talks. ends with absolutely no deal. transit options you have on this fourth of july holiday. good morning. >> good morning. happy fourth of july. it is the holiday. i have to tell you, it is a ghost town here at the west oakland b.a.r.t. station parking lot completely empty. will may be a silver lining in that. that is that if you do have to ride a b.a.r.t. this morning, chances are the bus bridges they have set up, you probably won't have a lot of company there. ten hours of talks between b.a.r.t. and would biggest unions ended in oakland late last might. still no contract. no a agreement on day four. one union negotiator said they made progress on tuesday but the same person only said last might that they were working with state mediators. b.a.r.t. has been offering buses into san francisco from four of its other stations and spokesperson told me yesterday services is costing them about $100,000 a day.

have go to work is an unnecessary accident or delay. we will keep you updated. start your temperatures this morning and you can see they are mild. we are running anywhere between two to ten degrees more mild than yesterday. except for novato where we have rain-cooled air and showers actually coming down right now. in combination with temperatures in the mid to upper 60s to low 70s. livermore starting out at 73 degrees. look at all the lightning firing off to the north. lot of this north of the bay area now lifting even further north. as you can see now, pretty dangerous conditions for ukiah to cloverdale. all the activity is winding down and pushing into the central valley. over the mountains a lot of it will fall apart. look at this. showers coming down now in the marin county area. this is enough to cool you down in novato. take down to south bay, western facing slopes surrounding san jose. little bit of moisture. we will see more of the clouds, thunderstorm clouds, developing over the local mountains today.

it is very moist out there. going to feel the difference when you walk out the front door. temperatures today are going to be just about as warm as yesterday. we are not going the heat you up. 102 for liver more and 87 in fremont. 93 in san jose. full fireworks forecast coming up. that's a mouthful. back to you for now. >> thank you so much. san jose fire fighters are trying to figure out what spark ad fire at a business on king road near mayberry. this one is an industrial area east of highway 101. our camera crews caught crews out there boarding up one of those businesses early this morning. the two-alarm fire started about 11:30 last night. firefighters there say they were able to finally get this one under control at 40 minutes. nobody was hurt and the cause right now still under investigation. less than a block away from that fire we are getting word from pyfirefighters a bicyclist was hit bay car.

unclear at this hour just how bad the collision was or whether the bike rider suffered any midge or injuries. we are still waiting to hear back from the dispatchers and we will update you as soon as we have more information. >> this is an odd warning to tell you about this morning. san francisco's -- police say that someone or people there in san francisco in the twin peaks say you should keep an eye out for poisonous meatballs. the warning comes after a dog ate a cooked meatball found. when the owner of the dog return prosecuted the walk the dog became very sick. that's when the owner went back and found more discarded meatballs. police say that the meatballs appear to be poisoned and investigators are running tests to determine exactly what is in those meatballs. and who put them will. >> keep an eye out for that. 5:09. would southern california officers under police protection this morning after shooting a

family of san jose woman who died in a storm accident in willow glen last month now filing a lawsuit accusing two drivers of being distracted behind the wheel. the woman was riding her bike to work when a delivery truck and dump truck collided at the intersection. the delivery truck then rolled on top of that woman pinning her right underneath. her family filed a lawsuit claiming both drivers were distracted by the cell phone at the time of the deadly crash. also followup this morning. we now know who will be representing major league baseball in that antitrust lawsuit filed by the city of san jose. the league hiring john kecker, partner in san francisco's law firm, kecker and vanness.

sets up a showdown between kecker and another heavyweight, joe, who leads san jose's side of the case. the city accusing the league of violating federal laws you about blocking the as' efforts to move down to the south bay. california's biggest junior college facing an uncertain future this morning. city college of san francisco will lose its accreditation in july of next year. that accreditation commission for community and junior colleges says they did not do enough to fix financial and educational deficiencies. the school will be appealing this decision. the campus will remain open and acredited. san francisco's twitter doing its best to keep the rest of the world connected to the unrest in egypt. scott mcgrew is translating tweets from cairo as they happen. >> reporter: it is interesting history to watch. country that turned towards democracy on to see a military

leader. chief justice who was sworn in moments ago after the overnight removal of president morsi. the egyptian military suspended the islam cyst drafted constitution calling for a new election and installment of the temporary civilian government. in the u.s., president obama called an emergency meet thing morning with the national security team saying that in a statement he is deeply concerned. the u.s. is now reviewing a billion and a half dollars a we are in aid to egypt. a special honor tonight for the 19 fire fighters that died battling a wildfire in arizona. earlier this week. the fireworks shot will be a tribute to the members of the hot shot team who died on sunday. fire officials say that even though there is a high-fire danger in the area the fireworks will be deployed safely. experts are still trying to determine what went wrong just before the firefighters died. about 500 firefighters still battling the pyre near yarnell,

it burned 8400 acres. 45% contained. have you heard about this one? officer in southern california right now fearing for his life after a video of him shooting and killing a dog goes viral. the graphic video which has now more than 3 million views shows d dog owner being arrested. as he was being put in the car, police car, 2-year-old rottweiler, max jumped out and rushed to the owner's side. the officers tried to grab the leash but fearful the dog would bite him or others he then shot max four times, killing the dog. since that department has gotten hundreds of angry calls and e-mails, even death threats. >> all police officers are not bad. >> the lawyer now says he will be filing a lawsuit against the police department accusing officers of excessive force. >> it is 5:21.

>> reporter: good morning. happy fourth of july. i wish i could tell you the b.a.r.t. trains were running and the strike was over but it isn't. the silver lining in this my be that because of the fourth of july, will aren't very many people using alternate forms of transportation. i have only seen one person looking for the transit bus had morning. 9:15 when b.a.r.t. sent out a notice late last night saying we are sorry for the union's actions. they caused tremendous disruption to the people of the bay area. have to tell you i just spoke with a couple of them. they are still here. picket lines running. telling me they are hang something will on day four, started this morning at 4:00 a.m. this after ten hours of talks between b.a.r.t. and the two biggest unions ended in oakland late last night and still no contract. no deal on day four of the strike. when union negotiator has said they made progress. that was on tuesday. only said they were working hard

if you want the coolest spot tonight, for those fireworks, it is going to be the city. 68 degrees at 6:00 p.m. 9:00 p.m., downright perfect. 60 degrees out there. you will be able to see the fireworks this year. lot of people in town. they are going to get spoiled. bay area will be nice tonight. >> thank you very much. right now a follow-up. man accused of killing two employees in oakland earlier this week now facing charges. that will happen tomorrow. police say that jermaine is being held without bail. he and another man allegedly entered that wing stop late tuesday night and when there was some kind of encounter with somebody. officers say girly and the man, other man, ran to the back of the restaurant and then they hid in a freezer when the two employees went to investigate to see what was going on, they were shot to death on the spot. police say that they are still looking for the second man but at this hour they will not say if it is a suspect. a story you will only see on nbc bay area.

several sources tell us a police officers association has locked its arbitration battle with the city. we are told the ruling means a cap on cashing out accrued vacation and sick time. it also means that the officers will not get back the 10% in pay they gave up to help the city balance the books. the city manager's office confirms there is a verdict but it cannot comment on the specifics. the time now is 5:40. here to tell you celebrations over egypt this morning after the country's president will being removed from office. but the white house is not thrilled about this. a live report coming up from washington next.

their rights are protected. demonstrations here in washington, certainly not to that scale. but outside of the white house, americans expressing their support for the new government in cairo. >> thank you very much. also this morning, we learning new details about the arrest of former new england patriots tight end aaron hernandez dead. investigators say they have uncovered a secret apartment maintained by hernandez. it is located about a dozen miles from the home where he was arrested just last week. officers at this point not sure exactly why he had that apartment but say inside of it they found several boxes of ammunition and also found a hooded sweatshirt, the same one -- looks like the same one, one hernandez was wearing on the night of the homicide. hernandez stands accused of killing an aquain nance back on june 17. right now he's also under investigation for possible involvement in a double homicide that happened last year. >> raef counselors are on hand

at after a paulg rekilled a camp counselor and injured four others. it happened at camp tawonga, a jewish camp. kids at the camp were inside of the dining hall eating breakfast when that tree came crashing down right outside of the window. annais rittenberg, a student at uc santa cruz was killed. he worked at kzsc where she host ad two-hour world music show. the station manager says that news of rittenberg's death hit everyone hard. >> it is one of those things when you hear you don't really know what to think or what to do. and -- it still hasn't quite hit me yet. everything feels weird and surreal. >> the radio station plans to hold a special tribute soon. her fellow deejays will play world music in her honor as well as airing clips from her show. over in south africa, well-wishers keeping vigil outside of the hospital where former president nelson mandela
