good monday morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> i'm marla tellez for jon kelley. san francisco police investigating a violent home invasion robbery this morning that happened at a home near the intersection of palou avenue and third treated in the bayview district. police say three people broke into the home and stabbed the person inside in the chest. officers arrested one man. they're still looking for two other suspects said to be a man and woman. a witness tells us the man police arrested and the victim were both taken to the hospital. there's no word on either's condition. the estranged wife of the limo driver involved in a fiery accident that killed five women on the san mateo bridge is breaking her silence, making startling claims about her l"°t driver, including an accusation that he was talking to her on his cell phone and was distracted just minutes before the limo burst into

flames. "today in the bay's" bob redell joins us live near the san mateo bridge with what else she had to say. >> reporter: good morning, laura. that's right. she is breaking her silence. rachel hernandez-brown says she was arguing wit her husband, orville brown, on the phone minutes before the tragedy she's raising concerns that he was too distracted to react quickly when the limo burst into flames.lsñ hernandez-brown tells nbc bay area that her husband even turned up the music as they argued so the women in the back of the limo couldn't hear them fighting. >> cussing me out saying, would you listen to me? i can't really talk because i have clients in the car and i can't be unprofessional. that's when i said maybe you need to pay attention to the road and leave me alone and do your job. >> reporter: what remains unclear is if an argument slowed his response when one of the

passengers started clopounding the closed partition. in the past the driver's attorney denied he was on the phone at the time of the fire. a new bride and four friends died in the may 4 fire on the san mateo bridge, the cause of which is still under investigation. four other women escaped. when reached by phone orville "ricky" brown responded to his estranged wife's claims by telling nbc bay area, quote, i have no comment other than to say there will be a full investigation. reporting live at the san mateo bridge, bob redell, "today in the bay." it is 6:03. the coast guard has detained a boat captain in the san francisco bay after he led them on a chase at sea. coast guard officials say a crew was patrolling near sausalito yesterday afternoon when they came across a 30-foot boat. it had no markings and no flag. and when the coast guard tried to board the vessel, the captain allegedly refused, pulled up the ship's anchor and took off. the coast guard followed it and approached again near ocean beach.

the coast guard says there was some sort of altercation but the captain eventually complied and was taken into custody. it's unclear what charges he will face or what his motive was for fleeing the post guard. it is a mixup that could put hundreds of high schoolers' plans in jeopardy. test scores thrown out and students want to know why. christie smith is live with more on the testing troubles at mills high school in millbrae. >> reporter: good morning. the students are frustrated, saying they didn't do anything wrong at all and being punished the same. the testing service that's looking into this say they're not investigating whether there was cheating going on or not. the reasons cited for all this is seating irregularities. that was the reason given by the college of board and educational testing service for invalidating the advanced placement test scores for up to 224 students at mills high school. students can go ahead and retake the test next month, but they're saying, look, we're rusty.

it's summer and they haven't been studying for a while and they don't want to do that. a testing spokesperson says there are protocols for administering the test, like the distance allowed between certain desks. the ticket is trying to figure out exactly what went wrong here. the students say they want their scores w7rreinstated. at this point they don't even know what they are. they started a website, whyweneedourscoresback.com. on the website, one person identifying himself as keith, my college application is on hold due to the delay of ap test scores. if i cannot turn in my ap test scores as soon as possible, my application may be withdrawn. please reconsider the board decision. the school is holding meetings to discuss this with concerned parents and students. one of them is tonight at 7:00 at the school. the other is wednesday night at 7:00 also at the school. reporting live in millbrae,

a dubai rape claim dispute says she has been pardoned and is free to leave the country. marte dalelv wound up being charged with a sex offense and sentenced to 16 months in prison for having sex outside marriage. that sentence was dropped today. more deaths are being reported this morning following that 6.6 magnitude earthquake in china. the quake hit the gone sue province in western china last night, followed by a series of smaller quakes overnight. this morning the local government is reporting 75 people are dead and at least 459 others are injured. the chinese red cross says it is shipping relief supplies to the area. but rescue efforts are being slowed by mudslides and also toppled power lines. 6:14. u.s. fighter jets dropped four unarmed bombs on the great barrier reef after a training exercise went wrong. the two jets were supposed to drop the bombs on an island

it's a smooth drive. the san mateo bridge, getting over there, westbound is already. the debris reported eastbound looks like it's cleared up. no problem closer to the toll plaza side. a smooth drive for 101 into san francisco. 280 the same thing, it's southbound 280 that we have report of an unusual incident around mag layne nah. reports are that somebody hit and knocked down a mountain lion. we don't know the status. we're waiting for the update from chp. we have a crew heading to see the scene. we'll let you know if there's anything to report. so far no slowing past the scene. no lanes reported blocked. northbound in the commute directs, north 101 from 680 toward 880, that's when you see the speeds coming into the 50s. a look at fremont, a live shot as folks are coming down into this area, 880 picking up the volume a little bit as you come

past the truck scales south of the dumbarton bridge. you see a burst of volume, traffic as well. the low clouds not playing a major factor as far as the speeds go. in sunol the clouds are touching the tops of these hills. not a problem into fremont. the issue is there was an earlier crash and which do see slowing around the golf course and around the bend. there may be another incident at the truck scales, although there's nothing in the chp report. it could be a flat. i'll scan the report carefully. another live look outside shows you the bay bridge toll plaza where all lanes are still building. we have the metering lights on. so we have a slower build coming up at basically the end of the park lot. it's pretty smooth up to west grand avenue and up to the 880 over crossing, the eastshore freeway. speeds just now dipping into the upper 50s as well. 6:19. fresh off the all-starlú break the a's continue their roll. pitcher bartolo colon shut out

wildfire that burned close to 42 square miles in palm springs. right now the mountain fire is 6% contained. yesterday a thunderstorm brought an inch and a half of rain+wé b also broader rat tick winds and the threat of flooding. 23 buildings have been destroyed so far. there are no reports of any injuries. firefighters say the fire is human caused, but it's unclear if it was accidental or intentional. 6:25. today a southern california family is taking toyota to trial for a sudden acceleration problem that prompted millions of cars to be recalled. the family is suing toyota for the death of 66-year-old noriko uno who died when her toyota camry unexpectedly accelerated and crashed into a telephone pole and a tree. toyota said there was no defect in the car but went on to recall 9 million cars due to accelerators that got stuck and floor mats that trapped the gas pedal. this is the first such case against toyota to be taken to trial. new reports this morning of

survivor nelly air an know says that brown was on the phone when the limo was filling with smoke. >> the smoke and the fire came and stop the car. >> reporter: in an interview with nbc bay area's cheryl hurd days after the fire, brown expressed grief for the victims and later his attorney denied he was on the phone at the time of the fire. brown said a language barrier and a misunderstanding prevented him from pulling over sooner. >> thinking she's saying she would like to smoke because they weren't panicking. >> reporter: hernandez-brown describes a volatile relationship with brown saying they split up a month before th fire. earlier on the day of the fire police were called to a walgreen's parking lot where the two had argued and brown allegedly kicked his wife's car. when reached by phone sunday by nbc bay area, orville brown responded to his estranged wife's claims by saying, quote, i have no comment other than to say there will be a full investigation.

hernandez-brown says investigators still have not contacted her. we heard from the san mateo county district attorney last night. he says his office is looking into her claims. reporting live atfs? the san ma bridge, bob redell, "today in the bay." >> thank you, bob. we spoke to a criminal defense attorney about the new allegations. christian picone says the key issue is whether brown was distracted by the alleged cell phone conversation and whether it contributed to his response to the fire. he also says the new claims could absolutely change the investigation. >> if her story can corroborate other evidence and it's proven to be true or reliable, it certainly changes things because now you have a victim saying the driver is not paying attention to us. he's on the phone. you've got someone saying, yes, he was on the phone, he was talking to me, we were arguing. if relishlgs it certainly could change the course of this investigation. >> the other issue is if the

slow from highway 84 around to the truck scales. an earlier crash has long since cleared, but therem&t may be activity in another spot with paperwork going on. the map does show thatywc area south of 84. coming in out of pleasanton as the volume starts to build that, is starting to compound. the tri-valley itself, no other surprises. west 84 is pleasant through livermore around vallecitos. there's debris on west 580, but not a big castro valley y is slow up to north 238. south 880 slows down into hayward. south 880 slows down into hayward. a typical pattern into san mat bridge. an earlier crash reported around the toll plaza. we'll take a livexa'ñ look at t camera and show no problems as folks head westbound with the taillights away from us. there's a little hayes, but you can't see while you're on the bridget étñself. the drive speeds down for the east shore and the approach to the bay bridge toll plaza, a nice easy drive, coming down

walking around, asking us wjgi do we know. so many here hoped to be here when the baby was born. outside of st. mary's hospital, outside of that private lindo wing, guards are standing by. kate has been in the hospital in labor for more than eight 4ñhou. we hear things are progressing normally. we're waiting to hear that this baby has arrived. when that happens, a signed medical document will be brought out of the hospital into buckingham palace displayed on an easel. we'll know the baby's gender, weight and maybe eye color. it could be a couple weeks before we know the baby's name. because of that, a lot of people here are excited, they want to take part in the event, they're betting on the gender and the name of the baby. many people hope they won't have to wait a couple weeks to find out what the couple does name the child. there is a sense of history because this child will likely inherit the throne regardless oñ their gender and be the first to

forecast. i really look forward to this time of year because typically we have some of the best weather all year long. we are still going to hold on to that, especially around the bay. we're going to add a little moisture, a little humidity. it's almost going to feel like florida as we head through the next couple days. all this moisture starts to push tint bay area from thesi)asout. today we're talking a 5%, 10% chance of seeing showers and thunderstorms tomorrow. we ramp up the chance to about 20% to 30%. that will be the case for wednesday as well. let's talk about what we're expecting. we stop the clock at noon today, clouds streaming in from the south, mostly cloudy at that point. all the way from san jose to fremont, still getting sunshine from santa rosa to san francisco. that will change between 12:00 and 4:00. mostly cloudy over the greater bay area to finish off the day. look at this. this is something you might not expect. showers move in when we meet back here tomorrow morning. we're going to be tracking these on the radar for you. you can see that on your futurecast. i can tell you right now

breaking her silence, and she's making startling claims about her husband, the driver, including the accusation that he was talking to her on his cell phone and was distracteded minutes before the:giç limo bur into flames. chapter is accuse of- shooting and killing pettigrew. investigators in east palo alto are asking for the public's help to track down the person who shot and killed a 30-year-old man in the middle of the day. the man was shot to death in his car about 3:00 saturday afternoon near the corner oflarksspur drive and o'connor street. the shooting is not believed to be gang related. the head of the naacp will hold a special news conference this afternoon to talk about the george zimmerman verdict. over the weekend hundreds of rallies were held nationwide in support of trayvon martin. in san jose, hundreds gathered outside san jose city hall to discuss race in america and call on states to overturn the stand your ground law. at least 22 states have

currently had laws similar to florida. >> san jose's controversial pension reforms have their first test in court today. a santa clara county superior court judge will hear arguments on measure b. the measure reduces pensions for new hires and would require current employees to contribute more of their salary toward their pension. voters overwhelmingly approved the plan last year. city employee unions argued their pension rates are protected under a precedent established by past court decisions. it could be months before a judge issues a ruling. important test scores have been thrown out for hundreds of students on the peninsula. high schoolers in millbrae say they're being punished for something that wasn't their fault and it's putting their college enrollment in jeopardy. christie, this all started because of a seating arrangement? >> reporter: yeah, that's the unusual part about this, but there's so much frustration and outrage that the school has set up a meeting to talk with parents about this at 7:00.

but the students, as you said, are saying, look, we didn't do anything wrong but we're being punished. they could have their advanced placement test scores thrown out and this could affect more than 200 students at mills high school. thezñ testing service is not investigating whether students are cheating or not, what they're doing is looking into seating irregularities. that was the reason given forzo this when the tests were taken in may. they're trying to figure out what went wrong. apparently there are protocols on the distance between desk and table size per student. the students can can retake the test but they say they don't want to. they started a website calling whyweneedourtestscoresback.com. they say the delay is disrupting their college enrollment plans. on the site a student wrote my college application is on hold
