>> i'm jon kelley. good morning everybody. we're following breaking news right now in san jose. police investigating the death of a 7-month-old baby found in a home on makati circle in south san jose near blossom hill and mochbt ray highway. "today in the bay's" bob redell is live at the scene with what we've learned from police. bob, good morning. >> reporter: good morning, jon. san jose police tell us their homicide unit is investigating this death, a death that was reported overnight, just after midnight, around 1:15 this morning at the terrace villas apartment complex in south san jose. you can see officers are still on the scene. they say it's too early to tell if something criminal happened or if the baby was murdered or if this was a situation where this baby died from natural causes like sudden infant death syndrome. it is standard for them to assign homicide to this until they determine one way or the other. someone at this apartment

complex did dial 911 early this morning, around 1:15 to call for help to let emergency know there was a 7-month-old baby boy who was unresponsive. it's not clear if it was one of the boy's parents that made the call. by the time police arrived, that baby boy was unfortunately dead. so far police tell us they have not made any arrests. reporting live in south san jose, bob redell, today in the bay. it is 5:02. learning new details about a hit-and-run crash in the south bay where a driver plowed into a group of cyclists. witnesses say the driver went to great lengths to hide their identity. the collision happened around 12:30 saturday morning on campbell avenue near the campbell community center. "today in the bay's" christie smith is live in campbell with the latest on the search for the driver. good morning. >> reporter: good morning, laura. pretty bold and deliberate. six people riding their bicycles home from a party. they say a driver swerved right into the bicycle lane, hit two of them, didn't stop to help.

instead turned off the headlights to the car and sped off to avoid being detected. one of the people injured showed us his leg wound and says he was lucky to have survived this. stephen was with five friends on west campbell avenue early saturday morning on a ride. part of a south bay tradition that attracts many cyclists. he says he heard a car and it was coming fast. he had no time to move out of the way and a dark colored honda sedan swiped him from behind. there was no honking, no warning. then he says it crashed into his friend nickie who flipped over and landed on the ground. friends say she frasuffered a fractured skull, hip and leg. police say the driver turned and then turned off his headlights. >> he knew what he did. that person knows. it's sad that someone has the nerve to just take off after you hit someone on a bike. >> reporter: the bike she was riding on has a bent wheel and

damage to the frame. apparently, though, pieces of the car's broken right mirror and headlight were left behind. police, of course, looking for the car and the driver. if you know anything about this hit-and-run accident, you're asked to call campbell police. reporting live in campbell. christie smith, "today in the bay." a summer camp counselor in morgan hill expected back in court today where he could enter a plea on lewdness and child pornography charges. 20-year-old nicholas larm nay was arrested earlier this month. police say a 6-year-old girl told her parents something happened involving him at the ymca paradise valley elementary child care center where he worked. they say they found child pornography on his cell phone including images of a 17-year-old girl. a palo alto man was killed and his wife hurt after their small plane crashed after taking off from lake tahoe's airport. the single engine plane took off yesterday morning, a crash just a mile east of the airport. the el dorado county sheriff's

department says the pilot, stephen luff ton died in the crash. she called her husband who happened to be a sheriff's deputy. he used the gps signal on her cell phone to find the crash site. the pilot's wife suffered minor injuries. a new mexico murder suspect who fled to san francisco and made a living becoming very popular playing a saxophone at a b.a.r.t. station now heading to prison for killing his ex-wife more than 25 years ago. ronald brewington was best known at the embarcadero station as the jazz man, arrested last year by albuquerque police wanted in the shootinging death of his ex-wife back in 1987. two weeks ago brewington pleading guilty to second degree murder and sentenced to 16 years in prison. in case you haven't heard, britain celebrating its newest heir to the throne this morning. prince william and his wife kate the proud parents of a baby boy. we have a live look at the

hospital where that baby was born yesterday afternoon. he weighs eight pounds, six ounces. mother and baby said to be doing well. we're waiting for our first glimpse of the prince of cambridge. we just got word from kensington palace saying kate will not be leaving the hospital until late this morning at the very earliest. last night the london i tower bridge and the british telecom tower were lit up in celebration of the new prince. no name released yet. but prince william and kate issued a statement saying they could not be happier. their lives have changed forever. >> yes and lots of bottles of champagne worldwide being popped in celebration. 5:06 right now. a little moisture outside. no champagne. maybe a little early for that. but christina loren, maybe some rain. >> not champagne raining down. good morning to you. we have real radar to show you this morning. this thing is lit up like a fire cracker. i want to make sure you're ready for it before you head out the door. this is actually a little heavier to moderate rainfall

embedded within the light stuff. it just started over the past four hours. so just in time to get your highways nice and slick for the morning drive. you want to give yourself extra time. i'm watching the little cells as they popup. we have the strong thunderstorms starting to develop. we'll continue to see more activity. all this is pressing south on 580 as we head through the next 15, 20 minutes. a lot of that activity is going to fall apart. but some of which could produce 60-mile-per-hour wind gusts, heavy downpours and maybe even pea-sized hail and lightning. so far no lightning, 88 degrees in livermore, 88 in fairfield and 85 in concord. we'll be tracking the storms as they develop all morning long. troofk and weather go hand in hand. 5:07. my right-hand man, mike inouye. >> you're talking about the rain coming through the altamont pass, south and west along 580. we'll track that. right now we're looking toward the bay bridge. turned the camera to the toll plaza. jon did show a bit of a backup

in a couple of the cash lanes. looking at the toll plaza itself right here. camera 167 showed the metering lights. there you go. we have the lights overhead. the red ones, the flashing ones are the fast track ones. the red ones are the close toll lanes. up until just a few minutes ago, up until when jon showed the live shot earlier. two lanes are blocked, not a big problem. >> looking at the carquinez and benicia bridges. a smooth flow from the north bay. in through the north bay we have highway 37, 29 and 37 a big rig crash overnight. a sig alert in place. scheduled to be cleared by 5:30. i haven't heard about any delays. meanwhile, tracking the tracks as well. we have mass transit with no major delays. ac transit across the bay looking really good. caltrain up the peninsula, a nice flow of traffic.

officials in the east bay and central valley looking to expand rail service for commuters and they're asking for your input. the san joaquin regional rail commission considering running more frequent ace commuter trains between stockton and san jose and extending the service to manteca and merced. there may be four public meetings to discuss the project over the next several days including one happening tonight at the fremont senior community center. the meeting is all part of an environmental preview of this project which could take effect as early as 2018. it is 5:09. new details we're learning this morning about a weekend boat chase in the san francisco bay. plus drivers getting extremely up close and very personal with a pair of whales out there. we'll hear from one of those men that happened to be riding the water when the big boys showed upcoming up.

to snap a few totos of whaems over the weekend. when they got about 2 1/2 miles out, they got way more than they bargained for. you can see sean and the other guy highlighted there. out of nowhere, these two giant humpback whales, mouths wooit wide open within feet of the guys. shawn says he could have reached out and touched one of those massive mammals. >> i figured i'm going to get hit by the tail, so i tried to get out from underneath from above the satail, worked over t the boat, got on the back of it as soon as i could. the other guys said they've never seen me swim that fast before. i can see why now that i've watched the video. >> the other guys had a joke or two waiting for him once he made it back safely. listen to this. >> you're going to have to do more to clean that wet suit. >> yeah, he is. he's going to have to take that suit to the cleaners. you can't blame him as you get

sunnyvale with plenty of clouds just like yesterday. the clouds are going to limit the sunshine. we also have some rain-cooled air starting to push from east to west. san francisco and the peninsula right now getting hit pretty hard. watch out on 280, 101, give yourself extra time. in the altamont pass we're tracking this thunderstorm cell heading towards 580, livermore, next to east pleasanton. make sure to give yourself extra time. now i'm tracking a new thunderstorm to just developed over the santa cruz mountains. want to give you an idea of the overall flow. for us, it means it's going to be muggy, sticky and we'll have showers in the forecast simultaneously with thick fog at the coastline, very rare here in the bay area. that is, in fact, the case for today, highs are going to be on the warm side, but not too bad. 88 isn't bad, isn't unbearable in livermore. 78 in fremont and 64 today in

san francisco. so they're still getting that normal summer pattern. meanwhile we have monsoonal moisture capable of producing strong thunderstorms. that goes from the north bay mountains, the best chance also goes for the south bay mountains and the spine of the sierra nevada. let's get right to it. here is your seven-day outlook. cierra thunder is what we'll be working with on sunday. the atmosphere not as right for those thunderstorms. friday, saturday, sunday, temperatures will level off and we'll see a drier pattern. back to that dry california heat. mike, that's a big smile on your heat about that. >> i'm smiling. then i'm thinking, i don't know. we have ants that found their way into our house. looking toward the maze, an easy drive toward the bay bridge. we showed you the change in flow. all lanes moving smoothly but getting ready for that morning commute. we're seeing the volume build up

toward the bay bridge and the westbound upper deck. look at the commute direction off 880. this is the dumbarton bridge here. highway 84. now, from dakota road down to dixon landing road that, is your compute direction from this part down. looking at the speed limit, 64 miles per hour registering on average as you're traveling south past auto mall parkway. here is a caltrans camera with a live look. this is the loop for 880 to 101. this is where we often have crashes. it's a very severe loop. these are the types of spots where we have mist on the road. watch those speeds at the off-ramps because during the mist and drizzly times, that can be a problem. overnight road work not presenting a problem right now. the entire south bay looking good as far as the speeds. other spots through sunnyvale and cupertino starting to pick up, not presenting a problem. in palo alto, 101, not a

problem. coming over the san mateo bridge, looking good. volume of traffic starting to get more company now. back to you. mike, thank you very much. right now a preview of an exclusive investigative unit report. a crisis has gripped our courthouses and is now affecting anybody who needs to file a small claim, get a divorce or settle a landlord-tenant dispute. every court in the bay area has seen longer delays in processing and scheduling civil cases on their calenders. across the entire state a total of 175 courtrooms have been closed due to budget cuts in the last decade. more than $1 billion has been cut from the state's judicial system by lawmakers in sacramento. to see exactly what that means, nbc bay area tracked the statistical delays in court calendars and discovered waits for civil cases can take four times as long as it did just a few years ago. >> we hear stories about victims of domestic violence who sleep

in their cars outside courtrooms because they can't get a hearing and they can't go home. >> we're creating backlogs. five years ago we had no backlogs. now in just about every division we have significant backlogs, particularly in civil and in family and in traffic and in records, substantial backlogs. >> coming up later tonight, investigative reporter stephen stock takes us behind the scenes of a system in crisis to see how this affects everyday people and he'll also be breaking down the numbers to see how long the wait for the justice system really is. that's coming up tonight at 11:00 on nbc bay area news. 5:20. a followup to a story we first told you about this weekend. the u.s. coast guard says the sailboat skipper who led them on a slow-speed chase in the san francisco bay was making false distress calls. a coast guard boat was patrolling near sausalito sunday afternoon when it picked up a distress call on the radio.

they tracked the call to david mccormick's boat and requested to board. he refused and sailed off. the coast guard boarded the boat and arrested mccormick after he allegedly lunged at an officer. he's in jail charged with assaulting a federal officer. we'll tell you about the bet that got away from him. a sports columnist calling out aaron rodgers after he made an ill-advised tweet. we'll explain next.

welcome back everyone. it's 5:23. the nfl found a way to fight performance-enhancing drug use among players. the league informed players earlier this month they will all be required to submit blood samples during training camp.

it will test for a human growth hormone t. players union declined to commentn baseball it is possible we could hear today more players will be suspended for using performance-enhancing drugs. the mlb expected to suspend as many as 20 players connected to a florida drug company. among those, the major name there, a's all-star pitcher bartolo colon, melky ka brer rand the yankees' alex records. the league has already suspended milwaukee brewer ryan braun who will be out the remainder of the season, doing it without getting paid. brawn was linked to the florida drug company that supplied players with performance-enhancing drugs. in a statement released by the mlb he says he made some mistakes and he will be accepting the consequences. just last season braun avoided suspension after a positive drug test because his sample was incorrectly handled. the 34rkslb is starting to crack down hard. that led the packers' aaron

rodgers to come to braun's defense. when asked if he believed braun didn't use peds, he said, yeah, i put my salary next year on it. the salary is worth about $4.5 million this year. however, don't bet on rodgers paying up on this one. 9ers fans may remember last year rodgers made a bet with the r&b group boys 2 men and promised to wear a 9ers jersey for a week if the packers lost. the packers lost, but rodgers did not wear said jersey. >> you'll be called grape soda. you know why? welch's. >> that much wit early in the morning. welcome back, jon kelley. welcome back some rain, too. >> we actually have a lot of rain t. whole radar lit up. widespread showers across the greater bay area. make sure you're ready for that.

found in a home on makati circle in south san jose near blossom hill and monterey highway. today in the bay's bob redell live on the scene with what he's just learned from police. >> reporter: good morning. it's standard in a case like this where you have a dead baby boy, 7 months hold. sjpd assigned the homicide unit to investigate. what they're trying to figure out is whether or not this was criminal or natural. was the baby murdered? did something happen as a result of foul play or is this perhaps natural death, maybe sudden infant death syndrome. they have not announced it yet to us. this happened overnight on makati circle in south san jose. 911 received an emergency phone call from this location around 1:15 this morning. the person on that phone telling the responder, my baby boy, 7-month-old baby boy was unresponsive. it's not clear if that call came from one of the boy's parents or

someone else. by the time police arrived here that child was dead. it should be noted that police have told us no arrests have been made. right now they're trying to figure out if this was an unfortunate, terrible tragedy, something that results from something natural or if there was something criminal that took place here. reporting live in south san jose, bob redell, "today in the bay." it is 5:32 right now. a 16-year-old boy stands accused of raping an intoxicated 40-year-old south bay woman before ripping off her stuff. police say this happened saturday night after that woman took a tax k3i home from a bar. the taxi driver apparently asked another woman and her teenage son to help get the intoxicated woman inside her morgan hill home. later that night investigators say that teenager went back to the house and raped her. he's now also accused of later burglarizing her home with the help of his 15-year-old girlfriend and another friend. 5:32.

the man accused of kidnapping and killing morgan hill teen sierra lamar may finally enter a plea in mark. anti lynn garcia torres has not answered charges of murder and kidnapping. last month his attorney asked the prosecution to turn overall evidence in the case. prosecutors say they were working with the sheriff's department to do that. that means garcia torres may finally enter a plea today. sierra lamar disappeared in march of last year. her body has yet to be found. this morning campbell police on the hunt for a hit-and-run driver who swerved right into a bike lane and plowed into a group of bike riders. this happened around 12:30 saturday morning near the campbell community center. "today in the bay's" christie smith live at police headquarters with how that driver made it very difficult for anyone to catch them. good morning. >> reporter: good morning, jon. these cyclists say there was absolutely no warning at all. they were shocked. there was no honking. they had no time to get out of

the way. they say they were riding down the street when all of a sudden this car swerved right into the bike lane and hit two of them. then they say the driver actually turned off the headlights and turned the corner to avoid getting caught. we spoke with one of those cyclists who showed us the injury that he suffered in all of this on his leg, says he was on his bike early saturday morning with five friends on west campbell avenue. they were associated with a larger group of riders that meat once a month to ride. he says he heard the car coming fast but again had no time to get out of the way. they were in the bike lane when the car, a dark colored honda sedan swiped him from behind. the car, he says, hit his friend nicki. she flipped over on the bike and was unconscious for about two minutes. her friends say she suffered a fracture skull, hip and broken leg. the driver, nowhere to be found. >> something like that doesn't need to happen. you're with a group of friends

enjoying a bike ride and someone wants to be irresponsible and take off after you hit someone. it's not right. >> the bike she was on has a bent wheel and damage to the frame. there are marks, tire marks in the bike lane. one witness says that after the crash the driver who turned off those headlights sped down wind chester boulevard but not before leaving pieces of a broken mirror and broken head lamp on the ground. campbell police asking anyone with any information on this hit-and-run to please give them a kauchlt live in campbell, christie smith, "today in the bay." >> thank you, christie. 5:35. a school district on the peninsula is considering legal action to have students' ap test scores reinstated. the santa fe school board will meet in closed session to discuss legal options. hundreds of mills high school students and parents met to discuss why hundreds of scores were thrown out.

educational testing services says the school didn't follow strict seating requirements. students say they now have to retake courses in college that they could have bypassed with ap tests. >> i already know this material and ild vee to redo it. i could be advancing forward, going to other classes, graduating earlier. in this economy, that'só$ everyone wants to do. >> we're counting on that extra money just to not only see that she graduates in four years and not longer, but just to save some financial -- some money. >> ets says the decision maintains the credibility of the tests. state senator leeland ye is pressuring ets to release the scores. 5:36. when coming in, there was rain on the windshield. that's a busy morning for meteorologist christina loren. >> they are busy, not so busy that you didn't blow back in this morning. we're happy about that, jon kelley. we sure missed you.

toll plaza where things have started to stack up over the last few minutes. this is not necessarily due to the rain. but we're watching slicker conditions on traffic tuesday. beautiful sunrise. that's for sure. don't let that distract you from the fact that you may have slicker conditions. a slower drive out of the altamont pass. look over the upper right-hand corner. the blue and the green. that means weather roadways registering on our road weather index. the traffic and weather tied together. my system takes over and shows you where it's probably going to be slick on those roads for 580. 84 through vallecitos, a new crash showing up for grant line road. no lanes blocked from what i understand. a little slowing toward the dublin interchange as well. taking you to the north bay, a nice easy drive to and from the carquinez and ben neegs bridges. still a gravel spill and clean up going on. in the south bay we have our

of people crowding around for the changing of the guard ceremony. it happens every day. it was special today. they played "congratulations" in honor of the new prince. at any minute, the celebration is about to begin. we'll hear gun salutes bellowing out from the tower of london and green park in front of buckingham palace. ha is a long-standing tradition whenever a royal child is born. in terms of a name, everyone is still guessing. we have not gotten an update from kensington palace. they're only telling us it's going to come in due course. that could mean up to a couple weeks. wurn thing i can tell you is when kate and william do finally ave the hospital, they are expected to head toward kensington palace and could head to buckle berry where the middletons live where kate can relax and enjoy her new child. live in london, danielle lee, back to you. >> it will be interesting to see them walk out, if we get a glimpse of the baby at all. a lot of people anxious,

set out to see if they could hear the whales sing. they didn't hear any music, but definitely got more than they bargained for. you can see sean and another guy in the water there. out of nowhere, here comes the two giant humpback whales, mouths wide open within feet of them. we'll show you again in slow motion to give you a better look of it. sean says he was right above one of the whale's tail and thought for sure he was going to get whacked or even worse considering the sheer size of the massive mammals. >> you see pictures, representations of how big a humpback whale is compared to a bus, to a jet. when you see one in person that close, they are giant. it blew my mind how big they are. >> probably an understatement there. everyone made it back safely to the boat. sean says he's never swam faster. one of the first things he did once he made it back to shore was post this video on youtube where it has almost a million

hospital with minor bumps and bruises, some had anxiety attacks. the flight originated in nashville. in the meantime crews cleared that plane from the runway a couple hours ago. a little more than an hour ago, laguardia actually reopened the runway to flights. b.a.r.t. is showing off its fleet of the future this week. from today through friday b.a.r.t. will host public tours of its new cars at the macarthur station. this is the transit agency's first overhaul in 40 years. they will have extra doors with wider aisles, expected to arrive in the summer of 2015. the ultimate goal is to buy 1,000 new cars. in the meantime, b.a.r.t. is still voething with labor unions this morning. a possible second strike is less than two weeks away. a deal does not appear to be imminent. both sides met with state mediators. after that b.a.r.t.'s largest union announced what it calls an investigation into b.a.r.t.'s
