i'm marla tellez. i'll have that story still ahead. plus the new efforts for transparency by supervisors in santa clara county. it's a cool start to your tuesday morning. plenty of upper 50s out there. but hey, we've got a hotter afternoon ahead. i'll take you through your full forecast. plus three incidents, two crashes to report for 880. we'll give you the latest on the nimitz coming up. we'll give you a view of the golden gate bridge early on this tuesday morning, august 13. this is "today in the bay." good morning to you. thanks so much for joining us, i'm laura garcia-cannon. >> i'm jon kelley. bay area hospitals right now on high alert this morning after a woman was caught impersonating a nurse. deputies this morning are still concerned because she's now back on the streets. "today in the bay's" marla tellez joining us from valley medical center in san jose where

the impersonator was caught. we're hearing investigators still worried because this woman can strike again. >> reporter: absolutely. good morning, jon. she was arrested in this parking lot of valley med on friday, though she is facing two misdemeanor charges she is already a free woman today. investigators are concerned that she could pull this elaborate scam all over again. that is why hospitals are being told to be on alert. here is a look at her. she is 29-year-old crystal cook of felton. the santa clara county sheriff's department says she was carrying a fake medical id when she was caught. they say she has zero medical training. deputies are reviewing the hospital surveillance video to see how long cook had been mask reading as a nurse. a valley spokesperson says the fake badge would not allow her to access more secure areas, for instance, where babies and drugs

are kept. investigators say after interviewing cook, they are not sure of her motive. >> she didn't give a valid reason, necessarily. she says she wasn't there to harm peel. so that's a good sign. >> reporter: regardless cook is facing two misdemeanors which carry a maximum sentence of two years in jail and $15,000 in fines. i have reached out to the santa clara county sheriff's department to see what is next for cook as she awaits her first court appearance. coming up in my next report, i'll explain how facebook helped deputies put an end to cook's scam. that coming up at about 5:30. live in san jose, marla tellez, today in the bay. hayward city worker's will go on strike today protesting what they call unfair labor practices. >> reporter: good morning, laura. haywood city hall says lit keep

services running as normal when the workers go on strike in about an hour. the sciu local 1020, hayward's contingency to back phil those jobs, they'll cherry pick from those not going on strike. as for critical jobs, 911 operators and workers in the wastewater treatment plant, the state public relations board has told them they cannot strike, they must show up at work, this after the city complained about what would have been an illegal strike. the other workers going on strike include library assistants, animal control officers and admin staffers. contract negotiations have stalled over pay. the city is asking the union to give up another 5% in their wages, arguing this concession is necessary to cut costs and close a budget deficit. they also say, hey, these are the same concessions that firefighters and other city workers have made. the union claims that the city

has $50 million it could use on the workers instead of using that money for what the union calls unnecessary projects. the union says besides, we've already given up 12% in pay since 2010. reporting live in hayward, bob redell, "today in the bay." it is 5:04 right now. a man facing animal cruelty charges in fairfield after police say he deliberately drown his father's dog in the city pond. investigators say brian cavanaugh repeatedly pushed the pit bull terrier under the water until it finally drown. a lot of people there witnessed the act, the disturbing act yesterday morning. police say cavanaugh admits to the crime but says he doesn't know what he did it. two officers recovered the dog's remains using a small boat. cavanaugh was already on probation for assault with a deadly weapon. >> more drama in america's cup, defending champion oracle usa is accused of cheating.

oracle ac 45 catamaran has been accused of illegal modifications during exhibition races in 2012 and earlier this year. these boats are different from the ac 72s used in the lewy vuitton cup in san francisco right now. the team ceo says he had no knowledge of the modifications but has retroactively withdrawn the team from events the modified boats raced in. a town hall meeting planned tonight for victims of a massive apartment complex fire in redwood city. a six-alarm fire ripped through the hallmark house affordable housing complex that happened back on july 7. one person died. 20 people were hurt in that fire and almost 100 people were left homeless. the cause of the fire remains under investigation. tonight's meeting stards at 7:00 at the fair observation community center on middlefield road. 5:05. a proposal requiring the santa clara county board of supervisors to publish their

public calenders online is up for vote today. critics says the proposal isn't effective and needs to be rewritten. the policy would apply only to board members, not their chiefs or staff or county appoint teas. in addition, critical information about meetings including dates and names of people in ad attendance would not be required in the online postings. supervisors are considering changes to the proposal. meteorologist christina loren was talking about the warmup. this week mother nature delivering. we can feel it already. >> just wait till this weekend. you're really going to feel it. 5:06. taking a live look. this is the bay bridge where you can see the top of the tower here. looking good on the bay this morning. it's pretty glassy out there. no real wind to speak of at this point. that's good news for your morning drive. we have fog especially at the immediate coast, high pressure moves in, compress it is moisture in the atmosphere. you'll find more of that ground level fog and reduced visibility

as you make you way up the peninsula. keep that in mind, mike will be watching that for you. 58 in oakland, 57 to kickoff a tuesday right before the first day of school for some, right here in san jose. here is what we're looking for. upper 60s to low 70s at the coast. high pressure making for a return of higher temperatures. let's take a pre pre-view. 7:00 a.m. tomorrow, 58 degrees. as kids make their way out the front doorks it's going to be a little chilly. maybe a light jacket. you can leave the umbrella at home. at the heat of the day, 4:00 p.m., 84 degrees. kind of a warm start for the first day of school. mike, that means the commute, oh, the commute. >> that's right. especially as the colleges get into play. a lot of cross traffic on and off the freeways. we'll keep the changes updated for you. looking toward oakland where there's not a lot of change past

the coliseum. this shot of 880 is fine. the nimitz has a lot of activity. we showed you southbound 880 in through downtown. a lot of slowing. there are crews clearing north and south. a lot of slowing over the last couple minutes that started to clear up, the remaining vehicle on the scene has moved to the shoulder. there's the showdown past 980 and oak street. all lanes clear for southbound 880. as you head toward milpitas out of san jose, we had a crash there as well. that had no injuries and it's over on the shoulder. no major slowing toward 237. a live look out here toward the mission boulevard off-ramp from south 880 that has reopened. one car taking that curve. >> great update. thank you very much.

5:08 right now. people in one palo alto neighborhood celebrating a partial victory. the palo alto city council voting to pan overnight parking in the crescent park neighborhood which is one of the -- on the edge of that city bordering east palo alto. neighbors there say people are crossing the city line and then parking on the streets to avoid paying for parking in the apartment complexes in east palo alto. crescent park hoped the city would start a parking permit program in the neighborhood. but for now overnight parking will simply be banned. 5:09. the new developments that could help save berkeley's post office. along with that we'll have the new details about what we're learning about a florida sinkhole that opened up at a resort near disney world causing an entire building. you can see it right there, collapsing into the ground. plus the type of car you drive could affect your behavior at, say, a stop sign. wheel take a look at who the bad guys are ahead in business and tech.

welcome back even body. we want to give you a lovely picturesque look from seattle, washington. we found this shot and thought we'd inspire you on your day and take you to the emerald city, also known as the city of jets as well. they have a ferris wheel there as well. a new study suggests your chances of divorce might be influenced by how many siblings you have. a study being presented today at a meeting of the american association -- sociological association. researchers finding each additional sibling a person has reduce it is likelihood of divorce by about 2%. that supp to seven siblings. the author suggests siblings help develop social skills, very useful in navigating marriage. soes olts are quick to say this does not necessarily show cause and effect and there are, of course, plenty of other factors

that influence divorce rates. >> yeah, a few. 5:12. berkeley's turn of the century post office may get a second chance. the cash-strapped postal service planned to sell the historic building and rent a space nearby to run mail service. it didn't sit too well with residents who held a rally outside the post office. california's wealthiest man seems to think apple's future is pretty poor. larry ellison hinting apple won't do well without steve jobs. >> ellison and jobs were very close. emily son is going to make those comments in a taped interview with charlie rose that will run later this morning. according to the transcripts of the interview, ellison says we already know what apple looks like long term without its founder. he points out apple fired jobs back in the '90s and the company barely survived. lots of praise this morning

for elon musk and his hyper loop idea. if not for the fact kalt of it, at least his imagination. musk unveiled drawings and specifics on monday afternoon. he is always thinking big. among those weighing in, retired outfielder jose canseco who suggested if we vacuum seal the first ten miles, we could double the speed, make bigger pods he wrote. jose is probably looking at retail sales, maybe looking for a third of percent rise month over month due to better auto sales. seema mody is live at cnbc headquarters. >> futures are higher. today look out for retale sales which could offer clues on the spending appetite of consumers as well as business inventories. in terms of how the market ended, the dow slipping ten points, the nasdaq closing 10 at

3670. 5:14. researchers at cal berkley say they're determined people who drive nice cars don't drive nicely. scientists watched drivers at various intersections including crosswalks including who did what and what kind of car they drove. right now too early for any of that to be going on. 101 showing a nice smooth flow toward palo alto and continuing toward the san mateo bridge, easy flow of traffic. san mateo bridge, that's 92 over toward the east bay. that's eastbound, a counter commute, both directions moving smoothly over the san mateo bridge. dumbarton bridge, not a problem either. in oakland we had the southbound side with the earlier crash, the hit-and-run that cleared from the roadway. now we have mild slowing as we have crews clearing from both directions between downtown and 980. a new incident on ashby, i'm tracking it to let you know if it presents a problem through berkeley. over towards the maze and the bay bridge. maybe you're heading toward the san mateo bridge. san rafael, southbound 101 shows a nice easy drive. at the limit novato, san rafael and toward the golden gate bridge. back to you. thank you very much. it's 5:18.

a gee oi tech oh tech -- geotechnical team will be in florida assessing a sinkhole in florida. act half of the three-story villa near disney world in orlando collapsed. the resort says the building is a complete loss. fire officials say the sinkhole is about 50 feet in eye am ter and think it's getting deeper. they can't tell if it's growing outward. this is actually video shot as the building was sucked into the ground. witnesses say they heard popping noises, windows breaking just before it collapsed. meanwhile a security guard is being hailed a hero. when a guest flapgd him down to say something was wrong, he went door-to-door to get people out. >> still can't believe no one got seriously hurt. the giants formally apologized to orioles outfielder adam jones when a fan admits he threw a banana at him. the fan is telling the "mercury

news" he grabbed that banana off the catering cart and threw it because he was simply disjusted with the giants and the way he was playing and it has nothing to do with race. he says he's embarrassed and has apologized. the team says it has a zero tolerance policy for this type of behavior. now to a preview of an exclusive investigative unit report. on the record for the first time since the series of reports, the head of the california department of toxic substances control is answering questions. debra rafael admits her department is not meeting its mission. the department is tasked with protecting us from polluters. >> how do you feel when people say the regulators are falling down on the job? >> i would say it's a little extreme to say we're falling down on the job. however, i would not say that we're doing everything we can. >> the director of the dtsc

welcome back everybody on a tuesday morning. want to light up your day with a shot of the bay bridge from the distance. you can see traffic flowing along as the lights matriculate down on the road. christina has the weather. it's going to be warm. that's coming up in a few minutes. the car company honda launching a brand new campaign trying to prevent drive-in movie theaters from becoming extinct. the movie industry planning to stop distributing 35 millimeter film by the end of the year.

most drive-ins don't make enough money to make the transition to digital. now honda wants to help preserve some of those theaters by supplying at least five dive-ins with projectors. drive-in movie lovers can vote on which theaters should receive the upgrade. hundreds of knitters in pennsylvania taking yarn where it's never been before. take a look at this artwork. more than 1800 it inners worked to create those blanket-sized hand knit panels. >> what happens when it rains? >> the group that organized the project is calling it the nation's largest yarn bomb using more than 3,000 feet of yarn. the yarn art will remain on the bridge until september 6th. so that avoids your rainy

"today in the bay's" marla tellez joins us from valley medical center in san jose where the impersonator was actually caught. >> reporter: good morning. crystal cook is her name and her entire scam came to an end at valley medical center in san jose on friday. now santa clara county sheriff's deputies are reviewing surveillance video to see how long she put on the nursing act. she's a 29-year-old woman from the santa cruz mountains. take a look at her. she's specifically from the town of felton. when she was caught, cook was wearing scrubs, carrying a

stethoscope and a fake medical id. deputies have facebook to thank because it was cook's very own post on her facebook page that caught the attention of some real valley med nurses. it was quickly determined she was not an employee at all. cook's second post was just as erroneous. >> she said she was part of a pediatric heart transplant. we don't do those. we send them to stanford. as soon as this was brought to the nurse's attention, protocols were followed, alerts were made and the person was apprehended the very next day. crystal cook was facing two misdemeanors. she faces a maximum of two years in jail and $15,000 in fines. as i mentioned, cook was arrested on friday. she is no longer in custody. that is why bay area hospitals are being told to be on high

alert. if you happen to see cook on any hospital grounds throughout the bay area, your bet bet is to reach out to authorities right away. still to come at 6:00, did cook access secure and sensitive areas in this hospital and what do patients have to say about all this? that's still to come in my next report at 6:00. live in san jose, marla tellez, "today in the bay." >> pretty amazing story. this morning officials in contra costa county discussing exactly what went wrong with the country's emergency alert system that sent an evacuation notice to residents who weren't in any danger. the alert went to some people outside the affected area. the text message telling people to evacuate immediately, but did not exactly say why. today the county board of supervisors will hear a report from the sheriff's department on that incident and what caused the glitch. 5:32. sentencing is scheduled today for a former livermore high school teacher who had a seblgs relationship with a student.

marie johnson pleaded no contest to nine felony charges for sexually assaulting a 14-year-old boy. prosecutors say johnson, who taught math at grenada high, had a six-month relationship with the student beginning in late 2010. police say the boy later told the coach about the relationship which led to johnson's ooh arrest in january of last year. she faces up to nine years behind bars. a young martinez boy mauled by a pit bull is set to have another surgery. 10-year-old hunter kilborne was mauled on sunday. his mother telling nbc bay area hunter and his friends were running upstairs when two dogs knock hikd down. one of those dogs jumped on him and was biting his face and arm. his mother was next door whnd twhen neighbor came running over and told her to call 911. >> the owner of the dog had a towel on his head. i walk over there and i put --

grab the towel and holding on to his face. he's like mommy, am i going to die? am i going to die? it made me cry. i'm like, no, you're not going to die. you'll be fine. >> 10-year-old hunter was rushed to the uc davis trauma center where he had his first surgery sunday morning. his mother says he will now need skin graphs and several more surgeries to repair his face and his injuries. she says she wants to see both of those dogs put down. >> poor little thing. 5:34. a local school district talking about changing testing policies after a security breach during starr testing. amador valley high in the pleasanton school district says it may require students to turn in cell phones before taking the testify next year. the school was one of 246 flagged statewide for security breaches during starr testing. a student snapped a photo of another student taking the test and posted it on social media.

you'll recall last week we told you the state was taking closer look at 16 schools for possible cheating influiding san francisco's lowell high school. in hayward, city workers will walk off the job in less than a half hour claiming the city is simply asking them to do too much. "today in the bay's" bob redell live in hayward right now with the impact this will have on this community. bob, good morning. >> reporter: good morning to you, jon. when 280 workers for the city of hayward go on strike in about a half hour, at 6:00, city hall says that services will resume as normal. how do they plan to fill those jobs? the city has a contingency plan of putting its managers into the field and cherry picking from the pool of the 450 other workers who would not be going on strike. for those critical jobs like the 911 operators and the workers at the wastewater treatment plant, the state public relations board

numbers on retail sales expected to come out this morning. we're learning thousands of stores aren't tracking just your spending, but your returns as well. "today in the bay's" danielle lee live on capitol hill with

what else retailers are looking at. good morning, danielle. >> reporter: good morning, laura. the next time you make a return, you may want to check out your receipt. it could wash you your actions are being tracked. that's because thousands of retailers are hiring third party companies to create what's called return profiles. that stores many of your recent returns as well as personal information, possibly a driver's license number, date of birth, address, name, phone number. this is all, they say, to prevent fraud. the retail industry estimates it absorbed about $254 billion each year. they say some that get returned are either stolen or used. consumer advocates say this is goes a little too far in terms of violating privacy rights, especially because not all retailers are disclosing that they engage in this practice. it's tens of thousands of stores engaging in the practice.

some of the big ones include best buy and also home depot. this did lead to a privacy lawsuit recently. that was tossed out in federal court. as americans more and more debate where is that fine line between protection and privacy, this is a topic that's sure to keep coming up. reporting live in washington, danielle lee, back to you. new video into our newsroom of a s.w.a.t. team dropping into the remote wilderness in idaho searching for missing teenager hannah anderson. 20 members of the s.w.a.t. team were the first on the ground looking for jim dimaggio and hannah. they spent 24 hours securing that area and checking nearby cabins and river banks. just a few hours after the fbi relieved them, they received word hannah was safe and dimaggio was dead. hannah's father says she's now back at home with the family in southern california. he's now asking everyone for privacy as his family grieves

and his family heals. investigators say it wasn't until the 16-year-old was rescued that she learned that her mother and brother had been killed. 5:44. the family of an 8-year-old girl allegedly killed by her brother in san joaquin county is speaking out saying their nightmare has not ended. barney fouler, his fiancee and oldest son spoke exclusively to our sister station in sacramento. they describe the pain of finding laila foul fowler dead and the add ordeal of seeing her 12-year-old brother arrested for her murder. >> i turned isaiah in. most people don't know that. that was hard enough. >> people don't see what happens at night when the kids go to sleep and we have to sit and deal with it. they don't see that we don't eat for days on end, and it's one or two hours of sleep of night.

it's an absolute nightmare. >> barney fowler and fiancee insist his 12-year-old son is innocent. they feel like the community has turned its back on them. there are new signs this morning the opening of the new bay bridge may not be delayed at all. the "contra costa times" reporting chp is still signing up extra officer to staff over time shifts planned for the end of this month when crews are supposed to shut down the bridge and realign i-80 with the new span. chp says it wants to be prepared in case the original construction timeline is restored. just last month the toll bridge program oversight committee announced it would delay the bridge opening at least until december to install new steel parts where those bolt ts snapped earlier this year. the original opening date was to be labor day weekend. meantime, the lights on the eastern span, they will be turned on tonight. the lights are being installed on the roadway and the span's main suspension cable. those lights, for the record, if
