friday. good morning everybody. about 4:31. i'm jon kelley. >> i'm laura garcia-cannon. lots to get to. let's first check the forecast with meteorologist christina loren. >> good morning to you. we have another beautiful day to look forward to. temperatures this morning are mostly in the 40s and 50s. you probably need a jacket at gilroy at 48 degrees there. 49 in santa rosa. we hit the stride of beautiful weather. i'll let you know how much longer it will last. we've got that all-important father's day weekend forecast coming up. first let's check the drive. >> good morning, christina. looking toward fremont where you'd expect this light volume of traffic and that's exactly what you do find. 880 smooth into the south bay. south of 237 crews just picking up the cones in the last few minutes. you do have slowing to two lanes, but lights on both sides of the roadway as you're getting through those two cones, be careful passing montague and

brokaw, reopening the montague off-ramp. the rest of the spots around here not impeding your flow ont or off of the freeway. we'll track the rest of your commute coming up. breaking news from the south bay where san jose police are investigating the city's 24th homicide of the year. it happened just after 12:30 on checkers drive on the east side, not far from the corner of mckee and king roads. police say a man believed to be in his 40s was frowned lying on the ground in front of a home. these are live pictures in front of the scene. you see investigators out in full force t. man was stabbed several times. he was rushed to the hospital where he died. right now there are no suspects, no motive for the killing. police, while they continue to investigate, they are not saying if it is gang relate sgld we have a developing story to tell you about from san francisco where police are removing

protesters from the hayes valley farm. police telling us they gave the group an eviction notice last friday. we do have new video from overnight showing police in riot gear surrounding that site. they've also brought in some cherry pickers to try to reach up and remove protesters camped out in trees. the land where the protesters are camping out is marked for construction of a brand new apartment complex. also this morning at 4:33, dozens of suspects indicted in this week's south bay's largest gang bust are expected in a courtroom. 34 members of the knew es stra familia drug gang. the santa clara district attorney indicted 48 people, nine ton run. five others held outside the county. on the peninsula, a driver accused in a crash that killed three people on memorial day.

paul diaz charged with three counts of vehicular manslaughter and felony hit and run. he turned himself into place a few hours later. crews are starting to arrive at levi stadium two days after a worker was killed right on the job. construction all set to resume today, that site was closed for part of tuesday and all day yesterday while cal osha investigated the death. the family of 63-year-old don white says it's still waiting to hear how the accident happened. white was killed on tuesday by a counter weight in the elevator shaft where he was working. 4:34, the man accused of sunnyvale's first homicide in more than a year could be in court this morning. steven bowie is in custody. police say the bouncer, david lucero was working security

during a hip-hop concert when shots were fired. they used video from several nearby surveillance cameras to identify buoy. the other person shot is expected to survive. crews have called off a search for a man who finished the beta breakers race. families of bo rasmussen planning a memorial service late they are month. his clothes, cell phone and credit cards were all found days later on the beach, but rasmussen has yet to turn up. a memorial service will be held june 29th in portland. that's where rasmussen's stepmother lives. this morning top law enforcement officials from here in the bay area and mark are teaming up with cell phone makers. george gascon and eric snyderman are meeting with representatives from apple, google, samsung and microsoft in new york city today for a smart phone summit. they'll also announce the

formation of a nationwide initiative to stop the surge in smart phone thefts. apple is already jumping ahead of the game. three days ago the tech giant announced a kill switch technology that will be available this fall. it locks out anyone who doesn't have your apple i.d. and password making the phone inoperable and tough to resell. crews will finish digging up the remains of a forgotten cemetery in san jose. the cemetery was discovered beneath a parking lot last year during construction at valley medical center. it's believed to have been used way back in the 1870s up to the 1930s and somehow disappeared from court records. experts say the cemetery was used to bury people who died at what used to be the county hospital but couldn't afford a funeral service. to date crews have now removed more -- actually 631 coffins from that site but have found no identifying information on those

devastating tornado at plaza towers and brier wood elementary school superhero strength. she along with volunteers made 250 superhero capes. she hopes the capes will make those kids feel invincible. >> one house i went to, there was little kid toys and there was a little stuffed animal. to me i have three boys, and to see the pain that that child must have been feeling or what they were going through at that moment, just envisioning my kids and not knowing if the child is okay, it was overwhelming. the points of having a superhero cape is let them go into an imagination land, get them away from reality. >> cosados is the founder of the kiss the toad creation for children with life-threatening illnesses and disabilities. she started sewing capes for her son who has ought tim.

hasn't been in action for more than a year. the goal is to release unused or abandoned i.d.s making them available to others who may want th them. google stopped a series of attempts to hack tens of thousands of account. the company says the e-mail phishing campaigns were named at users in iran. he thinks it's politically motivated in an effort to influence iran's presidential election which happens tomorrow. google is trying to down play its role in the nsa surveillance program. jackie deangelis from cnbc headquarters. >> that's exactly right. downplay it is, according to google, the secret internet surveillance program causing a lot of stir in this technology world. that the company is detailing for the first time how it would typically transfer data to the government if requested. google says the files would be delivered via low-tech means. the futures are lower this morning following another wild day on wall street, the dow posting another triple digit loss on wednesday. it was its first three-day losing streak of the year. the concern was the fed ending its stimulus program. that has been the concern pretty much for the past few weeks and big moves in the japanese yen as well. the nikkea slumping 6% overnight. here in the u.s. we'll get data on unemployment, retail sales and import prices, also business inventories, so watch tore those. the nasdaq losing 36 closing at 3400 even. apple is looking at iphones with a bigger screen. reports saying apple may launch two iphones next year, one with

a 4.7 inch screen, one with a 5.7 inch screen t. current iphone 5 has one of the smaller screens among the top-selling smart phones on the market. apple is thinking about launching a cheaper iphone later this year in a wide variety of colors. the device made with less expensive plastic cases would sell for as low as 99 bucks. back to you. >> thank you very much, jackie. people in the south bay may notice smoke in the air near milpit milpitas. don't call in an emergency. crews from several agencies including the santa clara fire department taking part in a live fire exercise at ed len vin county park. today is the last day of the event. practicing using the fire as a defensive tool for fighting larger and more dangerous wildfires.

been itching to do now that we are getting warmer, that's the day to do some sunday a much cooler air mass headed our way. low clouds, overcast conditions. it's going to be kind of comfortable if you do want to hit the beach. inland 76 degrees. feel free to comfortably have that barbecue even in the warm cities across the bay area. only hitting the 70s as we get into sunday. monday and tuesday we'll see a nights, nice week next week until thursday and friday when temperatures jump back up. we've got a heat wave towards the end of next week. we have hit that sweet stride and we'll keep it going. >> thank you very much, christina. 4:49. families of the victims of the sandy hook elementary shooting will be in washington. family and friends will hold a vigil to honor the 20 children and six adults killed and also hold a news conference calling for tougher gun control laws. house democratic leader nancy

pelosi and senate majority leader harry reid are expected to participate. playgrounds built to honor each of the 26 victims are beginning to take shape in connecticut. tomorrow ribbon cutting is planned. ground will be broken in nearby stratford for a playground honoring one of the teachers. the playgrounds are being built by a new jersey firefighters union. the man who says he blew the whistle on the nsa surveillance program offering new information this morning. edward snowden says the u.s. is also involved in extensive hacking operations against both china and hong kong n. an interview with the south china morning post, snowden says the agency ran tens of thousands of hacking operations against hundreds of targets. these are the first public comments from snowden since he checked out of a hong kong hotel on monday. he's telling the paper he plans to fight expedition and will try to stay in hong kong as long as possible.

the white house all set to welcome members of the lgbt community this morning in honor of pride month. president obama will be there to meet the guests. this is video from last year's event when the president stressed the importance of repealing the don't ask don't tell policy. you may remember raiders punter chris kluwe was invited to that event because of his support for same-sex marriage and equal rights. kluwe respectfully declined, said he had to be at a mandatory raiders mini camp. news broke overnight bay area's own jason kidd taking on a new job. >> congratulations to him. how a boy was able to throw out the first pitch of last night's a's game from more than 1800 miles away. >> quite an arm.

it didn't take long for bay area native jason kidd to find a brand new high profile job. the new jersey nets officially introducing kidd as the team's brand new head coach. the 40-year-old played ball in the bay area for cal. he retired early this month.

a couple nice things on his resume, a couple olympic gode meddles and an northbound title. kidd says, quote, it's a roll i've been studying for over the course of my playing days. 4:55. marco scutaro's hand may never be the same. you'll remember his hand was hit by a pitch earlier this week. giants told the giants' second baseman, it will take about six weeks to straighten out his pinky. scutaro says that's too long. he wants doctors to fit him with an orlanthopedic. he understands playing too early could cause permanent damage to that pinky. this one just a very cool and amazing site. at last night's a's game, the first pitch tossed out from 1800 miles away. 13-year-old nick legrande. he can't play baseball because of a life-threatening blood
