september 2nd, this is "today in the bay." >> let's first look at the forecast this labor day forecast with meteorologist rob mayeda in for christina. good morning. >> good morning. off to a very muggy and warm start to the morning. you'll see the temperatures over my shoulder, upper 60s. sunnyvale and san jose, very sticky outside right now. a few light showers east of san jose. 70s in san francisco. low 70s in oakland. coming up, we'll take a closer look at some of the areas dealing with the showers this morning. work on the bay bridge eastern span seems to be running on schedule. set to open by tomorrow morning's commute.

we want a live look at the new east span. even though it might not be open to traffic, there will be a special chain cutting ceremony this afternoon at 3:00 to celebrate the opening of the new span. caltrans says despite the rain out there, things do remain on schedule. right now a bay bridge spokesperson says plan for a 5:00 a.m. opening tomorrow morning. if work finishes early, they'll let you know. crews working on demolition. >> this is a continuation of the bay trail which extends down the shore lines of emeryville and berkeley and oakland. we really wanted it to tie into the natural setting of that part of the bike path. >> looking forward to it. once it opens up, i definitely want to be one of the first ones to ride on it. >> by 2015 they should be able

>> the obama administration will spend this week pushing for yes votes. >> if congress overrules a decision of the president of the united states on an issue of national security that could set a catastrophic precedent in the future. >> secretary of state john kerry says there's more evidence that syria's government used serin gas. >> he thought they would act with more moral authority and strength if we acted in a united way. >> meantime president obama is taking heat at home and abroad. >> syria to prepare for this and sending mixed signals to the world. >> i'm afraid that what is shown is weakness there. the world is watching. >> so is the public. the senate foreign relations committee debates here tomorrow afternoon. tracie potts, nbc news, washington. the president may be putting

what happens in syria to a vote, but he is getting mixed support from local lawmakers. south bay congresswoman on nah eshu says she does not doubt intelligence that assad carried out chemical attacks but wants more information before making a decision. jackie speier echoed the decision saying it should not be made in evidence. dufsh lynn representative eric swalwell says he doesn't want the u.s. drawn into another conflict to put troops on the ground. >> the president's resolution does not limit him from putting troops into syria. if that's the case, i can't support it. >> i have to tell you i am very reluctant as it relates to taking any military action that could lead to unintended consequences and also that would set us back from a negotiated

settlement. >> meantime senator dianne feinstein says she agrees with the secretary of state's assessment that the u.s. cannot let syria's attack pass without a, quote, meaningful response. as for house minority leader nancy pelosi, she released this statement saying, quote, it is clear that the american people are weary of war. however, assad gassing his own people is an issue of our national security, regional stability and global secure. more positive news from yosemite with firefighters starting to gain the upper hand on the massive rim fire. the almost 225,000 acre fire still doing damage, currently sits as the fourth largest in california's history. firefighters did gain a lot of ground over the weekend and now have that fire at about 45% contained. but we can also tell you the danger is not over. 5500 buildings still in arm's way including about 4500 homes.

however, no new buildings were burned over the weekend. the cause of this fire remains under investigation. it is 4:37. happening right now, a 64-year-old swimmer on a mission to swim from cuba to florida has her final destination in sight. about three hours ago diana nyad's team posted these photos showing the lights of key west for nyad and her crew. they're currently talking with local fishermen about the best route to take into key west. one of the big worries? jellyfish which has stalled her previous attempts a few times. this time she is wearing a protective mask and mouthpiece to keep the jellyfish away. this video is from saturday. this is her fifth attempt at making the 110-mile swim in the last three years. if she succeeds, she'll be the record holder for longest

unassisted open ocean swim. >> she is unbelievable. >> you said she was a warrior. she is. to do it without a wet suit. >> 64 years old and going strong. i'll be happy if i can make it across the bathtub at that age. let's check in with rob mayeda to find out what's happening outside. >> good morning. i'm surprised to see that. swimming since saturday. amazing fitness there. if you're going to head to the pool today, it might feel good to get into a pool in the bay area. waking up to temperatures in the upper 60s. so kind of key west like around san jose. 61 in san francisco and 70 in livermore. the reason why it is so humid outside, this tropical moisture from the south kicked off a few showers mainly to the east of san jose. this is off to the north of mt. hamilton. it will be the south bay and east bay hill tops that have the best bet of seeing showers

today. areas south of san francisco, you're seeing a lot of high cloud cover from the south. later on this evening and tonight we'll start to see the clouds head off to the east. upper 60s in san francisco. near 80 in san jose. mid 80s further inland towards the tri-valley and for at least the first half of the week. notice the temperatures kind of mild in the seven-day forecast. thursday into friday things change. high pressure building in with mid to upper 90s possible by the time we get towards saturday. >> 4:39. breaking news in the south bay. san jose police and chp on the seen of a deadly crash. at least two people are dead. bob redell has just arrived on the scene and received new information. first and foremost you're pretty close to sjc on the other side. is that right? >> reporter: good morning, ma la. yes. it turns out this is a hit-and-run. we just got word it was two women who were killed. north 1st street and sky port,

this happened around 3:20 this morning. the vehicle on your left, that's a toyota yaris. in spite of trying to save them, they did not survive. they were making a left turn. you have a car where the two cars collided. the driver of the silver mercedes is the hit-and-run driver that police are trying to find. they don't know why this person ran. they're not sure who had the right-of-way. they have a person they are speaking to who is not in either car that might have information. maybe that person will help them get a good idea. the silver mercedes is not a stolen vehicle. not clear why this person ran. they have no indication whether or not that person may have been drinking. so eventually checking local hospitals to see if anyone shows up in the hospital has maybe suffered an injury that would be similar to what you would have if you were in that silver mercedes.

welcome back, it is 4:45. egypt's president is likely to face charges for inciting violence. ousted president mohamed morsi will be tried for the killing of opponents who protested outside his palace. almost a dozen were killed back in july after millions took to the streets demanding morsi step down. morsi was later ousted by egypt's military. more than a dozen other members of the muslim brotherhood will also face trials. the nsa spy program targeting the presidents of brazil and mexico according to

glenn greenwald. documents contained by edward snowden show e-mails being read from mexico's president, enrica pin netto and brazil's president dilma rousseff were also targeted. snowden made world headlines in may after admitting to leaking classified documents about two secret u.s. programs that monitor telephone calls and internet traffic. snowden is now in russia after the country granted him asylum. we have new video this morning of nelson mandela's first night home in almost three months. the former south african president returned home last night, but he is still in critical condition, critical but stable condition. mandela spent more than 80 days at a pretoria hospital for a recurring lung infection. his family says they're happy to have him home and he's receiving the same care at home as he was

receiving in the hospital. meanwhile former president george h.w. bush is apologizing for mistakenly announcing the death of mandela. apparently his spokesman misread a headline on the internet and that led our 41st president to release a statement expressing his sadness. the south african president immediately rejected the statement saying mandela is alive. bush's spokesman says it was, quote, a stupid mistake by me, end quote. a south korean delegation will meet with north korea to meet in kaesong to find a date to reopen the come plechblths it's located inside north korea just past the border. more than 120 south korean companies employ about 50,000 workers at that complex. you may recall it was shut down four months ago during heightened tensions on that korean peninsula.

at that time south korea and the united states were conducting joint military exercises. a major deal is in the works between two communications giants. verizon is reportedly working a deal out with voda phone for about $130,000. the deal would include cash and stock. under the plan verizon would regain control of the entire cell phone business. voda's board has president said whether it approves the deal. 4:48 right now. a lot of people have today off to relax and enjoy labor day. what kind of weather are we looking at? >> rather interesting weather. first waking up to temperatures in the upper 60s outside. partly to mostly cloudy. san jose, 68 in fairfield.

customers will get a coupon for a new stuffed animal. a popular san francisco restaurant is reopening for business this morning following an e. coli outbreak over the weekend. public officials say 14 people got sick after eating at burma superstar in the richmond district. nine of the victims fell ill after eating there around august 16 or 17. they released a statement, we are working with public health officials to identify the exact cause of these incidents. and the city has reassured us that this was an isolated case and this is a safe place to eat. today an iconic san francisco strip club is closing its doors for the final time. owners of the lusty lady say they're shutting down because of a lease disagreement with the landlord. that club opened back in 1976 and dancers ended up making history in 1997 when they became the very first in the entire

world to unionize forming the exotic dancers union. another mosquito fogging is scheduled in san francisco clara county this week lead. wednesday night through thursday morning. it will be the tenth fogging in the county this year. that's up three, fogging from the old record of seven. if the warm weather continues, mosquito season could stretch into october. experts say it's not too early to start protecting ourselves against the flu, especially children. according to the american academy of pediatrics, now is the perfect time to get kids thinking about getting their flu vaccine. it usually protects against three strains of the flu virus. some of the injections will protect against four, two a strains and two b strains that are likely going to circulate
