -- really traumatized and she was crying for her mom and dad. >> the standard procedure requires that each driver will be required to undergo a drug and alcohol test. he loved his family and his job. tonight we're learning more about the mechanic who was killed yesterday in a construction accident at the new 49ers stadium. kris sanchez sat down with the family and joins us live in santa clara with more. >> reporter: don white's son said he prided himself on working safely and they don't

remember him ever getting hurt in the 43 years on the job. so while they wait for answers about the accident that claimed his life, they are taking comfort in the time they recently had together. >> that was a good one. >> wanted to be a cowboy. >> named us all after cowboys. >> because he was the best. >> reporter: as don white's family flips through photos, it's clear he lived the 63 years with love and laughter. >> he was a great father and friend. you knew he was there because he was just that guy. >> everywhere donny would go, he would meet somebody, had to be friends with everybody, had a lot of friends. >> reporter: he lived in sacramento with his wife wendy. when the stadium job came up he jumped in the chance to be back in the bay area near the peninsula where he grew up. his sons grateful to have dad closer, if just for a few

months. >> it's my dad, my old man. he loved all of us and just wanted to be near us and hang out with us and spend time with us. >> all four of don white's boys followed in his footsteps so they are familiar with the dangers of work sites like the one where their dad died yesterday when he was struck by an elevator counterweight. they said if it was a freak accident, they can accept that. they want to know for sure. >> he put his boots on and went to work and something happened. >> all accidents are caused by something. just trying to figure out how he is in position to be hit -- struck by the counterweight. >> obviously there was -- something happened and we still don't know. >> while they wait for answers, his family and friends are trying to do what he would have done. >> tell the person you love that you love them. don't ever take it for granted. >> reporter: you can see the

stadium is quiet behind me. work will resume there tomorrow, thursday. the cal osha investigation could take months. >> nice to see that family together. sunnyvale police arrested a man who shot and killed a bouncer at the popular sports bar. it's a crime that's exceedingly rare in sunnyvale. they arrested steven bowie yesterday in connection with the deadly shooting. peacock sports lounge with more on this investigation and the victim. damien? >> reporter: the memorial keeps growing here outside tpeacock sports lounge. he was doing his job during a hip hop concert when a gun went off. >> do i know the person? >> i hope not. >> reporter: that was the reaction from merchants at the

sunnyvale strip mall when we showed a picture. >> it's a good spping center. we've never had any problems, never had any problems with the sports bar. it seems to be a congruent group that comes here. everyone knows each other. we've never had problems. quite a shot. >> reporter: detectives say steven craig bowie shot him outside the lounge and investigators used footage from the cameras to track down the suspect. >> surveillance video was a portion of that but there was other physical evidence and leads that came into us that they followed up that led to the arrest. >> the motive, captain pitts says it seems to have been an altercation. >> i think it's dreadful. >> reporter: those who knew him describe david as a family man, a 37-year-old whose job was to keep the lounge safe, which ultimately cost him his life. we asked from an interview from

steven bowie and have not heard back from the jail. the owner says there will be a candlelight vigil tomorrow night here at 7:00. damian trujillo, nbc bay area news. lawmakers are making sure safety trumps deadlines when it comes to the bay bridge. there's a formal request to prevent crews from cutting corners or rushing work on the new eastern span. they want to find out if officials offered incentives to contractors to meet the labor day deadline. following a series of problems with faulty steel bolts, it's unknown if it will open on time. a decision is expected next month. still ahead here on the special 4:00 edition of nbc bay area news. he was training to help steer people away from trouble, but what this dog did goes beyond the call of duty. the story behind the hero dog in the north bay.

he suggested that his client would plead guilty to everything if that murder charge was taken off the table along with the death penalty. he added the benefit of the plea deal would avoid a trial and spare the three women from testifying. it's another nightmare scenario for the dreamliner. today in japan,thy had to cancel a flight when the right engine on the 787 would not start. the problem was not related to the battery issue that grounded the entire dream liner fleet for three months. this comes one day after japan airlines dreamliner returned to the airport shortly after takeoff because of a problem with the deicing system. it was less than two weeks ago when ana finally resumed dream dg liner direct flights from san jose to tokyo. >> it just got less expensive and more controversial to catch a ride in san francisco thanks to a startup dropping prices on the pickup service. scott budman got one of the more

affordable rides today. >> among the benefits of lots of competition in transportation, several choices for the consumer and prices are dropping quickly. the latest to drop prices, san francisco based uber, which today announced a 25% reduction in the price of uber ex service, you can call the car and have it meet you and take you where you want to go. it makes it less expensive than the taxiing services it competes with, trying to bring it to a larger audience. >> we would like to think of it as sort of like better, faster, cheaper and it's always been better and faster and the cheaper was the last part that was missing. that was the last -- we want to make it a no brainer. >> uber ex is the least expensive of the uber options, it is well funded with 250 employees now. it's also seeing many taxicab drivers move over to uber largely because of the flexible schedule. he reached out to the cab

drivers association for comment and did not get a call back and asked a couple of cab drivers what they thought of the uber price drop. one said it made him worry. raj. >> led the bay area search and rescue team since the worst disasters but menlo park's fire chief is fizz he canally sidelined by a freak accident in his san jose backyard. marianne favro talked with him. >> reporter: he has been with the men lo fire protection district more than 30 years, now he's hospitalized and in a wheelchair with limited ability to move his hands and legs. physical challenges that have not deterred his fighting spirit. when most run away from disasters, howard runs toward them to help. after 9/11 he led a bay area search and rescue team to the world trade center to look for victims. he brought with him plenty of experience. from the oklahoma city bombing in 1995, or responding to

hurricane katrina in 2005. now his latest challenge, hits closer to home. last month while trimming bushes at the san jose home, he fell off a ladder and broke his neck. >> kind of an irony, i was in a high risk low frequency operations and you know, a ladder did me in. it's an adjustment. >> he has regained some feeling in his legs and can use his right hand, promising signs. the menlo park fire chief is hopeful rehab will enable him to eventually return to the district. tim campbell, his friend and fellow firefighterer of 32 years is not surprised by that. >> his physical limits, whatever they may turn out to be in the long run, isn't going to stop that heart and that desire of what he wants to do. >> he admits it's tough to rely on others when you're used to others relying on you.

country. we had 89 in gilroy, walnut street, at 85. in stanford also at 80. the winds have picked up, 10 to 20 miles per hour. we noted that breezy conditions that were going to pick up today yesterday and they are right on track. that's also helped the humidity to drop from 25 to 30%. it looks as if we head throughout tomorrow we won't get rid of the wind. it will be more annoying than anything. meanwhile for tonight, stay clear at the coast and inland, a little fog at 5:00 a.m. by 11:00 tomorrow morning, sunny for everyone, even at the coastline. doesn't look too bad. but it will stay cool with low 60s and 70s for the interior valleys. let's get you to the live hd skycam ra network. we do have very clear skies and trees blowing around a little bit. fire danger increased slightly in the south bay. in fremont, plenty of sunny conditions and off to the north

in san francisco, what you're going to note is fog free, camera shaking around a little bit and we'll find clouds moving back in the coast line but not a huge fog event expected. the jet stream is sinking far to the south for this time of year. we couldn't get it this far south if we tried throughout january and february and also march. the storm system will stay off to the north but as high pressure builds in from the south, it will help to increase the wind. not only that, here's the good part. two more days of full on sunny skies and temperatures warming up by 5 to 7 degrees in the forecast. let's get you into the fog factor for tomorrow. i do think fog will be a factor in marin county and san francisco and san mateo and santa cruz. then by the afternoon, we're highlighting all of the spots that are expecting sunshine. you can see it's pretty much the entire viewing area from the north bay to the south bay. looks like a great thursday is shaping are for us. the wind will be 5 to 15 to start for tomorrow morning.

then as we head throughout the afternoon, it will gust from 5 to 30 miles per hour. otherwise in your thursday forecast, the hottest zone down here in the south bay, morgan hill 86, gilroy, 88, san jose, 83 and east bay notorious for trapping heat will do it again tomorrow. we can expect 84 in danville and livermore. richmond down to oakland, mid to upper 70s and 69 in san francisco. the heat peaks out on friday. then by the weekend, saturday and sunday starts to cool off by 10 degrees as we drop down to the 70s. no beach weather really mixed in there when it comes to any kind of hot weather. it will stay cool at our coastline. monday and tuesday, a follow event and drizzle mixed in as well. the next two days, it's all good. maybe if you have a staycation here, this is perfect. >> taking a couple of days off? >> give you the approval. >> i'll cover for you, raj.

using a hand held cell phone while driving is illegal in 11 states, including here in california. but using it hands free doesn't always mean it's distraction free. a new study by aaa says voice command technology for your car pitched as a safer alternative really isn't and using speech to text technology was three times more distracting than not using a cell phone or listening to the radio. according to the ntsb, more than 3,000 deaths were caused by distracted driving last year alone. bpa exposure is making girls overweight, that's the study looking at bpa and obesity.

a guide dog in san rafael is being called a hero after warning about an out of control driver. it was all caught on tape. >> i was under blindfoeld with my training supervisor behind me. >> reporter: o'neill, a guide dog in training was leading the way. >> then i heard crashing and i know the car but figured it was in a street. >> reporter: the sound prompted o'neill to tug at the leash and

turn around. >> i think o'neill actually heard the wheels come upon the curb. >> reporter: you can see all of this unfolding on the surveillance video taken from a camera mounted on a building in downtown san rafael. danielle had her blind fold on when o'neill went into protection mode. you can clearly see o'neill turning around to let his trainer know something was wrong. >> it was him first. then me. then i was like, said something i shouldn't have hen grabbed danielle and ran off. >> the camera caught it all as the group turned the corner to safety. the driver of the car is a 93-year-old woman who was attempting to parallel park when her careened down the sidewalk in reverse out of control. the driver jumped the curb because she may have thought she had her foot on the brake. no charges are filed but police would like the driver to be checked out by the dmv. what if o'neill had been on the
