it is almost 4:31. good morning to everybody. good to see you. i'm jon kelley. >> i'm laura garcia-cannon. we have breaking news right now in the south bay. police have been called to a home in south san jose where a 7-month-old baby has been found dead. it's happening at makati circle near blossom hill and monterey highway. "today in the bay's" bob redell just arrived on scene. what's going on? >> reporter: officers have been here for a few hours. san jose's homicide unit is investigating this death of this child because that's standard when it's not clear how the child died. we're talking about a 7-month-old baby boy. someone at this apartment complex on makati circle dialed 911 around 1:15 to call for help to let emergency know there was a 7-month-old baby boy who was unresponsive. it's not clear if it was one of the boy's parents who made that phone call. the boy unfortunately was already dead when police arrived. officers have made no arrests.

sjpd says it's too early to tell if something criminal happened, if the baby was murdered or died from natural causes like sudden infant death syndrome otherwise known as sids. you can see police are still here investigating the death of a 7-month-old baby boy found unresponsive early this morning. a 911 call was put in. homicide is investigating, but it should be noted that is standard when it's not clear how a child has died. reporting live in san jose, bob redell, "today in the bay." >> bob, thank you very much for that update. campbell police looking for a hit and run driver who plowed right into a group of cyclists at the san jose bike party about 12:30 saturday morning on campbell avenue near the campbell community center. we can tell you the driver did not stop. a 20-year-old woman was hurt badly. she's right now in the hospital with a fractured skull and hip, a broken leg to go with that. she's in bad shape. her friend was also hit by that

car. she says the driver in a dark-colored honda swerved into the bike lane and just kept driving. >> something like that doesn't need to happen. you're with a group of friends enjoying a bike ride and someone wants to be irresponsible and take off after you hit someone. it's not right. >> that group was riding in the monthly san jose bike party which draws hundreds of cyclists on the third friday of every month. campbell police right now asking any witnesses who happened to see this crash to please give them a call. a 16-year-old boy is accused of raping an intoxicated 40-year-old south bay woman in her home before stealing her stuff. police say it happened saturday night after the woman took a taxi home from a bar. the taxi driver reportedly asked another woman and her teenage son to help them get the intoxicated woman into her morgan hill house. later that night investigators say the teenager returned to the home and raped her. he's also accused of later

burglarizing her home with the help of his 15-year-old girlfriend and another friend. the man accused of kidnapping and killing sarah lamar will enter a plea. torres still has not answered to charges of murder and kidnapping. just last month his attorney asking the prosecution to overturn or actually turn overall evidence in this case. and prosecutors say they're working with the sheriff's department right now to do just that. that means garcia, tr resume finally enter a plea today. sierra lamar disappeared in march of last year. her body has yet to be found. a school district on the peninsula is considering legal action to have students' ap test scores reinstated. san mateo unified school board will meet at noon in a closed session to discuss legal options. last night hundreds of mills high school students and their parents met to discuss why hundreds of ap test scores were thrown out. educational testing services

says the school did not follow strict seating requirements. now students say they have to retake courses in college that they could have bypassed with ap tests. >> i already know this material and i have to redo it. i could be advancing forward going to other classes, graduating earlier. in this economy that's what everyone wants to do. >> we're counting on that extra money just to not only see that she graduates in four years and not longer, but just to save some financial -- some money. >> ets says the decision maintains the credibility of the test. state senator ye is promising to ask questions and to pressure ets to release the scores. of course there's more good vibrations as the world continues to celebrate this morning the birth of the heir to the british throne. in canada, how about this? niagara falls lit up overnight in the appropriate blue of course marking the arrival of the brand new prince. meantime in london -- that's actually cool to see -- danielle

lee is outside buckingham palace updating us on what's in store for the royal family today. >> reporter: well wishers crammed around the gates as buckingham palace into the morning, many raising their glasses to the new prince. >> just in time to burst my bubble. >> reporter: even a sudden downpour didn't scare the crowds away. >> i could not be more excited if i tried. >> reporter: for hours a golden eagle held the image everyone was coming to see, an official bulletin delivered from st. mary's hospital announce that the prince had been born at eight pounds six ounces. there was even a town cryer. >> here ye here ye, here ye, the prince today. god save the queen. >> reporter: kate and william could leave the hospital with their new baby at some point today. in a statement the couple said they couldn't be happier. their young prince is now third in line to the throne.

area tech companies, the markets finished on a positive note yesterday. things looking good all year long for the most part. for a look at how the futures are training, we turn things over to mary thompson live at cnbc world headquarters. mary, happy tuesday morning. >> happy tuesday to you. futures are looking higher after stocks posted small gains on monday, this despite a report showing a drop in existing home sales last month. the s&p 500 notching its 22nd record close this year. there's no exec data but we'll be getting a lot of earnings. ups, apple and at&t are on top. yesterday the dow finished two points at 15,546 and the nasdaq added 12 to finish at an even 3,600. taco bell is getting rid of its kids meals which it says really weren't selling anyways. the fast food chain says kids meals will be entirely gong from its u.s. menu, like the soft taco and bean burrito will move

to the regular menu. back to you. >> mary, thank you very much. in a few hours from right now, federal investigators holding a special meeting taking a look at possible new safety rule changes for school buses. the national transportation safety board all set to meet at 6:30 to consider a report on the probable cause for an accident in new jersey last year. this one was a crash killing an 11-year-old girl and seriously injuring five other students including that girl's two sisters. the board will be also looking at findings from a crash down in florida that killed one student while leaving four others seriously injured. possible recommendations could include mandatory seatbelts in all school buses. the house committee holding a hearing today on immigration reform after republicans rejected a senate bill on that issue. the house judiciary committee expected to endorse a path to citizenship for at least some immigrants right here in the united states, specifically immigrants brought here as children. democrats are still pushing for

a comprehensive solution dealing with all 11 million undocumented immigrants here in the u.s. earlier this month the senate passed a comprehensive reform bill, but it ended up failing in the house. 4:49. two humpback whales almost had a diver for lunch off the central coast. it was all caught on camera. >> this is wild to see. the video incredible. the whales are actually chasing a school of fish. you got to get lunch. there you see it. they come it up to the diver there, right next to him. the diver says they were so close he could actually almost touch them. probably could smell what they were eating for breakfast. they were able to swim back to the boat safely. afterwards they actually had a chance, happy to report they were able to talk about their experience. you can hear more on that coming up at 5:00. talk about staring right in the jaws of danger. >> there are things out there in the water. from whales to sharks. we'll tell you which members of
