>> there we go. you can taste it. >> it's tuesday, 4:30 on the nose, i'm jon kelley. >> i'm laura garcia-cannon. let's first check the forecast with meteorologist christina loren. >> good morning laura and jon. good tuesday morning to you at home. we have a gorgeous day shaping up considering we could be scorching this time of year. we're starting in the upper 50s just about everywhere. we're only headed towards the low to mid 70s today. then we'll increase that heat as we get into your weekend, lots to talk about on your forecast. we'll take you to the changes. 4:31. first let's check the drive with mike. it's traffic tuesday. >> it's also 4:31. have light in san jose. 101, a nice flow of traffic. the south bay moving smoothly. there is construction to talk about. but first this first report, i want to point out this crash that has been over on the shoulder, north 101 around

blossom hill. it's out of the lanes. but still on the chp report. the slowing southbound also not a big deal, just down to 60 miles per hour. we show it to you because it's in the sensors. it is 4:32 right now. yahoo! releasing information about the federal government's request for information about its users. sunnyvale company posted this statement on its website late last night. yahoo! says between december 1st of last year and may 31st of this year it received 12 to 13,000 requests from law enforcement agencies. many requests concern fraud, homicide, kidnapping and other criminal investigation. also new this morning, a firefighter right now recovering after getting hurt in an early morning fire at the mobile home park in san jose. this one happened on umbarger road inside the county fair mobile estates right near oak hill memorial park. firefighters say an electrical fire broke out in a bathroom of

one of those units. the damage was contained to that home. at this hour it's not clear just how serious the firefighter's injuries area former fremont teacher convicted of possession of child pornography has been arrested again. 63-year-old michael shoop was arrested in pleasant ton, a former special needs teacher. he's already served prison time as part of a plea deal after a man claimed shoop molested him as a child. shoop is set to appear in court on those new charges today. the trial of two men accused in taking part in a gang rape of a richmond high school student continues today one day after the alleged victim was on the stand. the young woman was very nervous, but she was deliberate when asked to relive what happened that night back in october of 2009. she tells the court no, she doesn't remember drinking or

agreeing to sex that night. the hospital said she did have a blood alcohol level of .35 the night she was brought in. she also says she did not remember the rape, but she still has scars from that night. the trial of accused serial killer joseph naso continues this morning. during a two-hour opening statement yesterday naso telling the jury, quote, i am not the monster who killed these women. naso as you may know is acting as his very own attorney. he's also told the jury the prosecution doesn't even have circumstantial evidence in this case, just theories and opinions. naso stands accused of killing four women in the bay area back in the 1970s and 1990s. this trial is expected to last several months. 4:34. the man who allegedly ran naked through a b.a.r.t. station and grabbed several passengers will face formal charges. the 24-year-old is charged with false imprisonment and misdemeanor battery and sexual

battery. the incident took place on may 10th and was recorded on cell phone video at the 16th and mission b.a.r.t. station. he'll be arraigned in court this afternoon. san jose's hp pavilion getting brand new name this morning. the city council voting to change the arena fondly referred to as the shark tank to s.a.p. arena. this is what the arena looked like earlier in the morning with the signs all covered up, no more hp. earlier this day hp let san jose know it's no longer wanting the naming rights to the arena. the name was removed just yesterday. now s.a.p. will reportedly claim more than $8 million for a five-year deal to have its name on the arena. once that name is squared away, the tank will turn to the interior of that building. the sharks say over the next couple years they want to make improvements to the 20-year-old arena. it needs a little upkeep. the team says it does not want to replace the sixth oldest rink

in the nhl, just renovate it. so far the team has not outlined exactly what those renovations would be. a couple major items will be on richmond city council agenda tonight, looking at two ordinances aimed at making the city greener. the first would ban single-use plastic bags in the city. the other would amend the current food ordinance to prohibit the sale of poly spring foam products. the council will consider an extension with its contract with a law firm looking to pursuing a claim against chevron for the august refinery fire. the city is currently trying to settle that issue out of court. get ready. some future stars of baseball in san jose suiting up for to night ice all-star game. lit be the first time ever the municipal stadium, the home stadium of the san jose giants will be hosting the california carolina league all-star game. it doesn't happen until 7:35 tonight. the festivities will get jumping at about 3:30 this afternoon.

if you have a chance, stop on by. a lot of past all-stars have gone on to play up with the big leagues. playing in tonight's game, keep an eye out or angel villa nowan, a few years ago she was a top prospect of the san francisco giants, at that point he was accused of murder in his native dominican republic and his life obviously changed. he spent two months in jail and several more under house arrest before he was finally cleared. right now he's getting that second chance with the minor league giants. feeding the birds could soon be banned in one bay area peninsula city. the reason is airport city. the millbrae city council is set to vote on feeding birds they don't know. they noticed a problem with birds being fed at the nearby millbrae b.a.r.t. station. they're considered that having so many birds in the area makes airplanes more prone to bird strikes. if the council passes the

ordinance, first-time offenders would be fined up to $100. 4:37 right now. what's nice is the weather outside. christina loren says it looks like another good one. >> it's gorgeous. temperatures are very comfortable. thanks for waking up was. as we head through the day today, you can see how we're starting, partly to mostly cloudy. i wanted to start with san jose to show you the low clouds have moved all the way inland. crisp out, there close to 60 degrees just about everywhere. you can go without a jacket in san jose, 56 degrees there. i don't know if you had a chance to enjoy yesterday, but it was just spectacular out there, same deal for today. it's going to be actually cooler. we'll see another strong breeze pick up as we head throughout the day, especially at the immediate coast through the higher elevations. by noon today, only seeing temperatures for most of the bay area in the 60s. we'll round out the day in the low 70s. san francisco today just 58

southbound are the taillights. that's your commute. if you happen to be by the oakland international airport this morning, want to give you a heads up. expect unusual activity out there. the airport conducting a full-scale emergency response drill that starts at 9:00. this one is required every three years by federal aviation officials to test the airport's systems and procedures in the event there is a major incident there. airport officials, they point out they need about 120 volunteers the to roll play for that drill. if you're interested, you have to get over there and be checked in by 7:00 a.m. the drill expected to be finished by 11:30. 4:40. this morning the city of concord will be giving away free anti-theft clubs. if you live or work in the city and own a toyota, nissan or acura made between 1985 and 2005, stop by the concord police department for your free steering wheelock. the program, operation wheelock, is hoping to reduce vehicle

rose on monday even as they're a guessing game over what the federal reserve will do this week. an article this week suggested the fed could pull back soon but that won't mean an interest rate hike will follow. we get data on consumer prices and housing starts, the dow rising to 15,180, the nasdaq at 2,452. rice her is expected to formally refuse the government recall. the risk is the fuel tank could rupture in a rear end crash which could cause a fire. regulators say 51 people died in related accidents. chrysler has said the jeeps are safe. car companies rarely spar with the government. the last time was in 2011 when ford fought back over the recall of faulty air bags. the ntsb won out in that case when it threatened to hold a public hearing. at&t is launching solar

that will be friday we have the solstice. you saw the live picture of the bay bridge. temperatures are nice and mild, 56 degrees. 57 in oakland. we're really comfortable across the bay area. as we head throughout the day, the winds will start to shift. we'll see a tight pressure gradient. low pressure starts to move inland, heads off to the east as this areas moves out of here, high pressure starts to move in. we'll see a pressure gradient as the two systems compete against each other. by about 9:00 a.m., even with cooler air headed our way, it's going to be really nice around here. look what happens. we have this weak disturbance come through between about 11:00 and 2:00. as that thing comes through here, it will reinforce that cold shot of air. we won't see temperatures break through in san francisco. 73 for livermore, 73 in santa theresa. 67 in san jose. this is the coolest of the week.

tomorrow we'll climb by a few degrees and be back in the low 80s, not too bad by thursday, even on saturday when we hit our peak, not that bad, 87 degrees. weak disturbance comes through sunday into monday. that will keep our temperatures level right about average for this time of year. 4:49. back to you, jon and laura. >> new this morning, protests escalating with more than 100,000 people taking to the streets in at least eight different cities. this all started last week after an increase in bus and subway fares. in rio protesters tried to break into the state assembly, throwing molotov cocktails at police and anything else they could get their hands on. at one point the crowd was dancing and singing around a burning object. this unrest causing big-time security concerns for that country which is currently hosting the confederation's cup soccer tournament next year,

next summer hosting the world cup. come 2016, the olympic games. it is 4:49. today is a historic moment for afghanistan. its armed forces begin to take the lead on the country's security from nato. afghanistan's president says over the next coming months security forces will replace nato forces as they withdraw from the country by 2014. the ceremony held at afghanistan's national defense university in kabul is a significant milestone in the afghan war which has lasted nearly 12 years. nato secretary general attended the ceremony where he promised the organization's continued support. president obama headed to berlin this morning. during the final hours of the summit, the leaders talking about how to stop the kidnapping of foreign workers in africa and how to get multinational companies to pay more taxes. there's also some behind the scenes haggling to see if all

eight can come to the agreement ton syrian civil war. russia's president, vladimir putin, an ally of syrian president bashar al assad standing firm on his stance. nasa marking a historic moment in space today. 30 years ago, sally ride became the country's first ro man in space. she and four colleagues blasted off aboard "the challenger." she also remains the youngest american to travel to space. she died last year at the age of 61. california lawmakers considering tougher restrictions today on the use of drones. an assembly committee reviewing a big aimed at establishing standards for domestic drone use. that bill recently passed in the state senate. doanes been a hot topic for agencies here in the bay area. last year the alameda county sheriff's department pitching a

plan to use drones for community surveillance, neighbors and the aclu complained it would violate privacy. also at the state capital today the senate committee considering a bill aimed at making limousines safer. senator jerry hill's bill requires all limos to carry fire extinguishers, the second bill introduced this week in response to a pair of limo fires in the past two months. early this month in walnut creek ten elderly women safely escaped after their limo caught fire. last month, five women died on the san mateo bridge when their limousine burst into flames. 4:52. giants playing well into the night, way past our bedtime. we'll tell you how things went next. plus the girl scouts offering a little pick me up this afternoon, you can get your hands on the thin mint flavor in your cup of joe. >> i hope they sell that
