good morning. i'm kris sanchez. and the final countdown to the possible b.a.r.t. strike is underway. we have reaction from both sides of the negotiating table as well as a backup plan for tomorrow's commute. also, local travelers react to the worldwide terror alert for travelers. and a driver runs into a crowd at a famous boardwalk, but was it deliberate? this is today in the bay. we are looking live at san francisco. not only do you see the fog squished down on the transamerica building but you see the flag there waving in the wind. it is a very cool start to the day there. and throughout the bay.

thanks for joining us i'm kris sanchez along with meteorologist rob mayeda. we have our first football game today. so it feels like fall. >> well, the weather will be comfortable, but may include some drizzle for the next couple of hours. especially around san francisco and oakland. 50s, low clouds all the way inland. a healthy see breeze into liver more this morning. should see sunshine for areas east of san francisco. but all day on the coast it's going to be cool with the drizzle perhaps lingering into the afternoon along the seashore. highs today, 60. 70s in san jose. low 08 ree80s inland today. temperatures look to get cooler, we'll talk about that coming up. a few minutes.

>> thank you very much. well, that tick tock of the clock is growing louder and louder. we are now 24 hours away from what could be another paralyzing b.a.r.t. strike. negotiations ended last night around 11:30. this is the negotiators walking out of the meeting room. again, salary, benefits, still the major sticking points. when the four-year contract between b.a.r.t. and the two largest labor unions expired at the end of june, 2,000 union workers went on strike, shuttling down the fifth largest rail line for 4 1/2 days and those days were painful. the 30-day agreement that got them running temporarily expires at 11:59 tonight. >> hopefully if we keep meeting we'll get to a proposal that both sides can agree to. >> the team is working diligently to get an agreement. we did not, we don't want a service disruption in the bay area. >> now, both sides are expected to return to the bargaining table. they plan to do that at 11:00

this morning. now, the 400,000 riders who typically count on b.a.r.t. each weekday could put extra pressure on bay area freeways and other public transit systems. caltrans and 511.org are urging people to plan ahead and plan on telecommuting or riding bikes. adjust work hours to leave early or stay late. caltrans says no matter what, allow extra time to get where you need to go. if there's a b.a.r.t. strike, they plan to offer limited bus service during the peak hours. charter buses will serve 4,000 people each day. you can get an update on charter bus service for the following day in the event of an strike, or go to alert511.org for the latest. you can count on nbc bay area for what you need to know.

tomorrow morning "today in the bay" the team will start at 4:00 in the morning to help you avoid as much traffic as possible. we'll have coverage all day and online. also new this morning some u.s. embassies and consulates are now shut down over growing security concerns. the u.s. embassy in egypt's capital is one of the embassies that closed its doors today. the u.s. government issued a worldwide travel alert to all americans through august 31st, because of an unspecified al qaeda threat. the alert was issued after u.s. leaders announced embassies and consulates would be closed. sundays are normal work days in muslim countries and in israel. analysts say the united states is mindful of what can go wrong, especially in the wake of the september 11th terrorist attack in benghazi which claimed the lives of four people, including bay area native, chris stevens.

some people are saying they're taking the travel warnings seriously, but are not changing their plans. they tell us they want to be safe but not fearful. >> don't give it a second thought. i mean, you have to just live, you know? the world is so big. it can happen here, it can happen there. it can happen anywhere. >> not going to let that stop me. i think if you stay at home and don't travel, they have won, haven't they? >> now, in addition to being aware of the surroundings, u.s. citizens are encouraged to register their travel plans through the state department's travel registration website. this alert for travelers expires on august 31st. we are learning new information in the shooting death of a 19-year-old woman who died in downtown san jose last night. rather, yesterday morning. according to the san jose mercury news, the victim is a college student and was not the intended target. investigators say the gunman opened fire on a car on san salvador street early yesterday

morning near 3rd street. the woman was sitting in the passenger seat when she was killed. the 21-year-old driver of that car was not hit and managed to call 911. police say he's not considered a suspect in this shooting. this is the 30th homicide so far this year in san jose. the city saw 46 homicides in all of last year. more than 200 people now face criminal charges this morning after a big protest at the chevron refinery in richmond to mark the one-year anniversary of the big refinery fire there. police estimate more than 2,500 democrat o demonstrators marched yesterday afternoon and then 500 people pushed police officers on to chevron property and then sat down. police told them they'd have to leave or be arrested for trespa trespassing. now, the protesters hope the

rally will bring about some change. >> i hope some legislation happens. i hope the government will pay attention. i hope that chevron -- i mean not chevron, but the city of richmond will win this suit against chevron. i hope that chevron will be responsible. you see my t-shirt? >> smoke from last year's fire sent 15,000 people to hospitals seeking treatment. the rally came one day after the city attorneys filed a lawsuit in connection with the fire. and an invest is underway to figure out what caused this fire that left an eld lehrerly man seriously injured. firefighters rescued that man from the burning home and was take -- he was taken to the hospital. the crews got the fire under control a half hour later. there were no other injuries. police are looking for a man they say shot three people in san francisco's bay view

district yesterday and are also shooting for the get away driver. it happened about 1:30 in the afternoon on palou avenue. the gunman got away in a white vehicle and the victims drove themselves to the hospital and the hospital has not released the word on the victims. and households, several communities had a big gun buy back. they all examined and packed up handguns and shotguns at three buy back locations. residents surrendered the weapons anonymously in exchange for gift cards ranging from $50 to $200 for assault rifles. >> i have some old guns that i don't need anymore. i don't use. i used to hunt. and i don't need them anymore so i'm going to give them up. >> the gun buy back programs

well, if you haven't made it out to see any of the america's cup racing, here's some of the set-up that you're missing. lots of things to do out there. and the crowds have not been too unbearable. time to check it out. chaos in los angeles after a driver ran into a crowd at the venice beach boardwalk. one person was killed and at least a dozen others are hurt. a surveillance camera captured images of that speeding car and pedestrians frantically trying

to get out of the way. the police have a suspect in custody though they're not releasing his identity. one woman saw her own grandmother get hit. >> it was just like a tragic scene. like really bad. everybody was surrounding her, there were kids. a little girl was all over the floor. people next to us, she broke her arm and legs and ribs. there was five or six people laying down right next to my grandmother. it was really bad. a lot of people got hurt. it was a very bad thing. >> witnesses say it appeared the driver deliberately drove down the boardwalk as he hit the victims. still ahead, it looks like a space ship, but it's piece of silicon valley history. we'll take you to a cool birthday party. a lot of low clouds and some drizzle in a few spots. enough to wet the roads in some places. we'll let you know what you can expect for the afternoon when we come right back.

everything is modern. i mean, i had to go from typewriter for example, and now to computers. at my age i have -- i use it. i love it. keeps my brain going. >> reporter: with plans to stay spacey long into the future. scott budman, nbc bay area news. >> it doesn't look that unusual, but today this morning, rob, with that foggy back drop, probably looks even more spacey. >> it probably does. we have drizzle in a few spots around the bay area. not just the places you'd expect like san francisco and the coast, but down into south bay and oakland. you have low clouds all the way into liver more and it's not too chilly. mid to upper 50s for most of south bay, but the on-shore winds will ensure as the skies here can this afternoon, we'll see mild temperatures today. look at the marine air that's moved in. humidity levels are at the

highest, but for august normally the inland locations are -- drier to start off the morning. so with that strong sea breeze, the fog has pushed its way into sacramento and stockton this morning. at least for now, the sierra not seeing thunderstorm activity. and aawway what from lake tahoe area. we have tropical moisture keeping the on shore breeze going. it will turn it more strong i think or turning it stronger as we go into monday and tuesday. so it will be mild today but trending even cooler for some of the inland valleys as we head through the first wehalf of the week. so around at&t park, fremont festival, the yard should be fine. a little misty for the morning as then fine for the afternoon. low clouds thickening around the

day. and by 10:00 you already see fog headed to the pass. so a healthy marine layer and a sign that the cool weather will stick around for a while. 76 for san jose today. areas south of downtown, closer to the mid to upper 80s. areas south of san jose will see the warmest temperature and the trivalley. mid 80s. but 70s as you get down into castro valley. and 63 degrees in san francisco. 60s in oakland for the a's game today. another cool day around the east bay and for the north bay, the highs in the low to mid 6 -- 70s. the numbers are below average for this time of the year and the numbers look like they'll hold up a bit longer. wednesday and thursday, the cooler temperatures. next weekend, we may see some tropical high clouds come our way. no showers in the forecast just yet. but we'll see them getting closer to what you'd expect to

well t video for a new song called "asian girl" has gotten more than 325,000 views in a few days, but a lot of folks on social media say it shouldn't be called that, but racist. it's released by a southern california band. today in the bay's stephanie --

on why there's a backlash. >> reporter: it's the first line -- ♪ my asian girl >> reporter: of what this song is all about. ♪ san jose native, a social media star with more than 100,000 facebook likes dances in skimpy clothing as the local band serenade her with lyrics. this isn't a joke video, but the latest single from the band set to headline at the house of blues sunset strip in l.a. >> this is kind of a bonus song on the album. we did it as jest. we threw it on there after much deliberation. >> reporter: and a music video released three days ago and there's controversy ever since. comments started to pour in. change.org petition went up as people demanded the band get pulled from the lineups for being quote, offensive. >> it is amazing how much

attention it's getting. we didn't expect all the backlash. >> reporter: that's led to the band losing business. the house of blues announced it's been dropped from the lineup. >> it hit me this is really dangerous when i heard the lyrics. >> reporter: for in woman, an advocate, the jokes at the expense of asians come too easily. >> i feel like media would have been on it right away. >> reporter: she helps the women who have been victims of sensual attacks. >> people have groped them, you know? it's okay. because you're an asian woman. we have been told this stuff. >> reporter: the woman in the video has apologized on twitter several times to all who feel she quote, set asian women back 50 years. as for the band, this was just an attempt at humor gone bad. >> it comes from a good place, you know? like actually i'm sure it's hard for people to believe that, but we've all had, you know, close

relationships with, you know, the asian community, asian people. >> reporter: stephanie strong. a people set to be married thought they had everything in place until they discovered they were scammed by a phony ad on craigslist. >> i have a friend who -- >> reporter: alan stout and his bride make preparation for catererer for what was supposed on the the happiest day in the lives. everyone in the wedding is from out of town. so this house was rented, walking distance to the church, or so they thought. >> we went to the house and knocked on the door and there were people in the house. i mean, i started crying. >> reporter: this house is for rent, not by the person who rented it to the not so happy couple and it's not the first time it happened here.

which will keep the low clouds across the inner bay probably into the mid morning. maybe even late morning hours. later on we'll see some clearing as which go hour by hour. but not as much clearing if you're around san francisco and the coast today. you'll see the low clouds sweeping back in by 7:00 through the san bern gap. and san francisco over to oakland, 76. downtown san jose, mid 80s. upper 8 -- 80s south. and the trend is running even cooler in the seven-day forecast. a look at that coming up. >> i may need a scarf. we are now just 18 hours away from what could be another paralyzing b.a.r.t. strike. these are the folks leaving the bargaining table. salary and benefits remain the major sticking points. after the four-year contract between b.a.r.t. and the two largest labor unions expired at

one that could leave hundreds of thousands of commuters stranded or stuck in gridlock. >> in the whole area, obviously they have to do what they have to do for their families but, you know, bay area is a crazy place without b.a.r.t. >> and when there's a home game, most patrons -- most people use b.a.r.t. no one wants to drive. everyone wants to get out here and use the b.a.r.t. train. >> $18 for parking is kind of insane. yeah. way more convenient to jump on the b.a.r.t. >> reporter: the oakland a's are away next week. if there's a strike, some people may feel the pinch as there's a seven-game homestand on monday. b.a.r.t. workers went on strike last month for four days crippling mass transit. and keep in mind that was during the 4th of july holiday. many commuters are concerned if b.a.r.t. workers strike again, this time it would be much

worse. >> i'm not looking forward to it. it puts a damper on the entire week. hopefully they'll figure it out before monday morning. >> now, if that's a strike we'll have you covered on monday morning. the "today in the bay" will start at 4:00. and now to a developing story. americans under a terror threat that is being called specific and serious. u.s. intelligence has learned al qaeda may be planning to attack american interests overseas and officials are taking no chances issuing a global travel warning and shutting down american embassies in several countries. >> reporter: in one of the most serious terror warnings in years the state department has alerted americans overseas that al qaeda could be plotting an attack and they have their eyes trained on the arabian peninsula. the warning covers travel for

americans worldwide, cautioning them to be vigilant at tourist sites and public transportation. in a statement, the state department said, terrorists may elect to use a variety of means and methods. in another rare move, the state department has ordered the temporary closure of 22 embassies. mostly in the middle east and north africa and including cairo and kabul where nbc filed this report. >> the last time there was an attack it was september 11, 2011 and insurgents were firing on the compound. >> reporter: the threat was identified through increased chatter but terror groups and other sources of information. new york congressman peter king says the intelligence points to yemen. >> al qaeda and the arabian peninsula is probably the most deadly of all the aftfiliates o

including one man who had his leg severed. four others were treated for minor injuries. students are complaining about a new rule intended to stop cyber bullying. the lodi school district is requiring high school athletes and others to sign a social media contract. it says they can be suspend ordinary kicked out if they post or even like something the administration considers inappropriate. students say the rule violates their first amendment rights. however, since 2011, state law has granted schools the authority to suspend students for what they consider on line bullying. in santa cruz an unlikely suspect is wanted in a down time bank robbery. a thin, blonde woman in her late 40s demanded money. she tried to disguise herself and was carrying a woven wicker

handbag. detectives are so sure that someone is going to recognize her that they rushed this surveillance photo out within hours of the robbery. and do you recognize this man? police in burling game are working to solve a bank robbery. they say this man robbed the wells fargo bank yesterday afternoon. police are asking anyone with information to call the burling game police department. now, to an nbc bay area follow-up. apple computers savoring some good news from the obama administration. the president's trade representative has overruled a trade commission decision banning imports of some apple products. the commission had banned imports of the iphone 4 and some versions of the ipad 2 saying they violated a patent. apple and samsung are locked in a battle over intellectual property. we have new rules for

football fans. the nfl is enfoerrcing the new clear bag policy for the first time today in canton, ohio. face paint still okay though. but the rest of the props have to stay at home. now fans can no longer bring in backpacks or large bags into stadiums. only clear plastic bags are allowed no larger that an one-gallon ziploc bags. no diaper bag, no camera or computer bags. you can't bring your suit cushions. you can watch tonight's hall of fame game between the cowboys and the dolphins right here at 5:00 following our special 4:00 p.m. newscast. going to feel like going to the airport next time we go to the stadiums. still ahead, the giants look to expand their winning streak against the rays and alex rodriguez may have played his final game as a pro. what the slugger says he intends

well, it might be a chilly start to the morning at at&t park. where we're looking live this morning, but for 20,000 participants who are taking part in the giant race it will probably feel good. half marathon that will help raise more than $200,000 for charity and the project open hand. meanwhile, across the country the giants were taking on the rays. san francisco looking for their fourth straight win and this game would go into extra innings, but the rays will meyers drove in the winning run in the tenth inning to break the modest streak. and the a's took on the rangers and the a's got off to the strong start. first inning with one run

already in. cespedes gave the green and gold a 3-0 lead. that's all the athletics would need, beating the texas rangers 4-2. and the lead over the rangers now increases to 3 1/2 games. last night, alex rodriguez played what might have been his last game on a baseball diamond for a very long time. after reports of negotiations between his lawyers and the league, major league baseball is expected to announce his punishment for using performance-enhancing drugs. rodriguez was back in uniform for the trenton thunder. the yankees minor league team has been rehabbing with rodriguez. he -- a-rod will be handed down we hear a 214-game ban tomorrow, eliminating his return to the yankees this season and next season. now, whether the shattering ban is handed out or not, rodriguez rodriguez is till going to

even with the transfer of low-level state prisoners to local county jails, california prisons are overcapacity and california governor jerry brown finds himself at odds with the u.s. supreme court over the issue. the justice refuse to accept brown's contention that the state's prison realignment program satisfied an earlier order to improve overcrowded

prison conditions. nbc bay area political analyst larry guesten joins us right now. this is a problem that precedes brown's office. >> it goes back to schwarzenegger, back to gray davis. all kinds of issues and jerry brown comes into office, no problem. except that the federal government says you've got to deal with this federal judicial issue here regarding overcrowding. you have too many overcrowded conditions none of which were his doing. that's the real problem for him. so the courts ordered him to reduce it by 27% of capacity. still overcrowded, but not as bad as the 180,000 or so they had before. through the prison alignment program, brown had distributed 35,000 prisoners to local jails in itself a controversial program that we can get back to in a second.

but the courts have said that, you know, you have to reduce the prison population by another 9,600 more by this december period. and then in the most recent supreme court decision, the majority said, yeah, you've got to do it. you have to go along with what the federal courts have said. >> in addition to the prison realignment, now there's talk there might be more low-level offenders being released on to the streets. is that really an option? >> well, it's a ripple effect. the governor will appeal one more time. but most say nothing will happen here. it will be much more symbolic than anything else. so that leaves jerry brown with two undesirable choices. he can move another 9,600 prisoners to county facilities but he's already catching flak for underfunding local governments which inial so ca s cases -- which in some cases have let out the prisoners into

the general public on parole. that's not going over well with law enforcement. that's not going over with the public. one choice. or brown can send the 9,600 prisoners to other states and that presents the governor with two other problems -- costs that are much higher sending them to county facilities here and anger by the california correctional police officer association. a very powerful union that represents the prison guards. so he may opt for a combination of the two, but whatever he does, brown is caught. he's caught and likely to step on a lot of toes. >> but something has to happen by september. the supreme court has spoken. there is an appeal, but as you said, it's largely symbolic. >> yeah. people say what if he doesn't do anything, what if he sits on his hands, then we're talking about a larger political problem for the governor. you know, federal courts have the right to act on constitutional matters. and in this case it's the eighth amendment claim that the

prisoners have been receiving the quote the is cruel and unusual treatment because of the overcrowding and he decides no ignore the court, critics will claim he's placing his own values over the constitution. look for him to go in the other direction, but regardless, the quagmire is an unpleasant interruption for a governor who has been enjoying a great deal of popularity with his voters and has as much of a problem that's not his doing altogether. >> we won't stop talking about it. still ahead, how president obama is spending his birthday weekend. outside right now, around the south bay we have some low clouds and drizzle in a few spots including out by campbell this morning. a look at the rest of your
