right now, 5:01. congratulations, you have made it to wednesday. good morning, everybody. thank you for joining us. i'm jon kelley. >> i'm laura garcia-cannon. hours away from b.a.r.t.'s police chief announcing a review of sweeping changes made to the department. all following the shooting death of oscar grant. christie smith joins us live in oakland with a look at reforms getting a closer look. >> reporter: good morning. you know, even a very well-known civil rights attorney is saying something like this doesn't happen very often. just a couple of hours, b.a.r.t.'s police chief is going to be announcing they're taking a second look at, as you said, sweeping police reforms that were made since 2009 when passenger oscar grant was shot right up there on the platform at the fruitvale b.a.r.t. station. one of the evaluators will take a look into b.a.r.t. changes instituted since 2010.

new year's day, 2009, very early. then-b.a.r.t. police officer shot grant, who was unarmed as he lay face-down on the platform. mehserle mistakenly pulled his gun instead of taser which he tried to reach for. in july, oliver will look at ten specific items, including train, use of force, bias-based policing, internal affairs, and discipline. oakland-based attorney john burriss represented grant's family one time and applauds the chief on taking a serious look back. >> i think the departments often do not examine themselves, certainly by outsiders. you can become very insular and not really have the critical eye that's needed. >> reporter: the timing of this is interesting. tomorrow night burriss and other invit invited guests will watch

"fruitvale station" it's a film on grant's last hour as live. that film opens nationwide july 12th. christie smith, today in the bay. >> police say they believe it was simply a tragic accident. sadly, leading to death of a 6-year-old boy in union city. he was out playing in his uncle's backyard monday when his unc uncle's pit bull attacked him, biting him on the head. his uncle is a san mateo police officer and was home when this happened. an attorney who represents officers across the area said the officer did his best to save the boy but the boy did die, and the dog remains in quarantine. 5:03. reward fund is growing for income leading to the gunman who kill an emeriville man in an apparent case of road rage. he was driving home from a game of pick-up basketball when his

car was reopened. after a confrontation the two men shot him and drove off. several family members and community groups offering rewards totalling more than $30,000 for information leading to an arrest. to a bizarre story with quite a long history here. two former san francisco landlords have worked out a plea agreement with the district attorney's office after they allegedly terrorized their ten e e tenants relentlessly. marla, quite a strange one out there. >> reporter: hard to believe. good morning. the married couple in the case has earned a couple of interesting nicknames. one, they're known as the lawless landlords, also landlords from hell, not people you want to pay rent to. they are charged with multiple felonies for putting tenants through a living hell, happening on clementina street.

it's hard to see but it's on the wry side of the street of south and market. kip and nicole macy bought the three-story, six-unit apartment building back in 2005. the trouble with their tenants began a year later when they tried evicting the five who lived here. they lost the battle and that's when terrorizing began. the macys ordered workers to cut the beams that supported the floor of one tenant. they also reportedly cut a hole in a living room floor, cut off electricity, stole money and jewelry all in an effort to get them to move out. prosecutors say nicole broke into an apartment and poured ammonia on clothes, the bedding, and that person's electronics. the couple was arrested but posted bail, then skipped town. they hid out in italy for a couple of years before being arrested there in 2012.

today, the district attorney is expected to announce a plea deal that will reportedly send both kip and nicole macy to prison for almost 4 1/2 years apiece. the attorney is expected to make the announcement at a 10:30 news conference. marla tellez. a small peninsula airport under scrutiny for high lead emissions. an epa study of 17 small airports across the country found san carlos airport had the highest concentration of airborne lead particles, more than double federal standards. small airplanes have to use leaded fuel to operate. the manager of the airport tells the mercury news the lead measurements are deceptive because monitors were placed close to where planes rev their engines prior to take-off. mon monitors in other areas registered lower amounts of lead. a cool, crisp, brisk start to the day.

northbound, up by the dump in navato one lane blocked. only two there. there's a crash going on on the shoulder. >> thank you. call this one the battle of the bay. now major league baseball firing back this morning, blasting the city of san jose for suing the league over the a's potential move to the south bay. thousands of fans packing the stadium in san jose for the minor league all-star game. of course all of the buzz was about the major league move. the a's foengs mopotential move in the make for four years and san jose running the of patience. 44-page complaint accusing major league baseball of, quote blatant conspiracy to deprive the city of san jose of having a major league baseball team. mark bloom lives in oakland but would support the a's migrate together south bay. >> i support what the city and

a's are trying to do. as a resident of oakland, i a little sad. >> the giants have no comment. a's owner lou wolf doesn't like the matter being solved with lit gaths. major league baseball releasing the statement, quote, the lawsuit is an unfounded attack on the fundamental structures of a professional sports league. it is regrettable that the city has resorted to litigation that has no basis in law or in fact. >> san francisco has hired a high profile lawyer who has successfully sued enron, the bush administration. taking the case on a pro bono because he's that upset. >> it's all about greed. this is not only a legal case, it's a moral outrage. you see what's happening. this is the tenth largest city in the nation. they're being subjected to a cold shoulder by bud selig.

we talked to chp and got details. traffic $wise the crash southbound 101 hillsdale a nonconcern. there are no lanes blocked. human interest, there is a report the coroner called to the scene. a solo car crash off the embankment, may have been medical issues related to that, causing that person to go off the roadway. that is the activity here. following it at news desk. as far as traffic new york lanes blocked. we're fol he llowing this in th newsroom. we'll look to the east bay. we have an issue on city streets. 238 and 880 are smooth. right on edge of the city, we have that intersection with activity. lanes are open but watch it past the scene headed toward 238 or 880. we have a small build coming here. westbound 580. slowing through livermore and we

saw how 84 slows. altamont pass, gusty wins into or out of the area. also in the area, talked about the alameda downty fair. live look fremont. slow of traffic into the south bay. southbound 880, no problem for speed. new this morning, the city of mountain view moving forward with a controversial road closure. the city council signing off on a developer's proposal to close the on ramp. the closure will make room for a new apartment complex. city council says it will cut down on the number of drivers cutting through the neighborhood. but concerned residents says, closing that ramp will make nearby moffet boulevard tougher to navigate during busy commute hours. good news heading out to state beaches in sonoma county.

parking for festivities will remain free for now. the board of supervisors rejected a plan to charge people for parking at the 14 lots with beach access. the state wants to install pay stations at the lots and charge people $7 to park. right now, as we mentioned, parking is free. we like to call it friday 99. it's unclear if the parks department will appeal the decision to the california coatle commission. the first time anywhere california academy of sciences has put on public display the larger pacific strirng an octopus so rare and it done have a scientific name. today in the bay's bob redell explains why one biologist has his arms full with the creature with too many arms to count on one hand. >> reporter: getting a rare eight-arm boy to mate with a rare eight-armed girl, that's

musk says model s vehicles affected were made between may 10th and june 8th of this year. the recall says the mounting bracket on the backseats is weaker than intended and may not hold in event of a crash. tesla has not received any customer complaints so far and no reports of injuries. affected owners will be contacted over the next few days. happening now, president obama spending last day of his trip to europe with meetings in germany today. little over an hour ago, president obama spoke alongside german chancellor angela america until berlin covering everything from the g-8 summit to afghanistan and the u.s. spying perhaps. in less than a half hour, the president expected to make one more speech before he flies home to the u.s. we'll have a live report with more details in 15 minutes. b.a.r.t.'s police chief wants to find out if reforms placed on his department are in fact working. following the shooting death of

"today in the bay" christie smith live at the fruitvale station with a look at reforms coming under scrutiny. >> reporter: good morning. an attorney who represented oscar grant's family after the shooting here at the fruitvale b.a.r.t. station thinks it's a good idea to look at what happens being done. what b.a.r.t. is doing is starting in july, bringing in a former police chief, patrick oliver. take a look at ten specific items that b.a.r.t. has been working on including training, use of force, bias-based policing, internal affairs and discipline to assess reforms made since 2010. current chief says when he came on board after the shooting of oscar grant in 2009, he had a couple of goals and that included trying to inprove public safety and strengthen ties to the community. in 2009, the then-b.a.r.t.

live with what's happening in the case today. good morning. usually the tenants cause problems for the landlords but it's the opposite in this case. the couple who used to own one of the apartment buildings south of market in san francisco earned the nickname landlords from hell. according to public records, kip and nicole macy bought the apartment building back in 2005. by '08, charged with multiple felonies, including first-degree residential burglary, stalking, vandalism and criminal threats, to name a few. prosecutors say, in an effort to get five tenants to move out they terrorized them. take a look at this laundry list of torments. prosecutors say the macys ordered workers to cut the floor beams inside one place and this man would potentially fall through. reportedly cut a hole in a living room floor, cut off electricity, stole money and jewelry from tenants.

located on farmhill boulevard in redwood city. pg&e customers in the south bay have a chance to weigh in on proposed increases for gas and power bills. pg&e wants to raise customers' rates to upgrade its distribution system to make them safer and more reliable. the california public utilities commission will hold two public hearings today, both at the alfred alquist building in san jose. one starts at 2:00, the other at 7:00. 5:36. christina loren has been saying over the last couple of weeks the weather helping with gas and electric bills. more of the same today? >> just living in the bay area helps as well. we could be in southern california where they have edison and you'd probably be payipa paying twice as month. for us, so far, it's an abnormal june. starting out clear in city by the bay. we talked about june gloom, which ed overcast conditions

have more security this morning. crews completing the first phase of a project to repair the bank of the san francisquito creek. the avenue resurfaced and the bank shored up with a new concrete dike. that creek, if you recall, overflowed last december sending mud and debris out on to the road and into homes there. city officials say there is work to be done. the cost of the repair project could reach up to $2 million. 5:39. major pet food recall to tell you about could get your family sick as well. the president getting ready to make one more address before he makes his return flight back here to the united states. we'll let you know what he's expected to say before he dep t depar departs. that's coming up.

a quick trip to germany. the president and chancellor merkel holding a joint conference which included comments on the nsa wiretapping scandal. president obama says he's committed to protecting the american people, also protecting civil liberties. in minutes from now, the president will speak to the german people at the historic brandonburg gate the same spot where president john f. kennedy gave a defiant cold war speech 50 years ago. "today in the bay" danielle lee is like with what the president is expected to say today. >> reporter: good morning. i'm looking at live pictures of the crowd waiting to hear from president obama in just a few minutes. officials gave out at least 6,000 tickets. quite a few people waiting to hear from him. during this celebratory speech, early at the brandonburg gate where president kennedy spoke, president obama plans to talk

about reducing nuclear stockpiles, specifically in the u.s. and russia, by one-third. he's going to be focusing on that issue which has been a priority of his. it was earlier today we saw the tough questions in meetings president obama had with russian president and also chancellor angela merkel. he faced tough questions on the u.s. spying program. german leaders had concerns about government surveillance and wanted more details about what exactly the u.s. was obtaining in phone records and e-mails. he also talked about ending the conflict and how to go about reaching a peace resolution in syria. it was during g-8 summit president obama and putin disagreed with what needs to become of assad as they try to find peace. he's looking for support from german leaders. the third big issue for president obama is the war in afghanistan. as talks gone with the taliban. they face a pushback from hamid
