up in a live report. new this morning, peninsula high school students saying their college enrollment is being disrupted because some high school test scores are being thrown out. i'm christie smith. i'll explain why and why the students are launching their own webside site about it. >> we've got this bizarre weather pattern, showers and thunderstorms creeping up from the south. quite warm inland. i'll let you know when the humidity will leave the bay area coming up. two new crashes showed up for highway 101, one in san jose, the other in san francisco. checking them both out and will bring you the latest coming up. taking a live look from london this morning outside st. mary's hospital where the duchess kate middleton is inside, reportedly about to give birth to the heir to the throne of england. we'll keep you posted this monday, july 22nd. this is "today in the bay."

good morning. it is 5:00. i'm marla tellez in for jon kelley. the estranged wife of the limo driver that killed five women. she's making startling claims about her husband, the driver, including the accusation that he was talking to her on the cell phone and was distracted just moments before the limo burst into flames. rob redell has more on what else she had to say. >> that's right. she is breaking her silence. rachel hernandez-brown says she was arguing with her husband orville on the phone just minutes before the tragedy and she's raising concerns that he was too distracted to react quickly when the limo burst into flames. hernandez-brown tells nbc bay area her husband even turned up the music as they argued so the women in the back of the limo couldn't hear them fighting. >> cussing me out saying would you listen to me? i can't really talk because i

have clients in the car and i can't be unprofessional. and that's when i said, well maybe you need to pay attention to the road and leave me alone and do your job. >> reporter: what remains unclear is if an argument slowed his response when one of the passengers started pounding on the closed partition. in the past, the driver's attorney denied brown was on the phone the time of the fire. a new bride and four friends died in the fire on the san mateo bridge, the cause of which is still under investigation. four other women escaped. when reached by phone, orville ricky brown responded to his estranged wife's claims by telling nbc bay area, quote, i have no comment other than to say there will be a full investigation. reporting live at the san mateo bridge, bob redell, "today in the bay." the suspect accused of killing the leader of san jose's chapter of the helps angel es

club goes to trial. jeffrey ped grew was killed two years ago. the president of a nick rag want chapter is accused of shooting and killing ped grew. a member of the san jose chapter is on trial for shooting and injuring a member of the nick rag want club during the same fight. investigators in east palo alto are asking for the public's help to track down a person who shot and killed a 30-year-old man in the middle of the day. the man was shot to death in his car at about 3:00 saturday afternoon near the corner of larksburg drive. witnesses say the man had just driven to the area when another man approached, firing several rounds into the car. the shooting is not believed to be gang related. a man who was killed on interstate 280 in woodside likely stopped to help the victims of a crash. the chp says the man saw a car clip the suv on southbound 280 near woodside yesterday morning.

the suv lost control and hit the center divide. chp officers say the man pulled over, got out of his car and tried to get across the interstate to get to the crash victims. he was hit and killed by an on coming car. two people in the suv suffered minor injuries. the driver of the car in the initial crash has been arrested on suspicion of drunk driving. the coast guard detained a boat captain in the san francisco bay after he led them on a chase at sea. coast guard officials say a crew was patrolling near sausalito yesterday afternoon when it came across a 30-foot boat. it had no markings and no flag. when the coast guard tried to board the vessel, the captain allegedly refused. pulled up the anchor and took off. the coast guard followed it and approached again near ocean beach. >> the master said that he would comply. they kept their guns out and

went on board. >> the coast guard says it was an altercation but the captain eventually complied and was taken into custody. it's unclear what his motive was for fleeing the coast guard. students at a peninsula high school say they have been cheated after their ap test scores were thrown out following security concerns. "today in the bay's" christie smith is live with more on the testing trouble at mills high school in millbrae. christie, good morning. >> reporter: good morning, marla. parents and students are so upset about this that the school has set up a meeting tonight at 7:00 to discuss it. here it is still summertime. basically what's happened is the advanced placement test sdoers were thrown out citing seating irregularities. that was one of the reasons given over this. the college board and educational testing service invalidated the scores of up to 224 students from when the exams were first taken in may. students at mills high school are demanding that these scores

be reinstated. they don't even know what the scores are, rather than retaking the tests in the upcoming weeks. the ets has not even investigated whether there was any cheating going on or not. students have created a website over this, it's called we need our scores back dot com. one student wrote on the website, my college application is on hold due to the delay of ap test scores. if i cannot turn in my ap test scores as soon as possible, my application may be withdrawn. please reconsider the board decision. the district recently said it's trying to get an sirs on exactly what went wrong here. mills has meetings set up tonight and wednesday night in the west gym at 7:00. live in millbrae, christie smith, "today in the bay." >> thank you, christie. it's 5:06. it won't be long now. the duchess of cambridge is in labor at a london hospital this

morning. police are standing guard right now outside st. mary's hospital. palace officials say kate middleton checked into the private lindo wing around 6:00 a.m. local time. that's 10:00 last night for us. prince william is by her side like every good husband, or maybe waiting in the wings i guess as well. the royal baby will become the third in line to the british throne behind prince charles and william. a live update at 5:40. >> royal officials say they traveled by car at a police escort. >> meteorologist christina loren, what is in score. we have high temperatures today. in deed we do. high temperatures will be warm in the upper 80s. san jose, 61 degrees to start the day in sunnyvale. we've got this cool pattern, not just today but every day this

week. let's get right into it. very interesting. we'll zoom in and show where the thickest fog is. as a result look at your noontime temperatures. we'll be in the 80s at livermore at lunchtime. the 60s, a 20-degree difference at the coast for today. we'll bring in skom thunderstorms and even showers as we head deeper into the day. temperatures work out like this, 88 for livermore, 74 in fremont and 63 in san francisco. i'll show you who has the best chance and when we're expecting the thunderstorms. shower activity kind of wild, mike, like you. >> classic. we're looking toward the classic shot of san jose. let me explain what i've been looking for. southbound, the taillights heading toward the transition of 101 and 680. there was a crash reported there. i don't see any slowing or problems. the northbound side with the good number of headlights, also

a crash reported there. the map will show you that's coming up toward tullie road. i saw no interruption to that traffic flow. a steady stream through the area. our speed sensors don't show any problems either. there may be a single car crash in either direction as you head through the corridor as reported to chp. the rest of the south bay moves just fine. no problems. 85 has a little construction right around the interchange with el camino. they're making the on-ramp wider. a look at the city as well, san francisco moves very nicely, north 101 there is a little crashing reported there at army. no injuries reported. they're also going to run a traffic break to move that to the shoulder. a live look at oakland, the other side of the bay. the volume starting to pick up already. it's 5:09. look at the flow of traffic past the coliseum, at that time limit. >> busy morning, 5:09. a peninsula business accepting invisible currency. the infamous bit coin. we'll have details next.

futures remain higher as the markets come off a fourth straight week of gains. earnings will be the focus this week because nearly a third of the companies in the s&p are set to report their numbers. the companies include mcdonald's, apple, boeing as well as cat pill hear. we'll get data on existing home sales today. in friday's session the dow fell five, finishing at 15,544 and the nasdaq fell 23 points closing at 3,588. get set for more pain at the pump. aaa says retail prices rose 12 cents to a national average of $3.67 a gallon. that's 23 cents more than a year ago, but still well below the all-time high of $4.11 setback in july of 2008. in san francisco gas is averaging $4.08, nearly a dime cheaper in the san jose area. aaa says drivers are experiencing sticker shock because prices are being pushed higher by summer demand, the

unrest in egypt and shutdowns in the u.s. and other countries. prices are likely to rise further in the coming weeks. ouch. back to you guys. >> say it isn't so. mary, thanks so much. the cleanup is underway in san diego now that comic-con is done. the four-day event brought plenty of surprises but none bigger than the one by warner brothers. let's take you outside and show you what we are working with. we have the actual potential for seeing some thunderstorms today. the chance gets better as we head deeper into the week. today you'll likely notice that increased humidity when you walk out the front door, feeling muggy this morning. temperatures are nice and comfortable though we're in the upper 50s to low 60s. 58 degrees, good morning, san jose. 58 livermore. napa at 56 degrees, a comfortable start there. 57 in san francisco. just about uniform temperatures to kickoff your monday. here is what is so cool. this is what we typically don't see in the bay area, monsoonal moisture headed our way. that is the case. i enhanced the satellite imagery to show you where the showers are coming down. subtropical flow all the way into the south bay at this point kind of gets cut off once it makes its way into the north bay. marin county, not yet seeing the flow, but you will later today. best chance for the thunderstorms, in fact, will be over the north bay mountains, the western-facing slopes.

we might get severe weather and strong thunderstorms later today. temperatures not too bad. 88 degrees on the way in livermore. holding steady when it comes to those temperatures, upper 80s to low 90s all week long. we're going to keep the humidity going just about until thursday afternoon. then we'll start to cut it off. the drive starts to pick up right now. mike is busy, let's check in with him. >> good morning. a lot of folks getting into san francisco even at this early hour. we want to warn folks that the northbound side picking up volume. the southbound side of 101 is where there's the issue. earlier crash off the bay bridge cleared through east 80. south 101 at army, we had reports of a crash and a traffic break was necessary to move from the center divide over to the shoulder. in the last couple minutes i got word that the all lanes were cleared. our traffic sensors are at a slower speed. that has come back up toward the limit. watch as you approach 280 towards san francisco, toward

you'll see the flashing lights near the right-hand shoulder. in the south bay we have a nice smooth flow northbound with your commute routes. an easy drive. looking over here north 101 passing by tullie. another crash here. no injuries reported. we do have reports of a spin-out and now activity in the center divide. it was just moved out of the lanes. they're marking it as an obstruction. there's a little slowing because of the distraction. a look at the san jose camera. we're looking at this live shot. i've shot this right between the overpass and sneaking a peak southbound toward tullie road, the off-ramp. northbound coming toward us a traffic break just for a couple seconds. that's a smooth drive coming up toward us. not a great shot. but at least that shows you what you can find. we'll look to the maps as well and show you travel times and drives as you're coming through the tri-valley. average speed for west 580 out

of the altamont pass. you're into the 50 range from the slowing from grant line. 680 and 84 moving smoothly. a live look for the bay bridge toll plaza, no problems at the toll plaza impeding our views of the east shore, but the eastshore freeway itself, you're just fine. 5:19. u.s. fighter jets dropped four unarmed bombs on the great barrier reef after a training exercise went wrong. the two jets were supposed to bomb an island range nearby, but the mission was ab borlted when civilians were reported in the area. instead the planes jet sinned the bombs in the marine park off the coast of queensland. they were developed in 165 feet of water away from coral to minimize damage to the world heritage site. u.s. navy says it's now working on a salvage operation. pope francis is on his way to rio dee jan niro this

morning. they took off from the leonardo davinchi airport for the week-long visit. more than a million young catholics are expected to join him in rio to celebrate world youth day. pope francis is the first pope from latin america and is expected to receive a very warm well come in brazil. the head of oakland's naacp will hold a news conference this afternoon to talk about the george zimmerman verdict. over the weekend hundreds of rallies were held nationwide in support of trayvon martin. in san jose hundreds of people gathered outside san jose city hall last night to talk about race in america and call on states to overturn the stand your ground law. at least 22 states currently have laws similar to florida's. daly city is increasing its sewer service rates to pay for needed maintenance. the city council approved a hike of 9% per year for three years. according to a staff report an

an inch and a half of rain, but it also brought erratic winds and a threat of flooding. 23 buildings have been destroyed so far. there are no reports of any injuries. firefighters say the fire is human caused, but it's unclear if it was accidental or intentional. two survivors of the ar record regard movie theater shooting turned a tragic day into a joyous one. >> you are husband and wife. you may kiss your bride. >> kristen davis and eugene hahn became husband and wife this past weekend on the one-year anniversary of the shootings. now july 20th will actually mark a happy anniversary for that kouchlt they were both injured in the shootings. some members of the wedding party were with them in the theater that night. talk about turning that situation around, not letting it control you, but you controlling it. i think that's great. >> interesting choice there. >> meteorologist christina loren, were talking about the

>> good monday morning to you. thanks for joining us. i'm willing. >> good morning. i'm marla tellez. jon kelley is off today. we're keeping an eye on london as we goif you a live look outside the hospital. late last night, the duchess of k5i78 bridge, kate middleton was rushed to the hospital by her husband, prince william. kensington palace is confirming she's in the early stages of labor. no word on how that labor is progressing. we'll take you live to london in about ten minutes. the estranged wife of a mim low driver involved in a fiery accident that killed five women on the san mateo bridge is breaking her silence. she's making startling claims about her husband, the driver, including an accusation that he was talking to her on his cell phone and was distracted just minutes before the limo burst into flames. died on the may 4th fire on the san mateo bridge, the cause of which is still under investigation. four other women escaped. survivor nelly air an know says brown was on the phone when the limo was filling with smoke. >> the smoke and the fire came -- stop the car. >> reporter: in an interview with nbc bay area's cheryl hurd days after the fire, brown expressed grief for the victims. later his attorney denied that brown was on the phone at the time of the fire. brown said a language barrier and a misunderstanding prevented him from pulling over sooner. >> thinking that she's saying she'd like to smoke, because they weren't panicking. >> reporter: hernandez-brown describes a volatile relationship with brown saying they split up a month before the fire. earlier on the day of the fire police were called to a walgreen's parking lot where the two argued and brown allegedly kicked his wife's car.

when reached on the phone on sunday, he responded to his estranged wife's claims by saying, quote, i have no comment other than to say there will be a full investigation. >> reporter: hernandez-brown says investigators still have not contacted her. we heard from the san mateo county district attorney's office last night. he says his office is looking into her claims. reporting live at the san mateo bridge, bob redell, "today in the bay." thank you, bob. we talked to a criminal defense attorney about the new allegations. christian picone says the key issue is whether brown was distracted by the alleged cell phone confrontation and where it contributed to his response to the fire. he also said the new claims could absolutely change the investigation. >> if her story can corroborate other evidence and it's proven to be true or reliable, it certainly changes things because now you have a victim saying the driver is not paying attention to us, he's on the phone.

you've got someone saying, yes, he was on the phone, he was talking to me. in fact, we were arguing. if reliable, it certainly can change the course of this investigation. >> the other issue is if the driver was on the cell phone, was he using a hands-free device. as you know, california law requires hands-free use for all drivers but also has a ban on all cell phone use for bus drivers. san francisco police investigating a violent home invasion robbery that happened at the intersection of palou and 3rd street in the bay area after midnight. investigators say three people broke into the home and stabbed the person inside in the chest. a witness tells us the man police arrested and the victim were both taken to the hospital. there's no word on either's condition. >> it is 5:34. students at a peninsula high school say they have been cheated after their ap test scores were thrown out following security concerns.

"today in the bay's" christie smith is live at mill's high school in millbrae. the students saying they should not be punished for someone else's mistake. >> reporter: that's exactly right. it's fairly uncommon to have test scores thrown out. turns out someone tipped off the educational testing service and they cited seating irregularities as the reason for advanced placement test scores being tossed out for up to 224 students at mills high school. students and parents are now demanding that the college board and educational testing service go ahead and reinstate those scores rather than having the students take them again next month. the exams were initially given in may and students are saying, look, i've been on vacation, i'm not rusty and not studying. most students feel they haven't done anything wrong. they started a website, why we need our scores back dot com. they think it may give some kids

an unfair advantage. they haven't been investigating whether actual cheating happened or not. there are5,fñ guidelines for distance between desks and table size for groups of kids. on the website one student wrote "a year's worth of hard work and sleepless nights can't be replicated in just three weeks." that was a student who identified himself as jason. another mom wrote, my daughter studied very hard for her ap tests. it's absolutely unfair for my dart's scores to be invalidated due to factors over which she had no control. she didn't do anything wrong so she should not face consequences of others mistakes. the school has set up meetings about this with the families. one is tonight 579:00. the other is wednesday also at 7:00. reporting live in millbrae, christie smith, "today in the bay." >> christie, thanks so much. i notice christie had a trench coat on. a cool start to the morning. let's check in with meteorologist christina loren.

>> 5:36. a live picture, san jose, mid-level moisture overhead. the subtropical moisture feels humid out there. it's going to feel stickier later on. we'll see the clouds bubble up as we head further into the day. a slight chance for thunderstorms and a better chance for tomorrow and wednesday. also expecting showers when we meet back here tomorrow morning. 57 degrees in san jose, at 58. 57 in san mateo and san francisco. that goes for gilroy as well. taking a look at your satellite doppler radar. you can see we have quite a bit of moisture creeping up from the south. this is very muggy air. you'll notice the difference. temperatures aren't going to exceed their overall average by much. maybe a few degrees. average about 86 in livermore, about 88 degrees today. isolated thunderstorms expected later today. we have a better chance as we head throughout tomorrow. want to put that on your map. for today, keep that in mind.

western-facing slopes for the san jose mountains, the best chance today. 88 in livermore, 85 in fairfield and 74 degrees in fremont, a city mike knows well. 880, what's going on? >> 880 in fremont always a trouble spot, but a little later. right now we'll check 880, 580, they all meet at the bay bridge toll plaza. all these folks are waiting in line for the cash lanes. nothing unusual about the pattern. we'll take you to the maps and show you as the approach comes down off the eastshore freeway, a smooth drive as well. the incline shows a little slowing, but not a big deal. the volume is the issue. this is counter commute. reports of a fire there on the shoulder. chp says they're going to check it out and let us know if there's anything else going on. there are reports of smoke. a little slowing into el sobrate. i'll let you know if we do hear something. looking at west 84, a smooth

if you go outside to st. mary's hospital to that private lindo wing, you can see guards are standing at attention. inside kate is being watched by a top team of medical doctors. we are told her labor is progressing normally. people are watching, very excited for any updates. when kate finally does give birth, a signed medical document will be brought out of that lindo wing, then taken by a guarded car here to buckingham palace. that announcement will will be posted. it could be days, even weeks before we know the baby's name. many people are hedging their bets on that today, trying to get involved in the action and excitement. this royal baby for many betting agencies is the single largest event outside of a sporting event. there's a sense of history here. that royal child will likely be the first to inherit the throne regardless of their gender. live in london, danielle lee,

reforms have their first test in court. a santa clara county superior court judge will hear argument opinions measure b which reduces pensions for new hires and would require current employees to contribute more of their salary toward their pension. voters overwhelmingly approved the plan last year. city employee unions argue their pension rates are protected under a precedent established by past court decisions. it could be months before the judge issues a ruling. even as the court hears arguments over the pension reform, san jose mayor chuck reed is trying to build support for a state constitutional amendment that would help cities reduce employee retirement benefits. mayor reed says cities should have the right to change retirement benefits workers earn in the future. he hopes to have the amendment before voters by november of next year or 2016. before us right now, a look at the forecast with meteorologist christina loren. >> that's right. good morning to you.

looking toward the eastshore freeway, westbound 580. that's the second spot that typically shows the build. first is the tri-valley. we see slowing out of the altamont pass. top of the screen, i've been scanning, the low clouds make it tough to see if there's any smoke in the area of san pablo. that's way at the top of the screen. waiting for chp. so far no updates means no problems eastbound side of 80. some smoke at one point over the morning. looking toward the bay bridge toll plaza, the cash lanes backing up. no metering lights yet. probably 10 to 15 minutes. looking at a good build. perhaps right at 6:00. the backup just to the 880 overcrossing for the cash lanes only. the maps show a similar situation. the maze moves smoothly through the area. 2340 problems for oakland. let me flip this map around. south out of fremont. this is the speeds, and the average speed is about the limit heading south out of 880 into milpitas. as the sun starts to come up,

welcome back. good morning. it is 5:53. scott mcgrew has the morning off. we're keeping an eye on all the top business stories this morning. the markets looking to build on the fourth straight week of gains. earnings reports will be released today including reports from mcdonald's, apple, boeing and caterpillar. there will be data on existing home sales. a new survey of professional economists finds companies are more confident about the economy. that means they're hiring. nearly a third say their firms added workers this spring, the highest percentage in two years. better yet, about 40% are expected to hire more people over the next six months. apple is reportedly testing bigger screens for both the iphone and ipad. the company's asian suppliers say apple has asked for a prototype smart phone screen that's bigger than four inches and a tablet screen that's bigger than 13 inches. the current iphone 5 has a four-inch screen and the ipad
