tracking your traffic. right now roads are clear. no major accidents to report. we'll get you up to speed in just a few. we'll take you outside and give you a live look at the golden gate bridge. a few cars there making their way into and out of san francisco on this thursday, august 8. you're watching "today in the bay." good thursday morning everybody. thank you very much as always for joining us. i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. we begin with breaking news out of texas where a violent shooting spree kills four people and leaves four others including two boys hurt this morning. police say one man now behind bars is responsible for two shootings, one in dallas and one just seven miles away in desoto. police say the gunman opened fire inside a home in dallas about 10:30 last night. when police got to the scene, they found four people with gunshot wounds. two were pronounced dead right there.

authorities say the same man fled to nearby desoto where he opened fire wounding two others. lerlene smith says her daughter and granddaughter are among the dead. >> i came back in, went to mia's room, and that's where i found her mother lying in the doorway. everything he was throwing. i don't know what he was doing. hopefully they didn't suffer long. >> so sad. smith says the shooter was her daughter's boyfriend. he was arrested at that second scene. no word yet on the condition of the other four victims. oakland police continue to gather information as they look into the disappearance of sandra coke. officers left her home with two bags of evidence yesterday afternoon. coke is an investigator for the federal defender's office in sacramento. she was last seen sunday night when family members say she was going to walgreens and never

returned. they previously said she was going to meet someone who found her dog which had been missing for months. both of coke's cell phones were found in different parts of the east bay. officers are now investigating her cell phone records. the city of san francisco giving residents a chance to turn their guns into cold hard cash. the city holding a gun buyback event tonight in the mission district. similar events have been held over the years in the bay area where people can give their unloaded guns to police in exchange for money. that money comes from the city as well as a non-profit group called gun buy gun which gets donations from community members to help reduce guns on the streets. tonight's buyback being held in the u.s. bank parking lot located at 22nd and cap street. that is in the mission district as mentioned. it all starts at 6:00 tonight. students from a peninsula high school holding a rally at a local courthouse today demanding their ap test scores will

reinstated. students at mills high school in mim bray filing a lawsuit after their test scores were thrown out. the organization invalidated hundreds of students' ap test scores because of a seating chart violation. while ets is arranging for a retesting period later this month, a lot of students say they don't have enough time to get ready. >> it is 5:03. take a very close look at those tickets. the latest powerball drawing made at least a dozen people a whole lot richer. most of them are from california. "today in the bay's" bob redell is live in sunnyvale where one of the winning tickets was sold. it's not the big-time jackpot, but still a considerable amount of cash. >> reporter: yes, good morning to you, marla. we're at the shell station at lawrence expressway and lake haven. that is one of nine lotto retailers in the state of california that sold second place tickets, not worth the

$448 million jackpot, but around $290,000. not too shabby. these are tickets that had all five numbers, but missed the powerball. if you're just waking up right now and wondering, hey, can that be me, here are the numbers, 5, 25, 30, 58, 59, powerball 32. there were three people outside of california who picked all five numbers plus the powerball. one in minnesota, two in new jersey. this super stop n shop in south brunswick, new jersey, sold one of the winning tickets. an acme market in little egg harbor in new jersey that sold the other. they haven't disclosed the location in minnesota that sold the third tinge. those three will split the $448 million jackpot which comes out to about $150 million each before taxes. not too bad. reporting live in sunnyvale. we're still waiting for this shell station to open and see what happens. bob redell torques day in the

bay. >> see if somebody shows up crying with joy. >> tears of joy. while none of us in the newsroom got any slice of that, the good news is every day we hit the powerball weather wise. >> christina loren, you're on the board on that one? >> sure. you know what, so much scenery around the bay area. i think that's why we fork out the big bucks to live here. likely you've been saving some of that hard earned cash on your pg&e bill. it's been unseasonably cool all month long. today more of the same. this is searching for low clouds and fog. you can see at abilities 8:00 a.m., livermore through antioch and concord getting the low cloud cover, a little drizzle out there. look what happens, by about 10:00 a.m., we're still mostly cloudy over the west end of shea through palo alto and up and down the peninsula. finally by about 2:00 p.m., we'll get sunshine. san francisco looking like a repeat performance from yesterday.

what i can tell you is we've got more ground level moisture out there this morning. and so you will find slick conditions. we'll talk to anthony about your drive. for today, 72 in san jose, 69 in fremont and 64 in san francisco with a gradual warmup headed our way. i'll get to that in my next report. as promised, here is anthony. >> still keeping an eye on the construction happening near the lake merritt area on 880. it's not impending a whole lot of traffic. you can see more cars on the road right now. as you make your way through that area, keep in mind as you finish the construction dwlu eel have more neighbors on the rode with you. on the traffic maps, red on the southbound side. northbound not too bad. we're starting to see slow pockets in the altamont pass. also in antioch on four, if you lose that route, a little slowing, once you get to pittsburgh, not too bad. thank you. anthony, here is an interesting story on the roads, a marin county man set to be in court to appeal a citation for a car pool

lane violation. his name, jonathan freeman. he drove in that car pool lane all by himself and he was hit with a ticket for that effort. he says no, he wasn't really alone. he had his corporation papers along for the ride. and since corporations are defined as people under u.s. law, he says that should allow him to drive in that car pool lane. no word yet if the papers actually had a seatbelt on. freeman says he will appeal his ticket to prove a point. >> those tickets are not cheap. i don't know where i was over the weekend, but it was $481. >> 481 bucks? >> yeah. >> a steep price to get where you need to quickly. but the cops are hardly around watching. i'm not suggesting you do it. i'm saying people do it from time to time. a new report out looks at which small cars are safest for your family. also, well, these look like a lot of fun. i'd actually like to try one. one popular tourist destination

if you're headed to the south bay, this is what you can expect on the roads, on 101 anyway in san jose. traffic seems to be picking up at this hour. but no problems to report as of yet. anthony slaughter is in for mike. he'll give you a full look of the roads coming up. right now it's 5:10. california boosts its free wi-fi service, making free wi-fi more accessible through public facilities. today wi-fi will start being offered at eleanor kogswell plaza in the downtown area.

city leaders hope the project will start a broader discussion on citywide wi-fi. tesla stock charged up after that company surprised investors with news it's making far more krars than expected. scott mccrew, the big question remains, is tesla making money? >> that's the nice thing about accounting. if you take out certain costs like paying the federal loan back early and stock compensation for some of the bigwigs, yeah, tesla is making money. however, if you include those numbers in a manner called generally accepted accounting principles, then tesla lost money, but still pleasing investors. this is your accounting lesson for today. who doesn't like accounting at 5:11 in the morning? tesla has far more cash on hand as it gets ready to build this, the model x. its crossover suv. i don't think that's the crossover right there. talking to reporters and

analysts on the phone wednesday afternoon, ceo elon musk says not this year, but full scale production in 2015. tesla is a stock to watch this morning. it's actually bigger than isuzu. bertha coombs is live at cnbc headquarters with a look ahead to trading. good morning, bertha. >> isuzu. i never even see those on the road. meantime futures are higher this morning. stocks have fallen for three days in a row. looks like we're set for a bounceback. markets spooked by comments from fed officials who seem to be suggesting the central bank could cut back on the stimulus program next month. today we'll get data in just about 20 minutes on new filings for weekly unemployment. last week they fell to a five-year low, expected to rise a little this week. but that's certainly going to help set the tone. the dow will start at 15,471 after dropping 48 points.

the nasdaq at 3,654 after slipping 12. mcdonald's this morning is likely going to be a positive force on the dow, scott. sales last month better-than-expected. >> terrific, marla. 5:13. jon and marla, our first peek at a new app called mix bid. this is stills from the company, aft expecting it to hit the iphone store. it's a video camera app with editing. it was made by these guys who you may recognize as the founders of youtube. chad hurley on the right has been talking about this app for months. he's pretty excited about it. it will be yet another video camera app. it's pretty neat. you'll be able to sed it in other people's videos. we'll take a look at it as soon as it's in the stores. >> you, too, guys. >> they probably have some notion as to how to work it. >> scott, thanks so much. i wish they'd come up with an app for scrap books. we have so many photos in our

look for a high around 74 degrees in los gatos today. as we head throughout the next couple days, it is going to get warmer, but not by much. until the end of next week we're still not talking about any big heat for tuesday and wednesday, those are your seasonal averages. by thursday into friday, though, that climb continues. if you want to hit the beach, not so great this weekend, but much warmer conditions getting into the upcoming weekend. the great news is it's friday eve. that drive is picking up, anthony. >> it is friday eve. happy about that. more cars on the road on 880. this is the southbound side. northbound moving smoothly. we did have construction near the lake merritt area that's been going on for the past few months. keep in mind that they're still getting off the roads there. as far as the rest of the area goes, you'll notice the bay bridge approach, starting to see more cars there. things are still moving smoothly even at the bay bridge toll plaza, getting right on through there. you can see how it looks from our perspective as we look at our computeers, lots of green on

the map. the slow spots right now through the altamont pass, coming down 580 into livermore. once you get past livermore, things are smooth into pleasanton and dublin. if you use route 4 towards antioch we're seeing slowing, typical for this time of morning. down in the south bay if you commute on 17, we have drizzle an fog moving through the santa cruz mountains. that is headed towards the south bay into santa cruz if you're using that route. you'll notice if you're moving into the south bay from santa cruz or the santa cruz mountains, things are moving smoothly. again, remember those windshield wipers. back over to you. it's 5:16. a new study out this morning looks at which small cars are best for your family. the insurance institute for highway safety says six of the small 12 cars it tested do well in a front crash test. among those tested, the two door and four door honda civic received a top rating of good. the dodge dart, ford focus,

hyundai' land tra, scion tc received acceptable. nissan sentra, kia soul received poor rates. the san jose sharks mourning the death of a former assistant coach. he died earlier this week in moss kof after police say he fell from his fourth floor apartment. apparently he was out there trying to repair a screen at the time of his fall. he worked as an assistant coach with the sharks from 1993 to 1996. you may not have known this but he was the son of the legendary victor deconoff, the former soefier union soccer coach. the u.s. department of transportation launched the everybody is a pedestrian campaign this week and in 28 ci across the country. the program includes grants to help fund education and enforcement programs san

francisco is one of the focus cities because it has 20 pedestrian fatalities a year. a very cool and popular water sport, but the state of hawaii talking about banning it. jet packs propel people as high as 30 feet in the air with the help of pumped water. you can see the video here. locals are concerned about the impact on the environment. fishermen and scientists are asking state officials to regulate these packs because of how they could affect local fish and coral. one local scientist says the noise made by the packs could drive fish away. the state says one option is to limit where those cool and crazy looking packs can be used. it is 5:18. an iconic painting that once hung in the historic palace hotel in san francisco will come home later this month. the pied piper by max field parish hung in the hotel for more than a century. in april it was taken down and

sent to new york for auction. art historians and neighbors quickly started a petition to bring the painting home, and the hotel eventually agreed. the painting has now been restored and we've just learned will be unveiled in the pied piper bar at the hotel on august 22nd. former giant brian wilson hadn't pitched in a game in over a year, but looking solid in his first game back since tommy john surgery. last night wilson pitching one inning for the rancho cucamonga quakes striking out all three batters he faced. his next stop is aaa in albuquerque playing for the isotopes where he is expected to make four appearances before he's called up to play with the dodgers. way to go, brian. cool video in to our newsroom. a surfer in chile comes nose to nose with a whale and a calf out there. this happened off the coast of

chee lay. you can see the surfer and the friend feet away from the animals and got some cool underwater shots. experts say this is very rare to see of whales off the cost of chile. normally stick to the waters off argentina. can you imagine that? >> no way, dude. >> that's called hanging scary. they might think you're lunch or something. >> remember the guy in central california, they came face-to-face with the whales as well. the whales are nice apparently a. running of the bulls on the streets of sf. it could happen. we'll hear from the guys behind the plan coming up. that u-verse wireless receiver. living on clh you see in my day, when my mom was repainting the house, you couldn't just set up a tv in the basement. i mean, come on! nope. we could only watch tv in the rooms that had a tv outlet. yeah if we wanted to watch tv someplace else, we'd have to go to my aunt sally's. have you ever sat on a plastic covered couch?

garcia-cannon. >> i'm jon kelley. >> good morning. right to breaking news overnight. a violent shooting spree down in texas kills a total of four people and leaves four others including two boys, an 1-year-old and 13-year-old, hurt this morning. police say the same man now behind bars is responsible for two shootings. both of those shootings, one in dallas and one seven miles away in desoto. authorities say that same man fled to nearby desoto where he opened fire again, killing two more people and wounding two others. larene smith says her daughter and granddaughter are tragically among the dead. >> my other grandbaby knocked on the window. we could hear somebody gasping for breath in there.

he said, granny, they're listening to head phones. i said, no, that's not a head phone. >> that's just so very hard to watch. heart-wrenching. larene say it is shooter was her daughter ooes boyfriend. he was arrested at that second scene. at this point no word yet on the condition of the other four victims. it's 5:31. more than a month after the crash of asiana flight 214 at sfo, a survivor says he cannot escape the physical pain or the nightmares and now he's suing. "today in the bay's" christie smith is live at sfo with a story for us this morning. good morning, christie. >> good morning to you. we had a chance to sit down and speak with the survivor of that crash. he does say the physical pain is with him every single day. he says he's not sure when it's going to go away. it sticks with him and now he plans to sue. he is 60 years old. his name is henry xie.

he's still in south san francisco more than a month after the crash of asiana flight 214 in a hotel recovering from a cracked jaw, strained neck and shattered vertebrae. he and his wife filed a lawsuit against asiana airlines in u.s. district court in san francisco claiming gross negligence and seeking $5 million in damage. he says he can't return to china until his back heals. the 11-hour flight, just too much to sit through. >> the broen was broken. for my injury, i don't know if there would be some -- can heal or not. i don't know. >> we lost her audio there. she was about to say he's a college professor. not sure when he'll return home.

we'll check back with christie in just a bit. the san francisco police commission honored four officers among the first to respond to that crash. james cunningham, guy tan know calderon, antoinette val len swear la received certificates of appreciation last night. they worked to clear out the plane despite the thick black smoke that continued to fill the cabin. when there's confusion about the number of missing passengers, cunningham ran back in to make sure no one was trapped. new trouble for the school district once headed by the superintendent of santa clara county school is now the focus of investigation for skewing test results. del la torre was head until last year. an audit finding irregularities in records for more than 1,500 students during that time. in some of the cases, the school

board claims special education or transfer students from mexico were not placed in certain grades to avoid taking standardized tests. the audit did not place any blame on del la torre or any other school employees. del la torre says the findings are, quote, overblown. no talks between b.a.r.t. and its unions are expected today. the board will hold a regular meeting. both sides of the labor dispute laid out grievances yesterday to a special three-member panel appointed by governor jerry brown. the panel will present its findings to the governor, but will not make a recommendation. it's ultimately up to governor brown to decide if a cooling-off period is needed. during yesterday's hearing, b.a.r.t. and its unions could not agree on the numbers. b.a.r.t. says the two sides are 6 $62 million apart on the three-year contract. the union says the difference is only $56 million apart. if the governor does not order a

cooling-off period, b.a.r.t. strike could happen on monday. a controversial gentlemen's club in the south bay set to open today as planned. despite outcry from city leaders, the gold club in downtown san jose will open without any new restrictions. the city council met yesterday to talk about the possibility of tighter rules and regulations for the business. but decided to put off the decision until a later date. the gold club is being described as a bikini bar, meaning nudity is not allowed. a battle is brewing in the south bay. at issue, a new $20 million library. santa clara's planned north side library was slated to open on moreland way near montague expressway in early december. construction was almost finished, now the city manager halting any further work at the site after the county won a court order freezing the city's former redevelopment assets. supporters of the library say they plan to rally at the construction site in hopes of

getting the project back on site. somebody in the bay area is waking up richer this morning. the latest powerball drawing producing a lot of winners including one ticket sold in the south bay. here is a look at him. police think james dimaggio is trying to get to canada. the body of anderson's mother was found in dimaggio's burned down home near san diego sunday night. a child's body was also found in the home. police think it is the girl's brother ethan. police say they will not be able to announce the identity of the child until tomorrow at the very earliest. the parents of a summer camp counselor killed by a falling tree have filed a lawsuit. urktsc santa cruz student died july 3rd when a large oak tree collapsed onto bench trees where she and others were sitting. in the lawsuit her parents blaming the death on faulty inspections by pg&e's tree management contractors since that tree stood just 15 feet from electric power lines. the suit also naming an arborist who performed tree inspections at the cam. gnaw report shows climate

change taking a toll on california. the environmental protection agency giving examples in the sierra showing confer forests are moving to higher elevations and claysiers are shrinking. spring runoff is falling. scientists say they hope this report will spur state and local governments to plan ahead and adapt to a much warmer future. another look down at the brush fire in riverside county burning out of control this morning. this one spreading very quickly as we speak. the so-called silver fire started near the town of banning less than 24 hours ago as we give you live pictures of those flames just really out of control, damaging and destroying at least 15 homes. these live pictures from banning, we can tell you about 1500 people have been pushed out by these flames and smoke. the fire has scorched a total of 6,000 acres so far and that number and that percentage is growing fast.

right now the fire, we're being told by the fire department, zero percent contained. one civilian so far has been burned. that civilian was airlifted to the hospital. two firefighters have also been hurt. but at this point the extent of their injuries remains unknown. so far, again, a raging fire out of control. but no word yet on the cause of this one. you can see for miles and miles, just that snake line of the fire burning so very quickly down there in dry conditions. >> i saw pictures on twitter where the flames made it to the roadway. >> all of that smoke is pushing into the coachella valley. it's bad for air quality. very dangerous. meanwhile here in the bay area, we've had a cooler-than-average start to august. we have plenty of moisture out there. we're not talking about elevated fire danger, at least not yet. i am tracking a heat wave as we get into the end of next week. but really for the week after

well. also from our other perspective, in emeryville you can see the cars moving right along. the good news is we're not talking about any standstills just yet. we are starting to slee slow spots through livermore. once you get past livermore, things do start to speed up. even through antioch, the typical slow spot there even through pittsburgh. once you get past that, things improve. back over to you. >> thanks a lot, anthony. speaking of roadways, work to fix dozens of broken bolts on the east even span of the bay bridge under way later this morning. crew also be pouring concrete for 12 steel salds that will attach to devices called shear keys. this is designed to help stabilize the bridge in an earthquake. the work is set to start at 10:00 this morning. caltrans says the permanent fix should be completed by mid december. caltrans also preparing a temporary fix that may allow the span to open a little earlier. people in richmond taking
