>> i'm marla tellez. laura garcia-cannon is off today. >> good morning to you. right now showers steadily streaming onshore. you want to give yourself ample time to reach your destination. the heaviest rainfall hitting the peninsula. the heaviest rain, the bulk of the moisture slated to come through right in the heart of your morning drive. we want to make sure you're prepared for that. watch out for slick conditions right now al wlong 280, also 82 near san mateo, starting to get nice and wet there this morning. we stop the clock on your futurecast. this is how much moisture we're expecting by the 6:00 hour. you can see showers will intensify quickly. that means it's going to be a slow drive to work. if you're trying to catch a flight, yesterday we had upwards of 1 1/2 hour flight delays for about three consecutive hours yesterday. let's find out what's happening at sfo this morning. in addition to the weather, our bob redell is live out there.

they're dealing with a whole other issue likely to coincide with the weather forcing flight delays this morning, right, bob? >> reporter: yes, good morning, christina. if your forecast is going to be right, which it seems like it is, because we're already starting to see a little spital out here, there could be more delays at sfo. we won't know until around 6:00 or 6:30 when the faa issues their ground delay programs, their directives as far as what they want the air traffic controllers to do with regards to the weather. to give you a sense of how bad delays have been, on a normal overnight at sfo, they receive six to ten arrivals. this will be after midnight. to make up for all the delays yesterday, they had over 60 flights so far. here is another wrinkle you can add into what could affect delays today. the sfo airport is going to have one runway closed for repairs. you've got the possibility of bad weather and you can see more delays. we won't know until the 6:00,

6:30 delay. yesterday well over 100 flights canceled at sfo. one woman was trying to get to portland to stop a new job at a hospital. >> booked the last flight to get home in time to start clerkships at the hospital and i'm missing them right now. >> how many flights have been canceled on you today? >> three. >> you seem to be holding up rather well. >> i've already cried enough about it. >> reporter: across the bay at oakland international, yes, delays, but nowhere near as severe as what we're seeing at sfo. normally they see two to three arrivals. yesterday there were around ten flights because of delays. they tell us they don't expect weather to affect departures. as far as norm net that, we have a call into them but haven't heard back yet. bob redell, today in the bay. >> thank you so much. with all the rain comes slick roads and then comes the troubling commute. mike inouye is here now. how is it look? >> it's pretty slick because of

the overnight rains. fortunately the first rain after a couple months, looking for a lot of spinouts, we didn't see that yesterday during the morning commute. it's been lighter because of the summertime. look at the bay bridge toll plaza, you see the water kicking um the mist behind the cars. the headlights of the cars coming behind them. be careful of the puddling at the toll plaza. the map shows you it's a smooth drive. light traffic through the area as well. the map system, the south area, south through fremont we're seeing a crash involving a big rig blocking two lanes at auto mall parkway. following that incident as well. that could be a combination. back to you. >> mike, thanks so much. 5:04. another morning of suspense at the u.s. supreme court as millions of americans are waiting to see what the justices will decide on california's ban on same-sex marriage. the court holds another session in less than two hours issuing rulings on six remaining cases. "today in the bay's" cheryl hurd joins us live in washington,

d.c. this morning. what are the chances we actually hear about prop 8 today? >> reporter: well, we're not hearing anything at this moment. they're going to begin looking at the rulings in about a couple of hours. but i talked to a couple of people standing in line before they went inside, they seem to think that something will come down today. i don't think they felt that way yesterday. to be quite honest with you, nobody really knows. there are 50 seats available to the public and about 150 people showed up today. most of the folks here are law students. some have come from california just to be here. of cows, you have special interest groups watching closely. i spoke with a policy director for the national center for lesbian rights here in washington, d.c. and she believes adding an extra day for rulings today means a lot. >> we sort of expected that, you know, just because these cases are so controversial, there are so many issues. that just really indicates that they're sort of taking their time and really each day we'll

in his early 20s. he was shot at about midnight on ellsworth street just off alemany boulevard. the victim was hit at least once in the chest and pronounced dead at a local hospital. so far there have been no arrests made in this case. menlo park police right now asking for your help as they search for evidence in a double shooting. police were called to hamilton avenue near bell haven elementary school just saturday night. they found evidence of a shooting there, but no victims. police tracked down two men at a local hospital who claimed they were hit in a drive-by shooting. both were treated for non-life-threatening injuries. so far detectives have no leads in the case. 5:07. a lawyer from one of the teams in the america's cup sailing race is threatening to go to court after rule changes after a deadly training accident. at issue is a change in specifications for a piece of boat equipment known as a rutter elevator.

it helps control the high-tech catamarans when they go airborne. the team says rutter elevators are for boat performance and not for safety and should not be regula regulated. it came after an art mass catamaran crashed and killed a person. good morning to you. 5:08, 51 in novato, 63 in san francisco. i 63 in san jose and 61 in gilroy. you can see it from time to time. it's not quite full, but that super moon is still out there this morning. you might catch a glimpse of it, through passing clouds overall, we have mostly cloudy conditions especially from the north bay down south to half moon bay. that's where the moisture is concentrated. you'll find slick conditions this morning. make sure you give yourself plenty of time. even where you don't see the green on the radar, we're

getting a steady mist and drizzle caused by the thick low clouds. nonetheless, we're starting out this morning in the 60s, plenty of mid 60s out there. you won't see a lot of climb today in terms of your temperatures in san francisco, 64 degrees there. plenty of mid 70s around the bay. 79 for livermore, 76 in san jose and 78 degrees today in los gatos. these temperatures are comfortable. we are in the triple digit plus range at the end of your seven-day forecast. i want to help you prepare for the major changes in the weather department up next. 5:09, how are we doing on a traffic tuesday? >> living up to its name. we already have issues. live shot at 880 southbound with the headlights near tesla. you see the auto mall parkway sign, the fremont auto mall over on the left. that's where there's a crash just north of there. the backup holds up the traffic going through that camera shot we just showed you.

actually slowing from stephen son boulevard where there may be three of your four lanes currently blocked by a big rig verses a smaller car there. no update on the injuries, but we do have the three lanes reported blocked. that means there's one, maybe two lanes depending on where it is in relation to the on-ramp. you see slowing developing already. ha is an issue south of the dumbarton bridge, highway 84. both the dumbarton bridge and the san mateo bridge moving smoothly. keep in mind it's slick guys. >> it looks lonely there. 5:10. stanford university issuing a new report this morning comparing public verses charter schools. which one provides a better education for students? we veal the answer coming up. wall street continues its slow slide. the dow down 5% on the month. we'll take a look at why it's totally normal to get a million dollars for going bankrupt ahead in business news.

the county's health system plans to use twitter and facebook to make sure information is delivered quickly to the community after a crisis. health officials say they are working to improve their facebook page and also training employees to become experts in social media. they're also asking other local agencies like the red cross to provide disaster information on the health department's social media pages. some of the nation's top mayors are banning together now promising to give the green light on car-sharing services and other collaborative efforts. scott mcgrew says san francisco is leading the way. >> mayor ed lee teaming up with mayor bloomberg in new york, mayors of chicago, other large cities, to promise companies like the bay area's lift, the guys with the pink mustache, that they will do their very best to encourage what we call collaborative consumption or the sharing economy. remember it's really easy to get used to getting a lift with the

click of an iphone. that's because you live in the bay area. in some cities, that's down right illegal. the mayors are not guaranteeing cities will allow such companies, only that they'll pish for allowing such companies. mayors don't make laws. city councils do. another disappointing day on the markets as investors added china to their worries. let's check in with bertha coombs live at cnbc headquarters. good morning. >> good morning, scott. the futures are pointing the a bounceback at the open stocks falling monday on the continued fears about the fed stepping back from its bond-buying program and worries about china's economy and the banking system there. things bounce back in china pretty strongly today after china's central bank made comments this morning to calm investors saying they were going to keep rates there within a reasonable range. this morning, in a few minutes, we'll be getting data on demand for durable goods, home prices

and sales. the dow dropping 140 points on monday starting today at 14,660. the nasdaq plunging 36 to 3,321. that included apple falling back below $400 a share yesterday. that was a two-month low. >> bertha coombs, thank you much. orchard supply hardware asked a bankruptcy judge to approve millions of dollars in bonuses for its executives which can sound kind of strange, of course. why would anyone get a bonus for going bankrupt? actually a common procedure. you need people in charge even after you file for bankruptcy protection. the stores are still open and, of course, osh is in the midst of selling itself. jon and march larks someone has to stay at headquarters and make decisions. bankruptcy tends to make executives flee companies. this will help them stick around. bonuses are not unusual. we saw it with salindra as well.

police on the scene of an overnight shooting, an attack that appears to be random. it happened after 2:00 in the morning near elmira and industrial at the 101-280 junction. one man according to police was shot in the face, another in the foot. also a woman was shot in her stomach. we are hearing unconfirmed reports two kids were actually nearby when this all happened. we're told, though, none of the kids was hurt. "today in the bay's" christie smith is heading to the scene. wheel check with her as goon as she gets there and gathers information. 5:16. time to say good morning to christina loren. the rain is here. we've got to be ready. >> that's right, prepare, prepare! it's not that bad. we want you to be ready. we don't want you to be late to work. we've all been there before. it's not fun. especially when your boss shows up before you.

59 in petaluma, 63 in san francisco. even though you might have your mind set on a lighter-than-normal drive, because a lot of kids are out for summer at this point and a lot of people are taking their summer vacations. i'm telling you right now, mike is a busy man this morning. 63 degrees in san francisco, 61 in napa. we're at 63 in san jose and 65 in livermore. very, very ball many to start out your tuesday morning. because of that nice mild start, we're going to see a nice finish today. showers will roll through mostly for your morning drive. yeah, that's the reason why i want to make sure you give yourself extra time this morning. we haven't had any significant rainfall like this in over two months. you are going to find a lot of oil out there, loosened up by the rainfall. this is what we're watching for you. right now it's really at half moon bay area, the north end of the peninsula seeing the most steady rainfall. look what happens as we take you into the 7:00 hour. we'll start to see the showers become heavier and more widespread.

that's when we kickoff rush hour. we continue the clock, stop it for you at 10:00 a.m. we're expecting showers right here in the san jose area. we stop that clock again for you getting into 4:00 p.m. this afternoon. a better looking evening drive home. we're going to keep showers very light, very spotty in the forecast all the way through the first part of tomorrow. then high pressure moves in quickly. it's going to warm us up. we'll be close to 90 degrees before the day is done tomorrow. so enjoy, 79 in livermore, 74 in fairfield and 70 degrees in napa. if you think the 90s are warm, wait till i show you where we're headed towards next week. yeah, 101 degrees, the hottest weather, the dog days of summer right on the heels of this rain. make sure you're ready for this. i promised you his report, he's here to deliver. >> we told you about the earlier crash involving the big rig. at the time it was blocking two or three lanes. now reports are that the fire

department is on scene blocking all lanes of 580. sig alert means major impact. status changed to a deadly accident. sounds like someone has been killed as a result of this crash involving a big rig and least one, maybe two other vehicles. this is just before you get to auto mall parkway, with south 880 closed and we don't know for how long, we have this backup quickly forming. this is boyce that can get you over toward auto mall or durham, get back on near pacific commons mall. our chopper has launched to the scene to get us a better look. we have southbound 680 which is just fine as well. if you do have an option to choose between the two, 680 to mission, that's the clearer version. 880 at auto mall, that's where the closure is. you can take dumbarton bridge, no problems. 484 or 92, that's the san mateo bridge. we'll give you a quick look at

the bay bridge as well. we also had the overnight rains. you can see a little water, sheen and puddling. that will be the case with the mist in the air. 5:20 right now. a study just released by stanford university showing charter schools are getting better. that study is a follow-up to one conducted four years ago. the old study shows 37% of charter schools are being outperformed by local public schools. in this brand new study that number is now down to 31%. researchers say charter schools vary widely state to state, making it difficult to pinpoint a national trend. now to an exclusive preview of an investigative unit report. was it a mistake or was it intentional? the california national guard tried to serve termination papers to one of its members who was in the hospital just hours after a suicide attempt. instead of sending support, the investigative unit learned that the california guard sent a

process server to master sergeant jessica brown's room to deliver firing papers. she accused leaders of failing to handle a sexual assault she says happened during her training mission. >> i didn't want to die, but i couldn't handle it anymore. >> what is this action in this hospital in this emergency room ultimately say about the california guard? >> that they don't care about their people, that they're more interested in getting rid of what they conceive to be problems within the organization. >> tonight the investigative unit is back with more controversy behind the gates of the guard. is this retaliation and is an emergency room the proper place to serve termination papers? chief investigative reporter tony kovaleski asks these tough questions tonight at 11:00. time is 5:21. coming up, this looks like any house you'd see on your average street corner. we can also tell you there's a little extra incentive to go

welcome back. it's 5:24. we are hearing from the bay area tech company that helped tightrope walker nik wallenda make it aks cross the massive george near the grand canyon. davis instruments provided wallenda with the weather stations and consoles that helped him cross the george. the company says had wallenda not use this technology, the crossing could have ended a lot differently. >> it would be evel knievel, totally taking his life in his own hands. >> now wallenda says his next goal is to walk between the chrysler and empire state buildings in new york city. new york city's police commissioner says no way.
