it is almost 5:01 on a monday morning. good morning everybody. thanks for joining us, always good to see you, i'm jon kelley. >> i'm laura garcia-cannon. we begin with a developing story, a last-minute reprieve that has commuters breathing a sigh of relief this monday morning. governor jerry brown put a stop to the looming b.a.r.t. strike late last night by calling for a seven-day investigation. "today in the bay's" christie smith live at the b.a.r.t. station where the trains are rolling through this morning. >> reporter: i have to tell you riders are very relieved this morning, some of them waving to us as the trains rolled by in san francisco, some wondering how long this will last. one woman told us she had gotten up at 2:30 this morning. she was so anxious about whether b.a.r.t. would be running today. she made alternate plans. now she's back on b.a.r.t. where riders seemed very, very happy. late last night governor jerry

brown stepped in to block a potential b.a.r.t. strike before the midnight deadline when b.a.r.t.'s union workers may have walked off the job. at the request of management, the governor appoint add board to investigate. he said he stepped in because a strike would indanger the public's health, safety and welfare. one rider said she's thankful that the governor acted. >> i'm glad he did. i'm very, very glad he did. now we at least can have a little more time to get some action taken so we can solve it. people want us to use mass transportation, they have toic ma it available. so this was really quite unpleasant. >> reporter: the board must provide the governor a written report within seven days. both sides will have their say in this. governor brown can then decide whether or not to impose a cooling-off period for up to 60 days. it had looked like there was some progress from both sides

earlier on pay, health care and pensions, but apparently not enough to get the job done. we're going to be keeping an eye on things this morning here at the west oakland b.a.r.t. station, the trains are rolling. it does look rather light this morning. we ooep eel keep an eye on things and give you an update as soon as we can. live in oakland, christie smith, "today in the bay." on the international scene we can tell you more than a dozen embassies and consulates shutdown. communications talk about a major attack. as a result diplomatic posts in about 19 cities will be closed and now will take place and happen through the end of the week. the threat has also led to heightened security in a number of major u.s. cities including san francisco. tod"today in the bay's" bob red is live in the city with what police are doing. bob, good morning. >> reporter: good morning to you, jon. san francisco police have not identified a direct terrorist

threat to the city, but as a precaution, the department is putting its officers on high end alert. i want to read from a statement. the department release add statement that says, quote, we want to be proactive given the state depth's warnings in order to protect our citizens and infrastructure. what heightened alert means is basically paying closer attention to certain areas of the city and trying to determine if they should deploy other officers. police are reiterating there's no known direct threat to the city. on friday the federal government temporarily closed 19 u.s. embassies and consulates. this is in response to intelligence indicating al qaeda is planning an attack between now and the end of the month. if you're traveling overseas, you might want to register your plans with the u.s. state department: there is a link on their website. live outside sfpd, bob redell, "today in the bay." thanks, bob.

it's 5:04. bay area's biggest city adding a weapon to the police force, a new gang suppression unit in san jose. "today in the bay's" marla tellez live in san jose where the unit was launched. good morning. >> reporter: good morning. just hours ago san jose police chief larry esquivel sent out a tweet announcing this gang suppression unit. it consists of 14 law enforcement officials. the unit has two teams, each team has six officers and one sergeant. the unit will be deployed seven days a week during peak hours. the department says it's part of its plan to increase police presence in san jose and thereby reduce violent crimes. the department used to have a gang suppression unit, but that was dissolved in the wake of those deep budget cuts it's endured over the last couple years. the gang suppression unit comes just as san jose police investigate the city's 30th

homicide of the year, a 19-year-old woman shot and killed over the weekend as she sat in her car near san jose state. it is not clear if this shooting was, in fact, gang related. but according to the "mercury news" she was not the intended target. at this point no arrests have been made. i have reached out to the san jose police department this morning to find out the very latest in this latest investigation. live in san jose, marla tellez, "today in the bay." contra costa county officials opening an investigation into the death of a man shot and killed by police in walnut creek. officers shot 22-year-old anthony banton december 27th after they say he charged them with a knife. the family sued four members of the police department saying the officer fired his gun in a panic after another officer tripped behind him. this morning the coroner's office will hold an inquest into the man's death at the county

courthouse in martinez. the owner of a now closed travel agency has filed for bankruptcy without returning money to customers. sunlight travel was run for 17 years. h ofrnlts's attorney says she ran into trouble when airline ticket wholesalers changed ticket structures and she didn't have money to pay them even throw though she already collected the money from her customers. many customers say the agency has not returned their passports. 5:07. correct me if i'm wrong, it is early august. >> especially on your birthday. >> i opened the door for that one. christina, as it is august, it's going to be hot, but it is going to be cool. >> it is going to be cool. good morning to you. a good looking day shaping up. we'll have a special happy birthday for jon. you'll have to stay tuned. that's going to surprise you. we have win, 11 miles per hour in concord, 4 miles per hour in

livermore. a beautiful day shaping up. what i can tell you as we head deeper into the week, temperatures will drop off even more so into the 70s. it's going to get even more comfortable around here. 56 in oakland, 62 in sunnyvale, 57 to start down in san jose. as we head throughout the morning hours, your temperatures are going to slowly, very slowly rise by about noon, 62 degrees. that's it for you in oakland. you're still going to be in the 50s at lunchtime in san francisco with plenty of 80s to finish off the day inland. i'm talking the low 80s, 71 degrees on the way to fremont. a lot of people might just be joining us. mike, go ahead, tell them the good news. you can do it. >> it's 5:08. no, that's not the good news. the good news is there's no b.a.r.t. strike today. that's what christina is talking about. b.a.r.t. is running full time. we look over here to the bay bridge, it was going to be a huge concern, there was early

backup that jon showed you. look at the lights, the green and red. only one red light. that means only one cash lane is closed. now all the rest of the lanes have opened over the last few minutes as we look at the backup that jon showed you, it's gone. i'm glad he did show you that a few minutes ago. now a smooth drive. as the map shows you, the maze has no problems. highway 4, again, you folks may be happy about this, lafayette into caldecott tunnel should be much smoother than predicted when there was a strike scheduled. 39 trains running on time, no delays reported. that means the other transit agencies who had contingency plans are back on their normal schedule as well. keep that in mind. 5:09. we'll tell you about easing up. the small-time crimes the los angeles police are letting slide. we're learning new details about the implosion of a california power plant injuries a number of people. back to work for wall street and the white house gets

current one, expected to include two hotels totaling 470 rooms. also a restaurant and office space as well as conference and meeting rooms. the hope is to have it done by 2017. matrix opened about a year ago and is planning to build a hotel of its own. that, of course, will create jobs and welcome jobs it will be. scott mccrew says at least compared to the jobs the american economy is making right now. >> we've had a few days to pour over the jobs report. the jobs created last month were by and large not that great. just as the numbers came in, it looked like the growth were in the mc jobs, not the high-paying jobs in construction and manufacturing that a new casino and hotel would be. our initial snap judgment was entirely correct. they are the jobs we didn't really want to see. that's going to affect wall street. let's get a check of the day's trading ahead.

bertha coombs is live at cnbc world headquarters. >> good morning, scott. futures are mixed right now. the stocks did manage to close higher on friday despite the tepid jobs report that saw fewer jobs added, and most of them lower skill, part time than expected last month. the dow has risen for six straight weeks is in record territory still. today we'll get data on the services or non-manufacturing sector. the dow will start the day at 15,658 after rising 30 points on friday. the nasdaq at 3,690. we'll see if it can get to 3,700. a 13-year high, scott. i think we're still about 25% from the all-time high. >> still a ways to go. >> we're back to -- yeah, we're back to like the october 2000 levels. >> fair enough. bertha coombs, thank you much. silicon valley tried to make sense of a decision by the obama administration striking down a

patent punishment against apple. it is complex. but here is the bottom line. samsung wins a patent case against apple at the international trade commission. the commission says guilty and tells apple it can't sell certain iphones and ipads. and then the white house steps in and says, no, apple can keep selling those phones. this is an entirely separate case from the federal court's decision which found largely the opposite, that samsung violated apple's patents and, therefore, owes apple billions of dollars. that the white house has no power over. so jon and laura, what do we make of this? this is the big head-scratcher this morning. basically buy what you want, it's all going to be on store shelves. as a manufacturer, they're trying to figure this out, who is in charge, courts or commissions. >> interesting. thanks, scott. >> a lot of money at stake. a lot of flexappeal involved.

let's bring back in meteorologist christina loren, kind of chilly. >> kind of chilly. that means no flex alert for the state of california. overall you've probably been able to save a little money over the past few weeks, unseasonably cool this week. more of the same. we have a cooldown headed our way. 59 degrees, good morning, san jose. 62 in sunnyvale and 56 degrees to kickoff a monday, a no-b.a.r.t.-strike monday if you're just joining us. as we head through the day, temperatures will be perfect for your outdoor plans, even in the hottest cities across the bay. we'll see plenty of low clouds hugging the coastline and the cool west early flow bringing in the ocean air all the way to the tri-valley. even in sacramento they'll be talking about the delta breeze because it will make its way through the delta as well. giving them cooling in the central valley. here is what we're working with, jet stream right on top of us, breezy conditions as we head through the day. the winds will pick up, you see anywhere shaded in the blue, that's when our winds will be at about 10 to 15 miles per hour.

feel free to open up the windows in your home with the beautiful ocean air in and give your ac a break. 83 on the way to fairfield, 81 in concord. 59 in san francisco. what ki tell you, i'm always looking about 15 days out. that's when the kids typically start going back to school. that's when it's looking to heat up. even at the end of this week, we're going to start to see temperatures come up saturday to 82 degrees inland. 91 sunday. but that's just three degrees away from seasonal averages. 5:17, let's check the drive. a great morning for the drive through the south bay. it's standard, 5:17, very light. a positive spin on it. toward the northbound routes, a smooth flow of traffic. south 17 was a concern as you head toward laurel kufr. both directions reporting there's maintenance work going on for the roadway. that's why it's slowing one lane in each direction. take that as a note. if you typically travel over the summit about now, you're aware of the typical pattern as far as

the flow. we see the build starting in the tri-valley. speeds on average down from 580. let's show you how this breaks down for west 580. the majority slowing off the altamont pass at 205. that volume building. by the time you get in livermore, a much more pleasant commute. livermore, dublin, pleasanton and livermore 584 showing a gradual build that we typically see this time of morning. looking toward the eastshore freeway, this is west 80. good space into cars. carquinez bridge down to the bay bridge for the eastshore freeway. on the other side of the bay, going into san francisco, a light flow. everything is ready for the morning commute. no delays from novato through san rafael down into the city. appreciate it, mike. thank you very much. 5:18 right now. the u.s. military searching for a crew member after a helicopter

crashes during a training session as a marine base in japan. the h860 went down in a mountainous area in okinawa. japanese television reporting three of the four personnel on board did survive the crash. as we mentioned, one of them still missing. we're learning more about a weekend demolition of an old power plant that wounded five people. one man had his leg amputated after shrapnel severed his leg saturday morning. the perimeter keeping spectators away was designed by the workers in charge of the power plant demolition. the company in charge, dem tex has yet to comment. pg&e which ran the plant and contracted out the demolition has responded saying our thoughts and prayers are with those who were injured during the demolition. safety of the public and employees is our first priority at all times. we are deeply sad denned that at

least one individual suffered serious injuries. theity of los angeles giving slack for small-time offendsers. they'll change 91 misdemeanors to now be considered infractions. violations like driving without a license or using a fake id to buy alcohol will not appear on criminal records and won't figure into crime stats anymore. the city's attorneys' office says the goal is to make the justice system more efficient and save taxpayer dollars. it is 5:20. army private bradley manning's sentencing hearing enters the second week today. state department undersecretary patrick kennedy is set to testify about how the classified information manning leaked damaged u.s. foreign relations. kennedy oversaw an investigation into wikileaks online publication of more than 250,000 state department diplomatic cables manning gave to them. 25-year-old now faces up to 136 years in prison for leaking the

if governor has requested a seven-day board of inquiry. >> an 11th hour reprieve, b.a.r.t. trains will run while governor jerry brown's office decides if both sides are negotiating in good faith. it's 5:29. i'm jon kelley.

>> i'm laura garcia-cannon. b.a.r.t. and union representatives leaving negotiations in oerk lapped late last night. just after 10:00 governor jerry brown called a seven-day board of inquiry. that heens the five-member board will be assembled and b.a.r.t. management and negotiators from the agency's two largest unions will present their cases about the negotiations today. then it will be up to the board to determine if a cooling-off period is necessary. "today in the bay's" christie smith live in oakland with what both sides are saying about this last-minute change as the trains are running now. good morning. >> reporter: good morning to you. the trains are rolling as usual. we heard them start to go by about 4:30 this morning. we spoke with riders who said they were relieved but didn't get a lot of sleep. they spent the night wondering what they would do, how they would get to work. at the last minute governor jerry brown stepped in. what that means is b.a.r.t. trains will be running for now and at least the next seven days. we shot video of some of the first trains into san francisco

from west oakland. not full, but it is still early. with that midnight deadline room looming, governor brown appointed a board to look into the stalled talks. union officials made the announcement and the talks were going okay and improving on pay and benefits and health care, but certainly not enough to get the job done in the end. union workers said that b.a.r.t. was still dragging its feet. they said they were unhappy that this had to happen. riders this morning, they seem pretty happy, but they did lose a lot of sleep. >> you mean did i sleep last night? no. i was up at 2:30 this morning, anxious over this. it was really impacting everybody's life, not just like the economy and the timing, but everyone's life and health and well-being. >> reporter: so basically what will happen is that the board will have b.a.r.t. and the unions present their offers to them. they'll take a look at that and provide the governor with a

report within seven days. during that time everyone will continue working. governor brown then decides whether to impose a cooling-off period for up to 60 days. reporting live in oakland, christie smith, "today in the bay." the good news is those trains are running. the reality is this the merely a reprieve. the b.a.r.t. strike simply on hold but has not been averted. nbc bay area followed the inquiry and what follows after that. we'll keep you updated all day long, on air and online at nbc bay nbcbayarea.com. 5:32, fir fighters looking into the cause of an overnight fire in san jose. crews had to call in backup to keep the fire from spreading. the red cross tells us 16 people were forced out of their homes including at least three children. luckily no one was hurt and the cause is still under investigation. overnight the largest city in the bay area launch ag

program to help grow the growing homicide rate in san jose. members of the new gang suppression unit hitting the streets last night for the very first time. "today in the bay's" marla tellez live at the san jose police department with exactly how this program works. marla, good morning. >> reporter: good morning. this new gang suppression unit will operate seven days a week, will not have a day off. according to the police chief it will be staffed with 14 law enforcement officials. chief larry esquivel sent out a tweet just hours ago explaining the unit will have two teams, each team consisting of six off serts and one sergeant. it will operate during peak hours. this is not a first for sjpd. it used to have a gang suppression unit before recent budget cuts took it away. the hope is the unit will help reduce violent crimes like the one that happened over this past weekend, a 19-year-old woman was shot and killed on east san salve door street near san jose state.

while it's not known if the shooting which was the city's 30th homicide of the year was, in fact, gang related, the "mercury news" reports kimberly estrada was not the intended target. so far no arrests have been made. now, this latest shooting happened very early saturday morning. this new gang suppression unit was launched just last night, and officials say the new unit will be evaluated at the end of summer to see how it's working and whether or not the police department will continue it. live in san jose, marla tellez, "today in the bay." new details are coming out into the investigation into the death of a teenager in the asiana airlines crash at sfo. a source within the san francisco fire department telling the chronicle first responders found 16-year-old yes mention yawn near the plane but didn't tell supervisors who arrived later. first responders may have mistakenly thought she was already dead when they found her.

footage from a helmet camera worn by a battalion chief shows no evidence a supervisor was ever informed that girl had been found. investigators say that young woman was covered in fire retardant foam at the time she was struck, ultimately and sadly killed by a fire truck. new trouble for the ambulance company that serves million of people in the south bay. rural metro group announced it plans to file for chapter 11 bankruptcy. it says the move will cut both its debt and expenses while allowing it to operate as normal. rural metro provides private ambulance and fire protection services to about 700 communities across 21 states including santa clara county. last month the company avoid serious complications when it paid $2.4 million in overdue bills. it came under fire in april for falling short of target response time. our meteorologist christina loren always on the move. what's happening today, young

we're looking this morning at 19 embassies that remain closed, 15 of them were closed over the weekend and the rest, four more were added just this week. they will be closed until saturday and now we're hearing there's also this travel alert from the state department for people traveling overseas, people who may be concerned about their safety. the state department says be vigilant, be alert, especially if you're on public transportation. now, none of this, these threats that seem to be based with al qaeda and yemen are directed at the united states, but new york and washington are adding extra security. they're on alert. we've got airports around the country adding security as well until the u.s. figures out exactly what this threat is and when it's over. laura? >> all right. everyone remains on high alert. thank you very much, tracie? >> that terror threat affecting

many u.s. cities including san francisco. extra officers monitoring different parts of the city, all ready to respond to an emergency. "today in the bay's" bob redell has more details on this story. >> reporter: good morning, jon. the city of san francisco and the police department has not identified a direct terrorist threat to the city, but it's still putting its police force on heightened alert. the department released this statement that reads in part, quote, we want to be proactive given the state department it's warnings in order to protect our citizens and infrastructure in san francisco, unquote. what heightened alert means paying closer attention to certain areas of the city and trying to determine whether or not those areas need extra officers deployed. police are reiterating there is no known direct threat to the city. it was on friday that the federal government temporarily closed 19 u.s. embassies and consulates in north africa and

summit. we see that as the volume starts to build and the construction has cleared -- actually not construction, but maintenance one lane in each direction. but not a major problem here, not a major surprise either. looking toward the tri-valley we have the gentle build, speeds down in the upper 50s through livermore. highway 84 starting to see folks bog down near vallecitos. coming out of the altamont pass, a good volume of traffic, more slowing into livermore as well. meanwhile through castro valley, no delays for west 580 and 880 south toward the san mateo bridge, a smooth drive right now. you're at the limit. should start slowing pretty soon. we'll look outside live and see how things are shaping up live on the peninsula. palo alto moving nicely. no delays for the peninsula side or 280, smooth flow in and out of san francisco. the b.a.r.t. trains are running, but some folks had already planned to drive this morning and they may still be out there,

so it will be a different traffic pattern this morning. new parking rules in the works for a palo alto neighborhood, not exactly the solution residents were hoping for. people in crescent park say they've seen an influx of cars crossing the border from east palo alto, particularly mere the newell road bridge. residents say these cars are taking their parking spaces and leaving a lot of trash. the residents have been asking the palo alto city council to create a parking permit program for the neighborhood. instead the city council has come up with a proposal to ban overnight street parking which it will be considering later tonight. a also tonight, the city council expected to vote on a controversial ordinance that would make it illegal for people to sleep in their vehicles. most cities in that region already have bans on car dwellers. supporters of that ban have raised concerns about safety and sanitation. opponents say the ordinance unfairly targets some of the city's most vulnerable

good morning to you. we or watching facebook trading at $38.05 this morning. that's an astonishing price when you consider back in may of 2012 that's about as high as it ever got, 38 bucks for facebook on the nasdaq. then you remember this big disaster, months and months of the share price falling. so facebook trading at $38.05. it's been technically higher than that. intraday trading was slightly higher than that, around 38 1/2. this is the first day we'll see it opening above the ipo price. the nasdaq doing very well. lots of fruit on the friday opening. the nasdaq is at a 12-year high. lots of reasons this shouldn't be happening. you remember, jon and laura, lots of tech companies largely disappointed in their financial reports. we continue to see this easy money coming in from the fed. that continues to get the froth
