that fire started near the intersection of park and lincoln boulevard. that happened at about 2:00 this morning. "today in the bay's" bob redell just arrived on scene. bob, what do you see? what can you tell snus. >> reporter: good morning. the good news is this fire is for the most part out. they have hot spots they're trying to contain we're about a quarter mile from the fire itself. you can see the gates behind me. it's on the property, up there in the southwest corner of the cemetery. it's a brush fire that started around 2:00 this morning and with the help of san francisco fire and the presidio fire department which is manned by sf fire, they have been able to get a handle on this. dana polk is with the presidio trust. came in, the call around 2:00 this morning. >> unfortunately we're having trouble with bob's audio. we will continue following this fire in san francisco with firefighters on scene.

the thing is spreading around the cemetery at the presidio. we'll check back in with bob for updates as it continues. in the meantime a statewide amber alert continues this morning. authorities looking for a man accused of kidnapping a girl and her brother near the u.s.-mexico border near san diego county. the children's mother has been found dead inside the suspect's home along with another victim. "today in the bay's" marla tellez along interstate 880 in san jose with an update on this search. good morning. >> good morning. i spoke to an officer with the california highway patrol this morning. he tells me late last night san diego county authorities contacted chp officers in the bay area and said, you know what? we're taking this amber alert statewide. as a result, if you're driving on any enter states or highways throughout the bay area today, you're going to see these, these electronic messaging boards lit up with the suspect's vehicle information. this one here, the board you're looking at is northbound 880

approaching the 101 interchange in san jose. the science sciences display the information which is a blue four-door niece is a versa with the license plate 6wcu986. here is a look at who officials are searching for. first the alleged kidnapper, 40-year-old james lee dimaggio. authorities say he took off from his home in the city of boulevard which is about 60 miles southeast of san diego and is suspected of taking with him 16-year-old hannah anderson and her 8-year-old brother ethan. the children's mother who officials say had a, quote, close platonic relationship with dimaggio was found dead monday night at his home. some dramatic video shows his home went up in flames on monday. the body of 44-year-old christina anderson was recovered from the rubble along with a child's body. officials are not saying whether

this child is one of anderson's children. in the meantime, authorities presume both 16-year-old hannah anderson and her 8-year-old brother ethan are in dimaggio's custody. take another look. hannah is 5'7", 115 pounds, blond hair, blue eyes. ethan is 4'11", 65 pounds with sandy blond hair. officials say they believe dimaggio is headed for either texas or canada at this point. again, the suspect's vehicle is a blue four-door nissan versa. something to be thinking about as you head out the door on this tuesday morning and make your way to your destination. be on the lookout for this nissan versa. live in share, marla tellez torques day in the bay. the family of the young woman shot and killed in downtown san jose speaking out for the first time. the family of 19-year-old kimberly chico telling nbc bay area she was a nursing student at san jose state and about to start her sophomore year. they say she graduated from

independence high school back in 2012. kimberly was killed early sunday morning near the intersection of second street and san salvador. police hoping someone will come up with some information because right now they have no suspects and they have absolutely no leads. they do not think she was the intended target in this shooting. it is 5:05. oakland police searching for a woman who disappeared from her home this weekend. police say 50-year-old san droe coke was last seen at her home about 8:30 sunday morning. family says she's healthy and never disappeared before. she drives a 2007 mini cooper with a blacktop and an off white body. anyone with information should call oakland police. a trio of cereal bank robbers struck again. it looks like they may be getting violent. the fbi says the group robbed a bank in the richmond district. this happened last thursday and hit a bank employee right in the head during the robbery. the same man reportedly hit two

other banks in san francisco and also one in millbrae over the past four months. in each of those situations, at least one of the men was armed. there's no word yet on the bank employee's condition this morning. a warning for people in palo alto after six homes were burglarized in as many days. police are asking people to be vigilant and lock their windows and doors. the rash of break-ins starting on july 26th with the most recent on august 1st. thieves believed to be on a bicycle or scooter. extra officers on the streets in response to these crimes. it's 5:06. day two of the workweek. sometimes when you get up and need that extra jolt to get you going, stick your head out the window. christina loren is here to tell us about it. >> even with that nice cool start, temperatures are going to stay cool today. high pressure is not really doing its job in california. it's concentrated over the four corners region. i'll show you when we get to

your seven-day forecast. good morning redwood city. temperatures are nice and comfortable out there. winds straight out of the west. the beautiful onshore flow transporting that cool marine influence all the way inland. we want to thank you for waking up with us. 59 degrees to start the day. you might want to grab a coat this morning. in san jose by 8:00 a.m., temperatures not climbing that much. by noon we'll see plenty of 70s inland and we'll round out the day at about 80 degrees in fairfield, 80 in livermore. temperatures nice and comfortable at gilroy at 77 degrees. as promised, here is anthony slaughter and your morning drive. >> things are very light right now. if you're one of the folks that gets stuck in traffic, tip for you now, leave now because the roads are wide open. you can see 880, this is still the area we were looking at earlier. traffic was congested because ofd construction. now there's a stall on 880 southbound near high street and

you'll notice our catch rah not showing too much of a slowdown. our traffic maps are picking um on the sensors that there is some slowing. as you approach that area, a heads up, no major backups there. over to the altamont pass, a little slowing through construction on 580 through dublin. once you actually get at least approaching that area, it doesn't look like things are too bad. even better news, let's take a look outside and show you the bay bridge toll plaza. it's like heavenly lights shining down from glory. not too often you see this. we have to stay on it form a little while. leave early if you're one of the folks that get stuck in this mess. not bad right now. >> not bad at all. anthony slaughter waxing eloquently on a tuesday morning. appreciate it. they were told to leave last night. this morning protesters still on the steps of an historic post office in berkeley. "today in the bay's" christie smith there now with why they're ignoring that eviction notice. christie, good morning? >> good morning to you. the pressure may be mounting for

the demonstrators to leave the steps of this berkeley post office on alston street. they're still here, apparently postal police and postal inspectors visited them, saying they need to remove the tents from the front steps and the signs in front of the building. camp side they say is a self they hazard for people trying to walk by. the protesters have been at this historic 57,000 square facility since july 24th. upset with the postal service's decision to put the building up for sale, this, one of many post offices and properties to be sold. the group of protesters estimated that 30 to 40 people, one of them told us why it's important to him to stay put. >> that does not remove our resolution to stay put and to keep fighting for truth and justice and equality, and we think it's a really important fight to preserve this berkeley post office. it's a precedent-setting deal. if it goes through, then it's going to be very difficult to

good tuesday morning to you. 5:12 right now. city manager of detroit hired christie's auction house to appraise some pieces of the city's institute of art. it comes as the city is looking to pay down some of its massive debt in bankruptcy. christie's says it will try to advise on ways to maximize the value of the 60,000-piece collection without selling it. the detroit institute of art is home to paintings and sculptures by van go, renoir and other masters. car companies having a hard time moving into the electric era. scott mcgrew, they're constantly dropping the price of electric cars. >> it's amazing. the absolute number of electric cars out there that we are seeing with prices dropping, the latest is the chevy volt. chevy is dropping the price of the volt by $5,000 this morning. it's hat some real trouble selling it.

part of the problem is that some of the fuel efficient cars that are out there are so much less expensive. but we've also seen the leaf lose price. we've seen several lose price. the problem for car companies is they have to sell a certain number of electric cars in order to sell the big fuel guzzling cars. you have to sell a certain number of electric cars in order to sell pickup trucks. turning to wall street, shares in facebook jumped over 40 dollars in monday's training. they'll open at $30.19. let's look ahead to trading with bertha coombs at cnbc headquarters. >> good morning, scott. all-time high for facebook $45 a share back on may 18th, 2012 a day that has lived in infamy for a while. futures this morning, flat, no real direction. stocks are taking a breather. despite a better-than-expected

report on monday, we did see the flat reaction. this morning we'll get data on the trade deficit and earnings from dish network, disney and 20th century fox. the dow starts the day at 15,612 after dropping 46 points. that's the biggest one-day point drop since late june. the nasdaq is up for five straight days in a row. we'll see if we can make it a six-pete today. i'll try to patent that. it was up three points yesterday to 3,693. amazon founder jeff bezos is buying "the washington post" publishing business including the name sake paper for $250 million. the sale ends 80 years of ownership by the graham family. bezos says this is a personal acquisition and the post will remain completely separate from amazon. he tells the post readers he'll strive to protect the paper's journalistic tradition. first john henry in boston, now bezos in d.c. >> fair enough.

b.a.r.t. didn't go on with the strike yesterday. he definitely deserves it. as we head throughout the day, temperatures will be so phenomenal for your outdoor activities. this might be your final week before the kids have to go back to school. maybe you want one last hurra, one summertime trip, the beach city to hit today is santa cruz. starting there at 57 degrees. as of lunchtime, santa cruz close to 60. you'll round out the day in the mid 60s. this is what we're working with. high pressure way off to our east. low pressure sitting and spinning right offshore. for us, that's going to keep that marine influence in place for today. temperatures are going to be comfortable. look at these numbers. 80 degrees for livermore, 77 in gilroy, 74 degrees in san jose, and here it is, we drop off even more so. we're hitting fall averages inland for the next couple days. yeah, the first official day of fall isn't until september 21st. so i can tell you it's early to get into this kind of spoiling,

but we're going to let it ride through saturday. sunday into monday, temperatures start to creep up. i can tell you right now we're looking at another area of low pressure to keep things mild. looks like the heat is going to return when the kids go back to school for the third week of august. we'll talk about that coming up. first let's talk to anthony. maybe you have the day off. anthony knows what can slow you down. >> things are wide open across most of the bay area. this sour emeryville camera. you can see traffic moving smoothly there. let's get you farther south into 880. headlights pointing towards us moving southbound. we had a stall earlier but not impeding traffic at all. further south, same corridor into fremont, you'll notice on 880 still wide open freeways. no major slowdowns to talk about right now. also in san jose coming from the southbound side moving towards the north, those are the headlights moving towards us. you can see wide open and one more stop will take us into palo alto. again, no problems to talk about

here at 5:18. that's good news. if you have to hit the road right now, wide open roads, no major accidents to report. of course, it is tuesday, so make sure you got a little jolt of extra coffee. >> always. and if you need some, i know where to go. it's 5:19 right now. one year ago today the chevonne refinery poured toxic smoke into the skies over richmond sending hundreds of people to the hospital. yesterday chevron agreed to pay $2 million in fines and restitution. some of the money will go to the richmond build project which helps put people to work. despite the settlement richmond decided to move forward with the lawsuit against chevonne. a town hall meeting planned for tonight for victims of the massive apartment complex fire in redwood city. a six-alarm fire ripped through the hallmark house apartments on woodside road. this happened back on july 7th. one person ended up dieing. 20 other people were hurt during this fire. almost 100 people were left

homeless. the cause of the fire still under investigation, and tonight's meeting is set to start at 7:00 at the fair oaks community center on middlefield road. now to an nbc bay area followup. attorneys for hundreds of high school students filed a lawsuit against the organizations that tossed out their ap test scores. the students at mills high school have sued educational testing service and the college board for canceling results of 634 exams due to seating chart violations. ets has arranged for a retesting period later this month. many students say they don't have sufficient time to now prepare. >> we'll keep our eye on that one. 4:20 right now. more than a dozen baseball players suspended for alleged performance-enhancing drug use. alex records, the biggest name. we'll hear from the man who actually studied the issue extensively and wrote a book on balco. we'll tell you about that next. living on cloud nine with that u-verse wireless receiver.

welcome back everybody. it's 5:22. on a tuesday morning state lawmakers today discussing the issue of using drones. the state assembly public safety committee holding a hearing on unmanned aircraft systems at the capital. drones have been a hot topic over recent months. several law enforcement agencies including some in the bay area have been looking into using drones to help in fighting crime. opponents have concerns about privacy. you'll soon be able to access research from all ucs online free. the ten-campus system is the latest and largest system in the world to open publications to the public. 8,000 faculty members and the 40,000 papers they reduce every year, aimed at breaking a decades old system under which most academic research appeared only in price see journals.

the policy takes effect november 1st. baseball fans, still a lot of people talking about the suspension of yankees slugger alex rodriguez this morning. so are the experts. lance williams who co-wrote the ex-pos say "game of shadows" that rocked professional sports says baseball needs its own investigative body and better drug testing. >> foolproof testing is a possible thing, but no one wants to put up the tens of millions of dollars that would be required. >> if you're a person that really doesn't care that much about baseball and maybe you don't even like it and you have an opportunity to take a shot at baseball, then you can say this is a bad day for baseball. but if you love the game and if you want the game to be played right, then this is a great day for baseball. >> that's a great perspective there. meantime at the little league intermediate world series, youngsters we spoke to were disgusted. >> what kind of example is he setting? taking drugs to enhance himself?

"today in the bay's" bob redell joins us live at the scene with the latest. good morning, bob. >> good morning, laura. this two-acre fire at the national cemetery in the presidio is out. it's just hot spots right now. what makes this fire so unusual is that this national park is not known for fire danger. just think about it. we're right by the golden gate. giving the fog and the mist in the air and the very moist ground that exists here raises the question of how does this start. right now the san francisco fire department doesn't know. a passerby called this in about 2:00 this morning. this is by the southwest corner of the cemetery just outside the cemetery fence. this is by park boulevard and ambulatoriry loop. all that burned was brush. part of the challenge was finding fire hydrants. the fire department had to run trucks back and forth to fill

the trucks. heads up if the presidio is part of your drive into work, lincoln boulevard will be closed between park and muraga. the fire is out. it's just a matter of handling hot spots. no structures threatened. reporting live at the presidio, bob redell, "today in the bay." a man is dead and a driver under arrest after an overnight crash in san jose. according to the chp the car was taking the bascom avenue exit from northbound 880 at about 10:40 last night. the driver similarity lost control on the curve and the car flipped across the concrete barrier and on to the on-ramp to northbound 880. officers say that car rolled at least three times before landing upside down. you q see it on the ramp. the passenger inside that car died on the scene. the 22-year-old driver was taken to the hospital suffering minor injuries. he has now been arrested on suspicion of dui.

familiar. authorities say 40-year-old james dimaggio out of san diego county is behind the wheel. here is a look at him, described as a caucasian man, 5'9", 150 pounds with brown hair, brown eyes. he lives in boulevard, a city about 60 miles southeast of san diego. officials say they have reason to believe he has with him 16-year-old hannah anderson and her 8-year-old brother ethan. hannah is 5'7", 115 pounds, blond hair, blue eyes with visible pierce sings including an earring in her nose. ethan is 4'11", 65 pounds with sandy blond hair. the two have been missing since saturday according to authorities. officials say in a tragic twist the children's mother, who officials say had a close platonic relationship with dimaggio was found dead just last night at his home in boulevard which was burned down. some pretty dramatic video shows that.

san francisco. might want to bring that coat with you for today, unless you're used to it. 80 degrees in livermore. 77 in gilroy. i'll show you when the summer heat returns, but first let's check on your drive to see if it's a traffic tuesday true to form with our own anthony slaughter. >> things are actually really good right now. the only thing we're starting to see is the bay bridge approach. things are starting to slow down a bit. no major construction. it's early in the morning so things are still getting going. as we take a look at our traffic maps heading from the north bay, really every bridge christina was talking about, keeping both hands on the wheel are looking good. we like green on the map and things continue to look good even approaching the bay bridge from the caldecott tunnel and through 880 where there was construction earlier keeping things slow and the other slow spot is the altamont pass. again, this is typical for your commute and also down through sunol, things are slowing down on 84. again, no major accidents, so very, very good news here on this traffic tuesday. so back to you guys.

the military trial of the accused ft. hood shooter starts this morning in texas. major nadal hasan charged with killing 13 people and injuring 32 more in november of 2009. nbc bay area leanne gregg joining us live from ft. hood with what we can expect to see as this trial gets under way. lee ann, good morning. >> reporter: good morning, jon. the trial should get under way within the next couple hours. hasan and army psychiatrist

could face the death penalty if convicted. he'll be representing himself which puts him in the position of being able to cross examine his victims. some of the victims will be testifying along with family members of the dead. hasan had wanted to use defense of others as a strategy, but a judge has ruled to bar him from telling jurors that he shot soldiers to protect taliban members in afghanistan. he faces 13 counts of premeditated murder and more than 30 other charges. he doesn't deny he did it. military law prevents a defendant from pleading guilty in a death penalty statement. in written statements he says he regrets serve manage the army and denounces his citizenship. he claims the u.s. is at war with islam. if convicted and sentenced to death there would be an automatic appeal which could take years. the last execution within the military was in 1961, more than 50 years ago.

again, the trial gets under way in less than two hours. >> thank you very much for the update. we now know what may have caused a man to walk into a pennsylvania town council meeting and open fire. it happened in ross township about 85 north of philadelphia. police say rockney newell had an ongoing dispute with officials about a condemned piece of property. he approached the building and began shooting through the windows. when he got in the building, someone tackled him and shot him with his own gun. he survived and is in police custody. a south korean passenger jet in japan overshoots the runway. fortunately we're learning no one was hurt. korean airlines flight 763 during the landing overran the runway and came to a stop on a grassy area beyond the landing

strip. at least 19 flights were canceled this morning at the airport because of this accident. an investigation right now is under way to try and figure out exactly what caused it. >> also from japan frkts authorities suspending their search for missing crew member in a u.s. military helicopter crash. searchers say human remains have been found at that site, but at this point they have not been positively identified. the helicopter went down yesterday at camp hanson, a marine base on okinawa. three other crew mep brs were found alive in that wreckage and they're right now being treated at a hospital. japan's prime minister has grounded all u.s. helicopters while the crash is investigated. 5:44. today marks the 68th anniversary of the world's first atomic bombing. meanwhile, across the world in hiroshima, hundreds of people gathered for a memorial ceremony. at the epicenter of the 1945

blast that destroyed most of the city. the mayor of hiroshima as well as japan's prime minister called for a worldwide ban on nuclear weapons. the bomb killed an estimated 140,000 people. happening right now at 5:45, protesters ignoring pressure from authorities and they remain camped out on the steps of an historic post office in berkeley. "today in the bay's" christie smith has all the details. good morning, christie. >> reporter: good morning, jon. warning or not, these demonstrators are still here this morning. i spoke with one man who says the issue is big enough in his opinion that he plans to stay put. despite the postal service giving notice that these folks need to move off the federal property. demonstrators at the berkeley post office on alston way near downtown say they were visited by postal inspectors on friday and given warnings specifically to those on the steps and those staying here in tents.

they've been in front of the historic building they say for 11 days, upset it's one of many postal properties to be sold off. the problem, according to the postal inspectors is they don't want the tents on the steps or they don't want the signs that these folks have attached to the buildings. they say it's become a safety hazard for people getting by. one protester told me in his opinion it's important enough to keep on fighting. >> the berkeley post office has been here for about a century. it's a historic building and it's got beautiful art inside. it's been serving this community in a dedicated way for many years. we don't want to lose that quality of service. we don't want to lose our historic building. we don't want to lose our great union jobs. >> those who don't want to stay can go, of course, if the pressure turns up, he says. we did see two inspectors out here walking around with flashlights this morning. we have not seen any police at all. at this point we still count at

for mike inouye. >> when you said santa cruz, i'm thinking put on my wet suit i just got. you can check it out on facebook. i had it on yesterday doing traffic. let's take a look at the bay bridge toll plaza, showing slowdowns approaching some of the cash lanes, but the fast track lanes are still getting through. that's good news. let's also show you on traffic maps we have a stall on the bay bridge. this is on the 880 eastbound side. the lower deck headed into the east bay. it's not impeding traffic. otherwise typical slow spots through antioch fon 4. past pittsburg and in to boy point, slow from 205 into livermore. once you get past livermore, lots of open roads, even from oakland down to the south bay in fremont. 680 wide open even through dublin. south bay, lots of green on the maps. no major accidents to report and can't forget the peninsula. lots of green from san francisco through palo alto.
