warning. they are graphic. >> we are human beings. we want to live. >> reporter: another horrific attack against children in syria. opposition activists say a school was attacked monday with a substance like napalm and posted disturbing video of the aftermath. no shrapnel or blood. just burns, doctors say, across 50 to 80% of their body. the interview with a british medical volunteer. >> it is just chaos here. we have an influx of what looks like serious burns. it must be some sort of -- i'm not really sure, maybe napalm. something similar to that. >> many were high school students in math class when a syrian government plane attacked the building next door. students starting running for cover. then -- >> as we were going inside the classroom. it hit again. i didn't hear anything, we just

saw people burning. i was burning. my classmates were burning. it felt like judgment day. >> reporter: rebels say at least ten were killed. dozens injured. agents are generally not considered chemical weapons but are illegal if used to do this. but that didn't protect him. syria hasn't signed chemical weapons reports. the syrian regime insists it does not use chemical weapons and says it is firing terrorists. back to you. >> richard engle in turkey this morning. thank you very much. >> here in the u.s. there's mounting questions over how the u.s. should respond. to according to a new poll 44% of americans disapprove in the job obama's doing in handling this situation, and lawmakers are voicing their own concerns following a briefing. andrea mitchell, good morning. >> good morning. the white house shared intelligence with top members of

congress but only by telephone leaving many wondering and wanting a lot more detail on this mission. even though the white house does plan to go it alone without a key ally. >> reporter: as protesters outside demonstrated against any military action against syria, inside, the national security team scrambled to build support for targeted strikes, briefing key members of congress by telephone thursday night. defense secretary hagel called in from the philippines. the president did not join the call. >> i was really disappointed in that. one of the things that has really bothered me is the president drawing a red line without knowing, in his mind, what he would do if he crossed the red line. >> i do think he needs to come up and consult with congress. again, you know, a few phone calls and those kinds of things, you have to have a robust

discussion. >> others on the call including robert menendez and bob corker were persuaded. what does the intelligence prove? much of it is circumstantial. but nbc news confirmed that the u.s. does have an intercepted communication with assad's brother discussing the attack last week. british intelligence says an attack this massive would require assad's personal approval as well. but the president lost a key partner thursday with the british people strongly opposed prime minister david cameron's own party rebelled denying his ability to strike syria. >> it's clear to me that the british parliament reflecting the views of the british people does not want to see british military action. i get that and the government will act accordingly. >> still, once u.s. inspectors leave syria over the weekend the u.s. military is ready only awaiting an order from the commander and chief.

and even without great britain america's closest ally, or the united nations, white house officials are signaling the president is prepared to go it alone, matt. andrea, thank you very much. elliott angle is the top democrat on the foreign affairs committee. he was on last night's conference call as well. >> were you convinced? >> i was convinced. what i have seen and what we have all seen is horrific and i don't think we should be allowed to see population, civilian population, children burning. i don't think we should see attacks on them. children frothing at the mouth. gasping for breaths. >> take the video out of your mind for a second. what was the most convincing piece of evidence presented on that conference call last night that tells you the u.s. should go in and take military action against the assad regime? >> the fact that the white house and american intelligence believes 100% that assad was responsible, that chemical

attacks were used. we just can't stand idly by. if we do, then no one will do anything. >> there were a lot of people on that call, and some people came away after hearing the same case laid out by the same administration officials and say they still think the president has a long way to go before connecting the dots and making the case. do you understand that difference of opinion? >> well, certainly. but these are the same people who were weeks and months criticized the president for doing nothing and now that he is doing something they're criticizing him for what he is doing. the president is doing the best that he can. this is a horrific incident and he's trying to build a coalition. >> trying to build a coalition without much success. great pwreupben britain as you know said they will not take action. israel is out and the arab nations on the sidelines. increasingly it will be a unilateral u.s. response. what are the risks involved in that? >> i don't think it will be

unilateral. we will have allies there. >> who is going to join? >> well, i don't know, but there will be others joining. they made it clear that the president of the united states will act and do what he thinks is best for the american people in a timetable that he chooses and a decision that he'll make that what parliament does in another country will have no effect on what we do. the united states has to stand for something and i think we stand for the fact that civilian and children should not be gassed. >> let me give you results of the latest nbc poll we conducted over the last day. we asked do you think the u.s. should take military action against syria? 42% said yes and 50% said no. how about this one. this effects you directly. when asked if the president should seek congressional approval before conducting any military action against syria, look at these numbers, 79% said he should seek the approval of congress. only 16% said he should not seek the approval of congress. >> well -- >> will you push for a vote? >> well, the war powers act

gives the president 60 days before he needs to get a vote from congress. this has been done. there's ample precedents by other presidents. president reagan did it in grenada, and president bush did it in panama. it was done by president clinton. there's ample precedent. there should be discussions with congress. we had that last night. there will be further discussions. >> after an attack? >> before an attack. we had a phone call last night and there will be other calls and i'm sure congress will be consulted. i'm not worried about that at all. the same people that criticize the president now are the ones that criticize him for doing nothing. i think he is doing a good job at this. he looks at this and he thinks it's horrific and i'm proud of what he is doing. >> congressman, thank you for joining us this morning. >> thank you. >> willie is here with a look at the overnight spike in gas prices. good morning, guys. good morning, everyone. bad news for more than 1 million

of you that plan to hit the road this labor day weekend. gas prices jumped up 4 cents in the last two days. that's the biggest jump of the summer. the nationwide average for a gallon of regular unleaded at 3.59 a gallon. originally they expected the average at $3.40 right now. 1.3 million americans are expected to travel at least 50 miles this labor day weekend. firefighters are turning to technology to battle a wildfire burning out of control. the rim fire has been raging for nearly two weeks outside yosmite national park. miguel almaguer is in california with the latest. good morning. >> good morning. an entire city of firefighters, some 5,000 men and women arrived here at base camp but today one of the most effective tools in fighting and analyzing this fire actually comes from the air. at dawn, some 300 miles away from the rim fire, a predator drone will be launched by the california air national guard and cal fire. nbc news was given exclusive access as video was beamed

directly to firefighters on the ground. they can track flames, hotspots and pinpoint access to attack this blaze. the drone's path is used by the boots on the ground to slow the exploding blaze in the wilderness. the fight for containment is a slow one. protecting homes is the number one priority. the rim fire has been brewing for two weeks. this time lapse video shows the suffocating smoke as it moves across this region, and it's going to be a tough day for firefighters. >> miguel, thanks so much. a third friend of the boston marathon bombing suspect has been indicted on two count of he allegedly made false statements to authorities as they investigated dzhokhar tsarnaev. he faces up to 16 years in prison. two other friends have already been arrested on obstruction of justice and both have plead not guilty. the justice department said thursday it will not challenge state laws legalizing the recreational use of marijuana by adults. however, states must enforce strict rules to keep the drug

away from children and the black market and federal property. voters have legalized wreck reational use in colorado and washington state. medical marijuana is legal in the district of columbia. bob filner is expected to leave office today among allegations he sexually harassed more than a dozen women. last week filner told the city council he is the innocent victim of what he called a lynch mob. some impressive home video out of croatia this morning. this was a water spout uploaded to youtube. it shows the water spout as it moves slowly and close to the shore. a water spout, as alabama can tell you, is a tornado over water. >> yeah. >> along the. >> croatian coast. >> beautiful area. >> i can't wait to go one day. >> you just go when there's no

>> turner and more than 45 former players sued the nfl. to settle the nfl will pay $765 million for medical examines, injury compensation and a researching fund. a lot of money but some critics say small change for a league that took in $9.5 billion last year. >> this litigation didn't require $9 billion to settle it. it requires a sufficient amount of money to make sure the benefits would be paid to the players when they needed them. >> on field success was no different. chicago bears super bowl quarterback jim mccann has early stage dimension. junior seau committed suicide. both diagnosed after their death. the nfl says they don't have to open their files on head injury.

sobriety, what got you to take that drink? >> too much stuff coming at me. i'm doing my auto documentary and everything was creeping up. i started going to my old neighborhood and dealing with old wounds that opened up. it was overwhelmliing. >> you said were you lying to everyone about being sober. that you're on the verge of dying because you're a vicious alcoholic. did you mean those words? you say people blew it out of proportion. but talk to me about those words. >> it's the words i use because sometimes i don't want to live when i'm in that state. it's difficult to discuss. i don't know i'm not experienced enough in my recovery to really pinpoint it. >> i went back and read some interviews you have done over the years and i found references on your part to suicide dating all the way back to the late 1980s. this is something that's come up from time to time in your life. how much do you think about it?

>> not that much. it's just sometimes i -- if i get drunk, i'm just not the same guy. so i just see my friends and sponsors and talk to them. >> so it's something you have struggled with your whole life. >> my whole entire life. well, you know, this is so interesting. when i was fighting, i was crazy. i wasn't getting high or drinking. it's hard for me to live normal. straight is hard. living a straight life is hard. smoking a joint and having a drink, thank god, i'm cool. but that's not the life i want to live. >> so when it comes down to it, when you were fighting, that clean and sober guy was the dgu you needed to be because there was rage in you. >> it's a bad guy, man. it's a real bad guy. i don't know why. i got that from my mother. my mother is that way. my mother is real tough. i have a real aggressive mother. >> what is it about you at this

stage in your life when you stopped and thought i have to say sorry to some people. >> well, i have to say sorry to myself, not to people. and i'm not doing this interview to try to help an alcoholic or help some drug addict. i'm doing it to help me. this is my own self-centered little move here. i need help. i need help real bad because i won't survive if i don't get help. >> i was reading an interview with you this morning and you were talking about being a dad and you were admitting there were times as a father you weren't the best father. how are you today? >> i don't know. i don't know how to judge myself. i am just taking care of my kids. >> do you think you're an attentive father? are you a present father? >> well, i'm present because i have nowhere else to go, so yeah i'm pretty present today. >> what do you think your kids would say about you? >> i don't know. i don't know if my older kids want me to be that close but i'm just happy that we're friends

♪ 9:26 that breaking news is going on in san jose where crews are trying to put out a house fire. this is a live look at the scene on the east side this morning. it is on commodore drive near north jackson avenue. two people, we understand, have been pulled out of that house. you can see through the fence there, one recovering from smoke inhalation. it looks like firefighters have got a pretty good handle on this, smoke still rising from that house this morning. we will have more on this story coming up in our 11:00 newscast. we were a reporter on the scene. san jose police investigating two officer-involved shooting. just before 5:00, an armed man roobed a safe way in the midtown area. the man surrender in less than

four hours before that. police confronted a robbery suspect in east san jose, in that instance, the suspect tried run over an officer with his car. the officer shot that suspect who was taken to the hospital with unknown injuries. on the new bay bridge, construction appears to be on schedule for tuesday morning opening, if not earlier. today, they will start paving the westbound lanes between yorba buena island and the toll plaza. working 24 hours a day on that one.
