good morning. thanks for joining us. i'm laura garcia-cannon. >> i'm jon kelley. in the east bay this morning a desperate 911 call from one girl about her parents fighting ends with officers shooting and killing her father. late last night hayward police showed up to an apartment complex on tennyson road not too far from his spearian boulevard telling police her father had a knife and was threatening to kill her mother. when officers got to that amendment, they ordered the man to drop the weapon, but he reportedly refused and police say he lunged at officers with a knife. that's when one officer fired, shooting the suspect at least once. the man died at the hospital. the other three people in that apartment, we can tell you they were not hurt. our bob redell is heading the that scene right now. he'll have a live update in about half hour. it is 5:01. a bay area driver who hit and killed a bicyclist in pleasanton faces murder charges because of something he tweeted out.

18-year-old cody hall was charged with murder yesterday and is being held without bail. police say he struck 58-year-old diana hersvort and her husband in early june, killing her and seriously injuring her husband. he was reportedly driving 43 miles per hour over the speed limit. police say hall boasted on twitter about speeding and that let to the murder charge. the martinez boy mauled by a friend's pit bull in a scary scene continues his long road to recovery this morning. hunter kilborn has a helmet-like bandage on his head and right side of his face. the 10-year-old has completed two success. surgeries since that scary attack. hunter's mother says one of those pit bulls knocked him down and the other bit him in the face and the arm. this all happened on sunday. the mother now demanding both those dogs be put down. one has reportedly been euthanized. the fate of the other dog remains still unclear.

san carlos right now seeing a dramatic drop in home burglaries thanks in part to vigilant neighbors. the "san francisco examiner" reporting the number of home break-ins is down about 50% in just the past few months. from the start of the year to mid april, the san mateo county sheriff's department says 26 home burglaries were reported in that city. in response concerned residents jumped into action calling community meetings and forming five new neighborhood watch groups. since then only 12 home burglaries have been reported in the city. 5:03. targeted twice, a milpitas church is beefing up security after being the sprik tim of two separate crimes in just matter of days. police say a 27-year-old man broke into st. john the baptist catholic church on sunday night. he was arrested on suspicion of burglary and possessing burglary tools. the very same church was vandalized last week. in that case a 30-year-old man

was arrested after police say he destroyed $20,000 worth of church property. the church is adding a surveillance system and more locks to doors and windows. an private all girl's school in hot water with the city. "today in the bay's" marla tellez is here with the story. >> reporter: good morning. 33 extra students may not sound like a lot, but it really is a big deal considering this school owes location. this is cast lay yeah school right behind me here. smack dab in the middle of a tight-knit neighborhood at the corner of bryant and embarcadero. you know embarcadero is a very busy main thoroughfare. according to the school's website, it's the only independent girls school for

grades 6-12 in the bay area. this comes with a hefty price tag, for the upcoming school year, $38,200 per student. cast lay yeah is permitted to have 415 girls. for the upcoming school year, it has enrolled 448. there's the extra 33. neighbors here are upset because they say parking is already just a huge problem, especially during drop-off and pick-up hours. they're worried about more noise and pollution. today the school is submitting a report to the city of palo alto applying for a new permit to allow for the extra students and to prove it has a plan for the additional traffic. in the meantime, to help address community concerns, the school is holding a meeting to nye. neighbors are encouraged to attend. if you're sbertsested, that meeting is scheduled for 5:00 on school grounds. ultimately the school could be fined by the city of palo alto.

just how much has yet to be determined. that's ahead because school is scheduled to start on monday, august 26. we're just about nine, ten days away from that. i reached out to the school's head master this morning, hope 20g hear back. coming up in my next report i'll explain one of the ideas the school has that could help alleviate the traffic concerns. live in palo alto, marla tellez, "today in the bay." coming up right here, right now, meteorologist christina loren has a look at the forecast. >> look at the forecast. it is balmy out there to start the day. this is the reason wichlt you clearly see the blanket of clouds over san jose. this traps in some of the warmth from yesterday. temperatures this morning are starting out in the 60s, about six degrees warmer than just 24 hours ago. in livermore running seven degrees warmer. that means open up the windows in your home because we're starting nice and mild in the city, easily hit seven degrees

with the fog rolling in a little early. about 4:00 p.m. this afternoon as opposed to 7:00 p.m. yesterday. 83 in livermore as you break for lunch, 81 degrees down in san jose. a warm day shaping up even here in the south bay. 86 degrees? the heat of the bay. highs at 4:30 p.m. this time of year. guess who is going back to school? the kids in morgan hill. this is what we're expecting for today. temperatures will be nice and comfortable to start, about 60 degrees at 9:00 a.m. 3:00 p.m., 88 degrees, sunshine headed your way. mike inouye has a traffic alert this morning. >> that's right. a sig alert which chp says will take a half hour to clear. that's the definition. looking at all these flashing lights. i pulled the camera back a little bit. the reason i'm pulling it back is because they were clearly trying to pull someone from that overturned suv. i talked to the officer at chp and he said all indications are

they did pull the only party out of that vehicle. i have seen them trying to rock that suv onto its wheels. they can't quite do it with the manpower they have there. a tow truck should arrive in five minutes. this is northbound 101 blocking all but one of your northbound lanes. we'll take you to the map. you see slowing approaching the scene. also university avenue itself. some folks using that as an alternate. be kafrl. a lot more cars headed there. this is the day when palo alto schools come into effect. this is early for the school crowd. it should be clear by the time the schools take effect. 280 is a great alternate or even el camino. 101 past university is tied up. no details yet from chp. we'll end with fremont, the other side of the bay, east bay looking nice for the nimitz. we've all been following

this one. we'll find out today whether that new span of the bay bridge will actually open up on labor day as originally scheduled. officials pushed the opening day back to december or even later, trying to give crews their time to install a fix for dozens of the broken bolts on seismic safety elements of the bridge. this week a report from the federal highway administration urging crews to put in a temporary fix. that would allow the bridge to open up sooner. the argument here is the newbridge with the temporary fix will still be safer than the current bridge. the toll bridge program oversight committee will be announcing its decision on the official opening date. that will be taking place at 10:00 this morning. we know where jon kelley will be. today is your last chance to visit san francisco's wax museum before it closes its doors. are they real or are they wax? the fong family opened that museum on fisherman's wharf back in 1963 but says it's time the

it's one of the most beautiful places on the planet. >> this move and the city's ultimate goal is to expand the storefront initiative to try to fill vacant storefronts in 12 other business districts. >> there you go. keep your money local. san jose's largest employer getting smaller. cisco systems shutting 4,000 jobs. >> sysco may be on the cutting edge of technology, often seems to be behind the curve as far as company. we're talking rapid job growth, but cisco is cutting 5% of its workforce, 4,000 employees worldwide. the company delivered perfectly fine numbers at least for the past quarter but says it needs to shift its focus to developing businesses. cisco jobs have been in slow bleed moment for a while, cutting jobs last spring and summer as well. the online textbook rental company chegg has filed for an ipo t. santa clara company grew

today we have strong enough onshore flow to carry the low cloud cover all the way inland. you'll see a full deck of clouds in san jose. between 7:00 and 8:00 clearing. by 10:00 a.m., mostly clear conditions. tomorrow, area of low pressure tracks closer to the coastline and as a result we'll wake up with a full deck of clouds. tomorrow is actually looking a touch cooler with mostly cloudy conditions all the way through about 10:00 a.m. the natural ac will kick in for the first part of the day tomorrow. 94 in livermore, another hot one in gilroy, up to 90 degrees there. on saturday the breeze will pick up and the heat picks up come sunday. we'll take a look at your drive. mike has the traffic alert. it doesn't seem to get any better every time i check. >> it's true. the backup and lanes blocked still the same. i'll give you the progress report. i'm show you the map first. this is an overturned vehicle. i'm going to step out of the way. as you get this full shot, let's take the live camera. we zoo the suv is still on its side, had about a half dozen

fire crew there as they were trying to rock that suv and get it back onto its wheels. they could not do it. just then i saw the tow truck arrived . they're going to right that vehicle, hopefully right it and clear it quickly. so far with the traffic stopped right now, all traffic stopped including the one lane that was getting by, you'll jam up from oregon expressway to university avenue where the overturned vehicle is. let's watch as this rig continues to right it -- the suv on its wheels. a lot of fluid and damage. we'll wait for chp to give us an official up date. take you to the maps and we'll see it is slow and jamming up as we said approaching the area north of oregon expressway. el camino and 280 all the way to the west all very clear. university avenue is getting more traffic as folks are routing around that.

traffic just starting to build for the peninsula. palo alto schools go into session today. so you'll see a lot more activity around the school zones. keep that in mind as well. in san jose, no big deal here. a live look at oakland where traffic flows nicely as well. north past the coliseum, earlier construction north and south between downtown and 980, minimal slowing. crews are clearing as we speak. no problems all the way to the bay bridge toll plaza. back to you. thank you very much. it is 5:20 right now. a bay area man has convinced the u.s. military to send search crews to a remote island in hopes of finding the remains of dozens of world war ii marines. "mercury news" reports 60-year-old bill nif venn has been studying the island in the south pacific for more than 20 years. he says he knows where the bodies of 73 marines, including a medal of honor resich yent are buried.

search teams will dig where the unmarked graeches are. the island has been scoured before. but crews have found nothing. in san francisco, a plan could be approached to build a shelter designed for homeless for the lgbt community. the planning commission expected to vote on a permit to expand an existing shelter on the grounds of saint mary and saint martha lutheran church. the expansion will hold a total of 24 beds for lgbt homeless people. a survey found 29% of the city's homeless person identifies itself as lgbt. the construction will cost about a half million dollars. that construction is scheduled to start come this fall. the shelter should open up early this year. 5:21. crash testing for dogs. the new research that looks at seatbelts for man's best friend and how effective they are. system integrates holistic care with advanced technology

>> reporter: good morning to you, laura. the man's daughter, a child, called 911 last night to let police know her mom and dad were having a really bad argument at their home at the tennyson apartment complex in hayward. it was so bad she says her dad was threatening her mother with a knife. there was so much yemg between the two, the dispatcher could hear them in the background. they were still at it when police arrived. officers say they were forced to fire on the father who was still armed with the knife. >> they came at the officer with the knife raised, forcing the officer to, in defense of his life, shoot the subject who was armed with a knife. >> reporter: they shot the man at least once. he was the father, a 37-year-old man. they haven't released his identity yet. he was take tone a hospital where he was later pronounced dead. the mother and daughter are safe. it's our understanding they were not hurt during last night's

confrontation. reporting live in hayward, bob redell. accused serial killer joseph naso set to give his closing arguments to the jury tomorrow. during closing statements yesterday from the other side, prosecutors reading from naso's diary telling details of him stalking and overpowering the victims, even writing he simply couldn't help himself. he's charged with strangling and killing four northern california women during the 1970s and 1990s. sentencing gets under way this morning for two men convicted of gang raping a teenage girl at a richmond high school. the two men each face 33 years to life in prison for that attack. last month the two were found guilty on all counts for the involvement of a gang rape of a 16-year-old girl outside the school's homecoming dance back

in 2009. two other men connected to the case took a plea deal. two more are awaiting trial. a bike rider who hit and killed a pedestrian in san francisco last year expected to learn his faye fate today. chris buccari hit and killed a 71-year-old man in march of last year. he then blogged about the incident soon after it happened, saying he simply could not stop in time. he's expected to receive 1,000 hours of community service and three years probation when he's sentenced this afternoon. meantime, the family of the victim, 71-year-old suchi wi is expected to speak this afternoon. the family will speak at the district attorney's office immediately after the sentencing hearing. we'll find out today whether the new span of the bay bridge will actually open on labor day weekend. officials pushed the opening day back to december or later to give crews time to install a fix for dozens of broken bolts on

school in palo alto could face fines for overenrollment. marla, we're talk ag few dozen students over the limit? >> reporter: less than three dozen, 33 to be exact. the next ten days really could be the last days of peace and quiet. school is set to start on the 26th. when it does, there's a good chance they'll open up the front doors to more students than they really should. the all-girl's private school sits on a tree-lirned street in the heart of a tight-knit neighborhood on the corner of bryant and embarcadero expressway. according to the palo alto daily news, neighbors are upset because the school, which is permitted to have 415 students has enrolled 448 for the upcoming school year. neighbors say those extra 33 students are going to make an already bad parking and traffic situation even worse. so to help address these

concerns, castilleja is holding a meeting tonight. this meeting is scheduled for 5:00 right here on school grounds. one idea the school has is to start a shuttle program that would bus students in from woodside, portola valley and los altos where many of the girls live, reducing the number of vehicles during peak hours. i have sent an e-mail to the school's head master. one of the questions i asked is why even the over-enrollment in the first place. in the end the school could be fined by the city of palo alto which by the way is tasked with ultimately deciding on how to deal with this overenrollment issue. i'll talk about that in my next report at 6:05. marla tellez, "today in the bay." school starting back up for students at palo alto public schools this morning. also going back to school today, students in the morgan hill unified school district.

wait till i show you that seven-day outlook. we've got crazy changes headed our way including thunderstorms. we'll talk about that coming up. first an update on the traffic alert with mike inouye. >> looking over here toward the 101. this is the sheen on the roadway from the earlier work the fire crews did on scene. they washed away what remained of the cleanup activity. the suv, sig alert, all lanes are clear north 101 at university. it's clear here. there's still a ripple. as you approach oregon expressway, expect slowing heading toward university avenue. also university itself, toward 84, the dumbarton bridge, we have slower traffic. some folks may have been using the dumbarton instead of the san mateo bridge as an alternate. it's possible. looking at a smoother drive right now as things start to sort themselves out. in the east bay, a nice drive off the castro valley y. the westbound side of the

dumbarton bridge showing the speeds dipping. we'll show the bay bridge as well, an easy backup for the cash lanes on the left. the right side looking clear. it's 5:39 right now. new word overnight, the man known for the amazing sky diving jump during the london olympics has unfortunately died. we'll let you know what we're now hearing. a brazen robbery at a south bay bank. police now looking for three men on the run. right now a live look from cairo, egypt as well. a lot of unrest in the streets. this is kind of the calm after the storm right now. the streets very, very calm and clear, but in the last day there's been reports of maybe over 500 people killed during the unrest, coming up in a live report.

if you take a live look of pictures from cairo, you can see people are already gathering. we're hearing supporters of morsi and the musz limb brotherhood are planning to protest to yesterday's crackdown by the egyptian military, trying to clear out sit-ins of people who support the ousted president. in that more than 500 people were killed. the violence was so severe that the country's vice president quit his job. secretary of state demanded an end to the violence, and

demanded they seek peace. what hasn't been said is whether the obama administration will end aid to the country. they've given billions in dollars to help stabilize the country. there's a growing concern that those resources are being used against civilians. people are saying it needs to be looked at, whether or not that money needs to be ended especially because experts say there's no telling when or how this country is going to regain stability at this time. reporting live in washington, i'm danielle lee. laura, back to you. >> certainly doesn't look like it's coming any time soon. thank you very much, danielle. more devastation on the international scene. this is in iraq where more than 30 people are dead this morning following a series of car bombs in bagdad. iraqi officials say five car bombs exploded across the capital this morning. that also wounded dozens of other people. one of those bombs went off near a bus station. this violence has been on the rise in iraq since a security crackdown on a sunni protest
