good morning everyone. we have a follow up for you right now. bike riders in the south bay demanding change to road safety after a cyclist was hit and killed in downtown san jose. residents there starting this petition on change.org calling on may your chuck reed and other city leaders to create a safer environment for cyclist. it's already nearing 100 signatures. on monday a driver in an suv hit and killed 55-year-old lynn ernest as he drove his bike on the taylor street overpass of highway 87. so far that driver has not been found. also new this morning, san francisco police looking for gunmen involved in an overnight shooting. this one happened around 10:00 last night at the corner of 6th and natoma street. a male victim suffering two gunshot wounds, right now listed in stable condition. investigators say he's not cooperating and refusing to give details of the shooting. police believe there was more

than one gunman based on the different shell casings found at the scene. back to business for berkeley's world famous restaurant chez panisse. doors will open almost four months after a fire destroyed part of that building. "today in the bay's" christie smith has more details on this price see grand reopening. this is full circle because you were one of the first reporters on the scene when it caught fire all those months ago. >> reporter: yeah. good morning to you. as you said, it's been nearly four long months since chez panisse shut its doors because of the fire. every time we've been there covering this because of the fire and the rebuilding process, people stop us and want to know what's going on. and they ask us when it's going to reopen. we have some good news. that is it's going to finally be serving food, opening the doors tonight with a celebration and fund-raiser at $1,000 to $2,500 per person with proceeds going to the edible school yard

project. that's a school curriculum that teaches students about healthy food choices. it is a private dinner. chez panisse was founded by chef alice waters, an icon and activist in the california cuisine movement. the building itself created by artists many years ago on march 8th. overnight electrical fire caused about $200,000 in damage and shut down the restaurant for months. originally it was believed that the restaurant could open up quickly, but the dates were pushed back. the original designer brought back in, the original redwood cleaned out by hand. the outpouring of support was simply huge. >> a young girl and her friend had a lemonade stand in front of their house, meyer lemons. she made lemonade and came over and gave me a gift of $37 that they raised. it was so touching, so

beautiful. >> now tonight our own raj mathai sits down to alice waters on the latest installment of "the interview" in a rare one-on-one conversation with her. that's tonight at 6:00. then after the game at 11:00 chez panisse opens to the public on monday. reporting live in berkeley, christie smith, "today in the bay." it's 5:04. this morning prosecutors say a stockton man convicted of killing his girlfriend and stuffing her body into a trash can in the bay area may have killed before. 34-year-old javier sandoval was sentenced to 15 years to life for the murder of his 25-year-old girlfriend. her badly decomposed body was found inside a trash can in pleasanton in may of 2012. she wasn't identified until several months later. prosecutors are saying the victim may be the third woman sandoval has killed in order to

get out of a relationship. they're now compiling evidence on the suspicious deaths of those women and hope he will be denied parole when he's up for parole in 2028. another bizarre and twisted story, a man suspected of killing three people, then stuffing their bodies in a car and lighting it on fire is expected to be in court today. sheriff's deepities in butte county arresting 72-year-old donald clark yesterday. the burning car was discovered last week in a rural area about 90 miles north of sacramento. two bodies were found in a trunk and a third in the back seat, all of them had gunshot wounds. investigators say that car was reportedly stolen out of sacramento and believe all three victims were from there as well. a bay area based clothing chain will pay almost $4 million in fines for knowingly selling defective children's clothing. the consumer product safety commission says ross continued to sell the kids' jackets and sweatshirts after the agency

at noon. closer to 90 today than yesterday. 84 for livermore, 77 in fremont and 67 degrees in san francisco. we're going to climb for saturday and then on sunday temperatures drop like a rock and we bring in some rain showers. so if you want to check out the moon, you'll get the best view of it on saturday night. closest to the berth, all of 2013 it's when the sun, the earth and the moon align. of course, today, longest day of the year, it's going to be a long one. 5:07, over to you. >> it's a friday, we like to enjoy as much friday as possible. looking over here, a long commute. already a long morning for a couple of voex involved in this crash sunday 880 at 66. that's across the freeway from the coliseum. two left lanes are blocked. i talked to chp. they say they don't know when the lanes will reopen. they're waiting for the right size tow truck to get there to remove the car blocking the left two lanes. at the bottom of your screen you

see the flashing hazard lights, it sounds like it's a non-injury, but still an ambulance heading there for precautionary sake. the map shows you, this happens right as you pass around the kufr approaching the coliseum as high street and it slows all the way past the scene. the buildup quickly happening, even though it's very early in the commute, it happens around the bend and that's causing folks to hit the brakes harder. so expect some slowing through the area and we'll follow this with chp as well as see what they have as far as any clearing time in the next few minutes. 580 completely clear in the eastbound direction. westbound would be your commute heading toward the bay bridge, no problem. the earlier construction on the bay bridge where we had slowing, looks like it's clearing. those crews should be on the move and completely cleared in the next few minutes. a little blurry, i have to work on the focus, but university avenue, reports of a crash there. i don't see any disruption to the flow of traffic.

land safely. >> after nine days of questioning potential jurors, they have seated a jury in the george zimmerman murder trial. the process of eliminating the pool of 40 prospective jurors began with each side getting ten strikes. from that they selected six jurors and four alternates. the jury is all women while the alternates include two women and two men. opening statements are set to begin next monday at 9:00. george zimmerman has pleaded not guilty to the shooting death of 17-year-old trayvon martin. if convicted on all charges, he could face life in prison. zimmerman maintained he was acting in self-defense. former enron ceo jeffrey skilling will find out today how much of his 24-year prison sentence will be reduced. last month the justice department and skilling's lawyers agreed on an early release which could set him free by 2017. under the proposal skilling would drop all remaining appeals and give $41 million in

restitution to victims of enron's collapse. he's currently serving a 24-year prison sentence after being convicted in '06 for corporate fraud. there's hope stocks may bounce back late bit a day after one of the worst hammerings in recent memory. scott mcgrew, a rough one out there. nearly every company losing big. >> none quite as big as oracle. the redwood company said shares lost nearly 9%. this despite good news, the world's second largest software company, double dividends announce add stock buy-back. oracle announced it's leaving the nasdaq, starting next month will trade on the new york stock exchange. this doesn't affect your investments really. it is an embarrassment really to the nasdaq. so the broader markets god walloped, that was a full day after the fed made that big announcement. it was as if investors weren't paying attention the first time around. let's check in can kayla

tausche. >> futures are higher today, stocks suffering their worst day of the year on their first full trading day after the speed from fed chairman ben bernanke. investors are most worried about the prospects of higher interest rates after the fed hinted it could scale back stimulus efforts. the dow, nasdaq and s&p 500 all falling more than 2% yesterday, the dow losing 354 to fall below 15,000 and the nasdaq losing 78 to 3,365 f. the fed goes ahead with the plans, that could not only push interest rates higher but also mortgage rates which could lower demand for new homes which would squeeze home builde builders, too. most builders say they're still optimistic believing higher rates will encourage potential buyers to jump into the market before they go higher. the good news in all of this,

if we see any showers over the course of the race, lit be at the very, very end. you know, very dangerous when you got that rain on the tracks out. there staying on top of this forecast very closely. as we head throughout the day, temperatures in the mid 80s, 84 for livermore, 67 degrees, a beautiful day in san francisco. then saturday into sunday, look at the difference. we'll drop your temperatures by about 10 degrees on sunday, fog and drizzle. showers sunday night continue the rainfall monday and tuesday. we'll be tracking those showers for you when we meet back there next week. wednesday and thursday, just as quickly as they went down, the temperatures will shoot right back up. we'll see a dry pattern, elevated fire danger toward the end of next week. lots to talk about in the weather department. good morning, mike. >> good morning. we actually had a lot of developments over the time between the time i just showed you this shot in berkeley and now. it looks the same, but in that time we did have a traffic break approaching university avenue. that's the shadow right there,

the over crossing, a traffic break right there. they moved some car to the shoulder and now the traffic has reinstated over the last five minutes it's been recovering in speeds. that's how light it is down the eastshore freeway. all is clear in your westbound commute direction toward the bay bridge. there's the volume you jt saw. farther south seeing a lot of slowing from fruitvale avenue toward the coliseum. there it is on the maps. a live shot. let me show it to you as well. the crews are still on scene. the tow truck just arrived and just pulled away. the flashing lights cleared in the last 30 seconds as we're looking overhear. the flares are clearing -- looks like all lanes have cleared as well. now traffic just flowing. how is that for a live report. we see it changing right before our eyes. a lot smoother over the next ten minutes. meanwhile the commute direction northbound past the coliseum, that's just fine. no delays out of the altamont pass toward livermore toward the dublin interchange. a note for the area, you have an

it is 5:31. good morning. thanks for being was. i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. a big story going on here. police in three peninsula cities on the hunt this morning looking for the very same man. police say this man, 20-year-old melvin bellard is responsible for a string of burglaries that started back in april. bellard broke into three homes in belmont in a matter of minutes. later police say he then broke into a home in san mateo, but this time a woman arrived home during the break-in and managed to scare him off. hillsborough police spotted him driving through an area nearby and started chasing him. bellard was able to get away, but his car was later found in san francisco and, get this, had about $30,000 worth of stolen goods still inside. >> his time will come, i'm sure, especially doing so much like

that. you can only get lucky so long until everything catches up with you. >> investigators say bell hard does live in san francisco but also has strong ties to the east bay. san jose police are talking about ways to keep the community safe this weekend. the department says it expects retaliation for the city's latest murder t. suspects in the killing of 16-year-old manuel urzoua are on the loose. a gang mop shot and beat him wednesday night. he died yesterday at the hospital. the attack happened on virginia avenue near the intersection of story and king roads. this killing is the city's 25th homicide of the year. now an nbc bay area followup. police need your help finding the man of this man. he was severely beaten in downtown san jose, beaten so badly he can't actually caulk now. yung oh remains in the hospital. because he can't communicate, they need relatives to make critical medical decisions for

him. he was beat up over the highway 87 overpass between san fernando and santa clara streets around 1:00 in the afternoon. police believe he lived in this homeless encampment. police are also looking for witnesses there. this morning a 16-year-old boy is behind bars in gilroy accused of stabbing another teenager. police say his 17-year-old victim walked into an emergency room at saint louise regional hospital about 8:15 wednesday night suffering a stab wound to his upper body. he's telling police he was stabbed near the corner of 10th street and monterey road just off highway 101. police set up a perimeter in that area and they were able to finally track down and arrest the 16-year-old suspect nearby. police say the stabbing may be gang related. 5:33. hollywood's spotlight is shining bright at oakland's grand lake theater. last night was the premier of the movie "fruitvale station, a film about the life of oscar

grant. all the stars in the movie walked the red carpet including academy award winning actress octavia spencer who plays oscar grant's mother and forest whitacre who is one of the producers. the movie takes you through grant's life before he was shot and killed bay b.a.r.t. police officer on new year's day 2009. the film's director is oakland native ryan cueing her. he felt grant's story needed to be told. >> it's hard being a young african-american male from this place, i think everyone was affected. >> "fruitvale station" opens nationwide on july 12th. governor jerry brown says he's appealing a federal court ruling to release thousands of california prisoners. yesterday the federal court ordering the release of nearly 10,000 inmates trying to relieve prison overcrowding. the ruling says the state must reduce the population to 110,000 inmates by december 31st. right now we can tell you the

population is over that number by about 9,400 inmates. since back in 2006, california has already shed about 46,000 inmates as many low-level non-violent offenders move to county jail. governor brown not a fan of inmates being let go saying the release of more prisoners could endanger public safety. 5:35. the kitchen is all set to go. berkeley's world famous chez panisse restaurant will open the doors today almost four months after a fire heavily damaged that restaurant. the smoke damage. finally the day is here. chez panisse serving food again tonight with a celebration and fund-raiser for education programs at the berkeley based edible school yard program that stretches all the way to the white house. that costs $1,000 to $2,500, it is a private affair. this is a long time coming. the world famous restaurant opened in 1971, caught fire on march 8, and that made national headlines. waters is a pioneer the organic sustainable food movement, and she wanted to get this restaurant back up and running quickly. they brought back in the original design tore help out. waters tells us what it was like getting the notice that chez panisse was burning. she actually got a call from the gm. >> and she said don't panic, but there's been a fire at the restaurant. and i think you should come over now. and i got up and i was kind of

we'll hit a high of 67 degrees at the coast. tomorrow we crank that heat. sunday we bring in some rain showers. i'll tell you who and when you're going to need that umbrella, especially next week everyone will get late something. microclimat microclimates, you know all about it. >> microclimates, micro commutes. so many different topographies, that's what we're talking about here. one of the early spots for our first commute of the day is the eastshore freeway and we had quite a bit of drama as there was a crash and traffic break. all traffic stopped for just a couple of minutes over here at university avenue. as you can see, the traffic flow has evened out. back close to the limit as you travel past the overpass and university avenue. over to the maps, you see no major issues heading toward the bay bridge. across the upper deck, fine across that incline. there's a new crash that shows up for 580 around 980, but no

"the guardian" is publishing two new documents from edward snowden, the self-proclaimed leaker that say there are top secret rules that govern how they collect information. ear learning more about how they store that information. according to these documents, sometimes these communications, the phone kaunlsd e-mails can be kept indefinitely if the government thinks there's information about foreign intelligence or evidence of a crime in some cases even though they're targeting foreigners, if the foreigners contact american citizens, then the american citizens' information will be kept, even in some cases if it's determined by an attorney -- covered by attorney-client privilege. these are exceptions, not the rule. and the nsa has said for the

a little warmer than average by tomorrow. but today hitting highs right on track for the first official day of summer. that's pretty unusual for us to actually hit those highs right on point. 7:00 p.m. saturday, look what happens, area of low pressure starts to track closer and closer to the coastline. going to get kind of blustery on saturday night. the area of low pressure will kick up some instability. we'll see gusty winds on saturday. we stop the clock for you 10:00 p.m. sunday, bringing in the rain showers from sonoma county down through marin and even san francisco to san mateo getting some light precipitation sunday night. so if you want to check out that super moon this weekend and lit be spectacular, you'll get a better shot of it on saturday night. by tomorrow, 87 degrees. when we peak sunday we drop your temperatures by 10 degrees. monday and tuesday we keep the rain in the forecast. mike and i will be here to guide you through the showers as we kickoff next week. we always are, mike.

>> we are. we will be here for you and paycheck. all right. we're looking over here as these folks are getting their paycheck, heading northbound 101. we've seen a little increase in volume, not a dramatic thing. that's friday. we have an easier build to the commute. looking at the map, overall, the sensors show just that slowing through the area, 87, 280 and 85 not a big deal right now in the northbound commute direction. even less of a deal in the southbound direction. as you travel through the tri-valley, a smooth flow of traffic, speeds coming down just toward about 60, maybe the upper 50s at the very worst traveling through livermore and toward the dublin interchange. right here as you're traveling down, no problems getting towards 680 where it flows smoothly through pleasanton. the alameda fair going on this weekend. you'll see congestion around that exit for now. looking at north 880, a new crash reported involving a big rig.

embarcadero exit. it's on the right-hand shoulder not impeding any lanes. traffic has been relatively smooth through that area. the bay bridge toll plaza on the maps, live look right here, you see the cash lanes blacking up. the fast track lanes still very clear right now. the north bay, no problems. but the raceway at sonoma will be crowded. a lot of blood, sweat and tears, but king james officially keeping that crown this morning. the miami heat and all their fans celebrating the team's second straight nba title. the rock and roll game an epic series. tim duncan the chance to be the hero misses not once, but twice. not the hero. more the zero. lebron james, on the other land, superhero. that's right. nails the dagger, gives the heat a four-point lead. less than 30 seconds to go, james a huge night, 37 points, 12 boards, hit five three-pointers, leads miami to a 95-88 victory. yes, to the victors go the spoils. he was crowned the mvp for the second straight year.

. we have mind-blowing video to show you out of china showing a child being rescued after falling from a window. >> a group of delivery men saw the 2-year-old girl dangling from a window five stories up. they gathered underneath. the girl fell right into their arms. state media quoted the girl's parents say they left her home alone when she was sleeping. when she woke up, she climbed out the window on her own. >> two of the men were actually injured during the rescue. the little girl escaped with just a scratch on her face. >> so hard to believe.
