good morning. it's 6:01. i'm marla tellez in for jon kelley. >> i'm laura garcia-cannon. in oakland an 8-year-old girl is shot and skilled overnight, possibly by suggs spektsz targeting the wrong house. bullets flew into the home on wilson avenue near montana street, also hitting two other children and a grandmother. "today in the bay's" christie smith live at children's hospital in oakland where she just learned new information. christie. >> reporter: good morning to you. just a horrible story. an 8-year-old girl shot and killed. two other children shot. they were taken here to children's hospital oakland. oakland police are calling this a heinous crime. they say that someone shot into the apartment that all of the children were in. this happened in the lower diamond neighborhood off of wilson avenue. oakland police asking for the public's help this morning finding the shooter or shooters.

this happened around 11:15 last night. police say their shot spotter technology system alerted them to gunfire in the neighborhood and so did the neighbors. when they arrived they found four people shot, a grandmother and three small children. the tribune reporting the 8-year-old girl was on a sleepover play date with this family. here is what police told us about those who survived. >> the 4-year-old boy and the 7-year-old girl, they were also shot and are in stable condition. the female adult, she was also shot and she's in stable condition. >> reporter: apparently another adult was also in that apartment but is okay this morning, was unharmed. police are unsure why this apartment was shot at in the first place, perhaps mistaken identity. they say they just can't say, just too early in the investigation. again, they are asking for the public's help with this. police and crime stoppers offering a $25,000 reward for information leading to an

arrest. >> thank you, christie. we'll get another update at 6:306r7b8g9s also in oakland it's been more than a week and still no sign of 21-month-old daphne webb. ♪ i never thought i would be shaken, oh ♪ >> daphne's mother sang at a vigil for the missing girl last night at 79th and international boulevard in oakland. that's where daphne was first reported missing last and. the baby's father was also at the vigil. he told police he left daphne in inside his suv for a few minutes while he bought a couple items at this corner market. he says when he came out, she was gone. both parents say police are keeping them updated on this investigation. so far police say they have no suspects in this case. 6:03. a mountain viewcve preschool u investigation for allegations of child abuse this morning and a

staff member has been put on administrative leave. "today in the bay's" bob redell joins us live outside the school with what parents are being told about what happened. good morning, bob. >> reporter: good morning, laura. a letter has gone out to the parents here to let them know a staff member allegedly inappropriately touched a young child who attends the little acorn christian preschool, a preschool run by the first presbyterian church of mountain view. mountain view police have been investigating for the past week. it was last week when they were notified by the county department of family and children services that something happened. the detective we spoke with will not go into any detail surrounding the allegation except to say that this person be administrative leave, does not have anymore contact with the students and has not been arrested. >> why is this person not under arrest? >> well, we haven't determined whether a crime has, in fact, occurred yet. obviously because of the nature of the report and the amount of

kids at the school, we have to conduct a very thoer row and systematic investigation and that includes the interview of 60-plus students and staff members and that takes a long time. we want to make sure we do a thorough job before determining the guilt or innocence of anyone. >> reporter: the detectives conducting those interviews have questions of children, questions that are sensitive in nature. so they do have sensitivity training in dealing with young people of this age. talking preschoolers here. one reason why they're interviewing so many people is they are concerned, the police, that there could potentially be other victims. the school tells us that they are cooperating with the police investigation and other than that, they have no further comment. reporting live in mountain view, bob redell, "today in the bay." >> two men accused of firing shots inside a santa rosa jewelry store will make their first appearance in court. stray trey vonn banks austin and

alexander brandon will be arraigned on attempted armed robbery charges. police say these two men entered bennett valley jewelers on tuesday armed with a shotgun and also a hammer. they have not said if anything was stolen or who fired those shots. the man accuseded of stealing a luxury yacht from sausalito and running it aground in pacifica will be back in court today. the preliminary hearing for 62-year-old lesley alan gardner is expected to start at 9:00 this morning. a judge determined he is mentally competent to stand trial for the theft of the $2.7 million yacht. his defense team says he's delusioned and believed the yacht was his. a man accused of stripping naked and harassing people at a bat station is expected back in court. the man known as the naked acrobat pleaded not guilty. investigators say he is the man recorded in this cell phone video right here chasing a woman at the 16th and mission b.a.r.t.

station. he also allegedly kicked a b.a.r.t.?[: worker. people who know him say he may be mentally unstable. we'll give you a live look at san francisco this morning where it is a very foggy start. want to check the fast with meteorologist christina loren. >> good morning to you. what happens is high pressure moves in and it actually forces those low clouds right to the surface. this morning it's going to be warmer even with more fog to start the day. i do want to point out here in san jose, this is a welcome sign. it means we'll be cool at least for i'd say the next four to five hours. then we'll really start to heat up once the fog clears by 10:00 a.m. mostly sunny conditions by 10:00 a.m. over the greater bay area. although that marine layer is right at the surface this morning, it's thin and it's going to clear quick. this is what we tear expecting. by noon today, 79 bay side at the coast, 67 degrees. we'll have your full forecast, the seven day ready to go in my

next report. yes, thunderstorms coming our way. i'm show you when, 6:07. first let's check the drive. >> the metering lights, headlights, brake lights, also the low clouds. smooth drive, but the approach with the backup. one of the reasons why those metering lights are going to be slower this morning, look at this view from emeryville, looking out of the eastshore freeway and looking toward the upper deck. that's where we're talking about the low clouds hovering right at the level. it could affect your view. not a problem for drivers here. but on the san francisco side it is swallowing up parts of the freeway on the approach towards san francisco. we do see speeds coming down a bit as is traditional about this time anyway. with the volume and low clouds, watch it there. a crash reported east 980 off 880. it may be visible passing by the connector. that might be why we see a little slowing. no lanes reported for 880. then another issue here, highway

wreckage of its burned-out plane by next friday. the remnants of flight 214 are being stored in a remote area of the airport. they're charging asiana $15,000 to store the wreckage. former south african president nelson mandela is celebrating his 95th birthday today. mandela, though, still in the hospital in pretoria being treated for the lung infection. his family says he is steadily improving. 6:14. jurors in the george zimmerman case were allowed to go bowling, shopping and get pedicures. the sequestration will cost florida taxpayers about $33,000 total. the all female jury of six spent 22 nights sequestered at a marriott hotel. excursions included a trip to see fireworks on the 4th of july and a trip to ripley's believe it or not museum. legal experts say the activities are important to maintain the mental well-being of jurors in a very stressful situation. 6:14. 63 different tech companies are

teaming up this morning to write a letter demanding washington come clean on domestic spying. scott mcgrew, strong words coming out of silicon valley. >> absolutely. we haven't seen the specific letter yet, laura. look what microsoft said yesterday. the constitution itself had been damaged. that's microsoft talking. we figure today's declaration will have a few choice words. high tech has been embarrassed by repeated reports, mostly from edward snowden, that companies have been handing over data to the government. they want to explain their side, but they can't because of secret court orders not to. tech companies clearly want to tell their story. the blog all things digital says the companies participating in this letter include apple, google, microsoft and facebook. where the rubber meets the road is if those companies will really show their displeasure the next time local politicians who support domestic surveillance come up for election. facebook's mark zuckerberg

california right now it's at about 18,000 acres whachlt. what i can tell you is if you're trying to head into southern california, not a great time to hit palm springs or the surrounding area. it's going to be in the news for the next few days. fire conditions are pretty bad down there. we don't want to spread our resources too thin. be on your best behavior. hopefully we won't have to send any local guys down to that fire. 55 in san francisco, 60 in sunnyvale and 57 to start the day in san jose. fog will be a factor until about 8:00 a.m. and temperatures will start to warm up by 10:00 a.m., full sunshine, beautiful day in the bay. >> let's check the drive with mike. >> we'll get you over there and show you, first of all, a live look out here. eastshore freeway, want to point out these low clouds. you saw the golden gate bridge, her shot. that will affect your viewer or what you can't see from the marin side, especially coming toward the bay bridge in the san francisco side as well. it's not an issue for drivers through berkeley and emeryville. farther toward the carcinas

bridge, you might get patchy. a note for drivers. look at this easy spacing toward the bay bridge. the map shows you also that traffic flows pretty nicely through the area. only in the upper 50s. the metering lights are on. a backup at the toll plaza. tougher to see as the clouds drift across the bridge. you will lower your speeds because you have to. north 880 towards 980, the earlier slowing has cleared. still reports of a crash east 980 off the con snek tore. we see the slowing that happened earlier clearing. we'll keep that in there until we get the all-clear. another report, second of the morning, same issue, north 13 right around carson, reports of the flatbed truck in the slow lanes. just watch that as you're coming off the split with 580 and heading toward piedmont. if that is your route, there will be some sort of activity as they move the truck from the shoulder. so far the connector is clear and no one else is reporting problems for speeds through the area. also looking toward the

tri-valley with a nice easy drive toward the dublin interchange. at isabel you're okay. heading through livermore, a nice easy drive, focusing on vallecitos. soon see slowing for 84 towards 680 and toward the ge plant. no problem right now. the northbound routes are typically your commute direction, no slowing. so 101 and 87 which showed a good amount of earlier slowing, that first burst kicked in. the second burst should be starting right now. we'll see the slowing right here and also right here. so prepare for that little preview and looking to the san mateo bridge, an easy drive westbound for your commute direction. getting more company. no problems at the toll plaza. you can see the high-rise off in the distance. even though there are low clouds, visibility is fine here. watch it closer to the coast, especially highway 1, caught up in a little limited view there. back to you. thanks so much, mike.

if you're wondering what the commute looks like on the way to the bay bridge. this is our emeryville camera. traffic moving fine there. but the typical backup with the bay bridge with the metering lights on. mike is checking the morning commute. it is 6:24. happening now, more than 6,000 buildings are cleared out as a wildfire rages southwest of palm springs. firefighters say the weather could fuel the flames with temperatures lingering near 100 degrees expected through the weekend. at least seven buildings have been destroyed by the wildfire which broke out on monday. more than 2200 firefighters are battling that blaze which is now just 15% contained. 12 arrests in a rampage through hollywood tuesday night. l.a. police say they're still looking for more suspects. police say groups of young people ran through the streets

of hollywood knocking people down, stealing their cell phones, grabbing food from restaurants and stealing t-shirts from local businesses. police say the suspects went on the rampage by taking advantage of peaceful protests against the verdict in the trayvon martin case. today texas governor rick perry will sign the state's newest abortion restrictions into law. the bill was approved by the state legislature friday despite protests from abortion rights advocates. the law will close most of the abortion clinics in texas. the law will also ban abortiontion after 20 weeks of pregnancy. house speaker john boehner is rejecting suggestions that to ban the olympics in sochi. boehner says he doesn't think the u.s. should punish athletes all because of one man's actions. snowden is reportedly stuck at the airport in moscow while he applies for temporary asylum. >> this week the boy scouts of america is hosting its national

jamboree which is being billed as the most physically demanding event in its history. that means obese scouts aren't allowed to participate. this year scouts and leaders must have a body mass index below 40 to take part in the jamboree. the boy scouts published the health requirements two years ago to give interested scouts enough time to lose weight iftl needed. this year every scout will be asked to take a three-mile trek up a mountain and the reward at the top is a barbecue. tense moments for monorail passengers at the state fair in sacramento. look at this. crews had to rescue about 20 people yesterday when the train lost power around 5:00 in the evening. everyone to the ground. no one was hurt. so far no word on when that monorail will reopen. >> good thing no one was hurt. 6:26 right now. still ahead, an update to breaking news in oakland. an 8-year-old girl shot and killed at a sleepover.

"today in the bay's" christie smith joins us live outside the home which was hit. christie, good morning. >> reporter: good morning. we moved from the hospital to the neighborhood. police are gone, it's a little crime scene tape, but if it's possible, the story keeps getting worse. we're now told that it was the children who may have answered the door. someone outside opened fire. this was around 11:15 last night. the 8-year-old girl, she was killed, two other children who

were with her, 7-year-old girl and a 4-year-old boy, they were also shot, taken to children's hospital. there was a grandmother believed to be in her 60s. she was shot, too. the other three, the 7-year-old, the 4-year-old and the grandmother did survive, all hospitalized at this hour. this was a sleepover here at this apartment. apparently what we're hearing is that the 8-year-old and the 7-year-old played often and they just decided to have a sleepover. oakland police, they were notified by their shot spotter technology about 11:15 that there was gunfire on the 3400 block of wilson avenue. this is in the lower diamond neighborhood off interstate 580. we're hearing that at least 11 shots were fired. oakland police, they're calling this a heinous, horrible situation. they're asking for the public's help in finding the shooter. we the tell you that oakland police and crime stoppers are offering a $25,000 reward for information leading to the

suspect. at this point they don't know exactly why this home was tarringed. it may have been a case of mistaken identity. they say it's too early to say. live in oakland, christie smith, "today in the bay." >> thank you, christie. we'll get another update from you at 6:45. a concord elementary teacher will be back in court today. 45-year-old joseph martin is scheduled to attend a bail hearing this afternoon. martin pleaded not guilty to 91 felony counts of child molestation. police say he molested 11 students in the past seven years, all on the campus of woodside elementary school. if found guilty, martin could face life in prison. a convicted prostitute once linked to the death of a businessman is expected to go free later today. raven dixon took a plea deal that dropped murder charges in exchange for pleading guilty to prostitution and drug charges. as part of this deal, dixon is expected to be released from

custody on probation. three other people are charged with the killing and robbery of ravi kumra last november. privacy advocates say police are overstepping their bounds tracking license plates on millions of bay area cars every day. the aclu says automatic license plate readers are constantly collecting and storing data. police use that technology to track stolen cars, but they also store photos of other vehicles. a man in san leandro says when he asked to see information collected on his car, police showed him more than 100 images. >> saaxgathering and storing information on people not suspected or charged with crimes, i find that problematic. >> the san leandro police department says it stores the information for one year. chances are, if your car is not involved in a crime, no one ever sees the data. uj5s to consider the privacy concerns and create some rules on who can access that data.

to pay for the toll, the bay bridge toll plaza. oakland, traveling north, not a problem. southbound with the headlights towards the coliseum, watching for the effects of what could be a traffic break. reports of a big rig tire in the lanes on the southbound side. we move our camera toward the bottom of your screen, the 66th avenue overcrossing. i couldn't see it. it might be hidden by trees or the overcrossing itself. no one is slaeming on their brakes. again, tracking this from chp. that's a concern. meanwhile a look at the maps and a drive over from 880 toward the peninsula. here is the volume of traffic through 101 and palo alto. 92 into san mateo heading down 101 or 804 into menlo park, east palo alto. a nice smooth drive as well. the peninsula, 101 and 280 not a problem. in the northbound lanes, starting to show the second bust which will hit and stick for the morning commute. this is north 101 and 87 with the sensors slowing.

"today in the bay's" christie smith joins us live from the neighborhood with new information this morning. christie, what's the latest? >> reporter: good morning to you. just a horrible story. an 8-year-old girl who was apparently on a sleepover with a good friend of hers, a 7-year-old girl. the 8-year-old girl ended up getting shot and killed. someone came to the front door of the apartment and opened fire. we shot new video a couple minutes ago where we counted 12 holes in the screen security door, more of them in the wood door behind it. here is what we know. it was around 11:15 near wilson avenue and macarthur. the spot shot ter technology alerted police there was a lot of gunfire in the neighborhood. neighbors called in as well. they got here, police did, found four people down. the 8-year-old girl who was shot, she later died. 7-year-old girl, that was the friend here. she was also shot and a 4-year-old boy, also a grandmother shot. now, the 7-year-old, the

4-year-old and the grandmother take even to the hospital. they're recovering at this hour. oakland police say they don't know why this apartment was targeted at all. may have been a case of mistaken identity. too early to say. they don't know if they're looking for one shooter, perhaps more than one. they are asking for the public's help in trying to solve this. we can tell you oakland police and crime stoppers are offering a $25,000 reward for information leading to an arrest in this case. live in oakland, christie smith, today in the bay. >> simply tragic. thank you, christie. time to check the weather as we take you live outside to the golden gate bridge. where, oh, where is the golden gate bridge? it is masked in fog this thursday. it's going to warm up, ms. christina loren. >> it certainly is. good morning, marla and laura, of course to you at home. that fog is actually a pretty welcome sight, especially now because san jose made it all the way here this morning. but you will notice the very tip

69 in half moon bay and temperatures are going to be in the mid to upper 70s today out in santa cruz. a beautiful day shaping up there. 77 degrees is the forecasted high. 91 for fairfield, 91 degrees in livermore. as we get into the week end, the east bay will be the hottest. we're still holding off on that sentry mark. we're not going to exceed 100 degrees. it's goings to feel hotter sunday and monday with the chance for thunderstorming. the best chance over the north bay, east bay and south bay mountains. put that on your radar. monday into tuesday temperatures start to drop off just a touch. we're going to keep that humidity going with some monsoonal moisture headed our way. let's check the drive at 6:57 with mike inouye. >> it will be the heat and the humidity. great. looking towards fremont with the southbound side, we saw a lot of slowing over the last ten minutes. i showed it to you actually as we came into commercial break. now things are much calmer. that burst of traffic past the

truck scale and tesla, heading down into the south bay it is smooth as far as the sensors go. you're still at the limit. that volume of traffic transitioning a lot of folks still going west 237. that's when we see our sensors slowing and towards sunnyvale and mountain view. that volume will head over towards the transition with 101 where we often see the bulk of traffic hitting a little later on, hablt half hour from now. north 101 toward mckee and alum rock with the slowdown. 87 into downtown and the volume affecting the speeds as well. a live look outside as we travel to our live cameras. we see the traffic flowing across the san mateo bridge. an easy flow of traffic off the east bay and towards the peninsula. low clouds visible here. you can see the flat shek shun from the peninsula. visibility is just fine, just like the freeways into san francisco. the north bay shows a smooth flow as well, southbound 101 through san rafael.

staff member allegedly inappropriately touched one of the young children who at tends the little acorn christian preschool run by the first presbyterian church of mountain view, the building right behind me. this went out in a letter to them. we have spoken with mountain view police and they tell us they became aware of this lachtd week when the county's department of family and children services notified them that something happened. now, the detective we spoke with won't go into any detail surrounding the allegation except to say this person has been played on administrative leave, does not have anymore contact with the students and has not been arrested. >> why isn't this person under arrest? >> well, we haven't determined whether a crime has, in fact, occurred yet. obviously because of the nature of the report and the amount of kids at the school, we have to conduct a very thorough and sis mattedic investigation and that 60-plus students and staff

members. that takes a long time. we want to make sure we do a thorough job before determining the guilt or innocence of anyone. >> one reason mountain view police is interviewing so many people, they are concerned that there could be potentially other victims. they just want to make sure of this before they bring up any criminal charges if, in fact, they are going to do that. the school tells us they are cooperating with the police investigation. other than that, they have no further comment. reporting live in mountain view, bob redell, "today in the bay." at 6:51, a couple who escaped from a deadly apartment fire in redwood city now suing the building's owner. the lawsuit claims the hallmark house apartments lacked a sprinkler system and didn't have enough smoke detectors. however, the sprinkler system was not required by law in the older building. one person died, 20 people were hurt in the massive fire on july 7th. dozens of others were left homeless. the cause is still under

investigation. neighbors in a collapsing lake county subdivision are planning a lawsuit saying the county is to blame. at least eight homes have sunk into the ground in the lakeside heights neighborhood. now an attorney for the neighborhood says a leaking county water system saturated the hillside and caused the collapse. county officials remain skeptical saying an irrigation system operated by the6he homeowner's association could have contributed to the ground's saturation. oakland police home pictures and vur veil lance videos will help identify vandals. while none show the faces of the vandals, police hope clothing and other characteristics will help tip someone off. hundreds protested in the streets and vandalized businesses after the not guilty verdict in the george zimmerman trial. later today, an oakland city committee will talk about implements a new anti-weapon law to protect people and businesses from vandals.

fire. that is not idlewild off of highway 17. that's way south in southern california. that's not a problem here. northbound 101 we saw a burst of traffic over the last 20 minutes. right now looks smooth. but the maps do show you there's a good deal of slowing north of 680 and starting from tullie. capital expressway, 87 and 280 seeing volume build. 85 suddenly from 17 into cupertino we're seeing the speeds start to dip little bit. but that trend heading up into sunnyvale. watch that for 85 itself. meanwhile the peninsula moves smoothly all over. 101 the concern on the northbound side right around kehoe. reports of a crash involving a fedex truck or some sort of delivery truck on the side of the road. there is slowing between 92 and third avenue over in san mateo. looking at the other side of the bay with oakland, 880 looks like a nice flow of traffic. past the coliseum, very smooth, very light for the nimitz. the concern with the southbound side, around 66 report of the
