good morning. it is just about 4:31. glad to see you. i'm jon kelley. >> i'm laura garcia-cannon. a lot to get to including a look at the forecast with meteorologist christina loren. >> good morning, laura and jon. of course, good morning to you at home. thanks for joining us on a tuesday. temperatures this morning are really comfortable out there. we'll have a hot day. today looks to be the warmest of the next five to six. 59 degrees to kickoff a tuesday in livermore. 60 in oakland. you're starting the day at 58 degrees right here in san jose. plenty of kids headed back to school. let's check your drive with mike inouye. >> good morning. looking over here toward oakland, 880, just as the kufr hits and you move over up past the sign, the off-ramp sign. you'll notice as we take this to full screen, the flashing lights moving you this morning over one lane to the left. still have the construction zone and lose a lane. we do look at the maps. even though at high street the live shot is not a problem.

this is the wrong map but we'll talk ab it anyway. there's construction between that spot and oakland and into downtown. i'll have to reset this. this is left over from one of the bay bridge projects we're working on. >> it's early. >> that's right. back over to you guys. happening right now. firefighters this morning finally gaining ground on the massive fire burning in yosemite. more than 3,700 fire personnel are in tuolumne county. at last check, 25% contained. >> it has now turned 161,000 acres which is larger than san jose and oakland combined. that gives you perspective. 4500 structures evacuated. >> 23 structures have been destroyed including one at berkeley's tuolumne family camp located about seven miles outside yosemite national park.

♪ >> last night families who have taken trips to the camps for years held a memorial to honor the lost camp. >> it was all about family. and there's so few places on earth that are all about family. >> you really felt like you were sharing in making that community be what it was. so all the kids could be free to go where they wanted to go. you knew there would be some other family that would be watching out for them if you weren't right there. it was safe that way. that's a special thing. >> the city opened the camp 91 years ago. it was evacuated last tuesday, and over the weekend most of the 80 buildings including 72 tent cabins just burned. city officials say they have not been able to survey the damage just yet so they're not sure about rebuilding.

>> we'll go live to tuolumne county plus worries for state fire officials. >> a sad scene in danville as a car crash kills a teenager the night before school starts. it happened just before 9:00 last night on el capitan road next to the crow canyon country club. police say the teenager was a passenger in that car when the drivers simply lost control and hit a tree. the teenager was rushed to the hospital but was later pronounced dead. the driver and a second passenger, they are also in the hospital. the police chief on scene telling us again that teenager was set to start school today. 4:34. a followup this morning, the san mateo child psychiatrist who molested boys during medical exams in the '90s will spend eight years in prison. william ayers sat silent and shackle in a wheelchair while nearly a dozen people read victim impact statements.

one of the victims said, quote, you are disgusting, what you did is horrible. end quote. also new images of surveillance images of the thieves and their vehicles. the images were shot just before the break-in at tiffany's, although these look like they're after. they show six people meeting in a parking lot where police say they removed a license plate from a white chevy trail blazer that was later used as a getaway car. the thieves took off with small items including jewelry. the city council in san jose considering a ban on styrofoam containers. supporters say the containers are harmful to the environment. but opponents argue other options are even more expensive. if the ban does pass, large

restaurant chains would have to make the switch by january 1st. smaller restaurants would have an extra year to make this transition. menlo park city council will take up the issue of red light cameras once again today. they were supposed to vote on a plan last week but put off the decision after hours of public debate. the issue is on today's city council agenda. the council will also consider signing a five-year contract with a camera provider to keep those red light cameras running. a couple of popular east bay businesses located just across the street from each other are both closing their doors. the chilli's restaurant will close for the final time at 3:00 this afternoon. chili's managers say the lease is expiring and landlords want to go in another direction. across the street, the lucky's supermarket is set to close at the end of the month. no explanation given for that closures. both locations have been in business for more than 15 years.

week and we'll see a return of the 90s. 79 in fremont, 81 degrees in san jose. look at some of your beach cities. 70 degrees straight up. highs coming in about 3:30, 4:00 p.m. 75 for santa cruz. i can't wait to show you that seven-day outlook. i think you'll like it if you're looking for outdoor weather. let's check in with mike inouye on a traffic tuesday. >> so far pretty normal tuesday, pretty normal for 4:38. looking at 101. no problem past our camera north of the 680 interchange. headlights coming northbound. we'll look southbound on the map as we look over toward 101 and capital expressway. we have a little slowing coming up toward the off-ramp. there was a crash there but chp says all activity in the lanes has completely cleared. that little dip in speeds only down toward 60. might be flashing lights. that's about the only thing going on for the south bay right now. a nice easy drive throughout your routes. we'll take you up toward

oakland, where the earlier map i was going to show you. we don't have the slowing that has cleared northbound. a little slowing remains as crews continue to clear. we'll watch that. that will change dramatically over the next half hour as the southbound side has crews leaving. and here is the san mateo bridge heading toward the peninsula. we talked about hillsborough schools coming back online today. watch that around 92, 280, 101. you can see more crowds around city streets. so be careful guys. back to you. >> good advice. thank you very much. the new warnings about waivers for the no child left behind law. how it could affect two major school districts in the bay area next. posing as federal agents the new warning from police on the peninsula. the new details we're learning about the patients a nevada state mental hospital shipped out to the bay area.

its allies consider launching strikes on syria, china and russia say western powers are rushing to conclusions before u.n. inspectors complete their investigation. secretary of state john kerry says washington has unmistakable proof of a chemical attack and will make that public in the days ahead. both rebels and the syrian government are blaming each other for last week's attack. students in newtown, connecticut heading back to school including those at sandy hook elementary. returning to the former chalk hill elementary school officially renamed sandy hook elementary. the former chalk hill school was donated and renamed after the december 14 shooting which ultimately killed 20 children and six adults. a task force has planned to demolish the school where the shootings took place and build a new one on that site. newtown residents must approve the project. apple is trying to revive

the plan for an iphone trade-in program and we're getting new word on who could replace fed chairman ben bernanke. jackie deangelis live at cnbc world headquarters. good morning. >> good morning, laura. cnbc has learned from sources inside team obama ha the president will likely name former treasury secretary and economic adviser larry summers to be the next fed chairman. he would replace ben bernanke is who is expected to step down before his term ends in january. meantime we're watching the futures, they're lower this morning after we saw stocks slumping into the close on monday. markets turn negative following comments by secretary of state john kerry about evidence that syria used chemical weapons in attacks near damascus last week. we saw investors fleeing stocks for assets like oil which is topping $107 a barrel today. gold which is typically a safe

haven investment in times of uncertainty at a more than two-month high add above $14 an ounce. the dow falling 64 points to close at 14,946 yesterday. the nasdaq slipping a frack shen to 3,657. also a story we're following this morning, apple reportedly prepping an iphone trade-in program. that was originally supposed to launch in june. it would allow apple store customers to trade in their old iphones for a credit towards a new one. reports say the program is currently set to debut next month which would coincide with the launch of two iphone models which apple is expected to unveil on september 10th. wheel be watching for that. back to you. >> there's hope for my old cracked iphone. a lot of texting. it still works. >> kids in the house. i understand. 4:45. christina loren is back to talk about our tuesday forecast. another nice one, right? >> it's going to be so nice,

guys. good morning to you. want to start this live picture of the golden gate bridge. you can see here mostly clear conditions right now. the same goes for san jose. we are going to see those low clouds start to drop off as we head throughout the morning hours. we're expecting a little drizzle some keep that in mind. 59 degrees in san francisco. 52 to kickoff a tuesday in napa. you'll see really comfortable weather in wine country. a lot of people flocking to wine country. we'll talk about why coming up. 55 in gilroy and 55 in livermore. today coastal fog, a little drizzle out there. we don't have all that much fog at this point. as we progress throughout the 6:00, 7:00, 8:00 hours, that's when we're really expecting it. today may be three the five degrees warmer. you may have to use your ac temps level off and then a much cooler weekend headed our way. a holiday weekend, 91 for livermore, 83 in santa teresa and 79 on the way to fremont. here we go.

temperatures as we head throughout the next couple days going to be a little on the warm side. we'll level off wednesday into thursday. friday just 90 degrees. that's a great day to hit the beach if you can, saturday into sunday. temperatures start to drop off. only expecting the upper 70s inland on sunday. then for labor day, looking really good. 82 inland, 74 bay side. 64 at the coast. i like to call that barbecue weather. back to you, jon and laura. >> i love beach and barbecue weather, christina. thank you very much. a new federal report out this morning offering new details into the nevada state mental hospital accused of shipping patients out to other states. that report finds about 40% of the patients discharged from the las vegas hotel -- i should say hospital, were sent to other states without plans for shelter or followingup care. many of the patients had been living in las vegas shelters or out on the streets before they were sent to other cities. the government investigation into rossen neal hospital started after "the sacramento

bee" reported they bused 1500 people to other states, many here in california. the san francisco district attorney threatened to sue the hospital if it didn't reimburse cities for the cost of taking care of those patients. 4:48. a strange phone call from a dea 'em poster almost cost a bay area man thousands of dollars. the victim previously bought prescription drugs online. the imposter told the man he was violating the law and tried to secure the victim's credit card number to pay off a bogus fine. police say the victim was lucky. but a couple months ago someone in san mateo county was targeted by the same scan, handing over $17,000. police say this particular scam can throw people off at first. >> there is that small bit of actual real information that the caller is providing the victim. so in that initial stage of the phone call the victim is -- maybe drops their guard a little bit.

>> hillsborough police say under no circumstance will someone from law enforcement ask you for money over the phone. a memorial being held today for a japanese american artist whose work is prominently displayed in the bay area. ruth osawa died on august 6 at the age of 87. she was the sculpture that created the fountain outside san francisco's highway as well as the internment memorial outside san jose federal courthouse. she will be remembered today in a memorial service taking place in golden gate park. a new study released this morning finds millions of at-risk students could fall through the cracks because of waivers for the no child left behind law. the campaign for high school equity says the department of education is not tracking at-risk students as carefully as before. duncan says congress needs to rewrite the law. earlier this month, eight

california school districts received waivers including san francisco and oakland. secretary of homeland security janet napolitano officially stepping down today. she already has a brand new job lined up as the president of the university of california system. this marks the very first time a woman has held that post in the uc system's 145-year history. napolitano served under president obama for more than four years. so far the president has not announced who he will be picking to replace nop politan know. it's 4:50. new trouble at america's cup. the scandal that's shaking up the famed race. we'll also tell you about the shot of a lifetime for new college freshman. this is the way to get it done. we'll let you know what he received for nailing that half-court shot. it's a beauty. >> look at the crowd. >> looking out here toward 880, a lot of activity. not quite so much celebration. but there are changes going on. we'll talk about that as well as an update for the tri-valley coming up.

reconvening as it exams the america's cup. did oracle usa illegally modify two boats that sailed during the warmup regattas last year and also earlier this year. team oracle members are accused of gross misconduct. on thursday the oracle syndicate will face a hearing on whether its alleged actions harmed the reputation of the america's cup. here is great action. have you seen this? a freshman at colorado state university certainly living large this morning with a free year of tuition. why? because he did that. the 19-year-old won the prize after he sunk a half-court shot during the freshman pep rally over the weekend. what a way to welcome yourself to college. >> no loans. no tuition loans. >> he had three chances to make the shot but he only needed one. should have done the others to continue -- >> two more years, three years. >> he was picked from a random drawing the take part in that

giveaway. i guess state tuition is about 21,000 if you're in state. >> the other cool part, the head coaches of the other sports put the money together. now he's going to be on the team a bit. >> the basketball coach will sign that kid up. let's check the morning commute with mike. >> got to get my kids to practice those half-court shots. looking over here toward 880 in oakland. we had a big backup here, the changes and that crew cleared it. toward the top of the screen there goes the last of those folks. that should be a better deal as far as right at the coliseum. the map shows you just north of there there's still more slowing and reports in the area where a crew didn't clear the last of their cones. just a minor issue. over toward the tri-valley, no major issues through 580. dublin also looks pretty smooth. a little slowing out of the altamont as the volume builds typical here.
