. and that breaking news, a 7-year-old girl is dead today shot to death overnight in her own home and oakland. her grandmother and two other children in the house at the time were also shot. it is 4:30. good morning. i'm laura garcia-cannon. >> good morning. i'm marla tellez in for jon kelley. police spent most of the night at this home on wilson avenue just across from interstate 580, from fruitvale elementary school. today in the bay's christie smith is outside children's hospital in oakland where the two other children are being treated. she joins us now on the phone. christie, at this point what have you learned? >> reporter: good morning. i can tell you we're outside of children's hospital in oakland

where we aren't seeing much activity in terms of family members coming and going, but what a horrible story. a grandmother and three young children shot, as you said, one of them has died. oakland police are telling us they got a call of shots fired activation around is 1:15. that's the system that alerts them of gunfire. they also got neighborhood calls of gunfire in the 3400 block of wilson avenue. that's the lower diamond neighborhood. police say when they arrived they found a grandmother and two 7-year-old girls shot, also a 4-year-old boy was hit. all of the children taken to children's hospital. unfortunately sadly one of the 7-year-old girls pronounced dead here at the hospital. the grandmother taken to highland hospital. it's unclear why this home was shot at in the first place. according to police they're saying it may have been a case of mistaken identity. as far as we know, no arrest

haves been made. we're in contact with oakland police and as soon as we get more information, we'll bring it to you. live in oakland, christie smith. back to you in the studio. >> thank you very much. it is 4:32. special detectives of the mountain view police department are interviewing students after reports of child abuse at a local preschool. last wednesday the santa clara department of family and children's services received a report accusing a staff member at little acorn preschool of inappropriately touching a student. mountain view police say the staff member is on administrative leave and no arrests have been made. little akofrn preschool is run by the first presbyterian kch of mountain view. the kch says as long as the investigation is taking place, it will not comment. meanwhile in the east bay a concord elementary teacher accused of molest ag number of students will be back in court. 45-year-old joseph martin is scheduled to attend a bail hearing this afternoon. martin pleaded not guilty to 91

felony counts of child molestation. police say he molested 11 students in the past seven years all on the campus of woodside elementary school. if found guilty, he could face life in prison. the verdict will be read later today for two men charged in the gang rape. marcel peter and jose montano are two of six men facing charges. two others have already taken plea deals. another two are expected to be tried later this year. >> a convicted prostitute once linked to the death of a businessman is expected to go free later today raven dixon took a plea deal that dropped murder charges in exchange for pleading gimity to prostitution and drug charges. dixon is expected to be released from custody on probation. three other people are charged with the killing and robbery of robby kumra last november. oakland police hope newly

released pictures and video will help reveal the identity of vandals. hundreds of people protested in the streets and vandalized bidses after saturday's not guilty verdict in the george zimmerman trial. later today an oakland city will talk about implementing a new anti-weapon law. the proposal would make it illegal to carry makeshift weapons such as hammers, sling shots, clubs and shields during protests. it was proposed after a downtown restaurant worker was struck in the face with hammer during a protest on monday. 4:34 this morning. we're getting new detail about where the wreckage of asiana flight 214 is being held and who is paying for it. the examiner reports sfo is charging the airline $15,000 to keep the wreckage from the crash at its hub for two weeks. asiana has to remove it by july

26th. sfo says ditz not plan to extend that deadline. last friday we showed you live as the wreckage was toed to a remote part of the airport to allow the runway to reopen. a monterey county family is the first to filed a lawsuit against asiana airlines. they filed in federal court seeking $5 million for negligence and recklessness. they say the mother is unable to return to work and her son has serious back problems now. three people died in that july 6 crash. tom of the top security experts in the nation are putting apple and samsung technology to the test today. they're looking at new anti-theft security features recently introduced by the two giants. they'll use similar tang ticks to the ones thieves use to try to resell ton global black market. george mass cone along with the attorney general launched the

580 heading toward harrison, the on-ramp was affected by a crash. just got word from chp that all lanes cleared, flashing lights should be completely cleared in the next couple minutes. a live look outside shows you across the san mateo bridge, coming down into foster city and san mateo. no problems for 101 or 92 right now that gets crowded over the course of the morning. here is the edge of the golden gate bridge as you're getting in. you e do see glowing lights, but not enough to make the roadways slick. we'll track it and send it back to you. privacy advocates say police are overstepping their bounds tracking license plates on millions of bay area cars every day. the aclu says automatic license plate readers are constantly collecting and storing data. police use the technology to track stolen cars, but they also store photos of other vehicles. a man in san leandro says when he asked to see information

better. something we're keeping an eye on for you this morning. oakland's bid to keep the a's in the city could get a much-needed boost. a final vote could pave the way for a waterfront ball park is expected this afternoon. last week the commission unanimously approved a lawsuit settlement that would end operations at howard terminal. the terminal is considered oakland's most viable spot for a new ball park because of its location near jack london square. it's not a home run just yet as there are environmental and infrastructure issues at that site. 4:43. the prime time emmy nomination also be announced in about an hour. it could be a historic day for netflix. there is a lot of speculation that for the first time a show made specifically for the internet will get a nomination. netflix was given a lot of buzz for its drama "house of cards." it also brought back the comedy arrested development which has people speculating about possible nominations for best

i'll show you the rest of this in about 15 minutes. stick around. all ki tell you the heat is going to crank. if you want a cooler day, get it while you still can. back to you, marla. i know you're following the next story. a wildfire burning near palm springs forced hundreds from their homes overnight t. mountain fire has already burned more than 34 square miles southwest of palm springs. evacuation orders are in effect for 300 homes in idle wild and fern valley. several homes have been destroyed. the fire has been burning since monday. cal fire says it's about 15% contained. 4:47. we know the cause of a mysterious landslide that swallowed several lake county homes in may. an attorney for 41 homeowners in a subdivision near clearlake blaming a leaking county water system for that slide. he said the leak went undetected for months saturating the hillside and causing the ground to give way.
