last night. >> wow. lots of electricity there. because of the dry conditions, fire departments all over the bay area have extra duty on staff working extra hard. a red flag warning is in effect. this fire here, a fire that happened in orinda was put out quickly yesterday because of the extra staff that was on hand. our extra staff, we don't need it because we have meteorologist christina loren tracking it all for us. how do we look right now? >> right now we're seeing a little dry break. we need that daytime heating. that's what fuels those thunderstorms and that area of low pressure is going to move further inland. if you live in the east bay or south bay, the western-facing slopes surrounding san jose, that's where we're facing the most activity. it could last all the way through thursday if the area of low pressure doesn't make its way inland. right now we don't have anything out there pushing it. the jet stream is way to our north. most of the lightning strikes took place right along the peninsula coast. we saw thousands offshore,

dangerous for mariners out there. temperatures are running cooler. as a result our daytime high also be a touch cooler as well. but we have a better chance for thunderstorms and showers today. i'm going to show you exactly where coming up in my next report. 5:02. breaking news out of east san jose where a late night triple shooting has turned deadly overnight. shots were fired around 10:00 last night at the hoang han restaurant on alum rock near capital. arturo santiago joins us live from the scene. what do you know right now? >> reporter: still a heavy police presence at the scene. you may be able to catch a glimpse from the forensics team hard at work. investigate lers be here for at least the next few hours, still busy gathering evidence and processing the scene. this is a pretty dubious statistic for the city of san jose. it is its 31st homicide of the year. shots were fired at around 10:00 last night outside the hoang hon

restaurant cafe on the 4800 block of alum rock avenue. three people were shot and taken to the hospital. only one person has what are considered to be life-threatening injuries. that person died just after 2:00 this morning. more than one shot was fired, seemingly from outside of the restaurant while at least one person inside the cafe was shot. >> it was multiple victims. i believe at least one of the persons that was shot was inside the restaurant. >> reporter: now at this time police don't have a lot of information to offer. there are no suspect descriptions or even a number of suspects involved and a motive is still not known. the two other victims have already been treated and released from the hospital. again, this is the city of san jose's 31st homicide of the year. last year in 2012, the city saw 46 homicides. live in san jose, arturo santiago, "today in the bay." a pittsburg woman recovering in the hospital after robbers

broke into her house through her children's bedroom and beat her up. thisappened in a quiet neighborhood on bending willow way off park side drive in pittsburg. "today in the bay's" bob redell is live on scene with what the woman's husband is telling us. >> reporter: he's wishing he could have been at home at the time, maybe he could have saved his wife from the beating she has received. unfortunately he had already gone to work when this happened last night. this is not yet confirmed by pittsburg pd, but a photographer we had did speak with the father. here is what he said happened. it was about an hour after the father left for his job, around 10:00 last night. the two men broke into his house on bending willow way by climbing through the second floor window in the back of the house. not clear if they had ladder or some other method of entry. turns out it was the children's room. the 6-year-old boy stayed hidden underneath his blanket, while his 4-year-old sister slept through it all. the two men encountered the mother who they beat up pretty

badly, causing wounds to the head. she's in the hospital with what we believe are non-life-threatening injuries. the men robbed the home and escaped through downstairs. that's when they triggered the alarm which alerted the husband that something was wrong. apparently the second floor window was not sensored. again, that mother is in the hospital with what we believe are non-life-threatening injuries. the rest of the family is safe. reporting live in pittsburg, bob redell, "today in the bay." an oakland father shot inside a home as he slept will be laid to rest today. 20-year-old andrew thomas died on august 7th along with his 1-year-old son. police say the two were sleeping inside a home on gormley avenue when someone opened fire into the back bedroom. a funeral service will be held at 11:00 at the antioch missionary baptist church. police haven't arrested any suspects in that case. a fire forces people out of their redwood city apartment and they're getting more help.

the largest landlord has offered leases for 23 of its units to tenants displaced last month. 97 tenants, many of them low income, elderly or disabled were disflased by the fire. equity residential waived application fees and are working with the san mateo county department of housing to streamline the process for those in need of housing. 5:06. more than three months after a deadly limo fire on the san mateo bridge, investigators say no criminal charges will be filed. we're also hearing newly released 911 tapes from that tragic accident. >> get out, get out, get out. >> chp says a mechanical problem is to blame for the may 4th limo fire that killed five nurses who were trapped in back. the catastrophic failure of the suspension system allowed the drive shaft to come into contact with the bottom of the car causing friction to ignite the carpets in the limo.

one of the rear doors had the child lock engaged preventing it from being opened from the inside. the limo operator is being fined $1500 for having more passengers than allowed. time is 5:07. meteorologist christina loren is busy in the nbc bay area weather department. show joins us after a night of lightning. >> chances are we'll see more of it this afternoon and tonight. the chance intensifies for parts of the bay area. right now the activity is coming down offshore. we'll see a little push from this area of low pressure. that means the wrap-around moisture, the instability is going to move into the south bay and the same deal for the peninsula coast today. same thing, if you live near the coastal mountains, you are fair game for seeing the thunderstorms. i hate to be cliche, but as the saying goes, when thunder roars,

go indoors. if you're close enough to hear the thunder, you're close enough to be struck. you want to play it as safe as possible. we don't want any unnecessary accidents out there. muggy subtropical feel continues. the red flag warning stands for today as well. you can see here the areas that i've highlighted, especially the hills above 1,000 feet, that's where we're expecting the most activity. the western-facing slopes surrounding san jose, that goes for the east bay hill as well. also fair game in the north bay. as we head throughout the day, highs will be more comfortable, 92 degrees in livermore, 82 in santa teresa and 86 on the way to gilroy. we'll take a look at the seven-day outlook. i'll show you when things return to normal. a couple more days with thunderstorms in the forecast. let's get to the traffic alert with mike inouye. >> looking over here, our live shot, photographer eric murphy showing us a couple seconds ago, during christina's report, they got this crash back over onto

its wheels. they have righted it. there's a tow truck on scene ready to load it. what it looks like is anyone who was injured was taken away already. this happened just about 4:10, 4:15 this morning and closed all lanes. you see traffic getting by just on the right-hand shoulder. we see a number of tow trucks as well as chp vehicles on scene making quick work of this. one of the remaining factors, i have seen fluid leaking out of the car. if they have to clean that up, as well as debris. sounds like chp is waiting for a sweeper. you see traffic eking by here. it had at one point stacked past our 280/880 camera. it may be a dark shot. look over here toward the map and toward the interchange and a smooth drive. the map itself shows there is no slowing at the 280 interchange. from time to time that may be the case. you may want to stay over on bascom avenue to stay clear of the entire incident. back to you.

it's kind of become a ridiculous new trend, but california state assembly has approved a new measure that would add a costly fine for making the falls 911 calls. under current law the penalty is paying a $1,000 fine and serving up to a year in county jail. but this new measure would add a fine up to $10,000 to cover the

cost of the emergency mobilization. the practice, often called s.w.a.t.ing, has been a big-time problem in l.a. where fake 911 calls are made to celebrity homes. the so-called anti s.w.a.t.ing bill returns to the senate for approval before it's sent to the governor. 5:13. another boast from tesla, this time claims that tesla is the safest car ever. scott mcgrew, you say they're probably right? >> it seems so. car companies, laura, are supposed to take their five-star safety rating, smile and say thank you. tesla did take a closer look at results behind recent crash tests behind the national highway traffic safety administration and says the car scored at the top of the heap, enough to make the claim it is, indeed, the safest car ever built. part of this safety comes from the fact that tesla is an electric car and its motor is really small. it means the rest of the car is made up pretty much of empty space.

it has two trunks, so empty speight space, a crumble zone is your best friend when you and your car get in an argument with a tree. we should start seeing invitations from apple any time now. the rumors are that apple will hold a press event september 10th, but the company hasn't confirmed that. yes, we have heard the same thing that you have, that there will be a gold iphone. it's been tough on the markets lately. let's check in with seema mody live at cnbc headquarters. >> it has been a tough couple days on wall street. futures slightly higher after stocks fell for a fourth straight day. treasury bond yields hit a two-year high undercutting stocks on rising concerns, higher borrowing costs if and when the fed raises interest rates. no economic data out today, but we get a slew of retail earnings. the dow dropping 70 points in

season three. >> let me tell you about this fire. first there was a fire and now flood concerns in idaho. thunderstorms forecast for today could trigger floods in the area where crews are battling that massive wildfire. so far it has scorched more than 100,000 acres and now threatens more than 10,000 homes along with a luxury resort. crews heading into their 13th day battling the beaver creek wildfire. as of yesterday the fire was a mere 9% contained, but strong winds pushing the massive flames in several directions out there. 2,300 families so far have been evacuated. more than 7,000 have been told to be ready to leave at any time. >> i was definitely ready for my close-up. a wildfire in oregon burning 80 miles east of portland. some residents are taking their choices, about 50 people have buckets of water ready and sprinklers on their roofs. many of them say they have lived

through much worse wildfires than this one. so far it's forced three separate evacuations. all the summer drive conditions and lightning, similar to what we're having around here, burned more than 3,000 acres. one home along with a structure. tough going out there. >> usually christina and i are the only ones that get to see jon kelley up that close. >> i'm good from far but far from good. >> oh, come on now. i have to say if you get to see him in person, it's a treat. >> makeup, wig, false teeth go a long way. >> a good looking day shaping up. things will be rather robust, the same system that's bringing them the fire danger up in the idaho area. the thunderstorm potential that's going to be here in the bay area. let me talk about idaho for one moment. we do have some of our local boys up there helping to fight the fire and the news that i can bring you is temperatures will be much cooler for today and we could see brief heavy downpours

from some of the thunderstorms that could actually help to knock down that fire. the opposite is we can see variable winds and that gets dangerous because it takes traveling embers across the area. we're watching the bay area as well, 64 in livermore. i just set this back. this is what's happening for the past hour. over the past six hours, we've had a lot of active, especially in the south bay and along the peninsula. we have two conflicting air masses. we're right in the middle of the two. here is what we're expecting for today. if we see thunderstorms, the best chances will be over the higher elevations, 1,000 feet and above. we could see the thunderstorms drift right over the valley. that's what i'm expecting today. hail is certainly possible. brief heavy downpours, gusty winds to the tune of 50 miles per hour. it's going to be one of those days really heating up as we head throughout the afternoon into tonight just like yesterday. this morning looks pretty good for your morning drive. mike is tracking a traffic

alert. 92 in livermore, 80 in fremont. about five to eight degrees cooler in most cities. we're already running cooler with a little bit of an onshore flow and plenty of low clouds drifting over the san francisco bay. we'll check in for you and track anything that develops in terms of thunderstorms all morning long. stick with us. temperatures are going to stay nice and warm as we head throughout the next couple days and that humidity stays. finally we'll drop you off. the dry heat returns getting into this upcoming weekend. as promised, here is mike inouye and the traffic alert. standing in front of our live look by photographer aaron murphy. this is one of the vehicles, we showed you just after it was turned back over. the tow truck is here but that one is loading the second of the cars onto its flatbed at the same time the other tow truck is loading this. so two vehicles involved, both getting loaded onto flatbed tow trucks. shattered glass scattered

throughout the entire area. the here is chp. there's the shattered glass. it looks like the investigation has finished up. now they're working on the cleanup. word is they're still waiting for a sweeper truck scheduled to be there in the next ten minutes. until they do that, quite a bit of debris. it's not safe to do that with all the cars going through. here is the traffic flow. it slows as you approach that 280 interchange and slow past bascom so you're completely clear of all that activity. if good news is, if you get on at bascom, you'll go north of that crash and southbound shows slowing from there as well past the scene. it's a distraction. right here the rest of your south bay looks good. it's traffic tuesday, we're watching for a heavier volume. an earlier crash has cleared, but now we see the slowing out of the altamont pass. on the san mateo bridge, you can see across the bay.

a community center popular with the homeless in palo alto will soon be closing during nighttime hours. on a regular basis more than a dozen people camp out in their cars and inside the community center. that has led to complaints from residents and staff about the uptick in the homeless population. last night the palo alto city council voting to keep it and other community centers closed at night between 10:30 p.m. and sunrise. homeless advocates say this is just another move to push away the homeless. earlier this month the city council voted to ban people from sleeping in vehicles. los gatos' town council voted to ban plastic bags. the new ordinance would ban all retailers except for dry cleaners, restaurants and thrift stores from providing free plastic grocery bags. recycled paper bags will be sold for ten cents. it is the trend. the bag ban goes into effect starting in february. >> bring your bags.

today biologists are still trying to figure out exactly what drove a young whale to beach itself on stinson beach. a pair of joggers found the 42-foot-long fin whale still breathing and struggling in the sand. the whale unfortunately died before biologists from the marine mammal center arrived on scene. a lot of people gathered to look at this. about 200 people were there. a lot of them say they are simply heartbroken after witnessing that scene. the county is planning to dig a pit and bury that whale at the beach. lake tahoe restoration is

being discussed as environmentals protest a bill they say would hurt it. the measure would modify an agreement reached last year to limit the powers of the tahoe regional planning agency. that agency sets environmental rules for development around the lake. it comes as hundreds of scientists, elected officials and environmentalists gather for this year's climate forum. former vice president al gore delivered the keynote address. a lot going on weatherwise, aren't we lucky to have ms. christina loren to bring it all to us. >> good morning, jon and laura. good morning to you at home. active weather day yet again and lake tahoe, we could see flash flooding up there. take it easy if you're traveling that way. also yesterday in the fresno area we saw a thousand lightning strikes plus. they actually had a flood advisory issued for much of hanford and fresno. this is the kind of activity you don't want to let your guard down. what i can tell you is the best chance for seeing thunderstorms today the going to be along the

western-facing slopes surrounding san jose and the neighboring valley cities. santa teresa, 82 for you today. we could see thunderstorms drift from the mountains to the valley. a lot of people don't live up there in the mountains, but they do live in gilroy, morgan hill and san martin. that's what we're watching for today. 85 in santa rosa, a closer look at when and where we're expecting those strong thunderstorms to potentially develop. first want to check on the drive and see if there's any improvement with mike inouye. >> there is improvement. crews have moved one of those cars on the back of a flatbed tow truck. the second right here, center screen, is still there. look at the glistening, the glass underneath on the bottom of the screen underneath the tow truck. they still have to clear all the glass and debris and fluid in the area. that's why we still have only the right shoulder going by, north 880. you see traffic flow continues

christina loren is here to talk about what's happening today and beyond. good morning. >> good morning to you. we still have that threat for today. i set your radar back detecting those lightning strikes over the past 12 hours. look at this dry lightning. we actually had flood warnings in place for parts of fresno yesterday. today the area of low pressure is going to move further inland. so we do have a really good chance of seeing more of that activity, especially down in the south bay. now i set this back six hours. this is the area we're targeting for today. the western-facing slopes around san jose and the east bay hills above 1,000 feet. it was an active night. we're also watching up in the north bey as well. we don't want to leave you out because the chance isn't as great for you up there, but we'll still keep it in place. we're expecting the 80s in the north bay for today. wherever you live, above 1,000 feet, especially in the high country, you really want to keep your guard up for today. we're going to show you some

spectacular photos from overnight as we continue into the morning hours. the good news is this morning we're starting a little more stable in terms of our atmosphere. temperatures are running quite a bit cooler, so it feels more refreshing when you walk out the front door. we'll take you through your full forecast. we have breaking news we want to tell you about out of east san jose where a triple shooting at a restaurant kills one man and sends two others to the hospital. shots were fired around 10:00 last night at the hoang hon restaurant. "today in the bay's" arturo santiago is live at the scene. we're hearing investigators are still on scene working very hard. >> reporter: yes, they are. it's a good seven hours after the shooting took place. investigators are still here, have a strong presence at the scene. the forensics team is gathering evidence including video surveillance. they should be here hard at work

for at least the next few hours. the shooting did happen around 10:00 last night at the hoang hon restaurant cafe. a dozen or more people were inside the restaurant at the time. the restaurant is on the 2800 block of alum rock avenue. when police arrived, they found three victims. those three were taken to hospitals in the area to be treated. only one of them had what was considered to be life-threatening injuries. the victim died just after 2:00 this morning. >> at this point we're investigating some of the evidence that we have. one person expired, two other people were released from the hospital we believe at this time. >> reporter: the sergeant says more than one shot was fired seemingly from outside the restaurant while at least one person inside the cafe was shot. the two other victims have already been treated and released from the hospital. at this time police don't have a whole lot of information to offer. there are no suspect descriptions or even a number of

"today in the bay's" bob redell live on scene with what the father is saying this morning. >> reporter: good morning, laura. bad timing for the father. he had only gone to work about an hour prior to the home invasion robbery at his home where his wife and two children were inside at the time. this is not yet confirmed by pittsburg police. we had a photographer on the scene who talked with the father. this is what he tells our photographer. around 10:00 last night two men broke into his house on bending willow way in pittsburgh. they climbed through the second floor window in the back of the house. it's not clear if they had a

tribune," 36-year-old joshua daniels suffered a black eye and broken eye socket, required ten stitches after a city worker assaulted him and beat him unconscious. daniels says the confrontation happeneder early sunday morning after he spit his gum into a trash bin the pair of workers was using. he started capturing the moments on his cell phone. that's when one of the men started punching him. daniels says he passed out. about an hour later he woke up in a pool of blood on the floor of his apartment. he says he doesn't know how he got there. right now his cell phone smising. the city's public works agency has launched an internal probe. it's 5:36. as students head back to school, san jose police department reinstating a program looking for kids skipping class. the t.a.b.s. program was dropped last year to put more officers on the streets. starting today the program is back in business with the

sure everything cleared up. there's traffic north 880 at stevens creek boulevard. still a little recovery going on. this will take you north past bascom avenue. then things clear up for the rest of the south bay, not a major problem. it is traffic tuesday so we're watching a heavier flow. a new crash in fremont, 880 past auto mall parkway. we hear of a crash on auto mall by pacific commons, the upper left of your screen. looks like an overturned vehicle and maybe a big rig. we're tracking that as well. i'll let you know as that affects your fremont traffic and possibly on the other side of the freeway, the connector between 880 and 680 as well. >> busy out there. 5:39. a large wildfire forcing the closure of a major roadway heading into yosemite national park. one bay area attorney threatening severe legal action over the alleged dumping of hundreds of psychiatric patients.

a new poll out shows the majority of californians still support the federal health care overhaul. a lot of people don't quite understand how it will affect them. the poll was sponsored by the non-profit california wellness foundation. among the findings, public opinion about the law has been virtually unchanged since it was signed back in 2010. 53% of the registered voters support the health care law. 38% opposed. people's understanding of the new law also remained practically steady with just 15% saying they have a strong grasp on the implications. 46% of voters say they don't expect the law to affect them at all. those who do expect their families to be affected, 23% predict they'll be better off. 26% predict worse. while californians support

opposition leader benazir bhutto. musharraf has been under arrest for the last four months, appeared before the court in person to deny these charges. the case has been adjourned until next week. 5:45. a wildfire raging out of control in the national forest forced the closure of a major highway into yosemite. the rim fire jumped highway 120 shutting it down in both directions from four miles west of groveland ranger station to four miles east of buck meadows. the fire has burned more than 800 acres since it broke out saturday afternoon. campers are being evacuated as 160 firefighters battle the flames. 5:45 right now. let's check back in with meteorologist christina loren who has been busy over there, a lot going on. >> a lot going on, guys. that's exactly right. at this point we want to make sure everybody is well aware of the fire danger we have in the bay area because of the

potential of the dry lightning strikes as we hid throughout the day. i'm going to be here through about 2:00 p.m. when i pass the torch to my chief meteorologist jeff ranieri. it's one of those days we don't want to let our guard down and don't want you to either. the areas shaded in red, mostly the hills above 1,000 feet, the mountain ak yas is where we're expecting activity. i set your radar back about 12 hours, lots of lightning, thousands of lightning strikes offshore. we had a floogd concern in the fresno area. for today, the area i'm bullseying is right around san jose, the western-facing slopes. two conflicting air masses, area of low pressure just offshore colliding with the moist subtropical air, the monsoonal moisture that we typically see this time of year. but it doesn't usually come this far up to the north. today muggy subtropical feel, dry lightning certainly

5:48. san francisco city attorney warning the state of nevada he may file suit over the dumping of psychiatric patients in the golden state. dennis herrera will send a letter to nevada's attorney general today threatening a class action lawsuit if nevada does not reimburse the cities and counties where the patients were dumped. since 2008, the las vegas psychiatric hospital has reportedly shipped 1500 patients to other states via greyhound bus. a third of them end up in california including san francisco and san jose. herrera says san francisco spent about $500,000 on medical care, housing and providing aid for the 20 people shipped to san francisco. newly elected santa county clara district attorney supervisor cindy chavez set to be sworn in at 6:00 tonight at the county government center in san jose. the labor leader will be the first woman to join the board since supervisor liz niss turned
