good morning. i'm bob redell taking you live to san jose where two women have been killed within the past hour and a half in a horrible hit-and-run. police still looking for that driver. the story coming up in a live report. temperatures this morning around the bay area off to a very balmy start. upper 60s outside and we're seeing showers as well. we'll have a look at that in the forecast coming up. we continue to watch the waters off key west this morning where diana nyad is trying to swim more than 100 miles from cuba to florida. her goal is in sight. she's less than ten miles away. i just talked checked the wires. >> right now speaking of goal, the goal is to open the new span of the bay bridge by tomorrow morning. if it happens earlier, we'll let you know. a live look outside over san francisco on this monday, labor day, september 2nd this is "today in the bay."

>> we're going to have to get used to the new view of the bay bridge. i'm marla tellez in for laura garcia-cannon. >> i'm jon kelley. breaking news in the south bay. officers are on the hunt this morning for a deadly hit-and-run driver, this crash happening less than two hours ago near the intersection of first street and sky port in san jose. "today in the bay's" bob redell has been on scene gathering information. he's live with the latest. >> reporter: good morning, jon. share police want to find the driver of that silver mercedes over my shoulder that was involved in this very serious auto accident that killed two women. it happened around 3:20 this morning, not far from norman mineta here. the two women in the toyota yaris were making a left-hand

turn off north first onto sky port when they collided with the mercedes. it's not clear who had the right-of-way. the collision, however, was so severe. one of the women didn't survive long enough to make to it the hospital. she was declared dead on the scene. the other one side at the hospital. it's hard to tell how badly hurt the driver of that silver mercedes is. clearly okay enough to get out of the car and leave the scene. not clear if they're going to end up going to the hospital. police will be checking local hospitals to see if anyone with injuries consistent with this kind of accident shows up. it's not obvious why this person fled. the car is not stolen, investigators will want to know if this person was under the influence, had an outstanding warrant or just panicked and made a horrible decision. two women killed at the intersection of north first and sky port. san jose police say it could be another two to three hours before they finish up this part of the investigation and reopen this intersection. reporting live in san jose, bob redell, "today in the bay." right on schedule, the new

eastern span of the bay bridge is set to open by tomorrow morning's commute. "today in the bay's" christie smith is live in oakland with the last-minute touches crews are putting on the brand new span. good morning, christie. >> reporter: good morning, marla. caltrans has been saying all along the newbridge is it will open 5:00 a.m. tuesday. the good news is there are no snags, no surprises. there's talk it could open a little earlier than that. right now a bridge spokesperson is saying it's just too early to say. what we can tell you is there was a lot of progress over the weekend. basically the striping and paving work near the toll plaza is done. the thousand foot section of roadway on the east side is removed and now sections of the pedestrian bicycle path are being lowered into place. lit be about 15 1/2 feet wide. that's wide enough to accommodate bikes and pedestrians. also it's an extension of the bay trail which extends down to emeryville, berkeley and

oakland. it opened noon tuesday. it will go just past the new suspension part. the old bridge still needs to be demolished in that area. >> it would be nice if they would get a bike lane that goes all the way across. in couple years, we'll have it halfway. >> it's a very complex process, very expensive process. that process is being still vetted and explored. >> reporter: a bridge spokesperson says they're looking into the possibility of a bike lane on the western span. meantime the chp is reminding drivers they have to get ready for a totally different view. i have seen it, it's quite stunning. they're concerned about the urge to gawk. they want to remind people that nin pulling over to take a look will be cited. also a ceremony for the newbridge today at 3:00 with san francisco mayor ed lee and lieutenant governor gavin newsom there. jerry brown is out of town. there's a lot of interesting

stuff going on, video tributes, a number of vintage cars as well. we'll be talking about that more in the next half hour. live in oakland, christie smith, "today in the bay." >> getting around the bay bridge closure has been far from easy. despite the fact it's a holiday, they're warning drivers to expect delays of one to two hours in and out of san francisco. even with the new electronic toll gate, traffic on the golden gate bridge has been heavy in both directions. that happened yesterday, really rough. traffic heavier than usual on the 19th avenue and on doyle drive. >> we can't find parking and there are a lot of cars, a lot of pedestrians. so it's people everywhere and you can't really drive very fast or can't go places. we can tell you b.a.r.t. trains still running around the clock trying to help people out. this weekend b.a.r.t. had its second busiest saturday ever

the bridge has been submitted to the state senate but has not had a hearing date. on the international scene, new numbers this morning showing the impact the civil war in syria is having on its citizens. the head of the u.n. refugee agency in syria says 7 million syrians have been displaced by the country's civil war. that's almost a third of the entire population. meantime president obama will be meeting with republican senator john mccain today to talk about the syrian conflict. the president now trying to convince congress the u.s. should be taking military action against syria's regime for last month's alleged chemical weapons attack. they say though the president has the right to ask without congress asking congress makes things more complicated for him. >> there is no certainty that congress will go ahead and support this. if you have folks on the far left and the far right ironically together on these issues. the question is are there enough

folks in the middle in congress to go along with it? it would be a blow to the president if congress denies him the right to strike. then he's really stuck. >> lawmakers are set to return from the recess a week -- actually set to return a week from today, though a lot of them will be returning earlier than that. this important business. >> new reports out this morning suggest east bay school officials tried to thwart a detective's efforts during a seblgs abuse case. the "contra costa times" reports detective julie valdez beat a case against teacher daniel witters almost two decades ago. he was a popular science teacher accused of sexually abusing students in the muraga school district. detective valdez says school administrators limited her access to information about his conduct. he killed himself days after the claims surfaced. police in palo alto have an image focusing on one of the suspect that robbed a couple at

a post office. they say he's about 30 years old, six feet tall and weighs about 200 pounds. police say he and another man robbed that couple just after midnight tuesday in the parking lot of the post office on east bayshore road. that husband, he did hand over his wallet and that's when the suspect took off. efforts to contain the massive rim fire burning in yosemite continue this morning. the fire is now almost 225,000 acres. that's larger than the city of new york. but it's also 45% contained. full containment is not expected for another three weeks. over the weekend the smoke reached into the yosemite valley making it very difficult to see half dome. this morning we're told the air quality in the valley has improved but people are still being told to avoid strenuous outdoor activity. not a good idea to go for a run or a hike. >> no, not at all. positive news, a little more under control. but almost a quarter million

acres burned up. >> meteorologist christina loren has the day off so rob mayeda is here to check things out on our labor day. what's it look like? >> seeing changes here and changes toward the rim fire. the smoke moving off to the north, towards the lake tahoe basin. poor air quality for toe all me. we have scattered showers off to the east of livermore and to the west of tracy. you can see from 580 out of the altamont pass, you can see we've got pretty good showers there that continue to advance to the north and east towards stockton and sacramento. hour by hour we will see mostly cloudy skies before the line starts to move to the east. as we head into tomorrow morning, clearing skies, all signs look pretty good weatherwise for the reopening of the bay bridge tomorrow morning with mostly sunny conditions. today mostly muggy with partly cloudy skies.

a chance of an isolated shower east of livermore. 69 for san francisco, 80s san jose, 70s in oakland. mid 80s towards the tri-valley. those temperatures fairly cool compared to where the seven-day forecast is going. you can see the mild temperatures, less humid tomorrow. thursday and friday the warmup begins. we're talking 90s inland. not just low 90s, upper 90s possible in the valleys as we start next weekend. happening right now, a true story of perseverance and endurance. a u.s. swimmer getting very close to her latest attempt to swim from cuba to florida. these are pictures from her sight diana nyad. her team posting the pictures earlier this morning. the 64-year-old is now nearly ten miles away from florida. if she's successful, she will have completed 100 miles swimming over multiple days, becoming the first person to swim from cuba to florida without a shark cage.

hello to you on this labor day. we give you a live look at that time brand new eastern span. >> that's pretty. >> so nice to see. it's set to open by tomorrow at 5:00 a.m. it might open ahead of time. we have our christie smith out there getting the latest information for you. we'll hear from her again at 5:30. it's 5:15 right now. high-tech firms are fighting plans to shell a new patent office in silicon valley. the automatic budget cuts known as sequestration are threatening the office's planned opening. tech leaders say the cuts are unfair because the patent office was never going to be funded by taxpayers. instead it would have been supported by almost $3 billion in annual patent fees. san jose representative mike honda is seeking an exemption for the office. fayou may zee soon see vide ads when you surf facebook. they're thinking of adding the 15-second ads featuring those

major brands. those ads would play automatically each time a user hops on to the news feed. other sites like google, youtube and yahoo! both use those ads. workers are getting a special bonus from their boss. he novo ceo is sharing his $3.25 bill million bonus with employees. the company over took hp to become the world's largest pc maker. the money will be split among the tens of thousands of staff in china and other countries including here and the u.s. each employee will receive roughly $300. >> love that sharing the wealth. the creator of "mega man" is turning to kick starter to create a new game. already proving very successful as well.

this line moves off to the northeast towards stockton and sacramento. during the day today it will be parts of the south bay hills and east bay hills that will see with the clouds occasionally a chance of a stray shower or two. we'll see clearing skies there north of the golden gate. eventually heading into tomorrow morning, less humidity, less cloud cover except for the fog approaching san francisco. weatherwise things should be fine for the reopening of the bay bridge coming up tomorrow morning. 80 in san jose. 70s elsewhere in the south bay as the sun is filtered off by those clouds. you may see a few more 70s for inland locations. numbers in the low to mid 80s around the tri-valley and to oakland we'll see highs in the mid 70s this afternoon. close to 70 in san francisco and 70s and 80s around the north bay. after today, we'll start to lose the humidity. the sea breeze will cool us off. wednesday still mild. second half of the week is when

changes arrive. high pressure building in from the desert southwest, boosting temperatures, mid to upper 90s in the valleys and 70s by the beaches as we kickoff next weekend. 5:19 right now. we could learn as soon as today whether oracle team usa violated rules during previous sailing races. the america's cup international jury holding a hearing on allegations the defending champs illegally modified two boats used during the warmup regattas last year and earlier this year. team oracle being accused of gross misconduct. the team leader said he had no knowledge of the modifications and they were likely made by a small number of people without proper approval. the jury now expected to issue a ruling either today or tomorrow. another san francisco high school is admitting it is under review after standardized testing materials online. the examiner reports gateway high school is one of 72 schools

flagged for social media postings. the state department of education is still investigating. >> just last month, we reported lowell high school in san francisco was also under investigation. the reviews can have a serious impact including invalidating test scores for students and repercussions for school funding. the tibetan association of california holding a fund-raiser for the community center which will be plesed by the dalai lama. that is high praise. the event, together for event, will be held at bacihsos. that will be happening in february. during the brunch they will be enjoying traditional tibetan performances. in the east bay the founder of ruth bancroft garden is turning 105 years old today.

good morning everybody. how are you feeling on a labor day morning? that is the bay bridge toll plaza. it is a ghost town out there. there's news heading on the bay bridge, the eastern span set to open up tomorrow, as you can see there, a gorgeous shot. everything is on schedule, right on time. christie smith reporting on that in a matter of minutes. we'll tell you what's new out there. a book about a peninsula city written by a famous local guy has hit the silver screen. that movie named "palo alto" based on a book from james franco, starring the actor as well. this follows the lives of two high school students in palo alto. it debuted yesterday at the venice film festival. museum day live is coming up at the end of this month. you get a jump start. that's the day museums across the country will open their

doors for free. some of the museums participating in the september 28th event include the bay area discovery museum, cartoon art museum of california and the aerospace museum of california. you can't just walk in. you need a ticket and tickets are available online at the smithsonian magazine website. how about this? parents in washington, d.c. now fighting back after school officials cut recess time. that is just wrong on too many levels. "the washington post" says kids in the nation's capital returned to school to find recess cut by 15 minutes per day. that is valuable minutes. the newspaper also reporting the change was just buried in the budget don'ts last year by the school, back in spring. parents argue, of course, kids need the time to exercise, stay healthy, stay focused and get out and burn off steam. d.c. school officials say five more minutes will be added. many parents say that's still

is on scene and has all the latest information. good morning. this is taking place not far from norm mineta international. a few hours ago, you can see the two vehicles involved, a toyota yaris with a blue tarp is the car carrying the two women who ended up dieing. to the right is the silver mercedes. you'll notice the driver door is open sthand appears to be how the driver left this vehicle during this accident that happened around 3:20 this morning. police are still trying to figure out who was at fault. who had the right-of-way. apparently the toyota yaris was making a left-hand turn off north first onto sky port. sky port taking you to sjc when the silver mercedes coming down first street collided. the impact was so severe, one of the women actually died on the scene. the other died at the hospital. it's not clear how badly hurt the driver, if at all, of the

mercedes is. something police will be doing is checking with local hospitals to see if anyone is going there for treatment, going for treatment for injuries that would be consistent with this kind of accident. the vehicle is not stolen. they don't know why this person would have fled the scene, whether they had been drinking, whether they had an outstanding warrant or whether they just panicked. they were obviously trying to get in touch with that person. there was a man, a witness that police were speaking with, someone not related to the accident who might have been walking by at the time. they were speaking to that person just to try to figure out what led up to this horrible accident. two women killed, the driver of the silver mercedes took off after this accident. clearly this is a hit-and-run. police are trying to find that person. live in san jose, bob redell, "today in the bay." 5:32.

buildings still in harm's way including about 4500 homes. however, a little good news here, no buildings were burned over the weekend. the cause of this fire does remain under investigation. the new eastern span of the bay bridge is set to open tomorrow morning. one of the biggest questions from commuters, will it open earlier than expected today in the bay's christie smith is live in oakland with new details on the opening of the eastern span. good morning. >> reporter: good morning, marla. kind of hard to believe that by this time tomorrow at the latest drivers will be getting their first experience of the new bay bridge. there had been talk about it opening before 5:00 a.m. tuesday. we can tell you everything is going very well. they're on schedule. no snags, no surprises. they're saying that the final finishing touches are about 80% complete. that as of sunday night. the connector roadway at yerba buena island, that's done.

contractors are replacing led lights, steam cleaning, too, things they ordinarily couldn't do when the bridge is closed. they're painting, doing striping work. the contractors talked about this earlier, they're demolishing a thousand foot section of the old bridge to make room for a new bike and pedestrian pathway. the chp is reminding drivers that this view will be sweeping, it will be incredible. i have to say i've seen it. it's quite something. while drivers may be tempted to gawk, pulling over to look or driving and taking a picture may earn you a citation. >> want to remind people that though the bridge is a very nice view, it is still a vehicular crossing that many people use on a daily basis to get home and get to work. safe driving is paramount on this bridge. >> another thing going on today at 3:00, and invitation only chain-cutting ceremony. governor jerry brown is out of

both sides have not met for weeks. late last night b.a.r.t. responding releasing the statement that says, quote, the mediators have set a negotiation schedule which resumes bargaining sessions starting the 9th. it is 5:37. starting today, it will cost you more to park in caltran parking lots. the daily parking fee is now $5.00 up from $4.00. monthly permits are $50, $10 more than before. caltran says it will not charge higher rates at the diridon station when there was events. what do you have planned for the holiday? barbecue, slip and slide? >> maybe a nap and a run. so boring. i might get drinks with girlfriends of mine actually. >> that's a better idea. >> what will she be seeing when the ladies go out for the beverages? >> it should be quite nice. looking pretty warm outside right now.

military action. tracie, good morning. >> reporter: good morning. he's meeting with two key republicans including senator john mccain trying to convince them to authorize this military action. over the weekend more than 100 lawmakers came back early to talk about this, to hear the administration's evidence. after that three-hour meeting, some still said no. lawmakers are all over the map on whether to authorize military action in syria. >> i'm a yes. >> i'm a no based on the information i have no. >> i'm still very skeptical about the president's proposal. it's not clear to me that we snow what the results of this attack will be. >> they have a lot more explaining to do. >> reporter: the obama administration will push this week for yes votes. >> if congress overrules the decision of the president of the united states on an issue of national security, that could set a catastrophic precedent in the future. >> reporter: secretary of state john kerry says there's more evidence that syria's government

welcome back everybody. a south korean delegation says it's planning to work with north korea to get their joint manufacturing company up and running. both sides will meet in kaesong to find a date to reopen that complex. industrial park located just inside north korea just past that border. more than 120 south korean companies employ 50,000 workers at that complex. this one was shut down four months ago. at that time south korea and the united states were conducting joint military exercises.
