across san francisco. you can see traffic on the upper deck motivating across the top on friday, august 23rd, this is "today in the bay." >> i'm feeling motivated myself. it's friday. good morning and thanks for being with us. i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. happening right now, we want to get to this, more than 105,000 acres scorch outside yosemite. firefighters are struggling to get any sort of containment on this one. the upper hand has been completely illusive. one percent of the fire is contained right now. that is down from 5% that had been declared as of wednesday. about 2500 buildings are in

danger of burning. highway 120, one of the three main roads into yosemite still completely shut down. the governor now declaring a state of emergency in that area to try and free up the money and resources to help 1,800 firefighters already on the ground. at least nine buildings we can tell you are destroyed. smoke and ash forcing a lot of the schools in that area to shut down to be very safe. the fire has forced the cancellation of the popular strawberry music festival. the five-day bluegrass event was supposed to be held on labor day weekend. but now things are in flux down there. for more on the fire, let's get a check with our meteorologist christina loren telling us about the conditions and what firefighters are up against. >> it is a rough time for firefighters in the area. it's hard to tell what the winds are going to do. we've got monsoonal moisture in the area. the good news is, no red flag warnings because our winds have shifted out of the southwest. that's carrying in moist ocean air all the way to the yosemite

area. we had the latest on acres burned. that's 105,000 acres, plus the elevation is about 3,000 feet. winds can whip through the mountains in the area. the firefighters still have a healthy battle on their hands as we get through out the day today. the gusty winds could carry traveling embers. temperatures will be much cooler. we'll take a look in your local forecast coming up. >> 6:03. new this morning, officers on the peninsula are investigating a deadly crash that shut down all northbound lanes of highway 101. chp says the crash happened before midnight on the freeway at kehoe avenue in san mateo. they tweeted a photo of traffic being diverted to the shoulder. here is a look at that. a sig alert was issued early this morning, but all lanes have since reopened. one person was killed in the crash. investigators have yet to

release a cause. a warning right now to women walking alone at night in santa clara after a woman manages to fight off her attack earl during a sexual assault. she's a lucky one. that's not the only attack against women. santa clara police are investigating three sexual assaults reported in the city of santa clara just this summer. that first one back in july on homestead road near central park. the second on august 1st on lexington street. that is very close to the santa clara university and now a third attack just this week also near the university. this time at the intersection of franklin and sherman. "today in the bay's" bob redell live at the santa clara police station this morning. bob, are police saying these attacks, they believe they're possibly linked? >> right now they do not think these three attacks, jon, are connected, simply forf'm the fa that the suspect descriptions are so different. i want to show you the latest sketch they just put out. this is for the attack that just took place early wednesday

morning. you can see just just how detailed the sketch is. it shows the man is a white man, hazel eyes, dirty blond hair, build. he attacked a woman on the edge of the santa clara university campus. this happened just after midnight wednesday morning as she was walking on franklin near sherman street. >> she was approached, knocked to the ground and sexually assaulted. she was able to fight off her attacker and he fled. >> as you mentioned, this is the third attack over the past month on july 26, a man climbed through with window on this apartment complex, raped a woman who lived inside one of those units. august 1st, a man physically attacked a woman on lexington street close to the university campus. in that instance she was able to fight them off. again, right now police are not saying all three of these attacks are connected for the simple reason that the descriptions of the suspect vary

so greatly among all three cases. reporting live outside santa clara police headquarters, bob redell, today in the bay. >> from the south bay to the north bay, the search is on for the gunman who shot a man several times in marin city. the shooting happened around 7:30 last night in a parking lot off drake avenue, not far from 101. this is near the border of sausalito. sheriff's deputies say the victim is a 21-year-old valet hoe man, shot multiple times in the chest sand was taken to the hospital for surgery. no word on his condition this morning. deputies say the shooter was wearing a ski mask but a motive is still unknown. defense attorneys looking to continue their arguments today, asking for a new trial in the case of the vacaville teenager convicted of raping and stabbing a 13-year-old girl and her baby brother. last september 17-year-old alexander savantes was convicted of assault with a deadly weapon

and rape. while awaiting sentencing, a team of bay area lawyers took over the case and they're questioning the effectiveness of his trial attorney saying the defense failed to carefully examine physical evidence. if a new trial is denied, sentencing is expected to follow. more people left homeless by the devastating fire in a redwood city apartment complex are suing this morning. so far 22 complaints have been filed against the owner of the hallmark house apartments on woodside road. attorneys for the residents there say at least six more complaints will be filed soon. a massive fire ripped through the complex on july 7th killing one man and leaving almost 100 others without a place to live. fire officials say the fire was likely accidental, but the complaints say the building was not properly maintained or inspected. an elderly man who broke his hip during a fall at mills peninsula medical center is suing this morning.

the man filed a lawsuit against the hospital, its parent company and his own physician. he says understaffing at that hospital to save money led to his injury last september. the suit claims the defendants were, quote, well aware of the understaffing that created a risk of inadequate nursing care, dangerous falls, injuries, neglect and abuse of elderly patients. time to check our local forecast at 6:08 as we take you outside. a live look at the golden gate bridge. traffic is picking up right now. about an hour ago no one was on the span. >> kind of clear, a lot of low-hanging clouds. >> looks great out there. meteorologist christina loren has a nice forecast in store for us. >> and which deserve it. we have to get through the monsoonal moisture. once we get rid of the low clouds, you see them situated over san jose. it could become a factor as we head through the next hour as the low clouds do start to drop

off. 60 degrees in livermore, 61 in san jose. good morning, gilroy at 59 degrees. at 60 in oakland and 59 to kickoff a friday in beautiful san francisco. it's going to be a comfortable day in the city by the bay. patchy low clouds, coastal drizzle possible. we'll keep watching the fog factor all morning long. slightly warmer in some cities across the bay area. more cities will be just about as nice as where we were yesterday. we can see the upper 80s in warmer cities across the bay. the cool ocean air will pick up as we head throughout the afternoon. you might actually get by without using the ac. pocket a little of that pg&e money and make the weekend plans. we'll see comfortable conditions. a.m. fog to p.m. sunshine today. works like this, 87 inland, bay side 74 degrees. we'll take a close look at that seven-day outlook, show you the weekend and what's to come for next week. we have changes headed our way. first let's talk to mike about

your morning drive. a very tough one right now. this is for 580 coming up toward the maze. the live look shows you that stream of headlights from left to right, barely traveling left to right across the screen. there are a couple of crashes across the stretch. a slow drive coming off 24 as you approach 580 and 580 approaching 980 and 24 because of a crash. one at the connector ramp involving one set of cars. it sunds like a motorcycle and pickup truck areçó closer over toward 580 and the maze. that's over to the right side of your screen. both of those combined causing a huge backup for folks. if you're coming from the caldecott tunnel, you can use ashby avenue which is a large surface street. that will take you through berkeley. that is moving pretty smoothly right now. if you take over towards college or shaddock, that will get you through the area as well. looking over to folks heading toward 880 as well. no break heading toward 980 because of the backup into the

area. if you stay off 580 and use 880 threw oakland you should be okay as far as the speeds go. we'll continuing to track the details. sounds like major damage to a number of cars in those crashes. that will take a little while to clear. if there were major injuries, i would talk about the investigation time. so far they're just talking about the crash and i think that's good news as far as the people involved. looking over here toward 680 in both directions, moving smoothly despite crashes south of that. slowing will end with this map of slowing as it builds for the dublin interchange. 84 looks nice heading through livermore, pleasanton and towards sunol. >> mike, thank so much. it's 6:11 right now. coming up, arrest in a wild scene. a plot to execute police officers in las vegas. we have details about the suspect including a look at why one of them could have ties right here in the bay area. that's coming up just ahead. brand new into our newsroom, the big shakeup ahead at microsoft. we'll take a look coming up in business and tech. a live look at san

. yosemite national park remains open as firefighters battle fierce 105,000 acre wildfire that's right now only 1% contained. authorities are going door to door in the gaited community of pine mountain lake. >> take a look at this. officers hope this sketch will help them track down the man who sexually assaulted a woman just steps away from santa clara university. investigators are seeing if this attack is related to two others in the area in the past month. police say a man and woman

spent hundreds of hours plotting to kidnap, torture and kill las vegas police officers to promote their sovereign citizens movement. authorities say david allen brutsche and devon newman. we're working to try to figure out if brutsche is the same man arrested five years ago after a six-hour standoff with police. breaking news, a big shakeup this morning at microsoft. >> business and tech reporter scott mcgrew has the breaking details on the story and joins us in our studio with the latest. >> good morning to you. microsoft this morning saying ceo steve ballmer will step down from that company within the next 12 months. ballmer is the second ceo following big gates. microsoft has had a lot of trouble lately. it had kind of a failed launch of windows, a not very good

launch of xbox and you have this microsoft surface. steve ballmer has been under a lot of pressure. the associated press saying microsoft has not named a successor yet. again, microsoft ceo steve ballmer will retire within the next 12 months and microsoft stock i can tell you is up big in pre market trading. that's big news. the big news before that was that google has made an investment in uber, that car service based in san francisco. where this goes to really big news is google ventures, the investment arm of google invested around $250 million, all things digital which is nearly the entire budget. if you're not familiar with uber, it's quite simple. you download the app, stand on any street corner in san francisco, press a button, a car shows up within a few minutes and takes you where you want to go. taxi cab drivers didn't like the

scrappy young startup uber, no longer scrappy. it's not one of the most powerful companies in san francisco. let's pull on the thread a little bit. this can't be about google getting into the taxi business, that doesn't make sense. you've got to let your imagination run here. google using uber's technology maybe to instand deliveries to take on amazon maybe. will you get rides from robot cars? this is evolving and they do have a plan. turning to the stock market, it's not so much what the nasdaq will do today as will the nasdaq do today. for three hours on thursday there was no trading on the exchange. the cause of the problem has not been determined. we'll have live coverage this morning and hopefully one of the nation's second largest stockm/ market will open at 6:30. we also got a peek inside the umpquab bank, definitely echl lating apple stores.

that goes for atlanta, seattle, los angeles and boston as well. as we head through the day, we have a bit of a fog factor to tell you about mostly along the peninsula and the north bay until about noon. after which time we'll get a lot of sunshine. make sure you bring the sunglasses and the sunscreen with you. today between noon and 2:00, mostly sunny conditions with enough low cloud cover hugging the coastline and west early flow transporting the cool ocean air in all day long as the jet stream sits just above us. mostly between the hours of 3:00 and 7:00, that's when you'll get the best of the best. you can probably get by without the ac. getting toasty in places like fairfield and livermore. 87 is not bad. that's actually average for this time of year. 75 in flee month, 79 in redwood city and 64 degrees in san francisco. getting into that all-important weekend, temperatures are going to actually drop off between saturday and sunday. so your better beach day is

going to be better. monday holding on to comfortable conditions. a touch warmer for tuesday and we drop you right back off into the middle of neck week. overall still staying warm, but no major heat in the forecast. let's find out how we're heating up on the roads with mike inouye. >> not so hot. what i mean. it's slow. i backed up the camera. you can see a wide shot of 580. look at this right next to me, all the lights streaming over and stacked up approaching the maze. want to show you where it is on the map. this is affecting west 24 as you come over toward 580 and 980 and has 580 tied up. what it looks like from the traffic flow is the first of the crashes over here, 580 and 24, that may have been moving from the roadway. that might be the reason why 580 is looking better. now we have a second crash over here at the maze. that's complicating things, causing that ripple back over there. we continue to track that. of course, we need to let the folks on site do their work. we'll let the pictures do the

talking. also north 880 shows heavy traffic. that might also mean some of the folks backed up on 580 traveled through oakland via north 880 as well. watching all the shifts. in the meantime we have the backup at the bay bridge toll plaza which is to be expected. looking over toward the southbound side of 880. we have a heavier volume of traffic heading over here toward the san mateo bridge and across the castro valley y. heavier than many fridays over the past summer. again, as the schools kick in, we see the heavier flow of traffic and the volume building. the south looks really good. 280 at the 17 interchange shows slowing. we'll watch for that. a stall over here north 680 off 101, looks like things are clearing from the roadway. an easy drive, palo alto, a smooth flow of traffic. light volume for 101 and 280. a look at the north bay, we had an early morning crash, southbound 101 at the curves of terra linda, all lanes have

reopened after achb earlier crash approaching north san pedro. they'll have to do work later this afternoon to repair a pole damaged on the side of the road. but clear for the morning commute. >> so overall, sort of friday light. >> kind of sort of, maybe. new developments in the crisis in syria including staggering numbers over the number of children trying to cross the borders out of that country. and a new statement from the u.n. about what action it will take in the wake of allegations of poisonous gas attacks by the syrian military.

new this morning, un secretary general ban ki moon is speaking out about allegations of chemical weapons attacks in syria saying the reports are troubling and they should be investigated immediately. >> any use of chemical weapons anywhere by anybody under any circumstances would violate international law. such a crime against humanity should result in serious consequences for the perpetrator. >> on wednesday rebel forces accused the syrian military of using poisonous gas in several villages against damascus, the syrian government denies the claims and blames the attack on foreign militants and islamic radicals. just an ugly reality as more than 1 million children are refugees as a result of the war in syria. this information according to the united nations.

new york stock exchange and the nasdaq this morning. the nasdaq, good news everybody, it appears to be up and running once again after the major high-tech breakdown yesterday. good news on many fronts because today is friday, august 23rd. this is "today in the bay." good morning everybody. thanks for joining us again i'm jon kelley. >> i'm marla tellez in for laura garcia-cannon. for more on the breakdown, let's check in with business and tech reporter scott mcgrew. scott, a three-hour shutdown does not bode well for market confidence. >> it certainly doesn't. it's a disaster for market confidence. americans were not that trusting of the financial world to begin with, enron, lehman brother rs, goldman sachs. the fact that the stock market couldn't figure out how to trade for three hours, not welcome news at all. as we look at the nasdaq, first trust of all things opening the nasdaq. i don't know if they were prescheduled to do that or if

somebody said, you know (what, that would be a really good idea. things do seem to be under way with actual trades again r nasdaq off-lin for more or nearly three hours where they could not get trades to go through. jon, we're unsure about what the financial implications were, but as marla points out, the consequences were enormous. >> another black eye. scott, thank you very much. happening to local action, more than 105,000 acres scorched on the outside of yosemite. firefighters are stuging trying to get containment, the upper hand, very tough to get. in fact, just 1% of the fire right now contained. that is down from 5% that had been declared as of wednesday. we can also tell you about 2,500 buildings are in danger of burning in toulumne county.

a lot of schools in the area have shut down. residents right now, a lot of them leaving their homes uncertain of what they will find when they get back. >> you don't know. it's unpredictable. >> scary. i could come home to nothing tomorrow. >> governor jerry brown declared a state of emergency in that area trying to free up money and resources to help 1,800 firefighters already on the ground. >> much of the same in terms of mother nature and the winds for these firefighters. meteorologist christina loren, can you give us any good news? >> the only bit of good news i can give you, jon and marla, is these winds are not offshore breezes meaning they're not drying out. the southwesterly flow and humidity actually up a little bit this morning. it's going to help the firefighters for the next few hours. once we get into the afternoon, relative humidity is a product of temperature and plois tour. we are going to see the teens

return. relative humidity is low later tonight. we got an update on the acres burned. this came in about an hour ago. 105,620 acres at this point. the elevations at 3,000 feet. this is a very dangerous situation because the higher you go up in elevation, the easier it is for the wind to move around. you lack the frick shen when you head up in the atmosphere. for us today we have a better scenario. we saw the red flag warning expire for the north bay. on wednesday, you probably notice not as humid out there. temperatures will be much more comfortable. done with the threat of dry lightning in the bay area. 60 degrees in livermore, 61 in san jose. temperatures will work like this today, 87 inland, bay side 74 and 65 at the coast. we'll take a close look at your weekend forecast and what's to come for next week. still seeing the schools starting, scattered school starts as we head through next week. that's all comin up on your next report. good news, bad news, mostly

bad news. if you're traveling 580 and toward the maze through oakland, looking at our camera. we're squeaking over the building tops. you can see the lights backed up from right over the clock all the way over to the left side ou your screen. you can see the whole thing backed up. this is west 580 approaching 24, 980 and the maze. we'll look at the map and show you this area. a couple of crashes, one has cleared. the second still there involving a motorcycle and pickup truck west 580 past 980, that's what's causing the backup, approaching 580 and off the area around college avenue and telegraph. meanwhile it's keeping traffic lighter at the maze and bay bridge toll plaza,[ i guess that's better news for those folks who don't have to travel through their a yeah of highway 24 westbound. good flow of traffic again. it's 580 past 980 that's the

problem. in the south bay a nice easy flow, northbound 101 on the right, that's where there's a crash approaching tully road. reports of a crash by the on-ramp. we'll look at the live look north of there, traffic very light because folks are held up back there. back to you. now to an nbc bay area followup. santa cruz detectives say they've just begun scratching the surface of identifying perhaps thousands of victims in a child pornography case. the accused is well-knownm(f su instructor dylan greiner. investigators revealed some of the victims received a free lesson from greiner through the city's boys and girls club. this is video from greiner from his website. nbc bay area interviewed him in the past because the surfer was well known in the community for helping clean up local beaches. he was arrested last week on charges including lewd acts with a 14-year-old girl and secretly recording girls as they changed clothes.

police now say they have uncovered more than a half million pornographic videos and pictures. new charges of vehicular manslaughter against a san bruno father behind the wheel when his car crashed killing two of his dautders last year. he was driving his family home from an all-night black friday shopping trip when he fell asleep and crashed on highway 101 in palo 2mqalto. a chp officer who pulled over to help a stranded driver was also badly hurt. tandell was not arrested but ordered to appear in court. a san francisco community is calling for change in a dangerous intersection. this is the scene when a fender bender sent a car through the front glass before class started at the karate business. the instructor says a student was sitting before the window

before impact. the good news, very lucky nobody was hurt. a lot of people who live in the area are not surprised by the accident and many, they would like to see the intersection changed into a four-way stop instead of a two-way stop. neighbors say they are planning to ask city leaders for help in trying to make that intersection a lot safer. very fortunate nobody got hurt. >> counting their blessings. 6:37. another brutal gang rape reported in india. we'll tell you about the search for five men accused of attacking a photom&t journalist assignment in mumbai next.

welcome back at 6:40. this morning police are reporting another brutal gang rape in india. police say a 22-year-old photo journalist was gang raped and her male colleague was tied up and beaten in mumbai. police say the woman was on assignment taking pictures of an abandoned factory when five men attacked her. the woman is now in stable condition at the hospital. at least one suspect has been arrested. police say he has named and identified the other four men. the assault comes amid heightened concerns about sexual violence in india. you may recall in december a student died after being gang raped on ooh bus iná new delhi. that incident sparked protests demanding better protection for women. we're just moments away from closing argument ms. the sentencing hearing of the u.s. soldier who massacred 16 afghan

danger of burning in dual lum knee county. 180025çujt)uq)s are on the ground. it's growing larger by the minute. >> reporter: absolutely perfect burn conditions for that fire as yesterday they saw 53,000 acres burn in one day. talking to veteran firefighters say they've never seen that before. the conditions are exactly the same today. they don't see any end in sight for this fire that is more than 105,000 acres. the fire has been burning in very difficult terrain for these fire crews, steep terrain. a large timber that's been burning here. the fire has been getting up into the crown of the trees. that's proving very difficult for them to stop. all they can hope to do is steer it away from the homes. we're happy to report that yesterday they did a great job of keeping it away from the homes along the rim of the toulumne river canyon on the outskirts of groveland. they were able to protect homes there as the fire came racing up

is traveling as far to the east, 200 miles plus. so far as we've just (iñreporte 105,000 acres plus have burned. so right now if you're going to be headed to lake tahoe you'll be able to see some of the smoke from the rim fire. definitely an air quality issue. our thoughts and prayers to everybody fighting that fire and everyone involved. 60 degrees in oakland, 61 in livermore. we had a red flag warning for most of the week. that was able to expire wednesday evening because we got rid of those dry lightning strikes. that will be the same story for yosemite as the monsoonal moisture pushes to the east. also seeing more of a southwesterly flow. that's why the smoke plume is able to travel to the east. here is what we're looking at for today, jet stream position about right on top of us. as a result we'll see the cool ocean air moving inland all day long. temperatures right about at seasonal averages in places like

holding folks up. the second one, coming over 24 at 580 because of the unexpected backup. that's causing more traffic to back up, 24 westbound toward 580, westbound also toward the maze. that's affecting the flow at the bay bridge toll plaza, but not the eastshore freeway and 880 toward the area. the areas south of here, in the south bay, the northbound rates for 87 start to show a bit of a jam. guadalupe parkway, a lot heavier flow of traffic this week. 101 northbound towards tully ro road, the backup at silver creek and heading toward the area. 101 very crowded. monterey a good option for you. if you know the local streets, try them because they're probably lighter through the area. also let me show you the san mateo bridge. westbound across the bridge this is the taillights section. we see heavier but steady flow of traffic over toward the peninsula side, getting off 101

and foster city. still close to the limit. my theory, right here. the notice about the bay bridge closure is all over the bay. next friday folks might need to use the san mateo as their alternate. maybe they're trying it. picking up where mike left off. new this morning officers on the peninsula investigating a deadly crash that shuts down all northbound lanes of highway 101. chp says the crash happened before midnight on that freeway at kehoe avenue in san mateo. they even tweeted out this picture of traffic being diverted to the shoulder. a sig alert was issued early this morning. we can tell you now all lanes have since reopened. unfortunately one person was killed in this crash. investigateers have yet to release the exact cause. 6:50. a warning to women walking alone at night in santa clara after a woman manages to fight off her attacker during a sexual assault, and that's not the only

attack against women. santa clara police are investigating this morning three sexual assaults that have been reported in the city of santa clara this summer. the first back in july on homestead road near central park. the second on august 1st on lexington street near santa clara university, and now, a third attack just this week also near the university at the intersection of franklin and sherman. campus. it happened just after midnight wednesday as she was walking on franklin near sherman street. >> knocked to the ground and sexually asulted. she was able to fight off her attacker and he fled. >> as you mentioned, marla. the third attack over the past month on july 26th, a man climbed through a window of this apartment complex on homestead road near central park, raped a woman who lived inside one of those units. august 1st, a man physically assaulted a woman on lexington street, close to the university campus. she was able to fight him off. again, police do not think that these three attacks, even thougp they've taken place within the same proximity, don't think they're connected simply for the fact that the suspect descriptions don't match. reporting live outside santa clara police headquarters, bob redell, "today in the bay." >> it is 6:52. two people under arrest on charges of plotting to kidnap and execute police officers. one of the suspects may have had

ties to the bay area. las vegas police say the two were planning to kidnap officers in vegas and put them on trial and execute them in a vacant house. officers say their motive was to bring attention to anti-authority sovereign citizens movement. federal authorities considering sovereign citizen extremists as domestic terrorists. 42-year-old david allen brutsche and 67-year-old devon campbell newman are being held until they appear in court. police say brutsche is a six-time convicted felon and child sex offender from california. we should point out a man by the same name was reportedly arrested in los gatos for yours ago after a six-hour standoff with police. we're working to try to find out if that is the same man who is now under arrest in las vegas. in southern california, the mayor of san diego will reportedly step down today because of the sexual harassment claims filed against him by at least 17 women.

"today in the bay's" elena gomez is live at the civic center plazs with details on the mayor's decision. good morning, alana. >> reporter: marla, al that could unravel today. there could be at 1:00 today, the public coming to talk before the city council goes into a closed session and makes the so-called decision on whether the mayor will resign. i want to set the scene and let you see all the media that is here buzzing about this, people from l.a., shaig and network are all here. on wednesday, city attorney dan goldsmith announced a proposed agreement made after three days of mediation with mayor filner and city leaders. the public still has no idea what is in that deal. we are learning it could affect us in san diego. taxpayers could be fronting that bill. although the city council did vote early on not to pay for any of the attorneys fees involved

in may your filner's sexual harassment lawsuit. if the mayor does not resign today, that could be another long process. a recall campaign is still going strong here. 11,000 signatures were collected in less than three days. this campaign will need 100,000 by september 26th to get a recall on the ballot. i looked at their facebook page today and they say they won't stop until mayor filner is out of office. at the same time, something against the mayor as well. the federal and state prosecutors are looking into potential criminal implications in may your filner's financial dealings. this has to do with a paris trip he took earlier this year using city money for a personal paris trip. the democratic national committee is also asking the mayor to resign today in one of their special meetings. all of this unraveling in shaig. we eel see what happens later this afternoon if the mayor resigns or not. that's a big question today.
