parts of the bay area. finally when the normal bay area heat returns to the forecast. a live look shows you a light volume of traffic through palo alto. a new crash interest chp, that's also on the bay shore freeway. the latest for high way 101. the south bay. a live look outside. beautiful start to our wednesday morning, waiting for the sun's arrival. there's a blue moon on wednesday, august 21st. this is "today in the bay." very good morning to you. thanks for joining us. i'm laura garcia-cannon. >> good morning. i'm marla tellez. in for jon kelley. south bay, we are following breaking news in san jose. a would-be burglar shot by a security guard at an apartment complex in almaden. it happened near guadeloupe oak grove park on star wood place. bob redell just spoke to police. this happened a few hours ago.

is it an active investigation out there? >> reporter: good morning, marla. sjpd still out here, still processing the scene. but as far as trying to find suspects, they've given up on that search. they have the security guard in custody downtown being questioned. they're still trying to determine whether or not he will face a crime charge. they also have the person shot in the hospital this morning, suspected car burglars. we're here at the apartments, senior apartment complex, this is almaden expressway here in almad almaden. around 1:30 the security guard came across four people trying to break into cars in the parking lot of the complex. it's not clear, police won't tell us whether the security guard works for the complex. there was a confrontation between the security guard and the four people trying to break in the cars. the security guard ended up shooting at those people. they were in a car, hence the shatter of glass on the parking lot here. he ended up hitting one of them,

and they ended up taking off the security guard is downtown at the police didnepartment being interviewed. >> reporter: police found the car that had -- that the four people used to get away. it was a stolen car. they found it a couple miles away inside was one of the suspected car burglars. this person had been shot at least more than once. has been taken to the hospital. nonlife threatening injuries, stable condition. as for his three accomplices, their location is unknown, as i mentioned earlier. san jose police has given up on the active search because they have recovered the car and they don't have a description to go on. i suppose they're hoping once they interview the man in the hospital, he'll be able to give them information on who they were. live in almaden, bob redell, "today in the bay." 5:02. breaking news out of east palo alto where a teenager has died

after being shot inside a car. this happened on emmett way near the university village shopping center. police say shot spotter sensors picked up the gunfire. they found a 19-year-old man slumped in the driver's seat of a parked car. he had been shot. he was rushed to the hospital but later died from his injuries. police say they're looking for witnesses. >> we have no motive. we have no suspect information. we just got the detectives here right now and we are doing a neighborhood canvass. >> if you have any information, you're asked to call east palo alto police. now to syria, where rebels are accusing the government of using tem cal weapons. we have to warn you, the video is difficult to watch. the syrian observatory for human rights says government forces fired rockets with poisonous gas heads during the attack.

more than 1200 people are dead, many reportedly women and children. the government is denying the claims, calling them baseless. nbc is working to confirm these reports. a 20-member u.n. chemical weapons team is in syria to investigate previous claims of chemical attacks. this morning, we are learning the french president plans to ask the u.n. to visit the site of today's alleged chemicals weapons attack. fast moving wildfire burns out of control near yosemite. the rim fire has scorched more than 11,000 acres and threatening homes and camps. the fire forced 10 obey area students and staff saying families evacuate. christie submit joins us from moffet field. good morning. >> reporter: good morning. there are many bay area firefighters that are already up there helping out with the rim

fire, and that includes the air national guardsmen with 129th rescue wing. still under the same conditions that we've been dealing with, the red flag warning. i wanted to show you some video of what crews are trying to fight up there. struggling to try and contain the rim fire here highway 120 by yosemite which jumped from 2500 acres to more than 11,000 with 2500 structures threatened. i just checked, right now 120 is closed, 4 miles west of groveland ranger station and 4 miles east of buck meadow. some of the structures threatened are at the family camp where the evacuations were quick, only 15 minutes to gather their things and get out. >> there was a point where it started moving quickly so it caught us sort of by surprise that cal fire came up and said, you've got to go. >> reporter: students and staff from maybeck high school in berkeley who were staying at the

camp are safely back home. reports that that camp is being used as a staging area to help fight this fire. also wanted to mention, in dublin, 160 acres burned at camp park. firefighters had to do structure protection. a reminder of the light flash fuels and low humidity and conditions we've been dealing with, these aren't the only camp evacuations. yosemite is not closed it may be a challenge to try to get there. live at moffet field, christie smith, "today in the bay." we are keeping our eyes on the wend out there. not us really. meteorologist christina loren. >> good morning. taking a live look here for now, nice and clear over the golden gate bridge but that will not last all morning long. through the next couple of hours an onshore flow. area of low pressure pushing into the las vegas region.

so we have the red flag warning in place for parts of the bay area. just parts. just the north bay. that stands until 5:00 p.m. after which time we're expecting more stability, and things will get comfortable around here as a result. 60 degrees to kick off the day in livermore. 58 in concord. 58 in san francisco. we have wraparound moisture, so it feels muggy. noon today all of the areas on your map shaded in yellow, that's where we get the comfortable marine influence. as a result, san jose 76 degrees at lunchtime. kids are heading back to school all over the place. san jose state is going back to school as well. 79 comfortable degrees for your first day back. 90 livermore. 83 later today up in napa. so, here's what we're expecting. throughout the next couple of days we'll see more of a dry pattern resume. temperatures are going to feel more comfortable, 80s towards the bay area. show you when that comes in my next report.

right now let's get a look at your drive with mike inouye. i'm here in the new studio. i don't see you, my friend. >> i see you. i watch you on tv every morning. looking here towards san jose northbound 101. easy drive now. no problems for the flow of traffic. but san jose state back in full session today. yesterday we saw a lot of traffic, orientation. today more. toward that south bay right now, easy drive. only thing marked on here is the circus is in town, but we have an issue here in mountain view, north 101, old middle field. we see slowing on the sensors just kicking in. a report on a crash, no details on injuries. two crashes might involve a big rig possibly in the area, at least pulled over to the should somewhere that's added distraction to the shoreline. chp still en route to the scene. 101 easier drive up the peninsula, no problems for san mateo or palo alto or san francisco for that drive on the bay shore. a live look outside, traffic

flowing westbound, interstate 80. headlights underneath university avenue. cal berkeley not in session, that's a week. that will be an issue as folks head through the east shore and the bay bridge as we saw yesterday. patterns coming back for fall-like traffic. >> 5:09. san jose taking a hard look at its taxpayer funded program aimed at getting rid of graffiti. is it effective. the city hired a contractor take care of the graffiti in 2011 to save money. a recent audit found things are going well. graffiti's removed within 48 hours. response times have been good when the public reported graffiti via a smartphone app. the program is costing more than anticipated and they'd like to see the city hire more than one contractor so prices stay competitive. menlo park has put off a decision on whether to increase the number of red light cameras in the city. the council was supposed to vote

on a plan to add a fifth camera last night but after hours of debate, the decision was put off until next tuesday. in the past five months, other bay areaties including redwood, belmont, hayward opted out of the red light camera contract saying they did not vastly improve safety. >> south bay, undead take to the streets again tonight in san jose for the annual zombie-o-rama. they are decked out. the event includes face painting, a kids' walk and the zombie crawl through downtown. event is a food drive for the second harvest food bank. festivities begin at 2:00 at gore park on williams street and south first street. >> one of the happiest zombie i've ever seen. >> looks like michael jackson's "thriller." 5:10. bay area city hoping to save lives by adding dozens of

lots of people in palo alto holding their breath, waiting on hewlett-packard. scott mcdegree, they have good reason to be anxious. >> most companies report profits, once a quarter. hp in the past few quarter announced disasters. we have no reason to think hp has bad news this quarter. but in just the last year the company's announced write-downs and losses worth $17 billion.

announcing it made $8 billion mistake with eds, another $9 billion in write-downs with autonomy. and in that time, it's announced lay-offs, tens of thousands of people. we don't expect necessarily terrible news this afternoon, and there are signs that meg whitman, who inherited some of the problems, is stemming the bleed. we'll know more before the bell. but in the meantime, investors are waiting like this. also waiting on fed minutes. we get to read the fed's diary this morning we think it's going to say, dear diary i'm going to stop buying so many bonds. courtney reagan, good morning. >> good morning to you. futures are lower, after stocks closed in mixed session tuesday. dow faded into the final minutes ending the first five-day losing streak since december. today a report on existing home sales and the minutes from last month's fed meeting this afternoon. we are thinking they'll provide clues on when the fed may start to taper or cut back on the

massive bond-buying program which is part of the stimulus measures helped to keep interest rates so low. the dow slipped seven points yesterday. it will start trade agent 15002. the nasdaq did gain, starting at 3613 today. >> 5:15. mark zuckerberg has a new organization this morning called internet.org a partnership between tech companies and nonprofits to spread the internet to developing countries. primarily working on making the internet simpler, compressing data. the organization says, quote, no one should have to choose between access to the internet and food and medicine. i would say if somebody offers you food and medicine, take that first. that seems like a good idea. >> exactly. >> a good effort, nonetheless. >> thank you.

california women in the '70s and '90s. investigators are proved he raped and strangled his victims. one woman was found dead in fairfax in 1977. her brother says the verdict provides some relief. now he hopes nasois sent to prison and not death row. >> he gets anything he wants in sent to death row. he needs to go to a main line prison to be treated like he treated them girls, get what he deserves. >> prosecutors are seeking the death penalty. nasois being investigated as a suspect in several unsolved murders. two men accused of kidnapping a teenager for two months are expected in a san francisco courtroom today. the two men are facing kidnapping, drug, and rape charges. authorities say he kidnapped the teenager in los angeles and brought her to a home in

clearlake. the men allegedly raped the girl and locked her in a toolbox for days at a time and accused of using her to help cultivate marijuana at the home. the men are scheduled to be in federal court today in san francisco for a status conference. american airlines fired one of its flight attendant trainees after learning he's on the tsa's no-fly list. in an e-mail, american airlines says he was removed from the training program in ft. worth, texas in may. he was accused of making bomb threats to several united airlines flights headed to and leaving from los angeles and london. he was arrested in the spring, charged with making false threats, and later pleaded guilty as part of a plea deal. 5:20. palo alto is getting ready to install dozens of defibrillators across the city. right now city's training both police departments and fire departments how to use those portable life saving devices.

"today in the bay's" bob redell joins us live from the scene. police took a security guard into custody. >> reporter: correct. good morning to you. security guard is trying to stop these break-ins here at the senior apartment home at coleman and almaden expressway. security guard is in police custody. the officer tells us he is being cooperative. they're trying to determine whether or not he did the right thing by intervening and shooting one of these people. they are interviewing him now to

determine whether or not he, too, could face charges, not clear whether he was registered to have that gun and whether he legally had the right to shoot at these people. it was around 1:30 that he confronted the four people who were already in a stolen car, a trolling the parking lot trying to break in other cars. the security guard pulled out a gun and started shooting at these people. if you see broken, shattered glass in the parking lot, that's where the shooting took place, presumably shooting at them in the car, the glass in the car shattered. those people took off. the security guard stayed, taken into custody. later this morning, the police did find that car that had the four people inside. three of them were gone. they found them a couple miles away. three were done, one remained in the car. he had been shot more than once. was taken to the hospital where he is under arrest, in stable condition, expected to survive. the whereabouts of his three

accomplices unknown. four people allegedly trying to break into cars here at the senior apartment home. one in custody, whereabouts of the other three unknown. as i mentioned the security guard is in custody, not clear whether or not he'll be facing charges. police say he's being cooperative. reporting live here in almaden, bob redell, "today in the bay." 5:33. high fire danger all over the state. in the east bay a car fire spread to nearby brush, shutting down eastbound lanes of highway 4 near martinez. cruise contained the fire and reopened lanes early this morning. you see the car badly damaged. crews were lucky in that case. across the state firefighters battling at least ten major wildfires take a look at this map. fires stretch all over the state. one of the largest is the rim fire near yosemite national park. christie smith live where the

local air national guard just deployed to try to help out with the fire. good morning. >> reporter: good morning. there is a massive effort under way to try to bring this rim fire under control. more than 700 personnel trying to fight this fire, including many from the bay area. including air national guardsmen from right here at moffet field. the 129th rescue wing, they left when the red flag warning was in effect and this morning there is concern about lightning in the sierra. this is what firefighters are struggling to fight, the rim fire near highway 120 by yosemite. last word it was 0% contained. it jumped from 2500 acres to more than 11,250 structured threatened. highway 120 closed. now for a time, some of the structures threatened were at san jose family camp, 46 acres along the river. campers say the evacuations came

70,769 football fields. much of this in southern california near the palm springs area. as we head throughout the day, we have that high red flag warning, high fire danger in place. for santa rosa, san rafael and na napa, we could see the wraparound moisture, kicking up instability and could get dry lightning strikes here in the bay area. should expire as we head through 5:00 p.m. this evening. hopefully it will be able to expire on time. we've had this stubborn cut-off low, made things difficult in the bay area. hard to forecast the cut-off low because it has nothing to push it inland. detached from the jet stream. starting to fizzle out a by but we have the fire threat from las vegas up through tahoe and the reno area in particular. 60 degrees here in the bay area. feeling more comfortable as the area of low pressure moves inland. 57 in san jose. 57 degrees to start the day in sunnyvale. noon, we'll hit 80. livermore, 65. on the way to oakland as you break for lunch.

comfortable conditions for people heading back to school. san jose 79 in the heat of the day. 83 gilroy. 64 san francisco. that means more traffic especially in the south bay. let's get an update on your morning drive with mike inouye. >> good morning. san jose state in session and that's a largely commuter school for much of the population. that's going to mean more traffic, 87, 280. today the first official day of instruction. here 280 at 17, 880, the connecter on to northbound from 880 to 208 is closed. between the two horizontal roads, there is flashing lights you can see. they've closed that on-ramp. they're fixing the sand barrels and going to repair that possibly until 7:00 a.m. could be a huge issue. we'll have the map oriented the same way as the traffic flow is going, 280 northbound toward us. you can get an idea what's affected as far as flow of traffic if this continues past

6:00 a.m. which it sounds like it will. more congestion out of downtown. san jose state back in session. a blip of slowing north of 680. that will see more slowing over the next half hour tri-valley new york big issues. a live look at fremont. the volume starts to bill coming south through 880 and past the truck scales. 5:38. new, tense moments at san francisco's city hall overnight as police moved in to clear out dozens of student protesters. about 150 students from city college of san francisco staged a sit-in last night, demanding mayor ed lee step in and do something to save the college from being forced to close its doors next year. >> unclear to us why the mayor won't even be willing to meet the students. collectively it was decided we would wait, hoping that mayor lee would listen to us and meet our two demands but inted of doing in he called the police to arrest us.

>> several protesters were arrested for disturbing a public meeting and trespassing. last month a regional agency ruled the college would be stripped on its accreditation unless changes made to the school's governance structure and finances. the protests came one day after college officials submitted a formal request for a review of the agency's decision. no one was hurt in the protest and so far, no word from mayor lee. here is something mike has his eye on today. south bay roadways will be extra crowded today as more students return to school. the big issue will be around san jose state after two days of orientation. classes will officially begin there. three san jose school districts return to school, evergreen, orchard, and union. the school year begins at livermore valley joint unified this morning. >> study hard, kids. 5:39. in over an hour the man who leaked thousands of documents to wikileaks will learn his fate. what we expect a judge to say. sacramento lawmakers looking

welcome back. egyptian authorities have captured two more key islamist leaders. a top ally of the muslim brotherhood captured as he tried to escape to libya yesterday. a spokesman for the group was caught on his way to catch a fly out of the country. the egyptian military cracking down on the muslim brotherhood, the party of former president morsi. senator john mccain calling on president obama to take a stronger stance against einter. >> -- egypt which receives federal aid from the u.s. >> the united states has influence. so far the united states has sent a very, very mixed message to the people who have caused

mayhem in the streets of cairo and egypt. >> mccain has called on the u.s. to cut off the more than $1 billion in annual military aid it sends to egypt. today, president obama could make a decision on that aid. "today in the bay's" live in washington with what could happen at the white house today. good morning, melissa. >> nice to see you. that's right. this has been a big topic of discussion the past couple of days. no doubt, it's going to stretch out for the rest of the week. right now, this aid the president says under review. this is not something that is yet entirely stopped or slowed that much to the point. $1.5 billion in military and economic aid is what we're talking about. the president meeting with top advisers tuesday, talking about this growing concern. the outcry by some lawmakers like mccain over whether to continue to fund it. if a coup is declared, most

forms of u.s. aid continue since much is spent on promoting democracy and that is allowed. if the united states makes cuts, other countries promised to replace the aid, pledging $12 billion in assistance for egypt. >> just into our newsroom, we want to mention this, across the wires, egyptian court has ordered the release of mubarak. an egyptian court ordering the release of ex-president mubarak. >> major development there. 5:44. in more than an hour the man at center of the largest leak of classified documents in history will learn his fate. a military justice expected to sentence army private bradley manning at 7:00 this morning. manning faces up to 90 years in prison for leaking more than 700,000 secret documents to wikileaks while working as an intelligence analyst in iraq. the prosecution is asking for a
